To find out whether an inheritance is taxed, first separate four questions: whether the deceased person’s estate owes a state estate tax, whether you as beneficiary owe a state inheritance tax, whether federal estate-tax filing rules apply, and whether you will owe income tax after selling inherited property. Start with the deceased person’s state of residence at death, every state where property was located, the date of death, the estate’s approximate value, and your relationship to the deceased.

Then use the revenue department for each connected state and verify that state’s rules for the specific date of death. State thresholds, exemptions, rates, filing deadlines and nonresident rules differ, and federal thresholds do not answer the state-tax question.

First identify which tax you are checking

People often use “inheritance tax” as a general term, but the legal distinction determines who may have to file or pay.

Estate tax is charged to the estate

An estate tax is assessed against the taxable estate of the person who died. The executor or personal representative generally handles the calculation, filing and payment from estate assets before distributions are completed. The tax base may depend on the gross estate, allowable deductions, lifetime taxable gifts, transfers to a surviving spouse or charity, and available credits.

Inheritance tax is charged to a recipient

An inheritance tax applies to what a beneficiary receives. The recipient’s relationship to the deceased can affect the rate or exemption. A surviving spouse, child, sibling, unrelated person or charity may be treated differently under the same state’s law.

Minnesota’s Department of Revenue states the distinction plainly: “Inheritance tax is a tax on what beneficiaries of an estate inherit.” Minnesota also says it has no inheritance tax, while warning that its estate-tax filing requirements can differ from federal requirements.

Federal income tax is a separate issue

Receiving cash, securities or property from an estate generally is not federal income to the beneficiary merely because it was inherited. The Internal Revenue Service states: “Generally, the person who receives a gift or bequest of property from an estate won’t have to pay any federal gift tax or estate tax.” That statement does not eliminate a state inheritance tax, and it does not make later income from the inherited asset tax-free.

Federal estate tax is another separate question

Federal estate tax is imposed on an estate under federal rules. It is not the same as a state estate tax or a state inheritance tax. For a decedent who died in 2026, the IRS lists a $15,000,000 federal estate-tax filing threshold/basic exclusion amount, subject to federal rules such as adjusted taxable gifts and available elections. That figure does not establish a state threshold and does not by itself determine whether a state return is required.

Gather the facts before looking up a state rule

State tax agencies apply their rules to specific facts. Write down the following before searching for forms or calling an agency.

  • Date of death: State thresholds and rates are usually tied to the date the person died, not the date you received the distribution.
  • Residence at death: Record the deceased person’s actual domicile, not merely a mailing address or the state where a beneficiary lives.
  • Property locations: List every state where the deceased owned real estate. Also note business interests, tangible property and other assets that may have a state connection.
  • Approximate gross estate: Estimate the value of assets before subtracting debts and expenses. Include financial accounts, real estate, business interests, life-insurance interests and property held through entities or trusts when the applicable rules require them.
  • Debts and deductions: Gather mortgages, other debts, administration expenses, charitable transfers and qualifying spouse transfers. These items can change an estate-tax calculation.
  • Lifetime taxable gifts: Federal and some state calculations can take prior taxable gifts into account. Ask the executor whether gift-tax returns or previous planning documents exist.
  • Your relationship to the deceased: Identify whether you are a spouse, child, grandchild, parent, sibling, other relative, charity or unrelated beneficiary.
  • How the asset was owned: Note joint ownership, beneficiary designations, trusts, retirement accounts and property that passed outside probate. A probate inventory may not include every item relevant to a tax calculation.

Check every state connected to the estate

Do not check only your own home state. The first state to examine is usually the deceased person’s state of residence at death. A second state may matter when the estate owned real property or other assets with a taxable connection there.

The deceased person’s resident state

Open the revenue department’s estate-tax and inheritance-tax pages for the state where the deceased was domiciled at death. Look for the law in effect on the death date, the filing threshold, the definition of a taxable estate, beneficiary exemptions, forms, payment rules and deadlines.

A state where real estate was located

Real estate can create a nonresident filing issue even when the deceased lived elsewhere. Washington’s Department of Revenue says a nonresident decedent who owned Washington property may owe Washington estate tax depending on the estate’s value. This is why an estate with a home, land or commercial property in another state needs a separate check for that state.

States connected through other property

Connections involving business property, tangible personal property, trusts or other assets can be technical. If the estate has substantial property outside the resident state, ask the relevant revenue departments or a professional familiar with both states instead of assuming that only the residence state matters.

Use the official revenue department: a step-by-step check

  1. Search the agency’s official site. Use the state name plus “estate tax,” “inheritance tax,” “nonresident estate” or “death tax.” Confirm that the page belongs to the state’s revenue or taxation department.
  2. Set the date filter. Find the page, bulletin or instructions that apply to the date of death. Do not rely on a current threshold if the person died in an earlier year.
  3. Determine who is taxed. The page should say whether the state imposes an estate tax on the estate, an inheritance tax on recipients, both, or neither.
  4. Read the threshold definition. Check whether the threshold uses gross estate value, a taxable-estate amount after deductions, an exclusion, an annual exclusion or another measure. Note whether lifetime gifts or prior transfers are included.
  5. Check beneficiary classes. For an inheritance tax, record the relationship categories, rates and exemptions that apply to each recipient. Do not assume that a family relationship is treated the same in every state.
  6. Check nonresident rules. Look for special instructions when a nonresident owned in-state real estate or other property. Some states require an allocation rather than taxing the entire estate.
  7. Find the filing deadline and payment deadline. They may be different. Record extensions, estimated payments, required certificates and who must sign the return.
  8. Save the instructions. Keep a copy of the agency page or PDF, the applicable year, your calculations and the contact information for the agency. Rules can change while an estate is being administered.
  9. Compare the state result with the federal result. A state return can be required even when no federal estate-tax return is required, and a federal filing threshold does not create a state exemption.

States reported to have estate or inheritance taxes

A 2026 secondary overview reports 12 states plus the District of Columbia with an estate tax and five states with an inheritance tax. Use this list only as an orientation tool; the official revenue department controls the filing rules for the particular death date and facts.

Tax category States or district reported in the 2026 overview
Estate tax Connecticut; Hawaii; Illinois; Maine; Maryland; Massachusetts; Minnesota; New York; Oregon; Rhode Island; Vermont; Washington; District of Columbia
Inheritance tax Kentucky; Maryland; Nebraska; New Jersey; Pennsylvania

Maryland appears in both categories in that overview. That means an estate connected with Maryland may require separate analysis of an estate-level tax and a recipient-level tax. A state’s absence from this orientation list does not settle every estate, property or local filing issue, so verify the official rules for each connected state.

What official state examples show

Pennsylvania: recipient relationship can change the rate

Pennsylvania’s Department of Revenue describes inheritance-tax rates that vary by recipient class. Its official information gives a 15% rate for transfers to “other heirs,” subject to exceptions for specified exempt recipients and property. The rate should not be applied without checking whether the beneficiary and asset qualify for an exception under the law in effect on the date of death.

Washington: nonresident property can matter

Washington’s Department of Revenue says resident estates and nonresident estates owning Washington property may owe Washington estate tax depending on value. The department also notes changes for deaths in 2026. An executor should therefore use the 2026 instructions when the death occurred in 2026 rather than relying on an older summary.

Minnesota: no inheritance tax, but state filing rules remain separate

Minnesota’s Department of Revenue says Minnesota has no inheritance tax. It also warns that state filing requirements may differ from Internal Revenue Service requirements. “No inheritance tax” does not mean that every Minnesota estate is free from state paperwork or estate-tax analysis.

Maine: a date-specific 2026 exclusion

Maine Revenue Services lists a $7,160,000 annual exclusion for estates of decedents dying in 2026 and explains its state taxable-estate calculation. The amount is specific to Maine and to deaths in 2026; it is not a general state threshold and cannot be substituted for another state’s rule.

How to think about the estate’s value

Do not compare an estate’s bank balance with a tax threshold and stop there. Start with the gross estate and then follow the state’s definition of taxable estate.

  • Gross assets: Include the values the state requires, even if an asset passes directly to a beneficiary or outside probate.
  • Deductions: Debts, administration expenses, charitable transfers and qualifying spouse transfers may reduce the taxable amount, but only when the state allows them and the required documentation exists.
  • Joint property and trusts: Ownership percentages, retained rights and trust terms can affect what is included.
  • Lifetime gifts: The federal calculation illustrates why adjusted taxable gifts and elections can matter. A state may use its own treatment, so ask for the state-specific worksheet.
  • Valuation date: Use the valuation method required by the applicable state instructions. Do not mix a later sale price with the date-of-death value unless the rules call for it.

What happens when inherited property is sold

The tax result at inheritance and the tax result at sale are different events. The IRS generally treats inherited property’s basis as its fair market value at the date of death. A qualifying alternate valuation date may apply if the executor makes the required election.

If you later sell the property, compare the sale proceeds with the properly documented basis. A gain or loss may need to be reported on your federal return, and state income-tax reporting may also apply. Keep the appraisal, estate inventory, closing statement, improvement records and any alternate-valuation election so you can support the basis used.

For example, receiving a house may not produce federal income merely because it was inherited. Selling it later can create a reportable gain or loss, depending on the date-of-death basis, permitted adjustments and selling costs. The state inheritance-tax question should be checked separately from this sale calculation.

Filing and payment: who usually acts

For an estate tax, the executor or personal representative normally gathers asset values, applies deductions and exemptions, signs the return and pays from estate funds. Beneficiaries should still ask whether a state inheritance tax is imposed directly on their distributions.

For an inheritance tax, the state may require a return, payment or waiver before property can be transferred. The responsible person can be the beneficiary, executor, trustee or another party named in state instructions. Read the agency’s instructions rather than assuming that the probate court will handle the tax automatically.

Common mistakes and how to correct them

Checking only the beneficiary’s state

Why it fails: The beneficiary’s residence is not necessarily the state with jurisdiction over the estate or property.

Correction: Start with the decedent’s domicile and add every state where relevant property was located.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using the federal $15 million figure as a state exemption

Why it fails: The IRS threshold for a 2026 death is a federal figure. State thresholds and filing rules are independent.

Correction: Record the federal number separately and obtain the state’s instructions for the death year.

Assuming “no inheritance tax” means “no filing”

Why it fails: A state can lack an inheritance tax while still imposing an estate tax or requiring a state filing that differs from federal requirements.

Correction: Read both the inheritance-tax and estate-tax sections of the state revenue site.

Correction: Classify each beneficiary separately and verify exceptions for the particular asset.

Ignoring property in another state

Why it fails: Nonresident estates can have state obligations for in-state real property, as Washington’s guidance illustrates.

Correction: Run a separate nonresident-property check for every state where the deceased owned real estate or other potentially taxable property.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Confusing inheritance with a later sale

Why it fails: Receiving an asset and selling it are separate tax events with different rules.

Correction: Document the date-of-death basis and analyze any later sale independently.

When professional advice is warranted

Consider state-specific advice when the estate touches multiple states, owns a business or valuable real estate, includes trusts or lifetime gifts, has uncertain domicile, or may exceed a state threshold. Advice is also prudent when a filing deadline is near, beneficiaries disagree about values, or the estate may owe both an estate tax and an inheritance tax.

Bring the professional or revenue department these items: the death certificate, will and trust documents, asset inventory, date-of-death valuations, debt records, beneficiary list, prior gift-tax information, property deeds and any notices already received. Ask specifically which state returns are required, who must file, which valuation date applies, what exemptions are available and how payment affects distributions.

A concise decision path

  1. Record the date of death and the deceased person’s state of residence.
  2. List each state where the deceased owned real estate or other potentially relevant property.
  3. Estimate the gross estate and collect deductions, gifts, spouse transfers and charitable transfers.
  4. Separate estate-level tax from beneficiary-level inheritance tax.
  5. Check each state revenue department for the death year, threshold, rates, exemptions, forms and deadlines.
  6. Check federal estate-tax rules separately; for a 2026 death, the IRS lists a $15,000,000 filing threshold subject to federal adjustments and elections.
  7. Preserve date-of-death valuation and basis records if property may be sold.
  8. Obtain state-specific advice when multiple jurisdictions or complex assets are involved.
