Do not rely on an “EU-hosted” badge. Ask the provider for its current Data Processing Agreement (DPA), named storage and processing countries, exact cloud-region identifiers, backup and failover locations, support-access locations, complete subprocessor list, deletion terms and safeguards for any processing outside the European Economic Area (EEA). Then confirm that each answer applies to your plan, tenant and enabled features.
EU residency is a scope question, not a marketing label. Primary databases may be in an EU region while backups, logs, telemetry, support tools or disaster-recovery copies are elsewhere. The checks below give you a documented way to verify what happens to your data.

What “stored in the EU” should mean
“Stored in the EU” normally describes where a provider keeps a copy of customer content at rest. That is only one part of the data path. A SaaS service may also collect account details, usage records, logs, diagnostics, analytics, support tickets and configuration data. Those categories can be processed by different systems and subprocessors in different countries.

EU, EEA and the location of processing
The European Union (EU) and European Economic Area (EEA) are not identical geographical concepts. Data-protection commitments are often written for the EEA, which includes the EU member states plus Iceland, Liechtenstein and Norway. Read the provider’s wording carefully: a promise limited to “EU data centers” may not cover every EEA operation, and a promise limited to “EU customer data” may exclude service metadata.

Residency is not the same as GDPR compliance
Keeping a database in an EU region does not, by itself, make a service GDPR-compliant. Compliance also depends on the parties’ legal roles, processing instructions, security, retention, data-subject rights, international transfers and oversight. If a provider processes personal data for you, you generally need a written processor agreement meeting the requirements of GDPR Article 28. If the provider determines purposes for some operations, it may be a controller or joint controller for those operations instead.
Mixed datasets remain relevant. If personal and non-personal records are combined and cannot realistically be separated, treat the dataset as subject to GDPR controls rather than assuming the non-personal fields are outside scope.
A seven-step verification workflow
1. Map the data and legal roles
Start with an inventory of what the service will receive. Separate customer content from account, billing, usage, security and support data. Note whether the service will handle names, email addresses, financial records, employee data, identifiers, special-category data or information about children.
For each operation, record whether the SaaS company is your processor, a controller, or a joint controller. The answer can differ by feature: it may process uploaded records only on your instructions but act as a controller for billing, fraud prevention or service analytics. Ask the vendor to identify these roles in its DPA and privacy documentation rather than accepting a single blanket description.
2. Obtain and read the DPA and service terms
Request the current DPA and the service terms that apply to your exact subscription. A useful processor agreement should identify:

- the documented processing instructions and purposes;
- the categories of personal data and data subjects;
- security measures and confidentiality duties;
- subprocessor appointment, notice and objection rules;
- assistance with access, deletion, breach and other data-subject requests;
- audit or inspection rights, including how evidence is supplied;
- retention limits and the return or deletion process at termination; and
- the countries and transfer mechanisms used for every non-EEA path.
The Irish Data Protection Commission (DPC) puts the control issue plainly: “A data controller must remain in control of the personal data it collects when it subcontracts the processing to a cloud provider.” Its cloud guidance also states, “Important for both control and security is the location of the data.” Treat those statements as a practical test: if the contract does not let you determine locations, subprocessors and deletion, the residency claim is difficult to verify.
3. Demand precise locations, not regional slogans
Ask for named countries and, where a hyperscaler is involved, the exact cloud-region identifier. “Europe,” “EU,” or “European data centers” is too broad to test. Request a separate answer for each of these:
- primary production storage;
- read replicas and caches;
- automated backups and snapshots;
- disaster-recovery and failover environments;
- logs, monitoring and security telemetry;
- analytics and product-improvement pipelines;
- support tickets, screen recordings and diagnostic files; and
- temporary copies created during migration, maintenance or incident response.
The DPC advises customers to establish “precisely where and how the data you provide to a cloud provider will be handled.” Ask whether each category stays within the EU or EEA, whether a different location is used only during an outage, and how long temporary copies remain.
4. Audit the subprocessor chain
A SaaS provider may rely on hosting companies, email and notification systems, customer-support platforms, observability vendors, payment processors, identity services and backup operators. Obtain the current subprocessor list and request, for every entry:
- the legal entity and corporate location;
- the service and purpose;
- the countries and regions in which it processes data;
- whether it can view content or only encrypted infrastructure data;
- the categories of data it receives;
- retention and deletion arrangements; and
- the date and method by which additions or replacements are announced.
The European Data Protection Board’s Cloud Code of Conduct describes mechanisms for providing subprocessor information and communicating changes in advance where a controller gives general authorization. Check the provider’s notice period and objection procedure. A list that omits locations, purposes or access type is not enough to assess residency.

5. Identify safeguards for international transfers
If any personal data is accessed, stored or otherwise processed outside the EEA, document the legal mechanism for that path. Depending on the destination and circumstances, the provider may rely on an adequacy decision, Standard Contractual Clauses (SCCs), Binding Corporate Rules or another GDPR-recognized safeguard. Ask for the specific module or decision and the supplementary technical and organizational measures.
Review controls such as encryption in transit and at rest, customer-managed keys, strict administrator permissions, logging, approval workflows, personnel screening and limits on government or third-party access. GDPR protection follows personal data when it is transferred outside the EU; moving a support session or diagnostic file can therefore create a transfer even when the main database remains in Europe.
6. Test the promise against your purchased configuration
Residency can vary by plan, tenant, service, feature and support tier. Some products require an administrator to select an EU region; others assign a region when the account is created. A service may keep customer content in Europe while storing identity, usage or configuration records elsewhere.
Check the actual settings before uploading personal data. Save screenshots or export the region assignment, enabled services and tenant identifiers. Ask whether collaboration with an account outside the provider’s EU Data Residency or EU Data Boundary changes the location of account, usage or configuration data. Documentation for enterprise identity services warns that cross-boundary collaboration can result in some of those categories being processed outside the boundary.
7. Preserve evidence and schedule a recheck
Keep a dated copy of the DPA, service terms, subprocessor list, region selection, vendor answers and any audit or certification scope. Record the person who approved the configuration and the date on which the provider confirmed each location.

Questions to send the provider
Send a written questionnaire and request answers tied to your tenant, plan and enabled features. The following wording is designed to expose gaps that a general “EU hosting” statement leaves open.
| Question | Evidence to request | Why it matters |
|---|---|---|
| In which countries and exact cloud regions are primary data, replicas, backups and disaster-recovery copies stored? | Named countries, region identifiers and a description of replication and retention. | Primary storage alone does not establish where recoverable copies exist. |
| Where are logs, telemetry, analytics and diagnostic data processed? | A data-category map showing systems, locations and retention. | Service metadata can contain identifiers or content and may follow a separate path. |
| Where are support tickets, attachments, screen shares and recordings stored? | Support-system provider, access countries and deletion period. | Support workflows often involve staff or tools outside the production region. |
| Which subprocessors can access customer data, for what purpose and from which locations? | Current list, purpose, access type, corporate entity and processing countries. | Third parties determine whether the residency statement covers the full chain. |
| Does the promise apply to our exact plan, tenant, enabled features and support tier? | Contract language and a written confirmation for your configuration. | Some controls are available only on selected editions or services. |
| Can support personnel or engineers access data from outside the EEA? | Access-control design, approval process, logging and transfer safeguard. | Remote access can be an international transfer even when data stays at rest in Europe. |
| What happens during failover, incident response, maintenance or service migration? | Fallback regions, trigger conditions, duration and customer notification. | Exceptional operations can move data outside the advertised region. |
| Which transfer mechanism applies to every non-EEA processing path? | The adequacy decision, SCC module or other safeguard, plus supplementary measures. | A transfer needs a documented legal and operational basis. |
| How are subprocessor additions communicated, and can customers object? | Notice period, delivery channel, objection deadline and consequences. | You need a way to respond when the processing chain changes. |
How to compare providers consistently
Use the same evidence standard for every candidate. A provider with a narrower but enforceable commitment can be safer than one using broad regional language with no contractual detail.
| Comparison axis | Strong evidence | Weak evidence or warning sign |
|---|---|---|
| Scope of residency | Contract defines covered data categories, services, tenants and features. | Homepage says “EU-hosted” without exclusions or plan details. |
| Primary, backup and failover locations | Named countries and cloud regions, with documented failover behavior. | Only the primary data-center country is disclosed. |
| Non-storage processing | Separate locations for logs, telemetry, analytics and support are listed. | Metadata is described as “may be processed globally.” |
| Subprocessor transparency | Current list includes purpose, location, access type and change notice. | List is incomplete, undated or provides no objection mechanism. |
| Transfer safeguards | Each non-EEA route is mapped to an adequacy decision, SCCs or another safeguard, with supplementary measures. | Provider says transfers are “compliant” without identifying the mechanism. |
| Contractual enforceability | DPA states instructions, deletion, audit, security and location commitments. | Residency appears only in sales material or a non-binding FAQ. |
| Evidence and auditability | Provider supplies dated documentation, region settings and independent assurance scope. | It refuses to identify regions or limits evidence to an undated badge. |
Common answers that need follow-up
“All customer data is in Europe”
Ask what “customer data” includes. The phrase may refer only to uploaded content and exclude account records, usage data, logs, support tickets or backups. Request a category-by-category statement and the retention period for each.

“Our cloud provider has EU regions”
The existence of EU regions does not prove that your tenant uses one. Request the exact region identifier, the replication design and the regions used for backup and recovery. Confirm that the selected region applies to every enabled service, not just the main application.

“Support is global but data remains in the EU”
Clarify whether support staff can view content, download diagnostics or access a live session from outside the EEA. Remote viewing or retrieval can be a transfer. Ask for role-based access, approval, logging, masking and the transfer safeguard.
“We use encryption, so location does not matter”
Encryption reduces exposure but does not remove the need to identify processing locations or establish a lawful transfer mechanism. Find out who controls the keys, whether support staff can decrypt data and whether encrypted logs still contain personal data.
“Failover is rare”
Frequency does not eliminate the obligation to understand the path. Ask which region receives data, what triggers failover, how long copies remain there and how you are notified. Include planned maintenance and migration, not only catastrophic outages.

- deletion and return instructions, including backup expiry;
- region-selection screenshots or configuration exports;
- vendor contact, response date and unresolved exceptions; and
- the next review date and events that trigger an earlier review.
Use the record during procurement, renewal and incident response. If the provider cannot answer a material question, document the uncertainty and decide whether the data can be minimized, pseudonymized, kept out of the service or covered by additional contractual and technical controls.
When the provider cannot guarantee EU-only processing
A non-EU path is not automatically unlawful, but it changes the diligence required. First, identify the exact data and operation involved. Then confirm the transfer mechanism, supplementary measures, access controls and retention. Consider whether you can disable a feature that creates the transfer, remove unnecessary personal fields, tokenize identifiers before upload or restrict support access.
For high-risk processing, obtain advice from your data-protection officer or qualified counsel. The practical decision is not simply “EU or not EU”; it is whether the complete, documented processing chain matches your legal obligations, risk assessment and contractual commitments.
