Choose an AI provider by tracing the complete data flow and checking the exact product configuration, contract and transfer safeguards. An “EU hosted” label is not enough. GDPR does not automatically require every personal-data workload to stay physically inside the European Union, but any personal data sent outside the EU must retain GDPR protection through an applicable transfer measure. A customer contract, sector rule or national requirement can impose a stricter location rule than GDPR’s general position.
For a defensible decision, define the use case and data categories first; verify storage, inference, logs, backups, support access and connected tools for the precise tier, endpoint and model; then review processor terms, subprocessors, third-country access, security, availability and recovery. The documented examples below are options to investigate, not legal certification or a finding that a particular deployment complies.

EU data residency and GDPR answer different questions
Data residency describes where data is stored or processed. GDPR compliance concerns the lawful, transparent and secure processing of personal data, including what happens when data is accessed from another country. The European Commission’s Your Europe guidance says organizations can generally choose where data is stored or processed, subject to exceptions. That means GDPR alone is not a universal “all data must remain in the EU” rule.

Location can nevertheless become mandatory in your situation. A banking customer, public-sector contract, insurance policy, professional-secrecy rule or internal risk standard may require EU-only storage or processing. Read those obligations separately from GDPR. A provider can offer an EU region while your contract still requires controls that the service does not provide.

Mixed datasets need particular care. A file containing invoices, employee identifiers or customer messages remains subject to GDPR even if it also contains non-personal information. Separating the non-personal fields does not remove the rules from the personal fields. Minimize the data sent to the model and document why each field is needed.
“When personal data is transferred outside the EU, the protection offered by the GDPR should travel with the data.” — European Commission, Your Europe portal, “Data protection under GDPR.”
The practical test is therefore not “Does this vendor have an EU data center?” It is “For this workload, which data travels where, who can access it, under what legal mechanism and with what technical and contractual controls?”
Define the workload before comparing providers
Classify the information
Make an inventory for each proposed AI feature. Mark fields that are personal data, special-category data, confidential business information, regulated records or genuinely anonymized data. In a finance context, examples include names, account numbers, transaction descriptions, income documents, fraud notes, support transcripts and employee records. A prompt that appears harmless can become personal data when combined with an identifier or a customer reference.
- Personal data: information that identifies or can reasonably identify a person, directly or indirectly.
- Special-category data: information such as health, biometric, union or political data that receives additional protection under GDPR.
- Mixed data: a dataset containing both personal and non-personal fields; GDPR still applies to the personal portion.
- Anonymized data: data processed so individuals are no longer identifiable using means reasonably likely to be used. Pseudonymized data is still personal data.
Record the purpose and lawful basis for each use. A customer-service summarizer, a credit-risk research tool and an internal coding assistant may need different providers, retention settings and approval levels. Do not send an entire database when a few fields or a redacted excerpt will perform the task.
Draw the complete request path
Diagram every system touched by a prompt and response. Include the user interface, your application, the provider’s API or workspace, the selected model endpoint, retrieval databases, plug-ins and connectors, content filters, logging and monitoring systems, support channels, backups and disaster-recovery copies. Add each provider entity and subprocessor that can store, inspect or administer the data.
Mark whether each hop involves storage, transient processing, human access or automated transfer. Include telemetry and error traces: a rejected prompt may still appear in an application log, and a support ticket may contain copied customer text. Your map should show both the normal path and failure paths such as retries, regional failover and backup restoration.

Assign controller and processor roles
The controller decides why and how personal data is processed. The processor handles data on the controller’s behalf and follows documented instructions. A provider may be a processor for one service and a separate controller for another purpose, such as its own account administration or abuse-prevention activity. Do not assume the role from marketing language.
Identify the legal entity that signs your agreement, the entity operating the service and the entities that provide infrastructure or support. Confirm the purposes, instructions, confidentiality duties, deletion terms and assistance commitments in the data-processing agreement (DPA). Your privacy or legal lead should approve any role allocation that is not straightforward.
Test the provider’s residency claim at configuration level
Residency commitments are often limited by plan, endpoint, model, feature or data type. Ask the provider to state in writing what “EU” covers for your exact deployment. A regional choice for primary storage may not cover inference, safety monitoring, support access or backups.
| Data-flow area | Question to document | Why it matters |
|---|---|---|
| Primary storage | In which countries are prompts, files, outputs and account records stored? | Determines the ordinary at-rest location and applicable transfer analysis. |
| Inference and processing | Where does the selected model execute, and can traffic fail over to another region? | Processing outside the chosen region can be a transfer even when storage is local. |
| Logs and telemetry | Are request content, metadata, abuse signals or diagnostic traces retained, and where? | Operational data can contain personal information. |
| Backups and recovery | Where are backups replicated, how long are they retained and how are they deleted? | Copies may survive ordinary deletion or sit in a different jurisdiction. |
| Safety and abuse review | Can automated or human reviewers access content, from which countries and for what period? | Monitoring is a separate access path that a region label may not cover. |
| Support and administration | Which staff or contractors can access accounts, and are remote-access locations restricted? | Support access can create an international transfer or confidentiality risk. |
| Tools and connectors | Do retrieval, browsing, storage or third-party integrations move data elsewhere? | The connected service may have different residency and contractual terms. |
Request an exclusions list as well as a coverage list. A credible answer identifies unsupported endpoints, models, plans, features, retention modes and data categories. Keep a dated copy of the documentation and configuration screenshots used for your decision because product scope can change.
What the documented OpenAI options illustrate
OpenAI has announced European data residency for ChatGPT Enterprise, ChatGPT Edu and its API Platform. The announcement says eligible API customers can choose European processing, while new Enterprise and Edu customers can choose to store customer content at rest in Europe. The live API data-controls documentation separately lists support by endpoint and model. Treat those lists as configuration-specific: verify the endpoint, model, account type and processing mode you will actually deploy.
The same announcement states that business-plan and API data are not used to train models by default unless the customer opts in, and describes a DPA. Those are provider statements; they do not establish that every customer use case meets GDPR or a stricter EU-only obligation. Check current terms, retention controls, subprocessor information and the exact deployment path before approval.
Analyze international transfers and third-country access
Identify the transfer mechanism
When personal data is accessible from outside the EU, identify the legal transfer measure that applies. An adequacy decision is one mechanism: the European Commission has determined that a destination provides an essentially equivalent level of protection. Adequacy decisions are periodically reviewed, so record the decision and its review status rather than treating adequacy as permanent.

Where adequacy is unavailable, a provider may rely on Standard Contractual Clauses or another GDPR-approved safeguard, subject to the conditions that apply to your circumstances. A transfer assessment may be needed to evaluate local law, government-access risk and supplementary technical or organizational measures. Your DPA should identify the mechanism, the relevant modules and the parties covered.

Physical storage in the EU does not answer whether a non-EU parent company, administrator or subprocessor can be compelled to provide access. Ask which entities may receive a third-country authority request, how the provider validates the request, whether it challenges overbroad demands, when it notifies customers and what transparency it can provide.
The European Data Protection Board’s final Article 48 guidance, announced on 5 June 2025, focuses on assessing the conditions for responding to requests from authorities in third countries. Use that framework when documenting whether a provider’s response commitments and technical controls adequately address compelled access.
Review the legal-entity chain
Obtain the provider’s current subprocessor list and map each entity to a function and country. Check change-notification rights, objection procedures and the time available to assess a newly added subprocessor. OpenAI’s DPA, labeled February 2024, names OpenAI Ireland Ltd for EEA- and Swiss-origin customer data and describes intra-group transfer mechanisms that may include EU Standard Contractual Clauses or an adequacy decision. That is a provider-specific example, not a universal term; confirm the entity and mechanism in your own contract.
Read the DPA and operating commitments line by line
A DPA should match the service you will use, not merely the vendor’s corporate template. Check:
- The controller’s documented instructions and the provider’s stated processing purposes.
- Definitions of customer content, prompts, outputs, account data, support data and telemetry.
- Retention periods, deletion triggers, legal holds and backup-erasure timelines.
- Whether content is used for training, product improvement, safety or abuse monitoring, and how any opt-in works.
- Subprocessor names, locations, functions and notice or objection rights.
- Confidentiality, encryption, access controls, authentication and personnel training.
- Incident notification timing, cooperation, evidence preservation and assistance with data-subject rights.
- Audit reports, certifications or inspection rights that are actually available to your organization.
- International-transfer mechanisms, supplementary measures and the process for government requests.
- Return or deletion of data at termination, including exports and disaster-recovery copies.
Do not treat a DPA signature as a compliance conclusion. It is one part of the processing arrangement; your instructions, access design, retention settings and downstream systems still determine the risk.
Compare security, resilience and practical fit
EU location is only one decision axis. The EDPB-hosted Support Pool of Experts training material on cloud AI processing, published in June 2025, highlights transfer, infrastructure-vulnerability and cloud-outage considerations. Evaluate those risks alongside model suitability and cost.

| Axis | Evidence to request | Decision question |
|---|---|---|
| Security | Encryption descriptions, key-management options, identity controls, privileged-access procedures and independent assurance reports. | Can you enforce least privilege and detect unauthorized use? |
| Availability | Service-level commitments, regional dependencies, maintenance policy and incident history or transparency reports. | What happens to customer or staff workflows during an outage? |
| Recovery | Recovery-point and recovery-time objectives, backup geography, restore testing and deletion behavior. | Can you recover without violating a location or retention requirement? |
| Model suitability | Accuracy evaluations relevant to your task, supported languages, context limits, versioning and fallback models. | Will a less capable model increase manual review or data exposure? |
| Integration | API controls, regional routing, logging configuration, connector permissions and change-management process. | Can the service be constrained to the approved data path? |
| Cost | Usage pricing, reserved capacity, data-egress charges, support tiers and compliance administration. | What is the total operating cost at expected volume, including controls? |
Ask whether the provider can pin traffic to one region or whether automatic load balancing can move requests. Confirm what happens when a model version is retired, an endpoint is unavailable or your account is downgraded. A cheaper plan that lacks regional controls may cost more once manual redaction, monitoring and incident response are included.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.A due-diligence procedure you can reuse
- Write the use-case statement. Describe the business purpose, users, lawful basis, expected volume, retention period and decision impact. State whether outputs influence eligibility, pricing, fraud action or another significant outcome.
- Build the data inventory. List every field sent in prompts, files, retrieval results, tool calls, logs and support tickets. Mark personal, special-category, confidential and anonymized data.
- Apply minimization. Remove unnecessary identifiers, redact free text, tokenize account references and test whether pseudonymization preserves the task. Keep the re-identification key under your control when practical.
- Draw the request and failure paths. Include your application, endpoint, model, connectors, monitoring, support, backups, subprocessors and regional failover. Record storage and access locations for each hop.
- Confirm roles and entity. Determine who decides purposes and means, who acts on instructions, which legal entity signs the DPA and which entities operate or support the service.
- Request written residency scope. Ask for coverage and exclusions by tier, endpoint, model, data type, processing, storage, logs, backups, abuse monitoring, support and recovery. Verify the current product documentation at implementation time.
- Validate transfers. Record every non-EU access point, the applicable mechanism, any transfer assessment, supplementary measures and the provider’s process for third-country authority requests.
- Review contracts and subprocessors. Check deletion, retention, training use, incident assistance, audit rights, change notices and the current subprocessor list. Save dated copies.
- Test technical controls. Use a non-production account to confirm regional routing, disable unnecessary logging, inspect API responses and verify that connectors do not bypass the approved region. Test deletion and account closure.
- Assess resilience and cost. Model an outage, regional failure, provider exit and model change. Compare recovery options, manual fallback, latency, quality and total cost.
- Document residual risk. Record assumptions, unsupported requirements, compensating controls, owner and review date. Have the privacy or legal lead approve the final processing arrangement.
Use a weighted decision matrix instead of a marketing score
Set minimum gates before awarding points. For example, reject a configuration that cannot meet a contractual EU-only processing requirement, lacks a required transfer mechanism or exposes special-category data to an unapproved subprocessor. Then score viable options using weights that reflect your use case.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →| Criterion | Suggested evidence | Example weighting |
|---|---|---|
| Residency coverage | Written scope for processing, storage, logs, backups and support. | 25% |
| Transfer and legal safeguards | DPA, transfer mechanism, entity map and Article 48 response process. | 20% |
| Security and privacy operations | Access controls, encryption, incident response, retention and deletion tests. | 20% |
| Resilience | Availability commitments, failover behavior, backups and recovery testing. | 15% |
| Model and integration fit | Task quality, languages, latency, API controls and connector permissions. | 15% |
| Total cost | Usage, support, egress, engineering and governance costs. | 5% |
Adjust the weights to your risk. A regulated financial workflow may weight transfer safeguards and resilience above price; an internal, anonymized experiment may weight model quality and cost more heavily. Keep the evidence beside each score so a future reviewer can reproduce the decision.
Common mistakes and how to correct them
“The provider has an EU region, so we are done.”
Why it fails: inference, logs, support, backups or connectors may use other locations. Correction: obtain a configuration-specific scope and test the actual route.
“GDPR requires every byte to stay in the EU.”
Why it fails: GDPR generally permits transfers when an applicable safeguard protects the data, while separate contracts or sector rules may be stricter. Correction: identify the legal, customer and policy requirements independently.
“The vendor is always a processor.”
Why it fails: purposes such as account administration, abuse prevention or product improvement may have different roles. Correction: map each purpose and entity in the DPA and service terms.
Recommended Free Tools
“We removed names, so the dataset is anonymous.”
Why it fails: combinations of dates, account details, free text or rare events can re-identify a person. Correction: assess reasonable re-identification means and treat pseudonymized data as personal data.

“The DPA solves government-access risk.”
Why it fails: contract language cannot eliminate the laws applying to a provider or subprocessor. Correction: document entity locations, authority-request procedures, technical isolation and supplementary measures.
“A single successful test proves residency.”
Why it fails: failover, model updates and support paths can change the route. Correction: test normal and failure paths, monitor configuration changes and set a periodic review date.
When to approve, limit or reject a provider
Approve when the provider’s documented scope matches the use case, transfers have a valid mechanism, contractual roles are clear, security and recovery controls are proportionate and your technical tests confirm the promised route.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Limit the deployment when the model is useful but some data paths are outside policy. Restrict it to anonymized or low-risk data, disable connectors, require human review, shorten retention and prohibit copying production records into support channels. Document the compensating controls and their owner.
Reject or pause when the provider will not identify processing locations, cannot supply a DPA or subprocessor information, lacks an applicable transfer measure, cannot meet a binding EU-only requirement or cannot explain third-country access. A high-quality model does not compensate for an unmanageable legal or operational exposure.
Reassess after material changes: a new endpoint, model, region, connector, subprocessor, retention policy, corporate entity or applicable adequacy decision can alter the original analysis. Keep the approval tied to the exact configuration rather than to a provider name alone.
