Do not ignore an income-tax notice because it looks suspicious, and do not assume that a genuine-looking PDF is legally in time. For an India-issued communication, first authenticate it on the Income Tax Department’s pre-login service, then check its DIN, statutory section, assessment year or tax year, service record, approvals and the limitation rule under the Act that applies to that tax period. These are separate tests: the portal can confirm that the Department recognizes a document, but it does not decide every question about statutory authority or whether the notice was issued before the legal deadline.

This guide covers notices issued under India’s Income-tax Act, 1961 and the reassessment transition to the Income-tax Act, 2025. It is general information, not a calculation for a particular notice; the exact result depends on the document, tax period, dates and procedural history.

What “valid” and “within time” mean

Two different questions are often mixed together:

  • Is the communication genuine? Does it match a record held by the Income Tax Department, and does it carry the required Document Identification Number (DIN)?
  • Was it legally issued? Did the officer use the correct statutory route, obtain any required approval, serve it correctly and act within the limitation period for that notice and tax period?

A successful portal search addresses the first question only. A notice can be recognized by the Department while still requiring a separate objection about limitation, jurisdiction, approval, service or another procedural requirement. Conversely, a message that cannot be authenticated may be a data-entry problem or a document that should not be acted on until its source is confirmed.

The response date printed on a notice is also different from the Department’s authority to issue it. Treat both as deadlines, but do not use one as a substitute for the other.

1. Authenticate the notice on the official portal

Use the Income Tax Department’s pre-login service, “Authenticate Notice / Order issued by ITD”. You do not need to sign in to begin. The Department’s user manual describes two search methods.

Search with PAN and document details

  1. Open the official e-Filing portal and select Authenticate Notice / Order issued by ITD.
  2. Choose the option to search using PAN and document information.
  3. Enter the PAN, document type, relevant year, date of issue and mobile number exactly as shown on the communication.
  4. Request and enter the one-time password (OTP) sent for validation.
  5. Review the result returned by the portal and compare the displayed document information with the PDF, letter or order you received.

Search with the DIN

  1. Select the DIN-based authentication option.
  2. Enter the complete DIN printed on the notice and the mobile number requested by the service.
  3. Complete OTP verification.
  4. Compare the record returned by the portal with the notice’s section, date, taxpayer details and document type.

A matching record supports authenticity. It does not calculate the limitation period, confirm that every approval was obtained or resolve an objection about service.

What a “no record” result means

A no-record response means that the details supplied did not locate a matching record in that search. It is not, by itself, a legal finding that the notice is out of time. Re-enter the PAN, DIN, document type, year and issue date from the original document; a single incorrect digit or date can prevent a match. If the result remains unclear, use the Department’s official portal contact channels. Until the source is confirmed, avoid replying through hyperlinks, phone numbers or email addresses contained only in a suspicious message.

2. Check the Document Identification Number (DIN)

Look for the DIN on the actual notice or order, usually in its header or identifying details. The Income Tax Department’s Authenticate the Notice issued by ITD FAQ states that every communication issued by the Department on or after 1 October 2019 should bear a unique DIN.

“Every communication by Income Tax department issued on or after 1st October, 2019 shall bear an unique Document Identification Number(DIN).”

The same FAQ says that a communication without a DIN “would be treated as invalid and shall be non est in law or deemed to be as if it has never been issued.” That is the Department’s published rule. Preserve the document and check whether a legally relevant exception or separately documented circumstance applies before treating any particular communication as conclusively disposed of. A missing DIN is a serious warning and should be raised through the official channel, not silently ignored.

3. Record the notice’s legal identity before calculating time

Do not start with a generic internet deadline. Make a record of the facts that determine which rule applies.

Item to record Where to find it Why it matters
Statutory section Heading, opening paragraph and operative direction Different sections have different purposes, prerequisites and limitation rules.
Assessment year or tax year Notice heading, computation or demand details It identifies the income period and helps determine which Act and amendment apply.
Date of issue Notice header or order metadata Often relevant to an issue-limitation analysis.
Date and mode of service Portal delivery record, email, physical envelope, acknowledgement or other proof Some statutory periods and procedural duties turn on service rather than merely the date printed on a document.
Response date Notice’s compliance instruction This is the immediate date for responding; it is not automatically the Department’s issue deadline.
Earlier steps Prior notices, show-cause communications, replies and orders Reassessment and other proceedings may depend on the sequence of earlier events.
Approval or sanction Notice file, order records or information supplied by the Department Section 151 of the 1961 Act and corresponding procedures can make approval a separate issue.

Download the portal copy and keep the original email, envelope, delivery timestamp and any acknowledgement. Do not rely only on a forwarded PDF or a screenshot.

4. Identify which Act governs the notice

The transition to the Income-tax Act, 2025 makes the tax period decisive. The Department’s Reassessment Proceedings FAQs state that the 2025 Act’s reassessment provisions, sections 279 to 286, apply to Tax Year 2026–27 and later.

For a tax year beginning before 1 April 2026, reassessment remains under the Income-tax Act, 1961 framework. The date you happen to receive a notice after 1 April 2026 does not automatically switch the case to the new Act. The tax period and the transition provisions control.

Pending proceedings at the transition

The Department’s FAQ explains that proceedings initiated under the 1961 Act and pending on 1 April 2026 continue under the old Act, subject to the limitation in section 149. It also gives an example of a notice sequence that spans the transition. Therefore, list every earlier notice and order instead of selecting an Act from the latest email date alone.

5. Match the section to the correct limitation question

For the 1961 Act, the official consolidated text separates several provisions that readers often collapse into one:

  • Section 148: the reassessment notice route.
  • Section 149: the time limit for issuing that notice.
  • Section 151: approval requirements in the circumstances specified by the Act.
  • Section 153: the time limit for completing an assessment, reassessment or recomputation.

Read the current and historical wording in the India Code text of sections 148–153: Income-tax Act, 1961, sections 148–153. The document includes amendments and different timelines, so quoting one number without tying it to the applicable period and facts can produce the wrong answer.

Issue limitation is not completion limitation

Ask two separate questions:

  1. Was the notice issued within the period allowed for that section and tax year?
  2. After a valid notice, was the assessment or reassessment completed within the separate period allowed for making the order?

Section 149 concerns the first question. Section 153 concerns the second. Extensions, exclusions and amendments can affect the completion calculation. A notice that was issued on time is not automatically followed by an order that is in time, and an order deadline does not cure a notice issued outside its own limitation period.

The 2025 Act’s completion period

For the 2025 Act, the Department says section 286(1), table entry 4, generally requires a reassessment order under section 279 within one year from the end of the financial year in which the section 280 notice was served. The same explanation describes extensions and exclusions. This is an order-completion period; it is not a universal deadline for issuing every notice.

6. Compare the dates in a defensible sequence

Once the section and governing Act are identified, build a chronology rather than counting casually from the date printed on the PDF.

  1. Identify the relevant tax period. Write the assessment year under the 1961 Act or the tax year under the 2025 Act.
  2. Locate the statutory trigger. Determine whether the applicable provision counts from issue, service, the end of a financial year or another legally defined event.
  3. Record issue and service separately. Keep the notice date, portal upload date, email timestamp and physical delivery evidence in different columns.
  4. Check the law in force for that period. Read the applicable version, amendment and transition clause rather than relying on a current summary that may describe another year.
  5. Check prerequisites. Look for the required preliminary communication, approval, sanction and reasons or information referred to by the relevant section.
  6. Apply exclusions and extensions. Note any statutory exclusion, court-related period or other extension that the applicable text recognizes; do not assume that every delay is excluded.
  7. Compare the resulting last permissible date with the actual event. Keep the calculation and source text with the notice file.

If a date is close, disputed or dependent on an exception, do not make a final “out of time” assertion from a calendar count alone. Have the actual notice and chronology reviewed by an Indian chartered accountant or tax lawyer.

7. Distinguish the notice’s response date from its legal authority

Even while checking limitation, comply with an immediate response instruction unless a qualified adviser tells you a different lawful course. A response date printed in the notice tells you when the Department expects information, documents or a reply. It does not, by itself, prove that the notice was issued within the section 149 period or that the officer had authority under the relevant procedure.

If you believe the notice is defective or late, preserve the objection in the response or through the appropriate legal channel instead of simply deleting the message. Silence can create avoidable consequences even where a limitation objection may ultimately be available.

8. Use this working checklist

  • Download the notice from the official e-Filing account, if available.
  • Save the original email, physical envelope, portal delivery record and OTP-authentication result.
  • Write down the DIN and verify it through the pre-login authentication service.
  • Record the PAN, document type, issue date, assessment year or tax year and statutory section.
  • Record the exact service date and method, not just the date shown in the header.
  • Collect earlier show-cause notices, replies, approvals, orders and acknowledgements.
  • Determine whether the 1961 Act or 2025 Act applies, including the pending-proceeding transition.
  • Read the limitation and completion provisions that match the section and tax period.
  • Mark the printed response date separately from any statutory issue or completion deadline.
  • Seek prompt professional review if the deadline is near, the DIN is missing, the portal result conflicts with the document, or the chronology crosses 1 April 2026.

Common mistakes and how to avoid them

Assuming a genuine PDF is automatically lawful

Authentication establishes that the Department recognizes the communication. It does not replace a section-by-section review of authority, approval, service and limitation.

Using the receipt date as the only date

A notice may display an issue date, arrive by email on another date and appear in the portal at a third time. Preserve all three and identify which event the applicable provision uses.

Applying one deadline to every notice

Reassessment, completion of reassessment and other proceedings follow different statutory routes. Start with the cited section and tax period.

Choosing the new Act because the message arrived after 1 April 2026

The 2025 Act applies to Tax Year 2026–27 onward, while relevant pre-1 April 2026 tax years and pending 1961 Act proceedings remain governed by the transition rules described by the Department.

Treating “no record” as proof that the notice is out of time

A no-record result can reflect an incorrect PAN, date, year, document type or DIN. Recheck the inputs and use official Department channels before drawing a legal conclusion.

When professional advice is warranted

Get an Indian chartered accountant or tax lawyer to examine the actual file promptly when the notice concerns reassessment, a large demand, a missing or disputed DIN, an approval question, service at the edge of a limitation period, or proceedings that cross the 2026 Act transition. Give the adviser the notice, authentication result, delivery evidence and complete chronology. A general online deadline cannot substitute for that fact-specific review.
