Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →The right professional is the one whose current credential, federal representation authority, experience, process, and written fee scope match your specific tax problem. Start by deciding whether you need return preparation, planning, audit defense, collection help, an appeal, or litigation. For federal matters, a tax attorney, certified public accountant (CPA), and enrolled agent (EA) all have unlimited IRS representation rights. A paid preparer must have an IRS Preparer Tax Identification Number (PTIN), but a PTIN by itself does not establish the same authority or expertise.
Verify the person independently through the appropriate state board, state bar, or IRS enrollment resources; ask for relevant case experience and who will actually sign and support the return; obtain a written engagement and fee schedule; and keep control of your records, identity information, and refund account. Do not choose based on a promised refund or a credential alone.

Identify the work before choosing a credential
“Complex return” can describe very different jobs. A professional who is excellent at preparing a partnership return may not be the right person to defend a collection case, and an attorney who handles litigation may not be the most efficient choice for recurring bookkeeping and filings. Define the work in writing before you compare candidates.
Return preparation
This is the work of assembling source records, applying tax rules, completing federal and state returns, and filing them. Examples include business entities, estates, partnerships, foreign reporting, and multi-state filings. Ask whether the professional regularly prepares the exact forms and schedules your situation requires, not merely whether they “do taxes.”

Tax planning
Planning is advice delivered before a transaction or filing deadline. It can involve entity choices, estimated payments, retirement contributions, compensation, a sale, an inheritance, or a cross-border issue. Request a written description of the assumptions, decisions, and deliverables so planning advice is not confused with a guarantee of a particular tax result.
Audit or examination defense
If the IRS or a state tax agency has contacted you, you need someone who will analyze the notice, communicate with the agency, prepare responses, and attend or manage the examination as allowed by their authority. Ask who will be named as your representative, who will draft responses, and whether the quoted fee includes correspondence and conferences.
Collection and payment problems
Installment agreements, currently-not-collectible requests, levy or lien issues, and other collection matters require experience with the agency’s procedures. Confirm that the candidate handles collection cases routinely and can represent you through the specific stages you face.
Appeals and litigation
An appeal or court matter is different from ordinary preparation. A tax attorney may be the best fit when legal analysis, privilege-sensitive advice, or litigation is central. A CPA or EA can have unlimited IRS representation rights, but you should confirm that the individual has the particular controversy experience your matter demands and can bring in legal counsel when necessary.

Credential comparison: what each professional can and cannot prove
| Credential | How it is authorized | Federal representation | What to verify | Typical fit |
|---|---|---|---|---|
| Enrolled agent (EA) | IRS-licensed; generally must pass the three-part Special Enrollment Examination and undergo a suitability check; continuing education is required. | Unlimited IRS representation rights. | Current enrollment, continuing-education compliance, disciplinary information where available, and experience with your issue. | Federal return preparation, planning, audits, collections, and other IRS matters when the EA has matching experience. |
| Certified public accountant (CPA) | Licensed by a state board of accountancy (or comparable jurisdiction); must pass the Uniform CPA Examination and satisfy that jurisdiction’s education, experience, character, ethics, and continuing-education requirements. | Unlimited IRS representation rights. | Active state license, disciplinary history, and whether the CPA’s current practice actually includes the tax work you need. | Complex individual or business returns, accounting-linked planning, and IRS matters handled by a tax-focused CPA. |
| Tax attorney | Licensed by a state bar after legal education and a bar examination. | Unlimited IRS representation rights. | Current bar standing, tax experience, and whether the practice covers preparation, planning, controversy, or litigation relevant to you. | Legal advice, controversy, appeals, litigation, and planning where legal analysis is central. |
| PTIN holder without one of these credentials | Has an IRS Preparer Tax Identification Number to prepare federal returns. | A PTIN alone does not grant unlimited representation authority. | Whether the person participates in the Annual Filing Season Program, the limits of those practice rights, and who will represent you if the IRS contacts you. | Routine preparation within the preparer’s competence, not automatically complex controversy or specialized planning. |
The IRS states: “Any tax professional with an IRS preparer tax identification number (PTIN) is authorized to prepare federal tax returns.” That statement does not mean every PTIN holder is licensed as an EA, CPA, or attorney, or that the person can represent you in every IRS proceeding. Annual Filing Season Program participants have limited practice rights. For a matter that may involve an audit, collection action, or appeal, identify the person with unlimited representation rights before you sign an engagement.
Build a shortlist without treating a directory as a recommendation
Use the IRS Directory of Federal Tax Return Preparers with Credentials and Select Qualifications as a starting point. You can also ask people who have dealt with the same type of return or controversy for referrals. The directory and a personal referral are leads, not proof of competence, current licensing, clean discipline, or availability.
Try to assemble at least two or three plausible candidates whose practices match your issue. Record each person’s credential, licensing jurisdiction, office location, stated specialties, expected turnaround, and the name of the person who would do the work. A firm’s marketing page may feature a senior professional while assigning preparation to someone else, so ask directly.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsVerify the credential and current standing
- Check a CPA with the relevant state board of accountancy. Confirm that the license is active and look for disciplinary information or restrictions. A CPA credential does not by itself show that the person currently handles tax matters.
- Check an attorney through the state bar. Verify current bar standing and review public discipline information where available. Then ask how much of the practice is tax preparation, planning, controversy, or litigation.
- Check an EA through IRS enrollment resources or the IRS directory. Confirm that enrollment is current and ask about the professional’s continuing education and experience with your type of case.
- Check the preparer’s PTIN process. Every paid preparer should have an active PTIN and include it on the filed return. Ask to see where the PTIN will appear and who will sign the return.
- Check the firm, not only the individual. If another employee prepares or signs the return, verify that person’s role and credentials. Determine who is responsible if the assigned preparer leaves.
Where a registry does not publish complete complaint information, treat “no result found” as unverified rather than as a clean bill of health. Ask the candidate to explain any public discipline, license lapse, or unresolved complaint in plain language.

Test experience against your actual facts
Give each finalist a short, factual description of your situation without sending sensitive documents before you have chosen a secure process. Ask questions that expose hands-on experience:
- How many returns like mine do you handle in a typical filing season?
- Which forms and elections do you expect this matter to require?
- Have you handled the relevant business entities, foreign reporting, estates, partnerships, or multi-state filings?
- Have you represented taxpayers in an IRS audit, collection matter, or appeal similar to mine?
- What facts would change your analysis or the expected scope of work?
- Who will prepare, review, sign, and communicate with the IRS?
- Who will remain available after filing, and for how long is ordinary follow-up included?
A credible professional should identify missing facts and request source records rather than promise an outcome from a short phone call. You are looking for a repeatable process and relevant judgment, not the most confident sales pitch.
Confirm representation before a notice arrives
Ask the candidate to describe exactly what happens if the IRS sends a notice after filing. The answer should identify the representative with authority, the communication channel, response deadlines, and what is included in the engagement. If the preparer has only limited practice rights, ask which attorney, CPA, or EA will take the matter and whether that person has agreed to do so.
Representation authority is federal and matter-specific. A PTIN holder may have prepared the return correctly yet still be unable to represent you in an audit or collection case. Put the representation plan in the engagement letter rather than relying on an informal assurance.

Compare candidates on the factors that actually affect risk
| Decision factor | Questions to ask | Evidence to request |
|---|---|---|
| Authority | Can you represent me before the IRS for preparation, examination, collection, and appeal if needed? | Credential, current standing, and the name of the representative assigned to the matter. |
| Issue-specific experience | How often do you handle my type of entity, transaction, filing, or controversy? | General examples that protect client confidentiality; list of expected forms and work products. |
| Current license | Where can I verify your status and discipline history? | State-board, state-bar, or IRS enrollment record. |
| Continuity | Who will do the work and answer questions after filing? | Names and roles in the engagement letter; response-time expectations. |
| Scope and fees | What is included, excluded, and billed separately? | Hourly rates, fixed or scope-based fee, assumptions, retainer terms, and change-order process. |
| Document controls | What records do you require, how are they transmitted, and how do I review the return? | Secure portal or delivery method, checklist, review deadline, and signed copy of the final return. |
| Professional history | Have there been disciplinary actions or complaints relevant to this work? | Public records and a direct explanation of any disclosed matter. |
No authoritative comparative statistic establishes that one of these credentials universally produces better outcomes. Choose the candidate whose authority and experience fit your facts, then compare process and price on the same scope.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Get a written engagement and a usable fee estimate
Fees may be hourly, fixed, or based on a defined scope. None is automatically safer; clarity is what matters. The written agreement should state:
- The returns, schedules, jurisdictions, planning memoranda, or representation tasks included.
- Who prepares and reviews the work, who signs the return, and who communicates with tax agencies.
- Hourly rates by role, fixed amounts, retainers, billing increments, and payment deadlines.
- Whether IRS or state correspondence, phone calls, amended returns, conferences, appeals, and collection work are included or billed separately.
- What assumptions support a fixed fee and how a change in facts or scope is approved.
- How unused retainer funds, termination, records, and work in progress are handled.
Reject percentage-of-refund arrangements for ordinary preparation, refund guarantees, and claims that a preparer can obtain a larger refund than competitors. A refund depends on your facts and the law; a sales promise is not evidence of competence. Compare estimates only after giving each candidate the same description of the work.
The Tool Desk
Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Use a disciplined document and review process
- Receive a records checklist. A legitimate preparer should ask for source documents and receipts appropriate to your return, including income records, basis information, entity records, foreign-account details, and supporting deductions when relevant.
- Transmit records securely. Use the professional’s secure portal or another agreed method. Do not send identity documents through an unprotected channel merely because it is convenient.
- Clarify missing information. Ask what is still needed, what assumptions are being made, and what the consequence is if a document cannot be obtained.
- Review the complete return. Receive the full federal and applicable state returns, schedules, and supporting statements with enough time to check names, Social Security or employer identification numbers, bank details, income, basis, elections, and carryforwards.
- Approve and sign only the finished filing. Taxpayers are ultimately responsible for the information on their return, regardless of who prepares it. Never sign a blank or incomplete return.
- Keep the final package. Retain the filed return, e-file acceptance, source records, payment confirmations, engagement letter, and correspondence according to your own record-retention needs.
Ask whether the firm offers IRS e-file and how you will receive proof of acceptance. The IRS says it issues most refunds in fewer than 21 days for taxpayers who file electronically and choose direct deposit. That is a general IRS processing statement, not a promise for an individual return; errors, reviews, identity checks, amended filings, and other issues can delay payment.

Keep control of your refund and identity
The refund should go directly to your bank account. Before filing, verify the routing and account numbers on the final return and on any authorization used for direct deposit. Do not allow a preparer to control the refund account or divert it through an account you do not own.
Limit access to documents containing Social Security numbers, employer identification numbers, passport details, bank information, and foreign-account data. Ask who inside the firm can view the files, how they are stored, and how records are returned or destroyed when the engagement ends.
Red flags that should stop the engagement
- The preparer refuses to sign the return or provide a PTIN.
- The preparer promises a guaranteed or unusually large refund.
- The fee is calculated as a percentage of the refund.
- The preparer wants to file from a pay stub instead of the required wage documents.
- The preparer does not request receipts or supporting records.
- You are pressured to sign a blank or incomplete return.
- The refund is routed to the preparer’s account.
- The preparer cannot explain who will represent you if the IRS contacts you.
One warning may reflect a misunderstanding; several together are a reason to leave. Do not let a filing deadline turn a verification problem into a signed engagement.
What to do if the preparer acts improperly
Save the engagement letter, invoices, emails, copies of every return and schedule, proof of what you supplied, and any notices. Contact the preparer in writing and preserve the response, but do not delay a tax-agency deadline while waiting for a dispute to resolve.
The IRS directs taxpayers to use Form 14157, Complaint: Tax Return Preparer, when a preparer acts improperly. If you believe a return was filed or changed without your consent, use Form 14157-A, Tax Return Preparer Fraud or Misconduct Affidavit. For credential-specific discipline, contact the relevant state accountancy board, state bar, or IRS enrollment resources. If the conduct may have exposed your identity or bank information, secure affected accounts and consider professional advice about responding to the tax agency.
A practical selection checklist
- Define whether you need preparation, planning, audit defense, collection help, an appeal, litigation, or a combination.
- Shortlist professionals who regularly handle your return type or controversy.
- Verify the EA enrollment, CPA license, or attorney bar standing independently.
- Confirm the preparer has an active PTIN and identify who will sign.
- Confirm unlimited IRS representation authority if an audit, collection matter, or appeal is possible.
- Ask who will do the work and who remains available after filing.
- Compare written scope, rates, retainers, correspondence charges, and change-order terms.
- Require source records, secure transmission, a complete-return review, and a signed final copy.
- Keep the refund going directly to your own verified bank account.
- Walk away from guarantees, percentage-of-refund fees, missing records, unsigned returns, or unclear representation.
The strongest choice is not the person with the most impressive title or the lowest quote. It is the verified professional whose authority covers the work, whose recent experience matches your facts, whose engagement defines follow-up, and whose process lets you understand and approve the return before it is filed.
