How to Claim a GST Invoice Correction or Refund When the Tax Charged Is Wrong (India)

If a GST invoice charges more tax than legally payable, do not change the invoice yourself or claim a refund automatically. First verify the correct treatment for the goods or services, date, taxable value, rate and place of supply. In the usual case, ask the registered supplier to issue a section 34 credit note and report it in the supplier’s GST return. A separate section 54 refund application may be appropriate when tax was wrongly paid or paid in excess, but the eligible claimant, deadline, evidence and whether the amount returns in cash or to the electronic credit ledger depend on the statutory ground and payment method.

Start by proving that the GST charge is wrong

An apparently high amount is not enough. Recalculate the invoice against the transaction that actually occurred. Check all of the following together:

As an Amazon Associate I earn from qualifying purchases.

  • the description and classification of the goods or services;
  • the taxable value, including discounts, ancillary charges and any valuation rule that applies;
  • the GST rate and any exemption or concessional notification in force on the supply date;
  • whether the supply is intra-State or inter-State;
  • the place of supply and, for an inter-State invoice, the State code; and
  • the tax amount mathematically derived from the taxable value and applicable rate.

GST invoice particulars include taxable value, rate, tax charged and (for an inter-State supply) the place of supply and State code. A rate that is correct for one product, service, date or customer location can be wrong for another. Preserve the facts that support your conclusion before approaching the supplier.

Choose the correct route

Use this decision table before filing anything. The supplier-credit-note route and the statutory-refund route are not interchangeable.

Situation Usual first route Who acts Likely treatment
Invoice overstates the GST rate or taxable value and the supplier agrees Section 34 credit note Registered supplier issues the note and reports it Supplier adjusts output tax, subject to the statutory conditions; recipient reconciles books and input-tax-credit records
Tax was actually paid to the government in excess, the supplier will not correct it, or a specific refund ground applies Section 54 refund claim The person legally entitled to claim, with the prescribed evidence Refund is sanctioned only if eligibility, limitation and unjust-enrichment requirements are met
IGST was paid when CGST and SGST (or the reverse) should have applied Fact-specific wrong-tax-type refund or correction analysis Relevant taxpayer, normally coordinated with the supplier Do not simply net one tax type against another; use the statutory mechanism that fits the facts
Tax was undercharged Section 34 debit note Registered supplier Supplier records the additional tax payable and reports it

The appearance of an invoice does not by itself establish a refund entitlement. The person who bore the tax, the person who paid it to the government and the statutory category of the claim all matter.

When a supplier should issue a section 34 credit note

What qualifies

Section 34 permits a registered supplier to issue a credit note where the tax charged in the original invoice exceeds the tax payable. That covers an excessive rate and can also cover an overstated taxable value or another correction that reduces the tax legally due. CBIC’s credit-note guidance describes the situation this way: “The supplier of goods or services or both has erroneously declared a higher tax rate than what is applicable for the kind of the goods or services or both supplied.”

CBIC’s FAQ also explains that an adjustment to an invoice already issued is made through a credit note or debit note under section 34. A recipient cannot unilaterally edit the supplier’s tax invoice and expect the supplier’s output-tax return to change.

How to request it

  1. Send the supplier the invoice number and date, the exact line or tax calculation you dispute, the treatment you believe applies and the documents supporting it.
  2. Ask for a section 34 credit note that identifies the original invoice and states the corrected taxable value and tax.
  3. Request written confirmation of the return period in which the supplier will report the credit note and of any action required on your input-tax-credit records.
  4. After the note appears in the relevant GST data, reconcile the supplier’s document with your purchase register, tax ledger and payment records.

Supplier reporting and the statutory cutoff

The supplier declares credit-note details in the return for the month in which the note is issued. Section 34 also sets a statutory outer cutoff for reporting and reducing output tax liability. The current Act text should be checked before filing because amendments can change the wording; the commonly displayed text refers to September following the end of the financial year to which the supply relates, or the date of the relevant annual return, whichever is earlier. Do not assume an old calendar from a prior year is still current.

The supplier cannot reduce output tax liability where the incidence of that tax and interest has been passed on to another person. This rule is why the supplier will ask how the amount was charged, collected and treated by the recipient.

Recipient accounting and input-tax credit

A credit note does not automatically tell the recipient how to post the transaction. If excess GST was included in input tax credit, payment, or a subsequent resale, reconcile the reduction with the return in which the credit note is reflected. The correct reversal or adjustment depends on the recipient’s records and circumstances; obtain advice from the person’s tax professional rather than leaving an excess credit in the ledger.

When a section 54 refund claim may be appropriate

Refund is a separate statutory process

Section 54 generally requires an application within two years from the applicable “relevant date.” That is not a universal deadline measured from the invoice date. The relevant date changes with the refund ground, so identify the category first. CBIC refund rules and circular guidance include excess payment of tax among the categories for which an application may be made.

A refund can be relevant where tax was wrongly paid or paid in excess, including some wrong inter-State/intra-State tax situations. It is not a fallback that every recipient can use whenever a supplier’s invoice looks high. The claimant must establish the legal ground, the amount actually paid, the connection to the transaction and compliance with the rules against unjust enrichment.

Identify the claimant and tax incidence

Ask four separate questions: Who issued the invoice? Who paid the tax to the government? Who ultimately bore the tax cost? Who is named by the applicable refund category as the claimant? Tax recovered from a recipient is generally treated as passed on for the relevant unjust-enrichment rule. If the supplier collected the tax and can correct its invoice, a supplier credit note is ordinarily the cleaner route. A claim by a different person requires facts and documents showing that the statutory conditions are met.

Prepare the RFD-01 application

Refund applications are filed in the prescribed form, commonly RFD-01 on the GST portal, with category-specific statements and supporting evidence. The exact attachments depend on the ground. A practical filing sequence is:

  1. Determine the refund category and its relevant date under section 54 and the rules.
  2. Calculate only the amount that was wrongly paid or paid in excess; do not include an amount merely disputed on an invoice without payment evidence.
  3. Complete RFD-01 and the required statement or invoice-level details for that category.
  4. Upload the prescribed declarations and supporting records, then submit using the permitted authentication method.
  5. Monitor the portal acknowledgement and respond to any deficiency memo or request for information within the stated time.
  6. Retain the acknowledgement, correspondence and final order with the underlying transaction file.

The officer will examine eligibility, limitation, payment evidence and unjust enrichment. A complete invoice alone is not proof that the government received the claimed amount or that the claimant is entitled to keep the benefit.

Cash refund versus re-credit to the electronic credit ledger

How the tax was originally paid affects the result. Cash and electronic credit are not interchangeable outcomes.

Original payment method Possible result for an admissible wrongly paid or excess-tax refund What to verify
Electronic cash ledger debit Cash refund may be available for the eligible amount, subject to the category and the proportion rules described in the applicable guidance Payment challans, cash-ledger entries and the amount actually debited
Electronic credit ledger debit Where the rules provide for it, the amount is re-credited to the electronic credit ledger through PMT-03 rather than paid out as cash Credit-ledger debit, return period and the sanctioned refund order
Mixed cash and credit payment Treatment can be apportioned according to the amounts originally paid by each method Return and ledger extracts that prove the split

Do not describe every sanctioned refund as money deposited into a bank account. The applicable category and the original payment method control whether the outcome is cash, ledger re-credit or a combination.

Wrong tax type: IGST versus CGST and SGST

A mistaken tax type is different from merely using the wrong rate. For example, a transaction treated as inter-State may actually be intra-State, or the reverse. The place of supply, supplier location and recipient details must be tested under the applicable provisions.

Official law provides refund mechanisms for specified cases of wrongly paid inter-State or intra-State tax, but the route is fact-specific. CGST, SGST and IGST cannot simply be netted against each other in the books or in a return. Coordinate the correction with the supplier, preserve proof of the tax actually discharged and use the refund or adjustment procedure that matches the statutory situation.

Deadlines, interest and status tracking

Two-year limitation is category-dependent

The general section 54 limit is two years from the relevant date, not automatically two years from the invoice date. For each claim, record the event that starts the relevant-date calculation and confirm the current rule for that category before submission. A claim filed on the wrong date can fail even when the underlying tax calculation is correct.

Interest after an order finding refund due

Section 54 provides for statutory interest when a refund that is ordered as due is not paid within 60 days after receipt of the application, subject to the statutory conditions and notified rate. This is an interest trigger for a refund found payable; it is not a promise that every pending or disputed application earns interest from the day it is uploaded.

Track portal communications

Save the ARN, acknowledgement, deficiency memo, replies, hearing notices and order. A deficiency or request for documents can affect the practical timeline and may require a fresh application under the rules. Use the live GST portal status and current forms rather than an old screenshot or checklist.

Build an evidence file before asking for correction or refund

Keep one indexed folder for each disputed supply. Include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the original tax invoice and any delivery, contract or purchase-order record;
  • the classification, rate notification or place-of-supply analysis supporting the correction;
  • supplier emails, letters and the request for a credit note;
  • the issued credit note, debit note or other revised document;
  • bank statements, payment proofs and electronic cash- or credit-ledger extracts;
  • the relevant GST returns, invoice statements and reconciliation showing reporting;
  • input-tax-credit entries and any reversal or adjustment made by the recipient; and
  • the RFD-01, statements, declarations, acknowledgements and refund order, if a claim is filed.

Prescribed documents differ by refund category. Organising the file does not replace the category-specific evidence required by the rules, but it prevents a common failure: proving that an invoice existed without proving the tax payment, incidence and legal ground.

Common mistakes and how to avoid them

Changing the supplier’s invoice yourself

Annotating a PDF or editing accounting software does not amend the supplier’s GST record. Obtain the supplier’s section 34 document and align both parties’ records.

Using the invoice date as every deadline

The two-year section 54 period runs from the relevant date for the chosen category. Determine that date before calculating the last filing day.

Assuming a refund is always cash

An admissible amount attributable to an electronic credit ledger debit can be re-credited through PMT-03. Check the payment trail before forecasting a bank payment.

Ignoring unjust enrichment

If the tax cost was recovered from another person, the law may prevent the claimant from retaining a refund. Show who bore the incidence and how the amount was accounted for.

Netting different tax heads

Do not offset IGST against CGST or SGST informally. Wrong-tax-type cases need a place-of-supply analysis and the prescribed correction or refund route.

Leaving input tax credit unreconciled

When a credit note reduces tax, check whether corresponding input tax credit was claimed and whether a reversal or other return action is required for the recipient.

Worked decision examples

Higher rate printed on an otherwise correct invoice

A registered supplier charges a rate higher than the rate applicable to the supplied service on the supply date. The recipient sends the rate analysis and invoice details, asks for a section 34 credit note and confirms the supplier’s reporting period. The recipient then reconciles the credit note with its purchase register and any input-tax-credit adjustment. A separate refund claim is not the automatic first step.

Tax paid in excess and supplier will not correct

The taxpayer can document the tax paid, the statutory refund category, the relevant date and the person who bore the incidence. It may then evaluate an RFD-01 claim under section 54, attaching the category-specific statements and proof. The result depends on eligibility and unjust enrichment; the invoice alone is insufficient.

Inter-State classification was wrong

The parties review supplier and recipient locations, place-of-supply rules and the tax actually deposited. They do not simply switch the tax labels in their ledgers. If the facts fit a statutory wrong-tax-type refund or correction mechanism, they follow that mechanism and retain evidence of both the original payment and the corrected treatment.

Tax was undercharged

The direction reverses: section 34 permits the supplier to issue a debit note for tax charged below the amount payable. The supplier reports the additional liability, and the recipient records the increased consideration and tax in its accounts.

A practical checklist

  • Confirm the goods or services, date, value, rate and place of supply.
  • Separate an overcharged rate or value from a wrong tax type.
  • Ask the registered supplier for a section 34 credit note when the supplier can correct the invoice.
  • Obtain written confirmation of return reporting and reconcile any input-tax-credit effect.
  • If considering section 54, identify the claimant, refund category, relevant date and unjust-enrichment position.
  • Prove the tax was actually paid and preserve cash- and credit-ledger records.
  • File the prescribed RFD-01 information and category-specific evidence.
  • Check the current amended Act, rules and portal workflow before relying on a cutoff or form instruction.

What the recipient should do first

For an invoice that simply overstates GST, write to the supplier with a documented calculation and request a section 34 credit note. Escalate to a section 54 analysis only when the tax was wrongly paid or another statutory refund ground fits, and then treat the claimant, relevant date, payment method, evidence and unjust-enrichment test as separate questions. That sequence avoids an invalid self-correction and gives both parties records that match their GST returns.
