How to Claim Foreign Tax Credit in India and Avoid Double Taxation (Forms 67 and 44)

The form you use depends on the tax period. For periods governed by the Income-tax Act, 1961, a resident taxpayer generally claims foreign tax credit through the online Form 67 process. For Tax Year 2026–27 onward, the Income-tax Act, 2025 and Rule 76 of the Income-tax Rules, 2026 use Form 44 instead. Do not file Form 67 automatically without first identifying the applicable regime.

In either regime, India does not simply refund every rupee paid overseas. The credit is restricted by the Indian tax attributable to the same foreign income, the amount of foreign tax eligible under the applicable treaty or domestic rules, and the evidence and timing requirements. The relief can therefore reduce double taxation without always eliminating it completely.

Start with the tax period, not the form

India has two different foreign-tax-credit procedures in transition. The Income Tax Department says payments for Tax Year 2026–27 onward fall under the Income-tax Act, 2025. Earlier periods, including Assessment Year 2026–27 and prior years, remain under the Income-tax Act, 1961. The applicable period determines whether the legacy Form 67 route or the new Form 44 route applies.

Tax period Governing law Foreign-tax-credit statement Core timing point
Periods before Tax Year 2026–27, including AY 2026–27 or earlier Income-tax Act, 1961 Form 67, filed online Form 67 instructions require filing by the due date for the income-tax return under section 139(1)
Tax Year 2026–27 onward Income-tax Act, 2025 and Income-tax Rules, 2026 Form 44 under Rule 76 Follow Rule 76 for Form 44 and supporting-document timing; the rules contain more than one timing provision

Tax terminology can make the transition confusing. An assessment year such as AY 2026–27 belongs to the earlier framework, while the new framework uses “Tax Year.” Check the period shown in your return, notice, or tax records before preparing the statement.

Who can use these foreign tax credit rules?

Both procedures are written for a taxpayer who is resident in India for the relevant period. Rule 76 refers to a “resident assessee,” and the Form 67 manual refers to a resident taxpayer with foreign tax paid by deduction or otherwise. Residence is a legal determination for the relevant Indian tax year, not merely a statement that you hold an Indian passport or maintain an Indian bank account.

You must also identify the particular foreign income and the country or specified territory in which it arose. Salary, interest, dividends, business profits, rent, capital gains and other categories can have different source rules and treaty treatment. A credit calculation cannot be completed reliably until the income has been reported, or is being offered for assessment, in India.

How the credit prevents double taxation

The basic mechanism is a foreign-tax credit. You include the foreign-source income in the Indian computation when the Indian rules require it, then claim credit for eligible foreign tax paid or withheld on that same income. The credit reduces Indian tax payable; it is not normally a deduction from the foreign income itself.

The lower-of limitation

Under Rule 76, the credit is calculated separately for each source of income arising in each foreign country or territory. For that country-and-source combination, the allowable amount is limited to the lower of:

  • Indian tax payable on the relevant foreign income; or
  • Foreign tax paid on that income, subject to the amount permitted under the applicable agreement for relief or avoidance of double taxation.

Foreign tax above the amount allowed by the applicable treaty is ignored for this calculation. A credit therefore may be smaller than the tax shown on a foreign withholding certificate.

Illustrative calculation

Assume, purely as an illustration, that foreign interest produces an Indian tax liability of ₹18,000 and foreign tax of ₹25,000 is eligible under the treaty. The credit for that country-and-source item cannot exceed ₹18,000. If the treaty permits only ₹12,000 of the foreign tax, the credit is restricted to the lower applicable amount, ₹12,000. The figures are examples of the limitation method, not a treaty rate or a result for every taxpayer.

Credit is calculated by country and source

Do not combine every foreign payment into one worldwide number. Rule 76 requires a separate calculation for each income source in each foreign country or territory. Keep separate schedules for, for example, interest from one country, dividends from another and employment income from a third. This makes the Indian-tax ceiling and the relevant treaty article traceable.

Income offered over more than one Indian tax year

If income taxed abroad is offered in India over more than one tax year, Rule 76 spreads the foreign-tax credit across those years in the same proportion as the income is offered. A taxpayer should retain a reconciliation showing the total foreign income, the portion included in each Indian year and the corresponding credit claimed in each year.

Currency conversion

For the new Rule 76 calculation, foreign tax is converted using the telegraphic transfer buying rate on the last day of the month immediately preceding the month in which the tax was paid or deducted. Record the payment or withholding month and the rate used; converting at an arbitrary year-end rate can produce an unsupported credit amount.

Legacy procedure: claiming credit with Form 67

Form 67 is the route described in the Income Tax Department’s Form 67 User Manual for periods governed by the 1961 Act.

What the official legacy instruction says

“A resident taxpayer who has credit for the amount of any foreign tax paid in a country outside India by way of deduction or otherwise will be required to furnish the statement in Form 67 on or before the due date specified for furnishing the return of income under sub-section (1) of Section 139 to claim credit of such taxes.”

This wording applies to the legacy Form 67 process. It should not be treated as the filing rule for the new Form 44 regime.

Information and attachments

The online Form 67 workflow is organized into Part A, Part B, verification and attachments. Prepare the following before opening the form:

  • The country or territory where the tax arose and the nature of the foreign income.
  • The foreign income included in the Indian return and the foreign tax paid or withheld.
  • The foreign tax certificate, tax statement or withholding statement.
  • Proof that the tax was paid or deducted, such as a payment record or withholding evidence.
  • The Indian computation needed to determine the credit ceiling.

The portal FAQ states that a chartered-accountant certificate is not mandatory for submitting this legacy form. That does not remove the need to retain credible foreign records and proof of payment or deduction.

How to submit Form 67

  1. Confirm that the return period is governed by the Income-tax Act, 1961 and that you are claiming credit as a resident taxpayer.
  2. Sign in to India’s income-tax e-filing portal and open the online Form 67 service.
  3. Complete the form’s parts for foreign income and foreign tax, separating countries and income sources as required by your computation.
  4. Upload the foreign certificate or statement and payment or deduction evidence requested by the form.
  5. Complete verification and submit the form electronically.
  6. Save the acknowledgement, submitted form and attachments with the return records.

The legacy manual requires Form 67 on or before the due date specified for the income-tax return under section 139(1). Treat that as a filing deadline, not as a suggestion to submit after the return whenever convenient.

Carry-back of losses

The portal guidance also requires Form 67 in the stated case where carry-back of current-year losses results in a refund of foreign tax that was credited in an earlier year. Revisit the earlier credit when a loss carry-back changes the foreign-tax outcome; do not assume the original statement remains sufficient.

New procedure: Form 44 under Rule 76

For Tax Year 2026–27 onward, Rule 76 of the Income-tax Rules, 2026 governs the statement of foreign income offered in India and foreign tax paid or deducted. The rule requires Form 44 and supporting evidence.

What Form 44 asks for

The new form is designed to connect the foreign tax to the Indian assessment. Its fields include:

  • Country or specified territory and taxpayer identification number.
  • Income source and the foreign income offered in India.
  • Foreign tax paid or deducted.
  • Indian tax payable on the relevant income.
  • The treaty article and rate, where relevant.
  • Details of disputed tax, if any.
  • The foreign-tax credit claimed.

Complete each country-and-source line from a reconciliation that agrees with the Indian return. If a treaty applies, identify the actual article and rate for your facts; there is no universal treaty percentage.

Acceptable supporting statements and proof

Rule 76 allows the certificate or statement specifying the nature of the income and amount of tax to come from the foreign tax authority, the person responsible for withholding, or be signed by the assessee. The rule also calls for an acknowledgement, bank counterfoil or challan for tax paid, or proof of deduction when the foreign tax was withheld.

Keep the underlying documents even if the form accepts an assessee-signed statement. A self-signed statement should reconcile to contracts, foreign returns, payslips, broker statements, bank records or other contemporaneous evidence available for the transaction.

Timing for supporting documents

Rule 76 provides a twelve-month period from the end of the relevant tax year for the supporting certificate or statement when the return was filed within the specified time. The rules also contain a separate timing provision for returns filed under section 263(6)(a). Because those provisions are not identical, do not reduce them to one blanket deadline. Check which return-filing circumstance applies and calendar the document deadline from the end of the relevant tax year.

The material supplied for Rule 76 does not establish one universal Form 44 submission date equivalent to the legacy Form 67 wording. Follow the current Form 44 and return instructions applicable to your tax year, while separately tracking the Rule 76 evidence period.

Step-by-step Form 44 preparation

  1. Identify Tax Year 2026–27 or a later period and confirm that the 2025 Act framework applies.
  2. Confirm Indian residence for the relevant tax year and list every foreign country or territory and income source.
  3. Reconcile each foreign amount to the income offered in the Indian return.
  4. Convert foreign tax using the telegraphic transfer buying rate on the last day of the month immediately preceding the month of payment or deduction.
  5. Compute the lower-of limit for each country-and-source item, then apply any treaty ceiling.
  6. Collect the foreign certificate or statement, payment acknowledgement, bank counterfoil, challan or withholding proof.
  7. Complete Form 44, including the TIN, treaty article and rate where relevant, and any dispute details.
  8. Submit through the applicable electronic process and retain the acknowledgement and calculation schedule.

What happens when foreign tax is disputed?

Under Rule 76, foreign tax that you are disputing is generally not eligible for credit while the dispute remains open. You should not count a contested assessment as currently creditable merely because the foreign authority has issued a demand.

Credit may become available for the year in which the related income is offered or assessed in India if the dispute is finally settled and you act within six months from the end of the month in which settlement occurs. The follow-up requires:

  • Evidence that the dispute was finally settled.
  • Proof that the foreign tax liability was discharged.
  • An undertaking that no refund of that amount has been, or will be, claimed.

Keep the settlement order, payment record and undertaking together with the original Form 44 working papers. Missing the six-month follow-up window can prevent the later claim under the stated rule.

Evidence checklist before you file

Common mistakes and how to correct them

Using Form 67 for a new-regime tax year

Problem: The taxpayer sees “foreign tax credit” and submits the familiar legacy form without checking the period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Start with the tax year. Tax Year 2026–27 onward uses Rule 76 and Form 44; earlier periods remain under the 1961 Act process and Form 67 instructions.

Claiming the full foreign withholding amount

Problem: The foreign statement is treated as the credit automatically available in India.

Correction: Calculate separately by country and income source, then apply the lower-of Indian-tax and eligible-foreign-tax limit and any treaty restriction.

Combining countries or income sources

Problem: Interest, dividends and salary from multiple countries are netted into one figure.

Omitting proof of payment or deduction

Problem: A tax certificate shows an amount, but there is no evidence that tax was actually paid or withheld.

Correction: Retain the foreign authority certificate, withholding statement, bank counterfoil, challan, acknowledgement or other proof required for the applicable regime.

Using the wrong exchange-rate date

Problem: Foreign tax is converted at the year-end rate or at the rate used for a different transaction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: For Rule 76, use the telegraphic transfer buying rate on the last day of the month immediately before the month in which the tax was paid or deducted, and retain the calculation.

Claiming tax that is still under dispute

Problem: A contested foreign demand is included immediately.

Correction: Exclude disputed tax while the dispute remains open. After final settlement, meet the six-month evidence, discharge and no-refund undertaking conditions.

Assuming a credit guarantees zero Indian tax

Problem: The taxpayer expects every rupee paid abroad to offset Indian tax.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Treat the credit as limited relief. Indian tax can remain because of the lower-of cap, treaty limits, different tax bases, timing differences, classification issues or amounts that do not qualify as creditable foreign income tax.

When country-specific advice is necessary

The correct treaty article, source-country withholding ceiling and eligibility of a particular levy depend on the country, income category, residence facts and the wording of the applicable agreement. No single treaty rate applies to all dividends, interest, employment income or business profits. If the foreign tax is disputed, refunded, carried back or imposed on an unusual levy, obtain advice based on the actual treaty and documents rather than relying on a general percentage or an online calculator.

A cross-border tax professional can be useful where the treaty classification is uncertain, income spans several Indian tax years, or a foreign audit or appeal is pending. The professional should be qualified for both jurisdictions involved and should review the tax period, residence status, treaty article, evidence and filing deadline.

Practical filing workflow

  1. Classify the period: Decide whether the 1961 Act/Form 67 or 2025 Act/Rule 76/Form 44 framework applies.
  2. Classify the taxpayer: Confirm Indian residence for the relevant period.
  3. Classify the income: Match each foreign receipt to its source, country and Indian return line.
  4. Verify the foreign tax: Determine whether it was paid, withheld, refunded, disputed or otherwise subject to a treaty limitation.
  5. Build the calculation: Convert currency as required, apply the country-and-source lower-of cap and record the treaty article where relevant.
  6. Assemble evidence: Attach or retain certificates, withholding statements and payment or deduction proof.
  7. Submit on time: Use Form 67’s section 139(1) deadline for legacy periods; follow Rule 76 and current Form 44 instructions for new periods, including the applicable document-timing rule.
  8. Archive the file: Keep the submitted form, acknowledgement, return, reconciliation, exchange-rate record and foreign evidence together.

Key points to retain

  • The tax period determines the form: Form 67 for the legacy 1961 Act route and Form 44 under Rule 76 for Tax Year 2026–27 onward.
  • Credit is calculated by country and income source and is capped; it is not an automatic refund of all foreign tax.
  • Foreign certificates and proof of payment or withholding are central to the claim.
  • Disputed foreign tax is generally excluded until settlement and completion of the Rule 76 follow-up conditions.
  • Treaty-specific rates and eligibility cannot be assumed without the actual country, income and residence facts.
