How to Check Whether a Product’s GST Rate Changed—and What to Do if You Were Overcharged

To verify a GST-rate change in India, do not rely on a headline or the rate printed in a search result. Identify the exact goods description and HSN on your invoice, find that entry in the current official GST notification, check its effective date and conditions, and then apply the time-of-supply rules to the supply, invoice and payment dates. If the tax still appears excessive, preserve your records, ask the seller in writing to explain and correct the charge, and escalate through the National Consumer Helpline or a consumer commission if necessary.

A product’s rate cannot be established from its name alone. Classification, the tax type charged, the notification in force and the timing rules can all change the result.

What you must establish before calling a GST bill incorrect

An apparent overcharge has four separate parts. Check all four before demanding a refund:

  1. What exactly was supplied? Record the product’s detailed description, quantity, brand or model where relevant, packaging and any features that affect classification. Note the HSN printed on the invoice, if one is shown.
  2. Which official rate entry applies? Match the description and HSN to the complete entry in the applicable CBIC or Gazette notification. Read the schedule, conditions, exclusions and effective date.
  3. Which tax is being charged? Identify whether the invoice shows IGST, CGST and SGST, or another applicable treatment. An IGST entry is not automatically a complete answer for every domestic invoice.
  4. Which date controls the rate? Compare the supply date with the invoice and payment dates under section 14 of the CGST Act. The date printed in a news story is not, by itself, the answer.

The official rate schedule can change through later notifications or corrigenda. A rate found in an old article or an archived table may no longer apply to the transaction you are checking.

Step 1: Read the invoice and preserve the transaction record

Start with the tax invoice rather than the product page. Section 31 of the CGST Act requires a registered person supplying taxable goods to issue a tax invoice at the specified time and to show particulars including the description, quantity, value and tax charged. Read the current text on the CBIC Tax Information Portal.

Write down these fields

  • Invoice number and invoice date.
  • Seller’s legal name, GSTIN and address as printed.
  • Exact product description, quantity, unit price and taxable value.
  • HSN or other classification code, if printed.
  • Tax type, rate and amount shown on each line.
  • Shipping, discount, bundled-service or other line items that affect the taxable value.
  • Delivery or supply date if it differs from the invoice date.

For an online purchase, save the order confirmation, the listing as displayed when you bought the item, the tax invoice, delivery record and payment confirmation. Take a dated screenshot or download a PDF if the listing may change. Keep the product label or technical description when classification is not obvious.

Why the invoice is only the starting point

An invoice can contain a typographical error, a seller’s classification choice or a rate that was correct for a different date. It is evidence of what was charged, not conclusive proof that the charge was legally payable. Preserve the original file and do not edit the document before sending it to a seller or authority.

Step 2: Find the matching official GST notification

Use the product’s precise description and HSN as search terms in the current official rate notification. Read the entire row or entry, not just a percentage shown in a search snippet. Closely related goods can have different classifications, and many entries include qualifications or exclusions.

Read every part of the entry

  • Description: Confirm that the goods, form, composition, use and packaging match.
  • Classification: Check the HSN or heading and do not assume that a seller’s code is correct merely because it is printed.
  • Conditions and exclusions: A reduced rate may apply only when stated conditions are met.
  • Schedule and tax type: Confirm whether the notification concerns IGST or another treatment relevant to the transaction.
  • Effective date: Record the date on which the entry takes effect and look for amendments or corrigenda.

One official document reviewed for this purpose is Notification No. 9/2025-Integrated Tax (Rate), dated 17 September 2025. It is an example of an official schedule, not a universal rate for every product, transaction or tax type. Before relying on it, check whether a later notification changed the relevant entry.

Do not turn a headline into a product-specific conclusion

A government announcement or media report may describe a rate cut in broad terms. The legally relevant question is whether the exact goods entry, conditions and tax type on your transaction are covered by the notification in force. If the product name is vague, obtain a fuller description from the seller or manufacturer before asserting that the wrong rate was used.

Step 3: Apply the time-of-supply rules to the rate change

Section 14 of the CGST Act governs the time of supply when the tax rate for goods or services changes. The provision distinguishes supplies made before and after the change and uses the timing of the invoice and payment in its scenarios. The statutory text begins: “the time of supply, where there is a change in the rate of tax in respect of goods or services or both, shall be determined in the following manner, namely:-” Read the complete provision at the CBIC Tax Information Portal.

Build a date timeline

  1. Write the date the goods were supplied or the relevant event that completed the supply.
  2. Write the invoice date and check whether the invoice was issued within the required period.
  3. Write the date payment was received or made, using the records available to you.
  4. Write the notification’s effective date and any amendment date.
  5. Compare the dates using the applicable section 14 scenario rather than choosing the newest date automatically.

For example, a customer may order before a rate change, receive the goods after it, and pay on a third date. Another customer may receive the goods before the change but receive an invoice or make payment afterward. Section 14 addresses these combinations; the headline effective date alone does not tell you which rate applies.

Keep the timeline with your complaint. If a seller says the old rate was required, ask it to identify the relevant time-of-supply rule and explain how it applied to your dates.

Step 4: Compare the calculation, not just the percentage

Once classification, notification, tax type and timing are checked, recreate the invoice arithmetic:

  1. Confirm the taxable value after discounts and before tax.
  2. Apply the rate that appears to match the official entry and timing.
  3. Compare the resulting tax with the amount charged.
  4. Check whether the difference comes from a classification or tax-type issue rather than multiplication.

A simple hypothetical illustrates the method. If a taxable value were ₹10,000, a charge at 18% would be ₹1,800, while a charge at 12% would be ₹1,200; the arithmetic difference would be ₹600. Those percentages are only an example. Do not use them as the rate for a particular product without matching the official entry and date.

Comparison points for a disputed bill

Question What to compare Evidence to retain
Goods identity Invoice description and HSN against the notification entry Invoice, label, product listing and technical description
Rate authority Notification number, schedule, conditions and effective date Official notification PDF and any later amendment or corrigendum
Tax treatment IGST or CGST/SGST shown on the invoice against the applicable notification Tax breakup and transaction details
Timing Supply, invoice and payment dates under section 14 Delivery record, invoice and payment statement
Amount Taxable value multiplied by the applicable rate Short written calculation

If the seller uses a different HSN, make that classification disagreement explicit. A dispute about the code is different from a dispute about the multiplication.

Step 5: Ask the seller to explain and correct the charge

Send a written request through a channel that preserves the date and contents, such as email, the seller’s complaint portal or registered post. Keep the message factual and attach copies rather than your only originals.

Include the information the seller needs

  • Invoice number, date and order or transaction reference.
  • Exact product description and the HSN printed on the invoice.
  • Supply, delivery and payment dates.
  • Taxable value, tax type, rate and tax amount charged.
  • Official notification number, entry and effective date that you believe apply.
  • Your calculation and the amount you believe requires correction.
  • A request for the seller’s classification and time-of-supply explanation.

Ask the seller to correct the account and return any amount that was collected above the tax payable if your analysis is confirmed. Section 34 provides for a supplier credit note when tax charged on an invoice exceeds tax payable, subject to statutory conditions and reporting rules. Read the provision at the CBIC Tax Information Portal. Do not promise yourself that a particular document or refund route must be used until the seller and, where necessary, a tax professional or authority has checked the facts.

Sample wording

“Invoice [number] dated [date] for [exact goods] shows [tax type] at [rate]. The official entry in [notification number] appears to apply from [effective date]. The goods were supplied on [date], the invoice was issued on [date], and payment was made on [date]. Please explain the HSN classification and time-of-supply treatment, and correct the invoice and return any excess amount if the tax charged exceeds the tax payable.”

Give the seller a reasonable deadline stated in writing and keep its response. If it asks for more information, answer with documents and preserve the exchange.

Step 6: Escalate an unresolved complaint

National Consumer Helpline

The National Consumer Helpline accepts consumer grievances through its portal, app, UMANG and WhatsApp. Its current public page lists toll-free 1915, available from 8 AM to 8 PM, and WhatsApp +91 88000 01915. Confirm the current channels at National Consumer Helpline before submitting a complaint because contact details can change.

Provide a concise chronology, identify the seller, state the amount in dispute, attach the invoice and payment proof, and show that you first asked the seller to resolve the issue. The helpline is a grievance-intake channel; it does not replace the need to establish classification and timing.

Consumer commission

If the matter remains unresolved, the Department of Consumer Affairs’ guidance describes filing before a consumer commission, including online filing, supporting facts and documents, and possible relief such as a refund. The guidance also describes a two-year limitation period. Procedures, jurisdiction, fees and limitation rules can change, so check the current official process before filing at the Consumer Protection Act 2019 knowledge base.

A commission complaint should explain what was bought, what was charged, why the notification and timing produce a different amount, what you asked the seller to do, and what remedy you seek. Attach a readable document set and a short chronology rather than sending an unindexed bundle.

Evidence checklist

  • Itemized tax invoice and receipt.
  • Order confirmation, payment record and transaction dates.
  • Product label, listing or technical description sufficient to check classification.
  • Relevant official rate notification plus any amendment or corrigendum.
  • Written calculation showing taxable value, rate and tax charged.
  • Written complaint to the seller and the seller’s response.
  • Delivery or supply evidence where the date is disputed.
  • For escalation, copies of every document and a concise chronology.

Store the files in their original form and keep a backup. Redact unnecessary personal information when sharing documents publicly, but leave invoice numbers, dates, tax figures and seller details visible to the authority handling your complaint.

Common mistakes that weaken a GST-rate complaint

Using an old rate table

Rates and entries are amended. A table without a notification number and effective date cannot establish the rate for your transaction. Use the current official schedule and check for later changes.

Assuming the product name decides classification

Two goods sold under similar names may fall under different entries. Compare the complete description, HSN and any qualifying conditions.

Ignoring the tax type

An integrated-tax notification should not be silently treated as the answer for every invoice. Identify what the seller charged and locate the corresponding current treatment.

Using only the purchase date

Section 14 requires the relevant supply, invoice and payment dates to be considered. Preserve all three where available.

Demanding a refund before checking the calculation

First separate a genuine excess tax from a disagreement about classification, taxable value or the tax type. A clear calculation makes a seller more likely to give a useful response.

Relying on a verbal promise

Ask for the explanation and correction in writing. Save call reference numbers and follow up by email so the record is complete.

When you need specialist help

A straightforward invoice error may be resolved with the steps above. Consider advice from a qualified tax professional or consumer-law adviser when the item is high value, the HSN classification is contested, several invoices are involved, the seller is outside your jurisdiction, or the notification contains complex conditions. Give the adviser the original invoice, complete product description, notification and date timeline; a percentage copied from a general article is not enough.

Businesses should also distinguish a consumer’s refund question from their own registration, invoicing and reporting obligations. The statutory provisions and notification may apply differently depending on the transaction facts.

Final decision path

  1. Identify: Record the exact goods, HSN, taxable value, tax type and all relevant dates.
  2. Verify: Match the goods to the current official notification, including conditions, exclusions and effective date.
  3. Time: Apply section 14 to the supply, invoice and payment dates.
  4. Recalculate: Compare the tax legally payable with the tax shown on the invoice.
  5. Request: Ask the seller in writing to explain, correct and return any confirmed excess.
  6. Escalate: Use the National Consumer Helpline and, if needed, the current consumer-commission process.

The Department of Consumer Affairs also publishes general information on consumer rights at Consumer Rights. Check the official CBIC and consumer portals again immediately before relying on a rate or contact detail, because both tax schedules and grievance channels are time-sensitive.
