Start with the return, the tax authority, and the notice—not your relationship status. For a U.S. federal joint income-tax return, both people generally are jointly and individually responsible for the entire tax, interest, and penalties, even when only one person earned the income or a divorce decree assigns the debt to that person. The IRS can seek the balance from either joint filer. An unmarried partner is not made federally liable merely by being in a relationship, but liability can arise from a joint return, a signature on another obligation, or a state law covering a legally recognized registered partnership.
Use the checks below to identify what you owe, then choose the correct relief or refund-allocation process. Federal and state rules are different, and a notice deadline can control your options.

Check these facts before deciding who is liable
- Tax authority: Is the notice from the Internal Revenue Service, a state department of revenue, or a local agency?
- Tax year and tax type: Confirm the year and whether it concerns income tax, payroll tax, property tax, or another assessment.
- Return status: Determine whether the return was joint, married filing separately, or single. For a federal joint income-tax return, liability is usually joint and several.
- Consent and signatures: Check whether you signed or otherwise consented to the joint filing. If you did not consent to a federal joint return, the IRS says the joint election is invalid; follow the notice instructions and contact the IRS using the number on that notice.
- Nature of the balance: Separate an unpaid amount that was correctly reported on the return from additional tax caused by an audit, omitted income, disallowed deduction, or other error.
- Notice details: Record the amount, date, response deadline, tax period, and whether the notice concerns tax, interest, penalties, or a refund offset.
- Residence and legal relationship: Identify where you lived during the relevant year and whether you were married, divorced, legally separated, widowed, or in a registered domestic partnership recognized by the applicable law.
Keep the return, every notice, account transcripts, payment records, and correspondence together. A liability conclusion based only on a spouse’s statement or a divorce agreement is unsafe.

When spouses file a joint federal income-tax return, the law generally makes each spouse responsible for the entire liability. That includes tax shown on the return, interest, penalties, and additional tax assessed later. The IRS may collect from either spouse, regardless of whose wages, business income, or error created the balance. The IRS Form 8857 instructions state: “When you file a joint income tax return, the law makes both you and your spouse responsible for the entire tax liability.”

A private agreement, separation agreement, or divorce decree can require one former spouse to reimburse the other, but it does not by itself bind the IRS or erase the joint federal liability. If the other spouse promises to pay and does not, the government can still pursue the joint filer; any reimbursement dispute is separate from the IRS collection case.
Separate returns and non-signature situations
A return filed as married filing separately generally does not create the same joint-return liability for the other spouse, although community-property rules, state law, and other signed obligations can change the result. Check the actual filed return rather than relying on what you remember selecting in tax software.
If you never signed or consented to a federal joint return, gather evidence such as your signature history, identity-theft report, prior filing pattern, and correspondence. Respond through the channel and deadline on the notice. Do not simply ignore a return you believe was filed without your consent.
Read the notice and classify the debt
The distinction between an understatement and an unpaid reported balance determines which federal relief route may fit.
| What the notice describes | Typical issue | Question to answer | Potential next step |
|---|---|---|---|
| Additional tax after audit or correction | Erroneous deduction, omitted income, or another item on a joint return | Did the other spouse control the item, and did you know or have reason to know of it when signing? | Review innocent-spouse and, where applicable, separation-of-liability relief on Form 8857. |
| Tax reported on a joint return but not paid | The return was accurate or mostly accurate, but the bill remains unpaid | Would collecting from you be unfair in light of hardship, knowledge, benefit, and other circumstances? | Review equitable relief on Form 8857. |
| Refund applied to another debt | A joint refund was offset for one spouse’s past-due obligation | Did the refund include income, withholding, or credits attributable to you? | Use injured-spouse allocation, Form 8379; this is not a liability determination. |
| State or local assessment | State-specific joint-return or partner rule | What statute, form, and deadline does that authority apply? | Use the issuing authority’s procedure; federal Form 8857 does not automatically control. |
Interest and penalties normally follow the underlying liability. Record them separately so you know whether a notice is correcting the return, collecting a reported balance, or reallocating a refund.
Federal relief from a joint-return balance
Form 8857, Request for Innocent Spouse Relief, is the federal starting point for three categories. You do not have to make a perfect legal classification before filing: the IRS says it will consider the information provided and apply any relief for which you may qualify. Read the current form instructions and the notice carefully.

Innocent spouse relief
This route generally addresses additional tax caused by the other spouse’s erroneous items on a joint return. Typical examples are unreported income, overstated deductions, or credits attributable to the other spouse. You generally must show that you did not know, and had no reason to know, of the understatement when you signed the return, along with the other statutory requirements. The IRS evaluates the facts, including what you knew about the household finances and the item itself; simply saying that your spouse handled taxes is not an automatic qualification.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsSeparation of liability relief
Separation of liability can allocate an understatement between spouses rather than making one person responsible for all of it. Eligibility commonly requires that you are divorced, legally separated, widowed, or have lived apart for the required period. Knowledge of the item, transfers of assets made to avoid tax, and other rules can disqualify a request; IRS materials describe an exception involving abuse.
The IRS generally requires this request within two years after receiving a specified notice of an audit or taxes due because of an error. Treat the two-year period as a filing deadline, not as permission to wait. The exact triggering notice matters, so preserve the envelope and delivery date.
Equitable relief
Equitable relief may cover unpaid or understated tax when innocent-spouse and separation-of-liability rules do not fit and holding you responsible would be unfair. The IRS considers the whole situation, including marital status, economic hardship, knowledge or reason to know, who had a legal obligation to pay, whether either spouse received a significant benefit, later tax compliance, and health or other circumstances.
Equitable relief is generally available while the IRS can legally collect, commonly described as a ten-year collection period from the date of notice, subject to extensions, suspensions, and other exceptions. Check the current instructions because the collection period and the deadline for your facts may differ.

How to request federal relief with Form 8857
- Get the complete file. Obtain the joint return, corrected return or audit report, account transcript, notices, payment history, bank records, wage and income information, and any divorce or separation documents.
- Identify every disputed item. List the income, deduction, credit, or payment at issue; who handled it; when you learned of it; and what you knew when you signed.
- Describe household circumstances. Explain control of finances, access to records, coercion or abuse, health limitations, language barriers, and whether you received a benefit from the unpaid or understated tax. Use dates and documents rather than conclusions.
- Complete Form 8857 for the relevant tax years. Follow the current instructions and include copies rather than originals of supporting evidence. If more than one year is involved, address each year clearly.
- File promptly using the method in the current instructions or notice. Keep proof of mailing or electronic submission and a full copy of what you sent.
- Continue responding to collection notices. A pending request does not automatically stop every collection action or erase the balance. Ask the IRS what collection protections apply while the request is reviewed.
- Expect contact with the other spouse. The IRS may notify or contact the spouse or former spouse during review. Do not assume confidentiality from the other filer.
- Read the determination and appeal instructions. The IRS, not the divorce court, decides federal relief. If relief is denied or limited, observe the response period stated in the determination.
Requesting relief does not guarantee an outcome. The IRS decides eligibility from the evidence and may grant relief for some years or items but not others.

Injured spouse relief is about a refund offset
Injured-spouse relief addresses a different problem: a joint refund was applied to the other spouse’s past-due debt. The IRS describes it as a way to reclaim the portion of a joint refund attributable to the non-liable spouse. Offset debts can include past-due child support, federal agency debts, state income-tax obligations, and state unemployment-compensation debts.
Use Form 8379 to allocate the refund. The form does not decide whether you are liable for tax owed on the joint return, and filing it does not convert an unpaid balance into innocent-spouse relief. A new Form 8379 is required for each year for which recovery is requested. Community-property rules can affect the allocation, so income, withholding, estimated payments, and credits may not divide simply by whose name appears on a form.
The IRS currently states that a Form 8379 filed by itself generally takes about 8 weeks to process. A form filed with the joint return follows a different processing path. Continue to monitor notices and retain the allocation calculations.
Deadlines and timing decisions
Use the earliest date in your file as the practical starting point: the date you received the notice, learned of the balance, or discovered the filing problem. Relief categories have different periods. Separation-of-liability requests generally have the two-year notice rule described above. Equitable relief is generally tied to the period in which the IRS may collect, commonly up to ten years but subject to legal extensions and exceptions. Innocent-spouse timing can depend on the type of notice and the relief sought.
Because a request may require records from an ex-spouse or an old employer, start immediately. Filing close to a deadline without the documents is usually safer than waiting until the deadline has passed, provided you follow the current instructions and explain what evidence is unavailable.
State, local, and partner rules
Federal spouse-relief rules do not settle state or local liability. State statutes can impose joint and several liability, create different relief procedures, or treat registered domestic partners differently. New York materials provide for joint and several liability in specified joint-return situations. Washington statutes address spouses and state registered domestic partners in particular tax contexts. Virginia Tax rulings discuss state joint-return liability and the department’s position on certain premarital debts. These examples show why the issuing jurisdiction, tax type, and exact year must be checked; they are not a nationwide rule.

Unmarried partners
An unmarried partner is not generally liable for a federal income-tax balance solely because of the relationship. Liability may still exist if the partner signed a joint return where permitted, signed a payment agreement or loan, received an assessment in their own name, or falls under a state statute covering a registered domestic partnership. Confirm whether the jurisdiction recognizes the partnership, whether the document was a joint filing, and which tax is being collected.

When professional help is justified
Consider a tax attorney, enrolled agent, or CPA with spouse-relief and state-tax experience when the balance is large, several years are involved, a business or community-property issue exists, identity theft or abuse is alleged, or collection action is imminent. Ask what credentials and experience the professional has, what years and jurisdictions are included, and how fees are calculated. No professional can promise that the IRS or a state authority will grant relief.
You can prepare the factual chronology and collect records before the appointment. That reduces time spent reconstructing basic facts and lets the professional focus on the legal tests and response strategy.

Assuming divorce removes the debt
Correction: treat the federal joint liability as continuing unless the IRS grants relief. Use the divorce order to pursue reimbursement from the former spouse, not as proof that the IRS must release you.

Filing Form 8379 for an unpaid tax balance
Correction: use Form 8379 only when a joint refund was offset. For an additional tax or unpaid joint-return balance, evaluate Form 8857 categories.
Waiting for the other spouse to cooperate
Correction: respond to your notice and file your own relief request on time. The IRS may contact the other spouse, but your deadline does not depend on cooperation.
Calling every balance an “innocent spouse” case
Correction: identify whether the problem is an erroneous item, allocation after separation, or an unpaid amount that may require equitable relief. Form 8857 allows the IRS to consider the categories, but your facts and evidence still matter.
Assuming a state follows federal rules
Correction: obtain the state statute, form, and notice instructions for the exact year and tax. A federal determination may be useful evidence but is not automatically controlling.
Worked examples
Example: omitted business income
A couple filed jointly. The IRS later assessed tax because one spouse omitted business receipts. The other spouse signed the return and says the business records were never available to them. This is an understatement issue, so the spouse should review innocent-spouse requirements, document lack of knowledge and access, and file Form 8857 promptly. Divorce after the assessment does not itself remove liability.
Example: accurate return, no payment
A joint return correctly reported wages and tax, but the couple spent the money withheld for estimated payments and now owes the balance. There may be no erroneous item to allocate. The spouse should examine equitable relief, including hardship, knowledge, benefit, legal responsibility, and subsequent compliance.
Example: refund offset for child support
A joint return generated a refund, but the entire amount was applied to one spouse’s past-due child-support debt. The other spouse is addressing a refund allocation, not tax liability. Form 8379 can be used to calculate and request the non-liable spouse’s share for that year.
Example: registered domestic partners and state tax
Two registered domestic partners receive a state notice for a joint state return. The answer depends on that state’s statute and the tax type. They should not infer federal spouse-relief eligibility or federal joint-return treatment from the state notice; they need the state form and deadline.
Quick Recap
A practical decision path
- If the notice is not from the IRS, start with the issuing state or local authority’s law and form.
- If the IRS notice concerns a joint return, verify consent, tax year, and whether the balance is an understatement or unpaid reported tax.
- If an erroneous item caused additional tax, assess innocent-spouse and separation-of-liability routes.
- If the return was accurate but unpaid, assess equitable relief and collection alternatives while responding to the notice.
- If a refund was offset for the other spouse’s debt, prepare Form 8379 for that year instead of treating the offset as innocent-spouse liability.
- Check the shortest applicable deadline, file promptly, and obtain qualified advice when the facts involve multiple jurisdictions, substantial amounts, or hardship.
