An assessment made after an Income Tax Appellate Tribunal (ITAT) remand is not automatically valid or invalid because it was passed after a particular number of months. The answer depends on the assessment year, the version of the limitation law in force, what the ITAT actually directed, when the order reached the senior tax authority named in the statute, and the date on which the Assessing Officer (AO) made the post-remand order.
For a fresh assessment covered by the current Section 153(3) framework of the Income-tax Act, 1961, the general period is 12 months from the end of the financial year in which the Section 254 order is received by the specified Principal Chief Commissioner, Chief Commissioner, Principal Commissioner or Commissioner. A separate, generally shorter timetable applies when the AO is only giving effect to the appellate order under Section 153(5). Because the law has changed and the Department has identified a transition issue for ITAT remands on or after 1 April 2026, you must establish the applicable statutory version before calculating anything.

The short answer: identify the route before counting days
Start with the operative part of the ITAT order. A direction to determine an issue afresh can amount to a fresh assessment even when only one issue was remitted. A direction that merely implements the appellate result may instead be a give-effect proceeding. These routes have different statutory clocks.

| Question | Fresh assessment route | Give-effect route |
|---|---|---|
| What the AO does | Re-determines an assessment or remitted issue under the ITAT’s directions | Implements the appellate result without making a fresh assessment or reassessment |
| Main provision in the current 1961 Act framework | Section 153(3), subject to the applicable enactment, amendments and transition rules | Section 153(5) |
| General trigger described by the Department | Receipt of the Section 254 order by the named senior tax authority | Receipt of the relevant appellate order by the designated authority |
| General period described in the current text | 12 months from the end of the financial year containing the receipt | Three months from the end of the month containing the receipt, subject to statutory additional time, verification and hearing provisions |
| What must be verified | Proof of authority receipt, the exact remand directions, applicable statutory version and the signed assessment date | Whether the order truly is only implementation and whether any extension or verification rule applies |
Do not use the date on which the taxpayer downloaded or received the ITAT order as a substitute for the statutory receipt date unless the applicable law expressly makes that event relevant. The Supreme Court has stressed that the date of receipt by the specified authority controls the commencement of the 12-month period for the relevant fresh-assessment provision.

Collect the record before doing the arithmetic
A limitation objection usually fails or becomes difficult to prove when the taxpayer has only the assessment order and a general recollection of the appeal. Assemble a dated chronology containing:
- the assessment year;
- the section under which the original assessment was made and the date of that order;
- the ITAT appeal number, order date and complete signed order;
- the exact operative directions, including whether an assessment, an issue, or a computation was set aside;
- the date on which the Section 254 order was received by the Principal Chief Commissioner, Chief Commissioner, Principal Commissioner or Commissioner named in the applicable provision;
- any internal acknowledgment, dispatch record, system receipt, or official correspondence proving that receipt;
- the post-remand notice, hearing record and assessment order;
- the date on the signed post-remand order, rather than only its service or portal-upload date; and
- records of stays, exclusions, verification requests, hearings, extensions or other events that the governing statute may remove from or add to the computation.
If one of these dates is missing, label the resulting conclusion provisional. A limitation calculation cannot be made reliably from the ITAT pronouncement date alone.
Choose the statutory version that governs the case
Section 153 has been amended repeatedly. Limitation periods that applied to an older assessment year or to an earlier procedural event must not be carried forward as if they were the current rule. The Income Tax Department publishes different versions of Section 153, including an archived 2022 text, and its current materials describe a different post-2019 framework in relevant cases.
Match the assessment year and procedural chronology
- Write down the assessment year. The year identifies the assessment framework, but it may not by itself resolve every transitional question.
- Identify the date and nature of the ITAT order. Record whether the order was passed before or after a statutory amendment and whether it set aside, cancelled, or merely modified the assessment.
- Read the enactment and amendments applicable to those dates. Use the official text for the relevant year and procedural event, not a summary of a later version.
- Check savings and transition clauses. A later enactment may preserve an earlier rule for proceedings already pending or may assign a new Act to proceedings begun after a specified date.
The Department’s e-filing help material specifically raises which Act applies when an ITAT remand occurs on or after 1 April 2026 and describes remand proceedings, in that question-and-answer context, as a continuation of the original proceedings. That does not answer every case. The assessment year, remand date and transitional text must be applied to the individual record.
Why a year qualifier belongs beside every deadline
Writing “the deadline is 12 months” without naming the statutory version is unsafe. The number may be correct for a current Section 153(3) case but wrong for a historical case governed by an earlier subsection, a different period or a transition rule. State the provision, the version and the reason it applies in the same sentence as the calculation.
Classify the ITAT order: fresh determination or give effect?
When the order requires a fresh assessment
Examine what the AO is required to decide, not merely the label used in the order. If the ITAT sets aside an assessment or a material issue and directs the AO to determine it afresh after considering evidence, arguments or a new computation, the proceeding may be a fresh assessment for limitation purposes. The remand can be limited to one issue; the entire original assessment need not always be cancelled.
In Nokia India Private Limited v Deputy Commissioner of Income Tax, decided by the Delhi High Court on 21 September 2017, the court stated: “When the assessment on an issue is set aside and the matter remanded, with a direction that the issue has to be determined afresh, Section 153 (2A) of the Act would get attracted.” That decision concerned the subsection and statutory language then in force. It is useful for the classification principle, but its historical period must not be presented as the current deadline.

When the order is only implemented
A give-effect order ordinarily performs the arithmetic or consequential changes required by the appellate decision: deleting an addition that was struck down, allowing a relief that was granted, or recomputing tax after a finding that leaves no fresh issue for adjudication. Section 153(5) separately addresses giving effect to certain appellate orders wholly or partly otherwise than by making a fresh assessment or reassessment.

The distinction is functional. If the AO must investigate and decide an issue afresh, the fresh-assessment analysis is relevant. If the AO has only to implement a binding result, the give-effect timetable may apply. The heading, the words “remand” or “set aside,” and the number of issues remitted are clues, not substitutes for reading the operative directions.
| Feature | Fresh determination | Implementation only |
|---|---|---|
| ITAT instruction | Reconsider, examine, verify or decide an issue again | Give effect to a specified relief, deletion or modification |
| AO’s work | May call for evidence, conduct hearings and make findings | Usually recalculates or alters the assessment consistently with the appellate result |
| Limitation analysis | Check the applicable fresh-assessment subsection and its trigger | Check Section 153(5) and any verification or hearing extension |
| Risk of misclassification | Calling it “give effect” does not shorten a period if the statute treats the work as a fresh assessment | Calling every remand “fresh assessment” can improperly lengthen a period that applies only to implementation |
Find the statutory trigger date
Under the current Section 153(3) framework described by the Department, the relevant trigger for a qualifying Section 254 order is its receipt by the named senior tax authority. The order date is not automatically the trigger. Obtain documentary proof of the date on which that authority received the order.
What counts as useful receipt evidence
- an official inward stamp or acknowledgment;
- a department dispatch or receipt register;
- an authenticated electronic receipt in the departmental system;
- an official communication identifying the date of receipt; or
- another contemporaneous record that links the ITAT order to the authority specified in the applicable provision.
A taxpayer’s copy, the date of a tribunal pronouncement, or the date on which an appeal was downloaded may show chronology but may not establish the statutory receipt event. If the Department relies on a different receipt date, request the underlying record and preserve the objection.
The Supreme Court’s explanation
In its judgment dated 8 August 2025, the Supreme Court of India explained the significance of the receipt date in these terms: “Therefore, what is of significance is the date of the commencement of the limitation period of twelve months which commences from the end of the financial year in which the order passed under Section 254 by the Tribunal, setting aside or cancelling an assessment is received by the Principal Chief Commissioner or Chief Commissioner etc.”
The practical consequence is that the calculation normally begins with the end of the financial year containing the qualifying receipt, not with the day the ITAT pronounced the order. The exact subsection, qualifying order and any statutory exclusions still have to be checked.
Calculate a current-law 12-month fresh-assessment period
Once the current Section 153(3) framework is confirmed, use this sequence:
- Record the verified date on which the Section 254 order was received by the specified senior authority.
- Identify the financial year containing that date. In India, a financial year runs from 1 April through 31 March.
- Take the last day of that financial year as the statutory starting point described in the provision.
- Apply the 12-month period stated in the applicable text, together with any exclusions or extensions that the statute permits.
- Compare the resulting date with the date on the signed assessment order.
Example: receipt before 31 March 2026
Assume the applicable current 1961 Act provision applies and the authority received the Section 254 order on 14 November 2025. That receipt falls in financial year 2025–26, which ends on 31 March 2026. A 12-month period from the end of that financial year ordinarily runs to 31 March 2027, before considering any statutory exclusion or extension. An order made on 31 March 2027 would be tested against the governing computation rules; an order made on 1 April 2027 would require an explanation for the extra time.

Example: receipt after 1 April 2026
Assume the same type of qualifying order is received on 5 April 2026. It falls in financial year 2026–27, ending on 31 March 2027. Under a provision that still uses the 12-month formula, the unadjusted endpoint would be 31 March 2028. However, a remand on or after 1 April 2026 raises the Department’s transition question. Confirm which Act and transitional rule govern before relying on this arithmetic.

These examples illustrate the method, not a determination for any particular taxpayer. A different subsection, a non-qualifying order, or a statutory extension can change the result.
Calculate the separate give-effect period
Section 153(5), as summarized in the Department’s current text, provides a separate general period for giving effect wholly or partly to specified appellate orders otherwise than by making a fresh assessment or reassessment. The period is three months from the end of the month in which the order is received by the designated authority. The text also describes possible additional time and a separate rule where document verification or a hearing is needed.
Example: a straightforward implementation
If the relevant order is received on 14 November 2025 and the proceeding is genuinely a Section 153(5) give-effect matter, the month ends on 30 November 2025. Three months from that month-end ordinarily reaches 28 February 2026, subject to the precise statutory wording and any permitted extension. The signed order date must be compared with that endpoint.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteVerification and hearing provisions
Do not treat the three-month figure as an absolute answer when the AO was required to verify documents or provide a hearing under a provision that allows additional time. Identify the specific subsection, the event that activated the additional period, and the dates of the verification request, documents supplied and hearing. An extension must come from the governing law; administrative delay alone does not create one.
Check the date the order was made, not just when it arrived
Limitation generally tests when the assessment order was made. Keep separate columns for:
- the date printed on the signed assessment order;
- the date it was digitally signed, if shown separately;
- the date it was uploaded or served; and
- the date the taxpayer actually viewed it.
Service can matter for appeal rights, but it is not automatically the date on which the assessment was made for Section 153. If the document carries inconsistent dates, preserve the original file and request clarification from the Department rather than choosing the date most favorable to either side without evidence.
Account for exclusions, stays and statutory extensions
After calculating the basic period, read the applicable Section 153 text for exclusions and extensions. The answer can change where the statute excludes a period during which a proceeding was stayed, permits extra time for a direction or verification, or applies a special rule to a particular appellate order.
Build a separate adjustment schedule:
| Event | Date range or statutory period | Why it matters |
|---|---|---|
| Stay or injunction | Use the dates stated in the court order | The applicable provision may exclude the period or prescribe a different adjustment |
| Document verification | Record the request, production and completion dates | Section 153(5) materials describe a separate rule where verification is needed |
| Hearing or opportunity directed by the appellate order | Record notices, adjournments and the hearing date | The governing text may allow additional time in specified circumstances |
| Special statutory direction | Identify the exact subsection and amendment | Generic 12-month or three-month arithmetic may not apply |
Do not add every period of departmental inactivity. Add or exclude time only when the applicable enactment authorizes it and the record proves the triggering event.

Understand the 2026 transition issue
For an ITAT remand on or after 1 April 2026, the Income Tax Department’s help material asks which Act governs the proceeding and describes the remand, in that context, as a continuation of the original proceeding. The material does not eliminate the need to examine the assessment year, the date the original proceeding began, the remand date and the transitional provisions.
Use this decision path:
- Locate the statutory provision that was in force for the original assessment and the one in force on the remand date.
- Read the transition clause governing pending assessments, appeals and remands.
- Determine whether the new Act applies to the remand, preserves the earlier Act, or applies different rules to different procedural steps.
- Only then select the subsection and perform the limitation calculation.
If the transition clause is unclear, state the competing interpretations and obtain advice in the jurisdiction where the assessment is being litigated. Do not present the 1961 Act’s 12-month rule as universal for every remand decided after 1 April 2026.
Use historical case law carefully
Older judgments can explain how courts distinguish a fresh determination from implementation, but they do not freeze the law. The Delhi High Court’s Nokia India decision interpreted Section 153(2A) in the statutory setting applicable in 2017. A later amendment may renumber the provision, change the period or alter the trigger.

Common mistakes and how to correct them
Counting from the ITAT order date
Mistake: treating the pronouncement date as day one. Correction: locate the statutory receipt date for the authority named in the applicable provision, then identify the relevant financial year or month-end.
Assuming every remand is a fresh assessment
Mistake: applying the longer fresh-assessment route merely because the order uses the word “remand.” Correction: read the operative directions and ask whether the AO had to decide an issue afresh or simply implement a result.
Assuming a partial remand cannot be fresh
Mistake: arguing that the whole assessment had to be set aside before the fresh-assessment provision could apply. Correction: test whether the remitted issue required a fresh determination. Nokia India rejected that broad proposition under the historical provision it considered.
Using a historic period as the current rule
Mistake: copying a deadline from an older judgment or archived page. Correction: identify the assessment year, remand date, amendment history and transition clause first.

Mistake: relying on the date the order reached the taxpayer or representative. Correction: obtain proof of receipt by the specified senior authority.
Comparing the deadline with the service date
Mistake: using portal upload or service instead of the date on which the assessment order was made. Correction: inspect the signed order and keep service information separately for appeal-timeliness purposes.
Adding extensions without a statutory basis
Mistake: treating administrative delay, adjournments or internal approvals as automatic extensions. Correction: identify the exact provision and the event that activates it, then document the dates.

A clear worksheet lets a tax professional, appellate authority or court reproduce the calculation. Use these columns:

| Assessment year | Exact year and relevant enactment |
| Original assessment | Section and order date |
| ITAT order | Appeal number, order date and operative directions |
| Classification | Fresh assessment or Section 153(5) give effect, with reasons from the order |
| Applicable law | Section, amendment version and transition provision |

| Adjustments | Each exclusion or extension, its legal basis and dates |
| Assessment order | Date on the signed order and, separately, service date |
| Result | Within time, apparently late, or unresolved because a fact or transition rule is missing |
State the conclusion narrowly. For example: “On the present record, the order appears outside the 12-month period under Section 153(3), calculated from 31 March [year], but the conclusion remains subject to proof of the authority’s receipt date and any applicable exclusion.” That is more defensible than saying simply that the order is “illegal” or “time-barred.”
What to do when the record is incomplete
If the ITAT order, receipt proof or assessment-year information is missing, request those documents before filing a limitation ground. Ask the Department for the inward acknowledgment or electronic receipt relied upon, and compare it with the date stated in the assessment order or remand proceedings. If two dates appear in official records, preserve both and explain why one is the statutory trigger.
Where the classification is disputed, plead the alternatives in the appropriate proceeding: explain why the operative directions require a fresh determination, and in the alternative identify the shorter give-effect period if the authority characterizes the work as implementation. The court or appellate authority can then decide the legal route on the complete record.

An ITAT remand assessment is potentially time-barred only after five questions are answered in sequence: which enactment and version apply; what the ITAT ordered the AO to do; which statutory event starts the clock; what exclusions or extensions the text permits; and when the signed assessment order was made. Under the current 1961 Act framework, a qualifying fresh assessment generally uses 12 months from the end of the financial year of receipt by the specified senior authority, while a genuine give-effect proceeding generally uses the separate three-month rule from the end of the receipt month. The 2026 transition and any historical statutory version must be resolved before either figure is used.
