How to check whether a ticket resale listing follows DC’s markup rules

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: The District of Columbia’s RESALE Amendment Act is enacted, but its resale requirements apply on January 1, 2027. For a covered live event after that date, calculate the original ticket total (ticket price plus all fees and taxes paid at the initial purchase), multiply it by 1.10, and compare that ceiling with the resale ticket price. A secondary ticket exchange may charge a separate marketplace service fee of up to another 10% of the original ticket total. The District’s consumer-protection rules also require clear all-in pricing, itemized charges, original-price disclosure and seat information.

Before buying, establish whether the event is covered, preserve the original-price and fee disclosures, calculate the statutory ceiling, and compare it with the final checkout total. A missing original price, unexplained checkout increase, speculative-ticket language or pressure tactics is a reason to stop and save evidence.

When DC’s resale cap applies

D.C. Law 26-181, the Restricting Egregious Scalping Against Live Entertainment (RESALE) Amendment Act of 2026, adds Chapter 55 to the D.C. Code. The codified provision states that the resale requirements are applicable on January 1, 2027. Until that date, you should not describe the new 10% cap as an already-effective D.C. price limit. You can still use the disclosure and consumer-protection checks below to identify misleading listings and preserve a record for a complaint.

Events included

The chapter covers tickets for live concerts, theatrical performances, shows and similarly scheduled live activities. The practical question is where the covered event takes place and whether it fits the statute’s definition of a live activity. A ticket for a concert or play in the District is the typical example.

Events excluded

The definition excludes sporting events organized by a professional or intercollegiate sports team located in the District, and events of a professional athletic association held in the District. It also excludes motion-picture screenings. If your listing is for one of those excluded categories, do not apply the Chapter 55 resale formula as though it governed that ticket; look for the event’s other applicable rules instead.

The calculation: original total, 10% resale ceiling and marketplace fee

The law uses the amount paid at the initial purchase, not merely the face value printed on the ticket. Build the initial ticket total from the original ticket price plus every fee and tax connected with that initial purchase.

  1. Find the initial ticket total. Add the original ticket price, service or facility fees, taxes and any other mandatory amount charged in the initial transaction.
  2. Calculate the resale ticket-price ceiling. Multiply the initial ticket total by 1.10. This is the highest resale ticket price a reseller or secondary ticket exchange may charge under the 10% markup limit.
  3. Add a marketplace fee only if applicable. A secondary ticket exchange may charge a separate marketplace service fee of up to 10% of the initial ticket total.
  4. Compare the result with the disclosed all-in total. The listing and checkout must clearly show taxes and fees. A reasonable physical-ticket shipping charge may be added when appropriate, but it must be disclosed before final purchase; shipping that cannot yet be determined may be added later.

The Department of Licensing and Consumer Protection (DLCP) summarizes the two 10% allowances as a maximum total cost of 120% of the original ticket total, before any permitted reasonable physical-shipping charge. The resale-price cap and the separate marketplace-fee allowance are different parts of the calculation, so do not treat a platform fee as part of the seller’s 10% resale markup.

Worked example

Suppose the initial transaction was $100 in total: $85 for the ticket, $10 in mandatory fees and $5 in tax. The resale ticket-price ceiling is $100 × 1.10 = $110. If the ticket is offered through a secondary exchange, that exchange could charge a separate marketplace service fee of up to $10 (10% of the $100 initial total). The maximum before any permitted reasonable physical-shipping charge would therefore be $120. Any tax and fee lines must be visible before you complete the purchase.

Why face value alone gives the wrong answer

If you compare a resale price with the printed face value, you may overstate or understate the permitted amount. For example, a $100 face-value ticket that originally carried $20 in fees and taxes has an initial total of $120. The 10% resale-price ceiling is then $132, not $110. The exchange’s separate marketplace-fee allowance, if used, is another $12, producing a 120% all-in ceiling of $144 before permitted physical shipping. The original receipt or order confirmation is the best evidence of the correct base.

How to check a listing step by step

1. Confirm the event and date

Record the event name, venue, District location and performance date. Confirm that it is a concert, theatrical performance, show or similar live activity rather than a motion-picture screening or an excluded professional or intercollegiate sporting event. The effective date matters: apply the statutory cap to covered resale transactions on or after January 1, 2027.

2. Capture the first price display

Take a screenshot of the listing before clicking through. Include the ticket price, event date, venue, seat information, seller or exchange name and any visible fee language. If the platform offers an “all-in” or “total price” setting, capture that view as well as the default display. Keep the date and time in your notes because prices and inventory can change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Locate the original purchase price

After January 1, 2027, the secondary exchange must disclose the original purchase price, including all initial fees and taxes. Look for a line such as “original price,” “initial ticket total” or an equivalent disclosure. Do not substitute a face-value figure when the listing is supposed to show the complete initial total. If the original total is absent, ask the platform for it in writing and preserve the response; an absent disclosure is a compliance warning even before you decide whether the arithmetic is favorable.

4. Rebuild the initial total

Write down each component of the original transaction: ticket price, service fees, facility or delivery fees, taxes and other mandatory charges. Add them once. Optional products that were not required to obtain the ticket should not be silently treated as part of the original ticket total. If the seller supplies only a rounded figure, retain the underlying receipt or order confirmation if available.

5. Apply the 10% formula

Multiply the initial total by 1.10. For quick checking, move the decimal one place to find 10% and add it to the initial total. Keep the result separate from the marketplace-fee allowance. A $240 initial total produces a $264 resale ticket-price ceiling and, if a secondary exchange charges its full marketplace allowance, a further $24 fee. The resulting $288 is the DLCP-described 120% maximum before permitted physical shipping.

6. Audit every fee line

At the listing and checkout stages, identify each mandatory amount: seller price, marketplace service fee, taxes, delivery or shipping and any other charge. The law requires clear and conspicuous disclosure of the total ticket price, including fees and taxes, and itemization of every charge. A physical-ticket shipping charge must be reasonable and disclosed before final purchase. If the amount changes without an explanation, save both screens and do not assume the difference is lawful.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Check seat and ticket details

When applicable, the listing must show the seat number, zone and section. Compare those details with the event venue’s seating map or the ticket document. Vague descriptions such as “great view” do not replace the required seat information. Save the exact row, seat, zone and section shown, especially when two listings appear to be for different locations at similar prices.

8. Check the seller, licensing and possession

Before a resale or offer to resell, a secondary exchange must verify that the reseller meets D.C. licensing and bonding requirements and disclose the original purchase price. Look for the seller or exchange identity and any licensing or bonding information supplied with the listing. The chapter also prohibits speculative tickets: a reseller may not list, sell, resell or advertise a ticket that is not in the reseller’s actual or constructive possession. Statements that the seller will “obtain” the ticket later, transfer it only if another buyer cancels, or has no ticket number yet can indicate speculation. Ask for proof of possession before paying.

9. Recheck the final total before paying

Do not rely on the first price shown. At the last purchase screen, compare the displayed all-in total with your calculation and the saved listing. Confirm that the seat details, delivery method and refund or cancellation terms have not changed. If the checkout total exceeds the applicable ceiling, or a mandatory charge appears only at the end, stop and preserve the evidence.

What counts as a warning sign

  • No original-price disclosure: You cannot independently calculate the 10% cap when the initial ticket total is hidden.
  • A checkout jump: The mandatory total is higher than the listing view, with no clear explanation for the difference.
  • An over-cap total after the effective date: The resale ticket price exceeds 110% of the initial total, or the all-in amount exceeds the 120% calculation after accounting for a separate marketplace fee and any permitted physical shipping.
  • Unitemized charges: A single “service” or “processing” amount conceals the components required to evaluate the transaction.
  • Missing seat information: The listing omits the seat number, zone or section when those details are applicable.
  • Speculative language: The seller does not have the ticket in actual or constructive possession at the time of listing or sale.
  • Pressure tactics: A countdown, “buy immediately” warning or similar device encourages payment before you can review the all-in price and terms.

Hidden mandatory fees and artificial urgency have already drawn enforcement attention in the District. The Attorney General’s 2026 announcement concerning a $9.9 million payment by a major live-event company described mandatory fees hidden until checkout from 2015 through May 2025 and noted that the company implemented all-in pricing in 2025 after the investigation. Those facts do not by themselves establish that every current listing violates the 2027 markup cap, but they show why a price that appears low until the final screen deserves scrutiny.

Why the price can jump at checkout

A price increase usually comes from a fee that was not shown in the initial display, a change in delivery method, taxes calculated later, or a marketplace fee applied only at checkout. The statute permits shipping that cannot yet be determined to be added later, but a reasonable physical-shipping charge must be disclosed before final purchase. That limited exception is different from revealing a previously mandatory service fee at the last step.

Use a two-column note while checking out: copy the amount and label shown on the listing screen, then copy the amount and label at checkout. Add the differences. If a new mandatory fee appears, capture the screen before leaving. A countdown does not waive the disclosure requirements, and you should not let urgency prevent you from checking the original total and statutory ceiling.

How to compare two resale listings

The cheapest headline price is not necessarily the cheaper or safer purchase. Compare both listings using the same initial-ticket base and the same final-total standard.

Comparison point What to record Why it matters
Original ticket total Original ticket price plus all initial fees and taxes This is the base for the 10% resale-price calculation and the possible marketplace-fee allowance.
Resale markup Resale ticket price minus the original total, expressed as a percentage After January 1, 2027, the resale ticket price may not exceed 110% of the initial total for a covered event.
Marketplace and delivery fees Each fee, its label and when it appears A secondary exchange’s marketplace fee may be up to 10% of the initial total; physical shipping must be reasonable and disclosed before final purchase.
All-in visibility Whether the complete total, including taxes and fees, is visible before payment Late mandatory charges can make a seemingly cheaper listing more expensive and may signal drip pricing.
Seat and section Seat number, zone and section, when applicable Two prices are not comparable if the locations differ or the listing omits required details.
Refund and cancellation terms Terms shown before purchase A lower price may carry materially different risk if the ticket is canceled, invalid or undeliverable.
Seller identity and licensing information Seller or exchange name, licensing and bonding disclosures The exchange must verify reseller licensing and bonding before resale or an offer to resell.

What to screenshot and save

Create one evidence folder for each disputed listing. Save the following before paying or closing the page:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The event name, venue, date and listing URL as displayed in your browser.
  • The first price screen, including any “all-in” toggle or fee disclosure.
  • The disclosed original ticket price and every initial fee and tax used in the calculation.
  • The seat number, zone, section, row and ticket quantity, when applicable.
  • The seller or exchange identity and any licensing or bonding information.
  • Every checkout screen showing taxes, marketplace fees, delivery or shipping and the final total.
  • Any message or wording indicating that the seller does not yet possess the ticket.
  • The date and time of each screenshot, plus your arithmetic showing the 110% and, where relevant, 120% limits.

Keep the original files rather than relying only on cropped images. A complete sequence makes it easier to show whether a mandatory fee was visible before the final purchase decision.

What to do when a listing appears noncompliant

Before purchase

  1. Pause the transaction and do not rely on a countdown.
  2. Ask the exchange to identify the original ticket total, every mandatory fee and the seller’s licensing or bonding status.
  3. Request confirmation that the seller has the ticket in actual or constructive possession.
  4. Save the listing and checkout evidence before inventory or prices change.
  5. Choose another listing only after comparing its complete all-in price and seat details.

After purchase

  1. Save the receipt, ticket delivery record and all listing screenshots.
  2. Compare the amount charged with the original-total calculation and the disclosures shown before payment.
  3. Contact the exchange in writing, identify the unexplained fee or missing disclosure, and keep the response.
  4. If the issue concerns deceptive pricing, hidden mandatory fees, speculative tickets or a post-effective-date markup above the statutory limit, consider reporting it to the appropriate District consumer-protection authority, including the Office of the Attorney General or DLCP.

Do not delete the listing after receiving a refund or adjustment. The original and corrected records can establish what a consumer saw and when.

Answers to the practical DC questions

Is this ticket resale price legal in DC?

You can answer that only after checking whether the event is covered, whether the transaction occurs on or after January 1, 2027, the disclosed initial ticket total and the final itemized charges. For a covered post-effective-date resale, the ticket price must be no more than 110% of the initial total; a secondary exchange may add a separate marketplace fee of up to another 10% of that initial total.

How much can a ticket reseller mark up a ticket in Washington, DC?

For covered events under the law’s effective date, the resale ticket price may be up to 10% above the original ticket total. The original total includes initial fees and taxes, so it is not necessarily the printed face value. The exchange’s separate marketplace-fee allowance can bring the DLCP-described maximum total cost to 120% before permitted reasonable physical shipping.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does the 10% cap include fees and taxes?

The base used for the cap includes all fees and taxes from the initial purchase. The listing and each transaction step must also disclose the resale total, fees and taxes clearly and itemize every charge. Treat the all-in checkout amount as the number to test against the applicable 120% calculation, while keeping the resale ticket price and the marketplace service fee as separate lines in your worksheet.

How do I calculate the original ticket price?

Add the original ticket price to every mandatory fee and tax charged in the initial transaction. Use the receipt or order confirmation whenever possible. Then multiply that complete initial total by 1.10 for the resale ticket-price ceiling and by 1.20 when checking the DLCP-described maximum total with a full marketplace-fee allowance.

Why did the price jump at checkout?

The difference may be a fee, tax or delivery charge that was not displayed earlier. A reasonable physical-shipping charge may be added when it could not yet be determined, but it must be disclosed before final purchase. A mandatory fee that appears only after several screens is a drip-pricing warning; save both displays and ask the exchange to explain the change.

What should I screenshot before buying a resale ticket?

Save the first listing, original-price disclosure, all fee lines, seat details, seller or exchange identity, licensing or bonding information, every checkout screen and the final total. Add the date and time and your 110% and 120% calculations. Those records preserve the evidence needed to compare the offer with the D.C. requirements.
