Start by documenting the defect, checking your contract and warranty, and sending a written claim to the builder and any required warranty administrator. If the builder does not resolve it, use the complaint, mediation, arbitration, tribunal or court process that applies where the home is located—and do so before the relevant notice or limitation period expires. There is no single worldwide procedure: your country, state or province, contract, handover date and type of defect determine your rights.
What counts as a construction defect?
A construction defect is a failure in design, materials or workmanship that leaves a new home below the standard promised by the contract, warranty or applicable law. Examples can include water penetration, defective plumbing or electrical work, unsafe structural work, work that does not comply with the building code, or construction that is not fit for habitation. A cosmetic snag may be handled through a defects list; a safety or habitability problem may trigger a formal warranty or statutory claim.

The important question is not simply whether something is wrong, but which legal promise was broken, who made that promise, and which remedy process applies. A sales contract, construction contract, builder warranty, statutory new-home warranty, insurance policy and building regulations can create different rights and deadlines.

Make the area safe
If the defect presents an immediate danger—such as an unstable structure, exposed wiring, gas issue or active leak—protect people and take reasonable steps to prevent further damage. Contact emergency services or a qualified professional where appropriate. Photograph the condition before it changes and keep every invoice, report and message.

- WATER LEAK DETECTOR detects relative moisture content from leaks and flooding
- PINLESS MOISTURE METER measures relative moisture content in building materials
- NONDESRUCTIVE DETECTION up to 3/4-Inch deep using Electromagnetic field (EMF) technology
- USE ON DRYWALL, MASONRY, HARDWOOD, AND SOFTWOOD; calibrated for these materials only
- REVERSE-CONTRAST DISPLAY for easy viewing of reading and nine LED bars to indicate moisture range
Do not assume that you must wait for the builder, or that every emergency expense will be reimbursed. The legal treatment of emergency work varies. Check the contract, warranty, insurer and local law, and give the builder and warranty provider prompt notice where the documents require it.
Preserve the original condition when possible
Do not discard damaged materials or authorize extensive opening-up work before the responsible parties have had a reasonable opportunity to inspect, unless safety or further damage makes immediate work necessary. Record why urgent action was needed and what was done.
Build an evidence file before making the claim
A clear file makes it easier to show when the problem began, what it affects and what remedy is reasonable. Use a separate folder for each defect and keep originals in date order.

- Defect log: note the date first observed, exact location, symptoms, changes over time and effect on use or safety.
- Images and video: take dated, wide and close photographs, including a scale reference where useful. Keep the original files and a backup.
- Project documents: retain the purchase and construction contracts, plans, specifications, variations, payment records, handover or settlement documents, inspection reports and warranty certificate.
- Communications: save emails, letters, texts, call notes and photographs sent to or received from the builder, tradespeople, insurer, warranty administrator and regulator.
- Costs: record reasonable temporary measures, expert inspections, invoices and receipts. A cost record does not itself prove that the expense is recoverable.
- Delivery proof: keep postal tracking, email delivery records, portal confirmations or signed acknowledgements showing when a notice was received.
Where the cause or severity is disputed, an independent, appropriately qualified building professional can document the condition and explain likely causes and remedial work. A consumer moisture meter may supplement a dampness log, but a reading does not diagnose the cause, establish a code breach or prove legal liability.
Identify which cover applies
Read every document rather than assuming that “new home warranty” means one universal product. The U.S. Federal Trade Commission distinguishes a builder warranty supplied with new construction from a separately purchased home warranty or service contract. They can have different covered components, exclusions, claim procedures and dispute clauses. See the FTC’s explanation at Warranties for New Homes.
| Possible route | What to check | Who usually decides |
|---|---|---|
| Builder or developer warranty | Covered workmanship, materials, systems and structural items; exclusions; start date; notice method; repair obligations; mediation or arbitration clause. | Builder first, then the process named in the warranty. |
| Statutory new-home warranty | Qualifying home, prescribed defects, warranty periods, claim form, inspection rules and filing deadline. | A statutory warranty authority, tribunal or court, depending on the jurisdiction. |
| Insurance | Whether the policy covers sudden damage, latent defects, resulting damage or only specified perils; excess and notification requirements. | The insurer, with internal review or an external dispute route. |
| Contract or court claim | Promises in the sale or construction contract, notice conditions, limitation period, proof of loss and available damages. | A court or other body specified by local law. |
The FTC gives common U.S. examples of one year for workmanship and materials, two years for heating, ventilation, air-conditioning, plumbing and electrical systems, and up to ten years for some major structural defects. These are examples, not universal rules; the actual warranty controls, including the date from which each period runs.

Do not assume that a separately purchased service contract replaces a builder warranty, or that a statutory scheme covers every repair or expense. Confirm whether the home, purchaser and defect qualify.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsCheck deadlines, exclusions and required notices
Before sending a claim, make a one-page deadline schedule. Record the completion or handover date, the date the defect was discovered, the end of each defects or warranty period, any contractual notice window and the limitation period for a tribunal or court claim. Some periods run from completion; others run from discovery or a formal notice. Informal negotiations do not necessarily stop a deadline.
Read for exclusions such as owner damage, lack of maintenance, normal shrinkage, alterations by others, appliances not supplied by the builder, consequential loss or work performed without authorization. Check whether the warranty requires a particular form, inspection, opportunity to repair, certified notice or escalation step.
Because deadlines differ even within one country, obtain local legal or consumer-authority advice early if the dates are close. Never substitute a period from another jurisdiction.
Send a formal written defect claim
Follow the contract, warranty certificate or statutory form exactly. A phone call can alert the builder, but a written request creates a record. The FTC recommends submitting repair requests in writing and retaining correspondence.

- Address the correct parties. Send the notice to the builder or developer and separately to the warranty administrator, insurer, regulator or other party identified by the documents.
- Identify the home and contract. Include the address, purchaser names, contract or warranty number, completion or handover date and your preferred contact details.
- Describe each defect separately. State the room or element, what you observed, when it began, how it affects use or safety, and any visible progression. Refer to photographs, reports and inspection dates.
- State the remedy sought. Request inspection, a written diagnosis, a repair method and a proposed completion timetable. If you seek compensation, list the amount and attach an itemized schedule rather than an unexplained total.
- Offer reasonable access. Give proposed inspection dates and explain any access restrictions. Keep a record if an appointment is missed or declined.
- Set a response date that follows the documents. Do not invent a statutory response period. Ask for written acknowledgement and the next step within the timeframe required by the warranty or law.
- Preserve proof of receipt. Use the required portal, email, registered post or other method and save the confirmation.
Keep the tone factual. Avoid guessing the legal cause or accusing an individual when the evidence is incomplete. A precise notice helps the builder investigate and preserves your position if escalation becomes necessary.

If the builder does not resolve the defect
Escalation depends on the governing scheme. Follow any required opportunity to inspect or repair, but do not let repeated promises run out the filing deadline. Ask the administrator or regulator in writing whether a complaint, mediation or inspection affects the time limit.
| Route | Typical use | Questions to verify |
|---|---|---|
| Warranty administrator or statutory authority | A qualifying new-home defect under a builder or statutory warranty. | Eligibility, claim form, inspection, coverage cap, filing date and appeal rights. |
| Regulator or consumer complaint service | Non-response, licensing concerns or a government-supported dispute process. | Whether it can order repairs or only facilitate communication; whether it pauses no deadline. |
| Mediation | A negotiated settlement with an independent facilitator. | Cost, confidentiality, attendance, written settlement terms and effect on other claims. |
| Arbitration | A private adjudication required or permitted by the contract or warranty. | Whether it is binding, how the arbitrator is appointed, fees, evidence rules and appeal limits. |
| Tribunal or court | A binding decision on liability, repair or compensation when earlier routes fail or are unavailable. | Jurisdiction, limitation date, filing fee, expert evidence, representation and enforcement. |
The FTC notes that some U.S. new-home warranties require mediation or arbitration and may address costs and binding effect. Do not assume those clauses apply to every warranty or that an informal complaint preserves a court claim.
What compensation can include—and what it may exclude
Depending on the contract, warranty and law, relief may include repair, replacement, remedial work, reimbursement of defined costs or a monetary award. A warranty authority may arrange work instead of paying cash, or take steps to mitigate claimed damage.

Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Consequential expenses are a separate question. Many new-home warranties do not pay every out-of-pocket cost caused by a major defect; the FTC specifically gives temporary accommodation as an example that may be excluded. Do not promise recovery for alternative housing, lost use, storage, expert reports, financing costs or inconvenience without checking the controlling terms.
When claiming money, connect each amount to evidence: invoice, receipt, expert estimate or other record. Explain mitigation steps and any payment, insurance settlement or contribution already received. Double recovery is generally not available, and accepting a full-and-final settlement can affect later rights; obtain advice before signing.

The Protection for Owners and Purchasers of New Homes Act, 2017 establishes statutory warranties and a compensation process through the warranty authority. The warranties include construction in accordance with the building code and applicable law, proper workmanship, fitness for habitation and freedom from prescribed major defects. The act permits compensation from a guarantee fund in defined circumstances and allows the authority to arrange work in lieu of, or to mitigate, claimed damages. Its procedure and appeal route, including tribunal review, must be checked against the current regulations and the facts of the home. The warranty provisions are also published in the government’s current version at the Act’s warranty section.

NSW Government guidance explains complaint handling for building disputes, including inspection and possible proceedings in the NSW Civil and Administrative Tribunal (NCAT). It warns homeowners to apply to NCAT before the statutory warranty period expires to preserve rights. Read the current process at Resolving building disputes with your builder or tradesperson, confirm the applicable period for your work and do not rely on a period from another state or country.

Common mistakes that weaken a claim
- Waiting for verbal assurances while a warranty or tribunal deadline approaches.
- Sending one vague complaint instead of listing each defect, location, date and requested remedy.
- Repairing or altering the work without preserving evidence or giving the responsible party a reasonable inspection opportunity, unless urgent safety action is needed.
- Assuming a builder warranty, statutory warranty, insurance policy and home service contract cover the same losses.
- Claiming a total for accommodation or other consequential costs without checking exclusions and keeping receipts.
- Using a DIY measurement as proof of cause, code non-compliance or liability.
- Signing a release or full-and-final settlement before understanding its effect on unresolved defects.
- Assuming mediation, arbitration or a complaint automatically pauses a statutory limitation period.
A practical claim checklist
- Country, state, province or territory identified.
- Completion, handover, settlement and discovery dates recorded.
- Contract, plans, variations, handover papers and warranty located.
- Each defect logged with dated photographs, video and supporting reports.
- Safety and further-damage issues addressed and emergency costs documented.
- Coverage, exclusions, notice method and deadline schedule checked.
- Written notice sent to every required party with delivery proof.
- Inspection access and proposed repair timetable recorded.
- Escalation route selected before the filing deadline.
- Compensation schedule supported by invoices or estimates and separated from amounts whose recovery is uncertain.
When to obtain professional advice
Consult a local construction lawyer, licensed building consultant, consumer authority or claims adviser when the defect affects structure or habitability, the builder denies responsibility, the repair cost is substantial, an expert report is disputed, a release is proposed, or a deadline is near. Bring the organized evidence file and the deadline schedule. Professional advice cannot change an expired limitation period, so early review is usually more valuable than waiting for negotiations to fail.
