If your paycheck is being garnished, start with the notice—not a generic exemption letter. Identify the issuing court or agency, the debt type, the amount withheld, the required response method and the deadline. Then follow the exemption procedure for the state and jurisdiction named in the notice. There is no single nationwide form or deadline, and sending an informal letter does not automatically stop withholding.
Federal law usually limits ordinary consumer-debt garnishments, while state law may protect more of your earnings. Child support, taxes, bankruptcy orders, federal administrative debts and defaulted federal student loans can follow different rules. A frozen bank account is a separate problem from a wage garnishment and may require a different claim.

What to do as soon as you receive a garnishment notice
Time matters because the notice controls how and when you can object. Treat the document as a legal deadline even if you believe the debt is wrong or the money is protected.
1. Get the complete order
Ask your employer’s payroll or human-resources department for a copy of the wage-garnishment order or agency withholding notice if you were not given one. A payroll deduction alone may not show whether the instruction came from a court, a state agency or a federal agency. You need the underlying document to identify the correct challenge process.

2. Identify who issued it and what debt is involved
Write down the court or agency name, case or account number, creditor, alleged debtor, debt category and the first pay date affected. Determine whether it is an ordinary private consumer debt, child support, a tax debt, a bankruptcy-related order, a federal administrative debt or a defaulted federal student loan. The category can change both the amount that may be withheld and the procedure for seeking relief.
3. Find the response method and deadline
Look for instructions labeled “claim of exemption,” “objection,” “request for hearing,” “answer,” or similar wording. The notice may require a court form, an online filing, delivery to a clerk, or another method. It may also specify a hearing date. Do not assume that a deadline from another state, another type of debt or an internet form applies to your case.
4. Continue complying while you seek help
Unless the issuing authority tells your employer to stop, payroll may continue withholding. A general letter to the creditor, employer or collector does not automatically pause a garnishment. If the deadline is close, file the procedure identified in the notice and seek legal assistance at the same time.

First determine whether this is a paycheck garnishment or a bank freeze
People often use “garnishment” for two different events. The remedy, automatic protections and paperwork are not interchangeable.
| Issue | What happens | What you generally need to do |
|---|---|---|
| Paycheck withholding | Your employer receives an order and sends part of each paycheck to the creditor or agency. | Use the notice’s wage-exemption or objection process; provide payroll records or other evidence required by local instructions. |
| Bank-account freeze or levy | A bank restricts money already in an account and may send funds to the creditor or agency. | Review the bank and court notices, identify the source of deposits, and use the account-release or exemption process stated there. A wage claim form may not apply. |
The Consumer Financial Protection Bureau (CFPB) explains that a bank must review an account receiving direct deposits of certain federal benefits before freezing or garnishing funds under the federal benefits rule. That automatic review is separate from a wage-exemption claim and does not resolve every account dispute.

How the federal limit works for an ordinary consumer debt
For most ordinary private consumer debts, a creditor generally needs a court judgment before wages can be garnished. The Consumer Credit Protection Act (CCPA) sets a federal ceiling on the amount that may be taken. State law can be more protective, and the lower applicable limit controls.
Disposable earnings are the starting point
“Disposable earnings” means what remains after deductions that the law requires, such as applicable taxes and legally required retirement or similar deductions. Voluntary deductions— for example, optional insurance, savings or retirement contributions—generally do not reduce the disposable-earnings figure used for the federal calculation. Use actual pay statements rather than the amount that reaches your bank account.

The U.S. Department of Labor’s December 2024 Fact Sheet #30 states:
“For ordinary garnishments (i.e., those not for support, bankruptcy, or any state or federal tax), the weekly amount may not exceed the lesser of two figures: 25% of the employee’s disposable earnings, or the amount by which an employee’s disposable earnings are greater than 30 times the federal minimum wage (currently $7.25 an hour).”
For a weekly pay period, 30 times $7.25 is $217.50. Calculate both figures and use the smaller one. The $7.25 figure is the federal minimum-wage value used in that December 2024 fact sheet; the threshold changes with the length of the pay period.

| Weekly disposable earnings | 25% figure | Amount above $217.50 | Federal maximum for an ordinary garnishment |
|---|---|---|---|
| $250 | $62.50 | $32.50 | $32.50 |
| $600 | $150.00 | $382.50 | $150.00 |
| $900 | $225.00 | $682.50 | $225.00 |
For a biweekly pay period, the comparable threshold is 60 times $7.25, or $435. For semimonthly or monthly pay, the Department of Labor’s fact sheet provides the applicable multiples. Do not apply the weekly $217.50 threshold to a different pay schedule.
Why your state’s limit may be lower
Federal law is a ceiling, not a guaranteed amount that a creditor may take. A state may exempt a larger share of wages or impose a lower garnishment limit. When federal and state limits differ, the more protective result—the lower withholding amount—applies. The court or agency handling the case and your state’s official instructions determine how that comparison is made.
Debt types that do not follow the ordinary formula
Do not use the 25%-or-30-times-minimum-wage calculation mechanically when the notice identifies one of these categories.
Child support and other support orders
Support orders have special CCPA limits that can allow a larger percentage of disposable earnings than an ordinary consumer judgment. The allowed amount can also depend on whether you support another spouse or child and whether you are behind on support. Use the support agency or court named in the notice for the exact calculation and objection route.
Federal and state taxes
Tax levies and tax garnishments can be subject to different rules from ordinary private debt. The issuing tax agency’s notice should explain how to claim a hardship or other exemption, if available. A standard consumer-debt exemption form may be rejected.

Bankruptcy orders
A bankruptcy case or order may change collection activity and the treatment of wages. The Department of Labor identifies bankruptcy-related garnishments as an exception to the ordinary CCPA formula. Notify your bankruptcy attorney or the bankruptcy court promptly if a garnishment starts or continues during a case.
Federal administrative debts
Some non-tax federal debts can be collected administratively without the same court process used for a private creditor. The CCPA wage limits may still apply, but the federal agency that initiated the withholding handles the relevant referral and dispute process. Follow the agency’s notice rather than sending a private-creditor objection.
Defaulted federal student loans
Defaulted federal student loans can be subject to administrative wage garnishment. The notice should identify the agency or servicer and explain the hearing or review process. Because the route differs from an ordinary judgment, obtain the agency’s instructions and ask for legal help if you believe the debt, amount or withholding is incorrect.
How to claim a wage exemption in practice
The following sequence is a national framework. The form, filing location, delivery method and deadline come from the state or federal authority identified in your notice.
- Confirm the order. Obtain the full order from payroll and compare it with any notice sent to you. Check your name, employer, case number, creditor and effective date for errors.
- Classify the debt. Mark whether it is ordinary consumer debt, support, taxes, bankruptcy-related, federal administrative debt or a federal student loan. If the category is unclear, call the issuing clerk or agency using contact information printed on the notice.
- Read every page. Locate the exemption or objection instructions, deadline, hearing information, filing fee information and delivery address. Some notices include a detachable form; others direct you to a court website or clerk.
- Find official local guidance. Use the court named in the order, your state court system, or a state-based legal-aid service. The CFPB points consumers to LawHelp.org for state exemption information. A local attorney or legal-aid office can identify protections that a national summary cannot.
- Gather supporting records. Collect recent pay statements showing gross pay and legally required deductions, the garnishment order, benefit award letters, bank statements showing the source of deposits, and documents proving dependents or other facts relevant under local law. These are practical examples; the court may require different evidence.
- Complete the designated claim. State the exemption or objection that actually applies and attach only the documents requested. Do not substitute a self-written letter if the authority requires a prescribed form.
- File and deliver it exactly as directed. Follow the stated method—such as clerk filing, approved electronic submission or service on specified parties—and meet the stated deadline. Keep a complete copy, confirmation number, stamped receipt, mailing receipt or other proof of delivery.
- Attend any scheduled hearing. Bring the filed claim, order, pay records and originals of supporting documents. Whether a hearing is required is jurisdiction-specific; do not assume filing alone decides the claim.
- Notify payroll only through the proper channel. Give your employer a court or agency order changing the withholding. Payroll generally cannot decide an exemption based on your personal letter.
What evidence can support an exemption claim?
Exemptions vary by state, but accurate records help the decision-maker determine whether protected income or an allowable hardship is involved. Organize documents by the claim you are making:

- Family or hardship facts: documents specifically requested by the local form, such as dependent information, housing costs or medical expenses. Do not send sensitive records unless the notice or an adviser says they are relevant.
Bank-account freezes involving federal benefits
A bank-account levy is not a wage-exemption claim. Under the federal rule described by the CFPB, a bank receiving direct deposits of certain federal benefits must review the account and generally protect up to two months’ worth of covered benefits before freezing or garnishing funds. Covered benefits generally include Social Security, SSI, veterans’ benefits, certain Railroad Retirement payments, Civil Service Retirement and Federal Employees Retirement System benefits.
The automatic protection is limited. It concerns qualifying direct deposits, not every dollar in the account. Paper-check deposits, other types of funds, amounts above the protected level and exceptions can require additional action. If your account is frozen, promptly review notices from the bank, court and creditor, identify the source and dates of deposits, and use the release or exemption process in the notice. The CFPB notes that a judge may need information about where the funds came from before deciding whether money should be released.
Common mistakes that cost people time or money
- Waiting for payroll to explain the case: payroll usually follows the order and cannot give legal advice.
- Assuming every garnishment is capped at 25%: the lesser-of-two-figures test applies to ordinary garnishments, not every debt category.
- Using take-home pay as disposable earnings: voluntary deductions and legally required deductions are treated differently.
- Missing a state deadline: there is no universal national deadline for an exemption claim.
- Sending a generic letter: an informal letter may not be a valid filing and ordinarily does not stop withholding.
- Confusing wages with benefits in a bank account: account protections and wage protections use different procedures.
- Ignoring an underlying lawsuit: most ordinary private-debt garnishments follow a judgment, so failing to respond earlier can limit later options.
- Paying a scammer who promises release: verify contact information through the court or agency named on the official notice before sharing money or personal data.
When to obtain legal help
Contact a consumer-law attorney, employment-law attorney, legal-aid office or the agency’s designated adviser quickly when a deadline is approaching. Assistance is especially important if the notice concerns child support, taxes, bankruptcy, a federal debt or a student loan; if the amount withheld does not match the order; if your income includes protected benefits; or if you never received the lawsuit or order.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesThe CFPB recommends consulting a consumer-law attorney or state-based legal help about state and federal protections. Bring the complete notice, order, pay statements, bank records and a timeline of contacts. Ask specifically which exemption applies, where the claim must be filed, whether a hearing is required and what document will instruct payroll or the bank to release funds.
Sources for the federal rules
The CFPB article “Can a debt collector take or garnish my wages or benefits?” (last reviewed August 2, 2023) explains judgments, exemptions and benefit protections. Its article “Can a payday lender garnish my bank account or my wages if I don’t repay the loan?” (last reviewed November 25, 2024) addresses bank-account and wage collection questions. The U.S. Department of Labor’s Wage and Hour Division Fact Sheet #30, “Wage Garnishment Protections of the Consumer Credit Protection Act (CCPA),” dated December 2024, provides the federal limits, definitions and exceptions. The Department also publishes “Federal Wage Garnishments.” These federal materials do not replace the instructions of the court or agency named in your notice.
The practical takeaway
Start by identifying the issuing authority and debt category, then follow that notice’s exemption or objection procedure before its deadline. Use the federal CCPA limit only as a baseline for ordinary consumer debts, check whether state law is more protective, and treat a bank freeze or a support, tax, bankruptcy or federal-debt collection as a separate legal path. Keep proof of every filing and seek local legal help whenever the notice is unclear or protected income may be involved.
