Under the current Rule 89 treatment described by the Government, capital-goods ITC is left out of “Net ITC” when accumulated-ITC refunds are calculated for the specified zero-rated-supply and inverted-duty routes. For inverted-duty claims, input-service ITC is also excluded.
Whether any refund is available depends on four separate questions: whether the credit can be availed, which statutory refund category applies, whether the credit is counted in that category’s formula, and whether the taxpayer can prove all other conditions for the relevant period. The normal electronic application is FORM GST RFD-01 on the GST Portal. A Government FAQ describes a prospective change from 1 April 2027 for specified calculations, but that future measure does not itself broaden the class of taxpayers eligible under section 54(3).

What “GST refund on capital goods” actually means
Capital goods are business assets acquired for use in the enterprise. The GST charged on an eligible purchase may be recorded as ITC if the CGST Act and the taxpayer’s facts allow it. That accounting entry and a cash refund are different legal outcomes.

A refund application is available only through a statutory route. Section 54(3) and Rule 89 provide specified routes for refund of unutilized ITC, including claims connected with zero-rated supplies and inverted duty structure. An asset purchase, an electronic credit-ledger balance, or an invoice showing GST is not a refund category by itself. The current rules are published by the Central Board of Indirect Taxes and Customs (CBIC) at the CGST refund rules page.
#1 Best Overall
For the accumulated-credit calculations covered here, the present treatment excludes capital-goods ITC from “Net ITC.” This means a business can potentially retain an otherwise valid capital-goods credit in its electronic ledger while being unable to use that same credit to increase a cash refund under the current formula. The result must be determined for the particular refund category and tax period, not inferred from the fact that the business bought machinery, equipment, or another long-term asset.
The Government’s 2026 FAQ describes an intended prospective inclusion of eligible capital-goods ITC attributable to the relevant period in specified Rule 89(4) and Rule 89(5) calculations beginning 1 April 2027. It expressly says the change does not expand who is eligible under section 54(3). Treat that date as a future legal change until the final measure is in force and confirm the operative text before filing a claim for a later period. See the Government FAQ.
The four eligibility questions to answer separately
1. Is the ITC itself eligible to be availed?
First establish whether the business may take the credit under the CGST Act on the facts of the purchase and use. This is an ITC question, not a refund question. The invoice, supplier details, receipt and use of the asset, accounting treatment, return disclosures, and any restrictions that apply to the transaction must be checked under the live law. A refund worksheet cannot cure ineligible ITC.
2. Which refund category applies?
Identify the qualifying event before doing any calculation. The relevant routes in this context are generally:
- Zero-rated supplies: a claim connected with the statutory zero-rated-supply provisions and the applicable Rule 89 calculation.
- Inverted duty structure: a claim where the rate on eligible inward supplies produces the statutory accumulation pattern and the Rule 89(5) conditions are met.
Do not select a category simply because a capital asset was purchased. The supply type, the period, the return data and the statutory conditions determine the route.
3. Does the credit enter that route’s Net ITC formula?
Current Government guidance says capital-goods ITC is excluded from Net ITC for the described accumulated-credit calculations. In an inverted-duty claim, input-service ITC is excluded as well. The formula therefore cannot be built by adding every credit appearing in the electronic ledger. Use the definition and exclusions applicable to the exact period and category in the current Rule 89 text.
4. Can the claimant prove every other condition?
Eligibility also depends on the claimant’s returns, ledger balance, qualifying outward supplies, invoices, prescribed statements, and evidence that the refund amount is correctly derived. The answer can differ between two businesses that bought identical equipment because their supplies, credit mix, periods, or records differ.
How the two main routes differ
| Refund route | Qualifying situation | Current capital-goods treatment | Other credit treatment highlighted by Government guidance | Evidence to organize |
|---|---|---|---|---|
| Zero-rated-supply accumulated ITC | A qualifying zero-rated supply and the conditions of the applicable section 54(3) and Rule 89 provisions | Capital-goods ITC is excluded from Net ITC under the current treatment described by the Government | Apply the Rule 89 definition and exclusions for the period; do not assume every ledger credit is included | Supply records, invoices, return data, credit-ledger reconciliation and the category-specific statements |
| Inverted-duty accumulated ITC | The statutory inverted-duty pattern and the conditions of the applicable section 54(3) and Rule 89 provisions | Capital-goods ITC is excluded from Net ITC under the current treatment described by the Government | Input-service ITC is also excluded under the cited current treatment | Rate and supply analysis, eligible input invoices, return data, ledger reconciliation and required statements |
| Any other situation | A fact pattern outside these accumulated-ITC categories | There is no general cash-refund entitlement merely because a capital asset was purchased | Check the specific statutory provision rather than borrowing a formula from another route | The records and certificates required by that particular provision |
The table is a decision aid, not a substitute for the live statute. Compare a possible route by its qualifying supply or event, the credit types entering Net ITC, the formula and relevant period, the statements and evidence required, and whether the rule is in force for the period claimed.

Pre-filing eligibility checklist
Complete these checks before opening an RFD-01 application:
- Define the period: record the exact tax period for which unutilized credit is said to have accumulated. Keep the purchase period, supply period and refund period aligned with the applicable rule.
- Classify the outward supplies: determine whether the claim concerns zero-rated supplies, inverted duty structure, or another statutory category.
- Verify ITC validity: test each credit included in the proposed calculation against the applicable CGST Act requirements and the business’s supporting records.
- Separate credit types: identify capital-goods ITC, input-goods ITC and input-service ITC in the reconciliation. Under the current treatment described above, capital-goods credit is excluded from the cited accumulated-credit formulas, and input-service credit is excluded for inverted-duty claims.
- Reconcile returns: tie the proposed figures to the relevant GST returns and the electronic credit ledger. Investigate timing differences, reversals, amendments and credits that were carried forward from another period.
- Check the ledger: confirm that the claimed amount is actually available as unutilized credit after liabilities, reversals and other adjustments reflected for the relevant period.
- Confirm documentary capacity: make sure invoices, statements and supply evidence can be produced in the format required for the chosen category.
- Assess unjust enrichment requirements: Rule 89 materials require a certificate or declaration concerning unjust enrichment in specified circumstances, including claims above the prescribed threshold unless an exception applies. The applicable threshold and exception must be checked in the current rule for the claim.
- Check for changes in force: if the period is on or after 1 April 2027, verify the final legal text and portal implementation before deciding whether any eligible capital-goods amount enters the calculation.
Step-by-step: filing an RFD-01 claim
Step 1: Choose the legal category and period
Write down the statutory basis for the claim before entering figures. A description such as “refund of GST on a machine” is not enough. Identify the qualifying zero-rated supply or inverted-duty pattern, the relevant tax period and the section 54(3)/Rule 89 provision being used. If no category fits, stop and resolve that issue rather than filing under the nearest-looking option.
Step 2: Build a transaction-level reconciliation
Start with purchase invoices and the electronic credit ledger, then reconcile to the relevant returns. Create separate totals for the credit types that the applicable formula recognizes and those it excludes. For the current accumulated-credit treatment, remove capital-goods ITC from Net ITC calculations for the described routes; for an inverted-duty claim, remove input-service ITC as well. Preserve a line-by-line trail from each included amount to its invoice and return entry.

For a zero-rated claim, connect the proposed refund period to the qualifying outward supplies and the records supporting them. For an inverted-duty claim, document the rate and supply pattern that creates the statutory accumulation. Do not rely on the presence of an unutilized ledger balance without showing why the balance arose under the selected route.
Step 4: Prepare the prescribed statements and certificates
Rule 89 materials call for invoice information and category-specific statements. Assemble the statement in the format currently accepted by the Portal, together with the supporting invoices and reconciliations. Where the rules require an unjust-enrichment certificate or declaration, obtain it in the prescribed form and assess whether an exception applies. There is no universal document list for every category, so use the live rule and the Portal checklist for the selected claim.
Step 5: Start the electronic application
Sign in to the GST Portal and open the refund application workflow. Select FORM GST RFD-01, choose the applicable refund category, enter the period and figures, and upload the statements and supporting material requested by the current form. The Portal’s labels and validations may change; follow the prompts displayed for the selected category rather than an old screenshot or generic checklist.
Step 6: Review every figure before submission
Compare the form with the reconciliation prepared in Step 2. Confirm that the Net ITC figure uses the correct exclusions, the claimed amount does not exceed the available eligible balance, the period matches the returns, and invoice numbers and tax amounts are legible and consistent. A capital-goods invoice should not be included in Net ITC merely because its tax is visible on the document.

Submit the application electronically, directly or through a notified facilitation centre where that option is available under the rules. Save the acknowledgement reference number (ARN), the filed form, uploaded statements and a copy of the calculation on the filing date. The ARN is the reference needed for subsequent status checks and correspondence.

Step 8: Monitor the application and answer requests
Use the GST Portal’s refund-status function to follow the ARN and check whether an officer has issued a notice or requested additional information. Portal guidance explains how to view submitted or saved applications at the GST Portal refund-help page. A broader compilation of Portal functionality is available in the GST Portal functionality document. Respond within the period and in the format stated in the notice, using the same reconciled figures rather than replacing the original calculation with unexplained numbers.
Documents and working papers that make a claim defensible
The exact attachments vary by category, but a well-organized file normally links each conclusion to contemporaneous records:
- Tax invoices for the relevant inputs, including capital-asset invoices identified separately from other purchases.
- Return extracts and reconciliation schedules showing how the proposed figures tie to filed data.
- Electronic credit-ledger statements for the relevant period, with explanations for reversals, reclaims and carry-forwards.
- Outward-supply records supporting the zero-rated or inverted-duty classification.
- The invoice-level statement and any other schedule specified by Rule 89 or the Portal for the selected category.
- The required unjust-enrichment certificate or declaration where the rule calls for one, together with evidence supporting any applicable exception.
- A calculation sheet showing the formula, period, included credit types, excluded credit types and the resulting amount.
- Internal approvals and accounting records that explain unusual adjustments, amended invoices or timing differences.
Keep the calculation reproducible: an independent reviewer should be able to start with the filed return and ledger, trace an included line to its invoice, and see why every excluded line was left out.

Common mistakes and how to correct them
“The machine has GST, so I can claim that GST as a refund.”
Why it fails: the purchase does not identify a refund route, and current Net ITC treatment excludes capital-goods credit for the accumulated-credit routes described here.
Correction: first test ITC eligibility, then identify a statutory refund category and calculate only the credit types that category permits.
Using the entire electronic credit-ledger balance as Net ITC
Why it fails: the ledger contains credits that the formula may exclude, including capital-goods ITC and, for the current inverted-duty treatment, input-service ITC.
Correction: maintain a credit-type reconciliation and document exclusions before entering the RFD-01 figures.
Choosing “inverted duty” because the business has unutilized credit
Why it fails: an unutilized balance alone does not establish the statutory rate pattern or other conditions.
Rank #4
Correction: map the relevant inward and outward supplies, rates, period and statements to the Rule 89 requirements.
Copying an old Portal walkthrough
Why it fails: labels, validations and upload requirements can change, and a screen designed for another refund category may omit a required field.
Correction: use the current RFD-01 workflow and category-specific checklist visible after signing in, while retaining the filed form and ARN.

Why it fails: a certificate or declaration may be required for the claim’s circumstances, including claims above the prescribed threshold unless an exception applies.
Correction: determine the requirement from the live rule before submission and attach the prescribed document or the evidence for the applicable exception.
Applying a future rule to a current-period claim
Why it fails: the Government’s 1 April 2027 date is prospective; it is not authority to include capital-goods ITC in a claim governed by the current treatment.
Correction: apply the rule in force for the relevant period and verify the final implementation before filing for periods beginning under the prospective change.
Submitting inconsistent invoice and return data
Why it fails: mismatched invoice numbers, dates, tax amounts or periods make the claimed amount difficult to verify and can trigger a notice.

What changes from 1 April 2027—and what does not
The Government FAQ describes inclusion, from 1 April 2027, of eligible capital-goods ITC attributable to the relevant period in specified Rule 89(4) and Rule 89(5) calculations. The wording is prospective and tied to the relevant period, so a taxpayer should not automatically move an earlier purchase into a later claim. Confirm the final notification, effective date, attribution rule and Portal validation before relying on the change.
The FAQ also states that this measure does not expand the class of taxpayers eligible under section 54(3). A business must still have a qualifying statutory route, valid ITC, the required supply and period facts, and the prescribed evidence. The change concerns how an eligible capital-goods amount is treated in specified calculations; it is not a blanket refund for every capital asset.
Practical decision examples
Exporter with a newly purchased production machine
The exporter should first establish that the machine’s ITC is legally availed and then test whether the outward supplies support the zero-rated route. Under the current treatment, the machine’s capital-goods ITC is not added to Net ITC for the accumulated-credit calculation. The business may still need to account for that credit correctly in its ledger, but the invoice alone does not create a cash refund.
Domestic manufacturer with an inverted-duty pattern
The manufacturer must demonstrate the statutory inverted-duty conditions for the selected period. Its calculation must exclude capital-goods ITC and, under the current treatment described by the Government, input-service ITC. The remaining eligible credit and the qualifying supply data must be reconciled to returns and the ledger before an RFD-01 claim is filed.
Claim period falling after 1 April 2027
The taxpayer should check whether the prospective measure is legally effective for that period and whether the capital-goods amount is attributable to it under the final text. Even if the amount enters the specified formula, the taxpayer still needs a section 54(3) route and all other Rule 89 conditions. Do not use a 2027 assumption for an earlier period.
When to obtain specialist help
Professional GST advice is particularly sensible where a capital asset is used across different supply types, credits were reversed and reclaimed, several periods are being combined, records do not agree, or a notice challenges the category or formula. An adviser can help classify the route and test the calculation, but paying for advice is not a condition of eligibility and cannot replace the statutory evidence.
