For an assessment year (AY) 2026–27 return, gratuity is handled as a salary exemption under section 10(10), not as a separate deduction you enter in a miscellaneous schedule. Report the gratuity received under salary section 17(1), claim only the exempt amount accepted by the return validation rules, and reconcile it with Form 16. The AY 2026–27 ITR-3 validation rules set a ₹20 lakh ceiling for listed public-sector undertaking, pensioner and “Others” categories, and ₹25 lakh for Central and State Government categories. Those are return-validation limits, not a complete statement of every statutory eligibility condition.
First identify whether you are filing an AY 2026–27 return under the Income-tax Act, 1961, or a Tax Year 2026–27 return under the Income-tax Act, 2025. The forms, relief provisions and terminology differ. Use the 1961 Act and Form 10E for section 89 relief connected with an AY 2026–27 return; the department says the 2025 Act and Form 39 framework starts with Tax Year 2026–27.

What “gratuity deduction” means in the return
Employees often call the tax treatment a gratuity deduction, but the official AY 2026–27 return rules describe section 10(10) as an exemption or exempt allowance from salary. The amount is connected to gratuity income reported under section 17(1), rather than being entered as a standalone investment deduction.

In practical terms, the exempt figure in your return cannot be higher than the gratuity receipt you have reported under salary, and the return cannot accept more than the ceiling assigned to your employer category.

This validation does not, by itself, decide every question of entitlement. The material available for AY 2026–27 does not set out the complete section 10(10) text, service-duration tests, employee-coverage rules, calculation formula or rounding method. A figure below the portal ceiling therefore does not automatically establish that the entire amount is exempt.
The department’s salaried-individual guidance explains that your employer supplies Form 16 at the end of the year. It contains salary income, exemptions or deductions shown by the employer, and tax deducted at source (TDS), all of which are used to calculate tax payable or refundable. Compare that document with the gratuity payment record before you submit the return: Income Tax Department guidance for salaried individuals for AY 2026–27.
Decide which law and filing year applies
“AY 2026–27” and “Tax Year 2026–27” are not interchangeable labels. The department’s forms FAQ says an AY 2026–27 return remains governed by the Income-tax Act, 1961. The Income-tax Act, 2025 applies from Tax Year 2026–27, with Form 39 used for specified relief claims under that Act.

Know the AY 2026–27 validation ceilings
The June 2026 CBDT e-Filing ITR-3 validation rules list two maximum amounts for section 10(10) gratuity exemption. They are software validation ceilings for the named categories; they are not a substitute for checking the underlying law and facts.

| Employer or taxpayer category named in the validation rule | Maximum gratuity exemption accepted by that validation |
|---|---|
| Central Government employee | ₹25 lakh |
| State Government employee | ₹25 lakh |
| Listed PSU category | ₹20 lakh |
| Pensioner category | ₹20 lakh |
| “Others” category | ₹20 lakh |
The same validation item also says the exemption cannot be claimed against more than one employer. If gratuity was paid by multiple employers, do not duplicate the same exemption in more than one employer record. Resolve the allocation with the payroll records and the return’s employer-wise salary entries.

What you must establish before claiming the exemption
The published validation rules answer how the portal limits the reported amount, but they do not provide the full substantive eligibility test. Before filing, confirm the applicable section 10(10) wording and rules for your employment category, the nature of the payment, and the period in which it was received. Do not infer entitlement solely from a category label or from staying below ₹20 lakh or ₹25 lakh.
This distinction matters in common situations such as retirement, resignation, death-related payment to a family member, a change of employer, or a payment described as gratuity but processed with another terminal benefit. The evidence cited here does not establish a universal service-period test, a complete employee-coverage list, a formula, or a rounding rule. If your facts do not clearly match the employer’s Form 16 description, obtain the current statutory text or professional advice before finalising the exemption amount.
Step-by-step checklist for an AY 2026–27 return
- Label the filing correctly. Write down whether you are preparing an AY 2026–27 return under the 1961 Act. Do not select a Tax Year 2026–27 workflow merely because the calendar year is 2026.
- Collect the primary records. Keep the gratuity payment advice or settlement statement, the employer’s Form 16, salary slips or payroll statement covering the payment, and the return computation. The payment record should show the date and amount actually received.
- Locate gratuity in Form 16. Identify the gratuity amount and exemption, if any, reported by the employer. Form 16 is the employer-issued year-end certificate containing salary, exemptions or deductions and TDS information.
- Enter the receipt under salary. In the applicable return salary schedule, report the gratuity receipt under the section 17(1) salary sub-head used by the return. The section 10(10) exemption cannot exceed that reported receipt.
- Choose the employer category accurately. Use the category that reflects the employer record and the return’s available options: Central Government, State Government, listed PSU, pensioner or “Others.” Do not select a higher-ceiling category simply to fit the amount.
- Apply the validation ceiling. For the named AY 2026–27 categories, check the ₹25 lakh ceiling for Central or State Government and the ₹20 lakh ceiling for listed PSU, pensioner or “Others.” If the amount is higher, the portal validation will not accept the excess as section 10(10) exemption.
- Check the one-employer condition. Ensure the exemption is not claimed against more than one employer. Where payments or Forms 16 cover more than one employer, reconcile the employer-wise entries before submitting.
- Reconcile tax and TDS. Compare the salary total, exempt gratuity, taxable salary and TDS in the return with Form 16. Resolve differences with the employer before filing rather than altering a certificate figure without support.
- Save the working papers. Retain the payment statement, Form 16, employer correspondence and the final computation with the filed acknowledgement. These records support the figures if the return is later queried.
How the portal’s validation affects real cases
Receipt below the category ceiling
Suppose an “Others” category employee reports a gratuity receipt of ₹18 lakh. The validation ceiling is ₹20 lakh, so the ceiling alone does not prevent a claim up to the amount supported by the salary entry. It still does not prove that every rupee is substantively exempt; the employee must satisfy the applicable section 10(10) conditions.
Rank #3
Receipt above the category ceiling
If the same category reports ₹22 lakh, the return validation cannot accept ₹22 lakh as section 10(10) exemption because the listed ceiling is ₹20 lakh. The taxpayer must not reclassify the employer to obtain the ₹25 lakh government ceiling. The correct treatment requires checking the underlying law, the employer’s records and any taxable balance.

Central or State Government category
A Central or State Government category has a ₹25 lakh validation ceiling. That higher software limit remains only a ceiling: the reported receipt, the employer’s certificate and the substantive statutory conditions still control the amount that can be claimed.
When a gratuity payment is in arrears or advance
A large one-time gratuity payment can bunch income into a single financial year and push part of the salary into a higher rate band. That issue is separate from the section 10(10) exemption. If the payment was received in advance or arrears and the bunching creates a higher tax liability, examine relief under section 89 of the 1961 Act.
The Income Tax Department’s Form 10E manual states: “The Income Tax Act u/s 89 provides relief to an assessee for any salary or family pension, gratuity, retrenchment compensation or commuted pension is received by an assessee in advance or arrears in a Financial Year.” For an AY 2026–27 return, the manual directs individuals to furnish the particulars through Form 10E and includes annexures for gratuity.
- Confirm that the payment is actually an advance or arrears situation and that the resulting income bunching is the reason for the higher liability.
- Use the 1961 Act framework for an AY 2026–27 return; do not substitute the Form 39 process that belongs to the 2025 Act’s Tax Year 2026–27 framework.
- Complete the Form 10E particulars and the gratuity annexure using the payment and salary records.
- Keep the submitted Form 10E details with the gratuity statement, Form 16 and return computation.
- Report the gratuity and exemption in the salary return as required; section 89 relief does not replace the section 10(10) reporting entry.
Read the department’s instructions before submitting the form: Form 10E User Manual.

AY 2026–27 versus Tax Year 2026–27: avoiding the transition mistake
The transition can create two separate errors: selecting the wrong legal regime and using the wrong relief form. An AY 2026–27 return is still an assessment-year return under the 1961 Act, even though it is filed during 2026. The department’s FAQ says the 2025 Act applies from Tax Year 2026–27 and identifies Form 39 for specified relief claims under that Act.
- Use AY language when the return screen, employer certificate and filing instructions identify AY 2026–27.
- Use Tax Year language only when the return is for Tax Year 2026–27 under the new Act.
- Do not transfer assumptions about exemption conditions, schedules or forms from one regime to the other.
- Read current Form 39 instructions for a Tax Year 2026–27 filing; the transition FAQ confirms the framework but does not detail every gratuity condition.
Records and reconciliation controls
A clean evidence file should let you trace one number from the employer’s payment record to Form 16 and then to the salary schedule of the return. Include:
- the gratuity settlement or payment advice;
- Form 16 for the year in which the amount was received;
- the employer’s calculation or written description of the gratuity and exemption;
- salary slips or payroll statements showing how the amount was included;
- the completed return computation and acknowledgement; and
- Form 10E particulars and annexure, where section 89 relief is claimed.
Check that the receipt is not entered twice, that the exemption does not exceed the salary gratuity receipt, and that the same exemption is not attached to more than one employer. Keep the records for the period required by the applicable tax and record-retention rules; the sources cited here do not prescribe a separate universal gratuity-exemption application form.
Troubleshooting common filing problems
The portal rejects the exemption as too high
Compare three figures: the gratuity receipt under salary section 17(1), the exemption entered under section 10(10), and the category ceiling. Reduce or correct the entry only after reconciling it with Form 16 and the payment record. If the employer’s certificate itself appears wrong, request a corrected certificate or written clarification.
The employer category is unclear
Do not guess from the employee’s job title. Check the employer identity and the category reflected in payroll and Form 16, then use the return option that accurately describes it. The validation rules list the ceilings, but they do not create eligibility for a category that does not apply to you.

Two employers appear in the return
Review each Form 16 and determine which employer paid the gratuity. The AY 2026–27 validation says the exemption cannot be claimed against more than one employer. Correct duplicate entries before filing and retain the allocation evidence.
Gratuity was paid with arrears or advance salary
Separate the section 10(10) exemption entry from any section 89 relief. For AY 2026–27, complete Form 10E under the 1961 Act if the payment’s timing caused a higher liability. Do not attempt to use Form 39 for that assessment-year return.
The return year is uncertain
Stop before submitting. Confirm whether the portal asks for AY 2026–27 or Tax Year 2026–27, then follow the matching Act and form instructions. The names look similar, but the department’s transition guidance treats them as different regimes.
What the official material does not establish
The cited AY 2026–27 validation rules establish reporting ceilings and the one-employer restriction. They do not establish a complete statutory eligibility checklist, service-duration requirement, employee-category formula, computation method or rounding rule. Those details must come from the current section 10(10) text and applicable rules for your facts. Avoid relying on a generic online calculator or a prior-year assumption when the payment, employer or filing regime has changed.
Final filing decision
For an AY 2026–27 return, treat gratuity as a section 10(10) salary exemption: report the receipt under section 17(1), match the amount to Form 16, use the correct employer category, observe the ₹20 lakh or ₹25 lakh validation ceiling, and claim it only once against the relevant employer. If advance or arrears timing increases the tax burden, evaluate section 89 relief through Form 10E under the 1961 Act. If the filing is instead for Tax Year 2026–27 under the 2025 Act, switch to the current Form 39 instructions and do not assume that the AY 2026–27 workflow carries over.
