Then ask the appropriate state regulator whether that entity is authorized for the specific loan activity, independently verify any claimed bank or SBA connection, reject advance-fee and high-pressure tactics, and compare the complete written contract before sharing sensitive data or signing. This guidance is U.S.-specific: the right license and regulator depend on the lender’s business model and your state.
A registration record is only one due-diligence step. It does not prove that pricing is fair, that the loan suits your cash flow, or that the company will treat you honestly. Use several independent checks and obtain advice from someone who is not affiliated with the lender.

1. Identify the business that is actually offering the financing
Do not begin with a logo, a search result, or a sales representative’s name. Ask for the company’s complete legal name, every trade name it uses, its physical or mailing address, telephone number, website, and the states in which it makes or brokers loans. Write these details down exactly as they appear on the application and proposed contract.
Determine the company’s role
Find out whether you are dealing with a direct lender, a broker, a lead generator, or another intermediary. A broker may send your application to several lenders; a lead generator may collect and sell applicant information without making loans itself. The entity receiving your tax identification number, bank statements, or online-banking credentials should be identified before you submit anything.

Ask these questions in writing:
- Which legal entity will fund the loan?
- Which entity will service it and receive your payments?
- Will your application or contact information be shared or sold to other companies?
- What privacy notice and secure upload method apply?
- Which state law and license cover this product?
The Federal Trade Commission warns that some companies that appear to offer financing instead sell applicant information or seek identity data. It also cautions, “Don’t just type in ‘small business loan’ and assume that the search results and rankings can tell you anything about those companies.” Read the FTC’s guidance on evaluating online financing providers at Back to business #3: Looking for small business financing?.
Do not send sensitive information during the identification stage
Until you know who receives the information and why, do not upload a driver’s license, Social Security number, employer-identification number, full bank login, tax return, or complete financial statements. A legitimate provider should be able to explain its identity, role, data handling, and secure submission process before asking for documents.
2. Check authorization with the right state authority
The FTC states, “Lenders must register where they do business.” Contact the state attorney general or the state banking or financial-services regulator and provide the lender’s exact legal name, address, website, and any license number it supplied. Ask whether the entity is authorized for the specific activity and product, not merely whether its name appears somewhere in a database. The FTC’s registration and advance-fee guidance is at What To Know About Advance-Fee Loans.

States classify providers differently. A bank, commercial-financing company, broker, mortgage originator, and short-term lender may follow different laws and use different licensing systems. Some institutions may be supervised under a separate banking charter, while a broker or nonbank lender may need a state license or registration. No source establishes one national registry covering every small-business lender.
Ask the regulator:
- Which office and statute apply to this lender and this product?
- Is the entity authorized to lend, broker, or service loans in your state?
- Does the license cover commercial-purpose borrowing, or only consumer lending?
- Are there public enforcement actions, disciplinary orders, or restrictions?
- Is the address and legal name on the company’s contract the same as the regulated entity?
A matching record is evidence that the entity is recognized for a defined activity. It is not a guarantee of honest conduct, affordable pricing, successful repayment, or suitability for your business.
Use specialized databases only when they fit the product
The Consumer Financial Protection Bureau describes NMLS Consumer Access as a free lookup for mortgage financial-services companies and professionals. That is mortgage-specific guidance, not a universal registry for business loans. CFPB’s payday-lender licensing guidance likewise directs consumers to state regulators and notes that rules differ. For a business loan, ask your regulator which lookup applies rather than assuming NMLS or any other database is definitive.

3. Independently verify claimed SBA, bank, or institutional connections
Scammers can copy a bank’s or government agency’s name, logo, caller ID, and documents. If a caller or email claims to represent the Small Business Administration, a bank, or another institution, end the contact and navigate to that organization’s official website yourself. Use the phone number or web address published there, not the details in an unsolicited message.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
The SBA says official SBA communications use addresses ending in @sba.gov, warns about lookalike domains, and recommends matching any emailed application number with your own records. It also says applying through SBA or an approved lender is free; an intermediary cannot charge you for access to an SBA loan. Read SBA’s fraud-protection guidance and confirm the contact through an independently sourced channel.
Check the claim, not just the email domain
An address that looks official is only one clue. Call the institution using its published number and ask whether the person, application number, and lender relationship are real. Do not click a link supplied in an unexpected message until you have independently confirmed the sender. Request a written explanation of the institution’s role and the exact legal entity that will appear in the contract.
4. Treat these signals as reasons to stop and verify
One unusual feature does not automatically prove fraud. A real lender may charge an application or appraisal fee before deciding on an application. The critical distinction is whether money is represented as guaranteeing approval or funding, and whether the payment request is combined with pressure, secrecy, or untraceable payment methods.
| Signal | Why it matters | What to do |
|---|---|---|
| Guaranteed approval before reviewing credit, cash flow, or repayment ability | Legitimate underwriting evaluates whether the business can repay. A guarantee paired with an upfront charge is a classic advance-fee warning. | Do not pay to secure the guarantee. Verify the company with the regulator and request the complete terms. |
| A fee said to guarantee funding, especially after an “approval” message | Application or appraisal fees can exist, but payment cannot legitimately guarantee approval or disbursement. | Ask exactly what the fee covers, whether it is refundable, and why it is required. Verify independently before paying. |
| Money demanded before proceeds for “insurance,” “processing,” or “paperwork” | These are common explanations in advance-fee schemes. | Stop the transaction and contact the lender through a verified phone number or website. |
| Pressure to decide immediately or refusal to allow questions | Urgency can prevent you from checking registration and comparing terms. | Slow down and require answers and the full contract in writing. |
| Instructions to pay by wire, cryptocurrency, gift card, prepaid card, or payment app | These methods can make recovery difficult and are identified by CFPB as fraud warning signs. | Do not transfer funds until the payee and purpose are confirmed through an independent channel. |
| Unsolicited message claiming to be SBA or a lender | Impersonators use copied names and logos to obtain money or sensitive information. | Go to the official website yourself, confirm the application details, and check the sender’s domain. |
| Requests for extensive financial data before the provider is identified | The apparent lender may sell leads, or a fraudster may be collecting information for identity theft. | Establish the legal entity, role, privacy terms, and secure upload route first. |

5. Review the complete written offer before signing
A company can be genuine and registered yet offer financing that is too expensive or risky for your business. Do not rely on a verbal quote, a one-page “approval” notice, or a payment estimate that omits fees. Obtain the full agreement, all schedules, security documents, and any broker or servicing disclosures. Ask the provider to explain unclear language in writing.

Use this term-by-term comparison checklist
| Term to record | Question to answer before commitment |
|---|---|
| Rate and cost measure | Is the interest rate or other cost measure clearly defined? If the product uses a factor rate, daily repayment, or another structure rather than a conventional APR, can you calculate the dollar cost? |
| Fees | What are the origination, underwriting, application, appraisal, servicing, broker, late, and other charges? Which are paid upfront and which are deducted from proceeds? |
| Total repayment | How much will the business repay in total, assuming every payment is made on schedule? |
| Payment amount and frequency | Are payments daily, weekly, or monthly? Does the schedule match predictable business cash flow, and can variable payments increase? |
| Term and maturity | When does the obligation end, and are there renewal or automatic-extension provisions? |
| Collateral | Which business or personal assets secure the debt? What happens after a default? |
| Personal guarantee | Are you personally liable if the business cannot pay? FTC recommends understanding the guarantee and the consequences of missed payments. |
| Prepayment | Is there a penalty, minimum-interest charge, or rebate if you repay early? |
| Grace periods and late payments | How long is the grace period, what fees apply, and when can the lender report or pursue a default? |
| Acceleration or demand clause | Can the lender demand the entire outstanding balance immediately, and what events trigger that right? |
| Data use and servicing | Who stores your information, who can receive it, and where should payment or hardship questions be directed? |
SBA advises borrowers to ask about rates, minimum credit-score and cash-flow requirements, prepayment penalties, grace periods, and when full repayment may be demanded. Its guidance also supports comparing lenders rather than accepting the first offer. FTC’s financing guidance emphasizes written terms, personal guarantees, and the consequences of missed payments. Ask a trusted accountant, attorney, or financial counselor who has no connection to the lender to review unfamiliar provisions.
6. Use SBA Lender Match as a source of contacts, not proof of legitimacy
SBA Lender Match can connect a business with potential lenders interested in its request. SBA says it is not a loan application and does not guarantee that you will be matched or offered a loan: “No, using Lender Match doesn’t guarantee that you’ll get matched or be offered a loan.” Participating lenders offer SBA-approved loans, and many also offer conventional loans, so you still must identify the entity and the product you are being offered.
The SBA page displayed more than 800 participating lenders across the 50 states and U.S. territories when accessed in 2026; that count can change and should not be treated as a permanent statistic. A match is an introduction, not a regulatory check, approval, endorsement of pricing, or substitute for reading the contract.
7. Compare multiple legitimate options on the same worksheet
Once two or more providers pass the identity and authorization checks, compare them side by side. Use the same requested amount and repayment assumption so a low payment does not hide a longer or more expensive term. Record the provider’s legal entity, whether it is the lender or a broker, the applicable state authorization, the rate or other cost measure, every fee, net proceeds after deductions, total repayment, payment amount and frequency, maturity date, collateral, personal guarantee, prepayment treatment, grace period, default fees, acceleration rights, and data-sharing policy.
Also record practical underwriting requirements: minimum credit score, time in business, required cash flow, documents requested, and how quickly the lender says it can fund. SBA Lender Match specifically suggests asking about rates, minimum credit score, cash-flow requirements, prepayment penalties, grace periods, and when full repayment can be demanded. Those questions help expose differences that an advertised payment or “starting rate” will not show.
A legitimate offer is not automatically a suitable offer. A daily-payment product may strain a seasonal business even when the total cost is disclosed; a personal guarantee may put household assets at risk; and a broker’s fee may be payable in addition to the lender’s charges. Have an independent adviser check your calculations and explain unfamiliar provisions before you choose.

8. Make a documented decision
Keep a file containing the legal name and address, license information, copies of all messages, the offer and disclosures, payment instructions, and your notes from regulator or institution calls. For each provider, record the same cost, payment, security, guarantee, data-use, and default terms so differences are visible. If a representative will not provide a complete agreement or written answers, remove that provider from consideration.
When to walk away
- The company will not disclose the legal entity that funds or services the loan.
- The state regulator cannot identify the required authorization, or the company refuses to provide information needed for a check.
- An alleged SBA or bank representative cannot be confirmed through an official channel.
- A fee is described as guaranteeing approval or release of funds.
- You are pushed to use an unusual payment method or surrender sensitive data before identity is established.
- The contract contains an acceleration, guarantee, collateral, or cost provision the provider will not explain.
9. Report suspected fraud and protect your accounts
The FTC asks people affected by an advance-fee loan scam, or people with information about one, to report it at ReportFraud.ftc.gov. FTC business-financing guidance also recommends reporting questionable practices. Preserve messages, caller details, applications, contracts, receipts, payment instructions, and every legal name used.
If you have sent money, bank credentials, tax identifiers, or identity documents, contact the relevant financial institution through its official channel immediately. Ask what account-protection, recall, or fraud-monitoring steps are available, change compromised passwords, and ask your state regulator about additional reporting requirements. Do not continue communicating through the suspicious sender’s links or phone numbers while investigating.
10. A short verification worksheet
Before applying, write the lender’s exact legal name, trade name, website, address, phone number, and claimed role at the top of a page. Note the states where it says it operates and the specific product offered. Then document which state office you contacted, the date, the person or department that responded, the authorization identified, and any enforcement information provided. Save a screenshot or PDF of the public record and the lender’s privacy notice.
For every email or call, note whether you initiated the contact, the address or number used, and the application number discussed. For an SBA claim, compare the number with your own records and confirm the contact through an address ending in @sba.gov or an official SBA phone number found independently. For a bank claim, call the number published on the bank’s own site or statement, not the number in the message.

Finally, attach the complete contract and a one-page cost summary. Highlight every upfront payment, deduction from proceeds, variable payment, personal guarantee, collateral grant, default trigger, and demand-for-repayment clause. This file gives an adviser or regulator something concrete to review and helps prevent a rushed decision based on changing verbal promises.

Frequently Asked Questions
Does a lender’s appearance in a state registry prove it is legitimate?
No. A registry match shows that an entity is recognized for a defined activity. It does not prove fair pricing, honest conduct, suitability, or successful repayment. Confirm the exact product and role with the relevant state authority, then review the written terms.
Is any upfront application or appraisal fee a scam?
Not necessarily. The FTC says a real lender may charge an application or appraisal fee before deciding on an application. The warning sign is a payment represented as guaranteeing approval or funding, especially when combined with urgency or unusual payment instructions. Ask what the fee covers, whether it is refundable, and obtain the explanation in writing.
Is NMLS the right place to check every business lender?
No. CFPB describes NMLS Consumer Access as a mortgage licensing lookup. State rules differ for commercial-financing companies, brokers, banks, payday lenders, and other products. Ask your state banking or financial-services regulator which law and database apply to the specific lender and loan.

SBA says applying through SBA or an approved lender is free. Independently verify any claimed SBA contact, check that an email uses the official @sba.gov domain, and match application numbers to your own records. Do not pay an intermediary merely for access to an SBA loan.
What should I do if a lender pressures me to pay by wire or cryptocurrency?
Stop and do not transfer funds. CFPB identifies wire, cryptocurrency, prepaid-card, gift-card, and payment-app instructions as warning signs, particularly when paired with urgency. Contact the lender or institution through a phone number or website you found independently and ask the state regulator to confirm the company and payment purpose.
What documents should I obtain before signing?
Request the complete loan agreement, all schedules, security documents, broker and servicing disclosures, fee schedule, privacy notice, and payment instructions. Confirm the rate or cost measure, total repayment, payment frequency, term, collateral, personal guarantee, prepayment rules, grace period, late consequences, and any acceleration or demand clause. Ask for unclear provisions to be explained in writing.
Does SBA Lender Match guarantee an approved loan?
No. SBA says Lender Match is not a loan application and does not guarantee a match or an offer. It is a source of potential lender contacts. You must still verify the legal entity, applicable authorization, data practices, and complete contract.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsWhere do I report an advance-fee loan scam?

If you sent money or identity information, contact your financial institution through its official channel immediately and ask the state regulator about additional reporting steps.
The Bottom Line
A legitimate-looking website is not enough. Identify the legal entity, confirm the correct state authorization, independently verify SBA or bank claims, reject guaranteed-approval and high-pressure payment demands, and compare the full written offer with independent advice. If the provider will not answer basic questions or document its terms, walk away.
