How to Check Whether an AI-Driven Mortgage Decision Used Inaccurate Information

Start with the lender’s written adverse-action notice. Ask for the specific principal reasons for the decision, then test each reason against your application, supporting records, credit reports, and any property valuation. If a credit report contains an error, dispute the entry with both the credit reporting company and the company that furnished it. If the property value appears wrong, request the appraisal or other written valuation and use the lender’s valuation-review process. Keep a complete paper trail and file a Consumer Financial Protection Bureau complaint if an apparent error is not corrected.

This guide is for U.S. mortgage applicants. “AI-driven” can mean an underwriting model, a credit-scoring system, or an automated home-valuation model. Those systems create different evidence and correction paths.

What you are entitled to learn after a mortgage denial

A lender cannot replace an explanation with “the algorithm said no.” The Consumer Financial Protection Bureau’s Circular 2022-03 states: “The adverse action notice requirements of ECOA and Regulation B, however, apply equally to all credit decisions, regardless of the technology used to make them.” In practical terms, a lender that takes adverse action must provide the specific principal reasons for that action, even when a complex or machine-learning system contributed to the decision.

The notice should let you identify what allegedly went wrong: for example, debt obligations, income, employment, payment history, credit utilization, assets, a property-value issue, or missing information. A generic statement that you failed to satisfy internal policy is not a useful substitute for the specific reasons described by the CFPB. You can ask the lender to identify the data item behind each reason and the source and date of an unexpected value.

That right to reasons does not automatically give you the model’s source code, a complete list of internal features, or proof that artificial intelligence was used in your individual file. Public guidance generally cannot establish which model a particular lender used, what inputs it received, or whether correcting one input would have changed your result. Your case file, the lender’s records, and the records of outside data providers are needed to answer those questions.

First, preserve the decision record

Before disputing anything, assemble one dated file. Save electronic notices as well as paper copies; online portals can replace or remove documents.

  • The complete adverse-action notice, including any attachments and credit-score disclosure.
  • The mortgage application exactly as submitted, plus every version you signed or electronically certified.
  • Requests from the lender for additional information and everything you supplied in response.
  • Any counteroffer, conditional approval, incomplete-application notice, or revised terms.
  • Pay statements, tax records, bank and investment statements, debt statements, and records supporting employment and assets.
  • Communications with loan officers, processors, underwriters, brokers, appraisers, and valuation-review staff.
  • The dates of the application, decision, follow-up calls, disputes, and replies.

CFPB sample forms include residential mortgage applications, notices of action taken, credit-score notices, counteroffers, and incomplete-application notices. Use the document you received, not a recollection of a telephone conversation, as the starting point.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 1: Ask for specific reasons and the underlying data

Send a written request even if the notice lists reasons. Written communication creates a record and lets you ask about a particular field rather than arguing generally about “AI.” Request:

  1. Each specific principal reason for the adverse action, in plain language.
  2. The data item or calculation supporting each reason—for example, the balance, monthly payment, income amount, employment status, utilization percentage, property value, or missing document.
  3. The source and date of any value you do not recognize.
  4. Whether the item came from your application, a lender-held record, a consumer report, a credit score, or a property valuation.
  5. Instructions for submitting corrected information and requesting reconsideration.

You can write: “Please identify the specific principal reasons for the adverse action and, for each reason, the underlying data field, source, and date used in my application. I dispute the items identified below and request correction and reconsideration.” Attach a short list of disputed facts and the documents that support them.

A request for an explanation is different from a request for proprietary model details. Ask for the facts used in your file and how they relate to the stated reason; do not assume that the lender must disclose source code or every internal model feature.

Step 2: Match each reason to the right evidence path

Separate the possible error sources. A lender-held application error, a credit-file error, and a valuation error are corrected by different organizations.

Possible source Fields to check Useful proof Who can correct it
Your application or lender records Income, employment, debts, assets, occupancy, loan amount, requested term, or missing documents Signed application, pay statements, tax records, bank statements, debt statements, and delivery records The lender; request correction and reconsideration in writing
Credit reporting company or furnisher Accounts that are not yours, balances, payment history, account status, dates, duplicate debts, or identity mix-ups Current credit report, account statements, identity documents, and payment records Dispute with the credit reporting company and the company that supplied the information
Credit score or scoring inputs Incorrect report data, utilization, payment history, or another factor identified in the score notice Score disclosure, credit report, and records supporting the disputed field Correct the underlying report data; ask the lender how the corrected information will be reconsidered
Property appraisal or other written valuation Property characteristics, condition, square footage, location, comparable sales, or omitted improvements Appraisal or valuation report, listing information, repair records, and comparable-sale documentation Use the lender’s appraisal or valuation-review process; the appraiser or valuation provider may need to address factual errors

The notice that a credit report was used does not, by itself, tell you why the application failed. The adverse-action reasons and the credit-reporting-company disclosure answer different questions.

Step 3: Examine the application and lender-held records

Check income and employment

Compare the income figure and frequency used by the lender with the pay statements, tax records, and other documents you supplied. Look for a misplaced decimal, an annual amount treated as monthly income, omitted variable income, a wrong employment start date, or an employer record attached to the wrong applicant. If your income changed during underwriting, distinguish the amount you reported at application from a later amount and ask which date the lender used.

Check debts and monthly obligations

List every debt on the application and compare the balances and monthly payments with current statements. A paid-off account, a duplicate account, a co-signed obligation that is no longer your responsibility, or a payment reported at the wrong amount can change the lender’s calculations. Ask for the debt amount and payment figure used, not merely the label “high debt.”

Check assets and missing information

Review account numbers, balances, ownership, and dates on bank and investment statements. If the notice refers to insufficient assets or missing documentation, identify the exact document the lender says was absent and show when and how you supplied it. Keep portal upload confirmations and email attachments.

Check the calculation, not just the label

Terms such as “income insufficient,” “debt-to-income,” or “insufficient reserves” describe a conclusion, not necessarily the underlying mistake. Ask which numerator, denominator, balance, payment, or reserve amount produced the conclusion. You may not receive the lender’s entire underwriting formula, but you can request the case-specific inputs that you can verify.

Step 4: Obtain and audit the credit report

If the lender denied credit based on a credit report, the adverse-action notice must identify the reporting company. CFPB consumer guidance says you can request a free report from that company within 60 days of the adverse-action notice. Use the reporting company named in the notice and retain the request confirmation and the report you receive.

Review every section, not only the score:

  • Accounts belonging to someone else or accounts created through identity theft.
  • Balances, credit limits, or utilization figures that are wrong.
  • Late payments, defaults, or account statuses that do not match your records.
  • Duplicate accounts, accounts shown as open after closure, or incorrect dates.
  • Names, addresses, or identifying information that could mix your file with another consumer’s.
  • Collections or public-record information that is incomplete or inaccurately attributed.

Circle the exact field, account number, and date. Gather statements, payment confirmations, identity-theft reports, or creditor letters that prove the correction. A general statement that the report is “wrong” is harder to investigate than a specific claim such as “the account was paid and closed on this date, but the report shows an outstanding balance.”

Step 5: Dispute inaccurate credit information twice

For an inaccurate credit-report entry, submit a dispute to both the credit reporting company and the company that furnished the information. The CFPB identifies both channels. Follow each recipient’s submission instructions, state the exact field in dispute, explain why it is inaccurate, and attach legible supporting documents. Keep copies of everything and proof of delivery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not send original documents. Redact unnecessary account numbers and other sensitive information while leaving enough detail to identify the account. If the same error appears in more than one reporting company’s file, dispute it separately with each company.

After the investigation, save the response and the updated report. If the item remains unchanged, compare the response with the evidence you submitted and ask the lender whether it will reconsider using corrected or newly documented information. A correction by a reporting company does not automatically reopen a mortgage application; request that action explicitly.

Step 6: Investigate property-value problems separately

A home-value issue is not the same as a credit-underwriting issue. If the decision refers to collateral value, loan-to-value, appraisal, or an automated valuation, ask for the appraisal or other written valuation and the lender’s instructions for requesting a review.

Look for factual errors

  • Wrong square footage, room count, lot size, construction year, or property type.
  • Missing renovations, finished space, energy improvements, accessory units, or material condition details.
  • Comparable sales that are not genuinely comparable because of location, timing, size, condition, or market segment.
  • Incorrect address, neighborhood, flood-zone information, or other property identifiers.

Support each objection with a listing, permit, assessor record, repair invoice, photograph, survey, or comparable-sale information. Ask the lender how to submit a reconsideration of value and whether a corrected report will be sent to underwriting. CFPB materials address appraisal and written-valuation rules and quality controls for automated valuation models, but they do not make every valuation disagreement an automatic error.

Step 7: Send a focused correction and reconsideration request

Once you have evidence, send the lender one organized package. Put the decision date and loan identifier on every page.

  1. Quote or paraphrase each stated adverse-action reason.
  2. For each reason, identify the disputed field and the correct value.
  3. Explain the source of the correct value and attach the supporting page.
  4. Ask the lender to correct its records, tell you whether it used an outside provider, and reconsider the decision using the corrected information.
  5. Ask for a written response and keep the delivery confirmation.

Keep credit-report disputes separate enough that the reporting company and furnisher can process them. Tell the lender that a parallel dispute is pending, but do not assume that notifying the lender satisfies the separate reporting dispute.

How the legal disclosures fit together

ECOA and Regulation B address the lender’s adverse-action explanation: the specific principal reasons for the decision. Fair-credit-reporting requirements address the use of outside consumer-report information, including identifying the reporting company and, where applicable, providing credit-score information and the right to obtain a report. These are complementary disclosures, not interchangeable ones.

For example, “Your application was denied based on information from [reporting company]” identifies a source, but it does not necessarily state the specific reason, such as a particular delinquency, balance, or account status. Ask for both: the reporting company and the principal reason tied to the decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Current Regulation B provisions changed in 2026. If you believe the decision involved discrimination, verify the current official rule and the law in your state or locality before relying on a specific theory, deadline, or remedy. CFPB guidance recommends checking local protections and provides a complaint route. The general fact that a lender used an automated system does not, by itself, prove discrimination or an unlawful decision.

What to do when the lender will not explain or fix the issue

Escalate inside the lender first

Ask for the lender’s compliance, customer-advocacy, or reconsideration channel if the loan officer cannot answer. Send the same concise evidence package and identify the unanswered question. Avoid changing several facts at once without labeling them; a reviewer needs to know which correction addresses which reason.

File a CFPB complaint

If the lender or credit-reporting process does not resolve an apparent error, submit a complaint to the Consumer Financial Protection Bureau. Include the adverse-action notice, your written requests, relevant reports, dispute results, supporting records, and a short chronology. Remove unnecessary sensitive information and retain the confirmation number and all responses.

Get housing-counseling help when the file is complex

CFPB mortgage resources include a housing-counselor locator. A counselor can help organize documents, interpret the notice, and prepare questions. Counseling does not replace a dispute with a credit reporting company, furnisher, lender, or valuation provider, and it cannot guarantee approval.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common mistakes that weaken an accuracy challenge

  • Arguing about “AI” instead of identifying a fact. The actionable issue is the wrong balance, date, status, income, employment record, property feature, or missing document.
  • Requesting only the model’s code. A request for proprietary technology may distract from the case-specific data that can be verified.
  • Disputing only with the lender. A credit-report error should also be disputed with the reporting company and furnisher.
  • Sending a long narrative without a field-by-field list. Use a table or numbered list linking each error to a document.
  • Failing to preserve the original report. Reports can change after an update; save the version used for the decision.
  • Assuming a corrected report automatically reopens the loan. Request reconsideration explicitly and ask for the lender’s written response.
  • Treating valuation and credit errors as one dispute. Use the lender’s appraisal or written-valuation process for property facts.
  • Relying on an old discrimination summary. Confirm the 2026 Regulation B text and applicable state or local protections.

A compact checklist

  1. Save the adverse-action notice, application, attachments, and decision date.
  2. Request specific principal reasons and the underlying data fields, sources, and dates.
  3. Classify each issue as lender-held data, credit-report data, scoring input, or property valuation.
  4. Obtain the named credit report within 60 days of the adverse-action notice if credit-report information was used.
  5. Dispute each inaccurate credit entry with both the reporting company and the furnisher.
  6. Request the appraisal or written valuation when collateral value is in question.
  7. Send the lender a documented correction and reconsideration request.
  8. Save delivery records, investigation results, corrected reports, and replies.
  9. File a CFPB complaint if the apparent error remains unresolved.
  10. Check current federal, state, and local law before asserting a discrimination claim or deadline.

Frequently Asked Questions

Does an adverse-action notice prove that artificial intelligence was used?

No. The notice must explain the specific principal reasons regardless of the technology used, but it generally does not establish whether a particular AI model made or influenced the decision.

Can I get the lender’s underwriting algorithm or source code?

The available CFPB guidance supports requesting the case-specific reasons and data behind them. It does not establish a general consumer right to the lender’s source code or complete internal feature list.

What if the credit report is corrected after the denial?

Send the corrected report and dispute result to the lender, request written reconsideration, and ask whether the application will be reopened or reevaluated.

Where should I report an unresolved mortgage-data problem?

After preserving your records and using the relevant lender or credit-report dispute process, you can submit a complaint to the Consumer Financial Protection Bureau.
