Confirm whether the supply is inter-state or intra-state, and apply section 14 of the CGST Act when the supply, invoice and payment fall on different sides of the change date. A product name alone is not enough to determine the rate.
The reliable way to verify a changed GST rate
A GST rate change is applied to a legal entry, not to a casual product label. Your conclusion should be based on six facts: what was supplied, how it is classified, the exact notification entry, the date that entry became effective, the location of the supply, and the timing of supply, invoice and payment.

The controlling document is the applicable rate notification and any later amendment or corrigendum. A GST Council recommendation, a news report or a rate-list summary can help you locate the change, but it does not replace the operative notification. If the description, classification or transaction facts are uncertain, do not infer a rate from a similar item.

Form, processing and use can change the entry
Official CBIC examples distinguish fresh goods from dried goods. Two items that consumers regard as the same product may therefore fall under different entries because their form or processing differs. Record the condition in which the goods are supplied, not merely their retail name.

Value thresholds and pricing bases can matter
Garment examples in the CBIC rates FAQ use different treatment depending on transaction value. Other entries may refer to retail sale price or another specified measure. Capture the value basis used by the notification and verify whether the threshold applies per item, transaction or another stated unit.
Services must be matched to the service actually supplied
A business name or invoice heading may not describe the taxable service precisely. Identify the activity, the recipient and the contractual deliverable, then match that description to the relevant service entry. The service notification’s wording and conditions govern the result.
Step-by-step verification workflow
1. Describe the supply precisely
- For goods, write down the physical facts: product name, composition, state or form, degree of processing, intended use, packaging and any value or price measure mentioned in the tariff or notification.
- For services, describe the actual activity: what the supplier does, what the customer receives, the contractual scope and any fact that could place it in a special entry or exception.
- Record the transaction facts: supplier and recipient locations, whether the movement of goods is involved, and the relevant supply, invoice and payment dates.
This description is the foundation for classification. Preserve the product specification, purchase order, contract and invoice wording so another reviewer can reproduce your reasoning.

2. Determine the classification or service description
Use the relevant tariff or HSN classification for goods, or the applicable service description for services. Do not select a heading solely because its wording resembles a marketing name. Compare the product’s composition, form, use and supplied condition with the classification rules and the notification entry.
If two entries appear possible, list the factual difference that separates them. For example, identify whether the goods are fresh or dried and whether a garment’s relevant value is measured by transaction value or retail sale price. The classification must be supportable from the item’s documents and characteristics.

3. Locate the official rate notification
Search the CBIC and GST Council notification indexes for the rate notification covering the selected goods or service. Open the notification itself and read the complete entry, including footnotes, provisos, schedules and explanatory wording.
For services, CBIC’s GST Returns FAQs advise referring to the notification relevant to the service selected and contacting the jurisdictional officer if there is doubt about the applicable rate or cess. That is preferable to copying a rate from an unsourced chart.
4. Verify the notification number and effective date
- Write down the notification number and issue date.
- Identify the commencement or effective date stated in the notification.
- Check whether the document amends, substitutes or supersedes an earlier notification.
- Search for subsequent amendments, corrigenda and schedule changes.
- Confirm whether an exception postpones the change for a particular product group.
The date the notification was issued is not automatically the date the new rate applies. Use the commencement wording in the legal instrument and preserve a copy of the version you relied on.
5. Confirm the tax component for the place of supply
Once the rate entry is identified, determine whether the transaction is inter-state or intra-state. The tax components differ:
| Supply type | Tax component |
|---|---|
| Inter-state supply | IGST |
| Intra-state supply | CGST plus SGST or UTGST |
The National Government Services Portal describes this basic distinction, but the notification entry remains controlling for the rate and any cess. Do not assume that a supplier’s registration state alone answers the place-of-supply question; use the applicable place-of-supply rules and transaction facts.

6. Document the conclusion
Prepare a short rate memo or working paper containing:
Free tools Windows power users keep installed
One-click scans. No signup required.
- the precise goods or service description;
- the classification or service-entry basis;
- the notification number, entry and effective date;
- conditions, thresholds, exclusions and cess language;
- the inter-state or intra-state determination;
- supply, invoice and payment dates; and
- the reasoning used when facts could fit more than one entry.
Keep the notification copy, product specifications, contracts and correspondence with the tax records. A documented conclusion is easier to defend and easier to update when an amendment appears.
How to read a rate notification without missing an exception
Start with the schedule and exact entry
Find the schedule containing the goods or service and read the entire row. The description may be narrowed by a tariff heading, a state or form of the goods, a value condition, or a use limitation. The percentage displayed beside a broad heading may not apply to every item that uses the same commercial name.
Read notes, provisos and explanatory text
Conditions can determine whether an entry applies. Look for wording about packaging, processing, brand or value, and for references to another notification. A condition in a footnote is part of the legal rate entry; it is not optional guidance.
Check amendments after the original change
Rate verification is not complete when you find the first notification. The GST Council’s April 2026 newsletter reports that Notification 01/2026-Central Tax (Rate), dated 30 April 2026, amended Notification 9/2025-Central Tax (Rate) to align tariff entries for specified beverage classifications with Finance Act 2026 changes. This illustrates why a later amendment can alter the classification wording even when you began with the correct earlier notification.

Separate recommendations from enforceable text
Council meeting announcements explain policy decisions and may state an intended date, but the legal rate is established through the notified instrument. Confirm that the notification has been issued and that its effective-date clause covers your transaction.
Transactions that cross the rate-change date: applying section 14
Why the invoice date alone may not decide the rate
Section 14 of the CGST Act addresses a change in the rate of tax when the supply, invoice and payment occur in different periods. The applicable result depends on the order of those events. Therefore, delivery date, invoice date or payment date cannot be treated as an automatic rule in every case.
Build an event timeline
- Write the effective date and time of the rate change from the notification.
- Record when the supply is treated as made under the applicable GST rules.
- Record the invoice date and check whether the invoice was issued within the required period.
- Record when payment was received, using section 14’s rule for determining receipt.
- Arrange the three events chronologically and apply the corresponding section 14 provision.
| Event to capture | Question for the file |
|---|---|
| Supply | Was the supply made before or after the notified rate-change date? |
| Invoice | When was the invoice issued, and was it issued within the required period? |
| Payment | When is payment treated as received under section 14? |
Section 14 contains different outcomes for the possible sequences. Use the statutory wording for the sequence that matches your facts rather than applying a general “old rate until delivery” or “new rate from invoice” shortcut.
Document supplies made before the change but invoiced later
The Ministry of Finance FAQ on the 56th GST Council meeting specifically summarizes cases in which supplies were made before the change but invoiced after it. Use that explanation together with the text of section 14 and the notification’s effective-date clause. Preserve evidence of the actual supply date, invoice issuance and payment receipt; a later-created document should not silently replace the underlying event date.
Current reference points for recent changes
Most changes linked to the 56th Council meeting
The Ministry of Finance FAQ states that most goods and services affected by the 56th GST Council meeting took effect on 22 September 2025. It also says the changes were to be notified through rate notifications available on CBIC. The FAQ identifies specified tobacco products as an exception whose effective date was deferred to a later notified date. Do not extend the 22 September date to those products without checking the separate notification.

Why 2026 amendments still matter to a 2025 change
The April 2026 GST Council newsletter’s report of Notification 01/2026-Central Tax (Rate), dated 30 April 2026, shows that tariff wording can be aligned later with Finance Act changes. When reviewing a transaction today, search forward from the original notification for amendments that were effective before the transaction date.
Practical examples of classification checks
Fresh versus dried goods
Suppose an invoice uses one everyday name for goods supplied in two forms. First record whether each lot is fresh or dried. Then identify the corresponding tariff descriptions and read the rate entries separately. Do not copy the rate for the fresh form to the dried form merely because the consumer-facing name is the same.
Garments with a value condition
For garments, capture the value measure used by the relevant entry. If the notification distinguishes transaction value from retail sale price, calculate and document the measure that the entry requires. A rate selected from a general clothing category without checking that condition may be wrong even when the HSN heading appears plausible.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →A service described broadly on an invoice
If an invoice says only “consulting” or another broad label, obtain the contract and describe the actual deliverable. Match that activity to the service notification, then check any conditions or exclusions. Where the classification remains uncertain, ask the jurisdictional officer for clarification rather than choosing the lowest or most familiar rate.
Common mistakes and how to correct them
- Using a Council announcement as the final authority: locate the issued rate notification and effective-date clause.
- Searching only by a product’s brand or nickname: classify the goods by composition, form, use and tariff description.
- Ignoring entry conditions: read value, packaging, processing and exception language in the full schedule.
- Stopping at the original notification: check amendments and corrigenda through the transaction date.
- Applying one date to every transitional sale: create the supply-invoice-payment timeline required by section 14.
- Confusing IGST with CGST plus SGST/UTGST: establish whether the supply is inter-state or intra-state.
- Relying on an old rate chart: verify the chart against the current official notification and its amendments.
- Guessing when classification is disputed: preserve the facts and seek jurisdiction-specific clarification.
When to seek a jurisdiction-specific clarification
Escalate when the product could fit multiple tariff entries, a condition depends on technical composition, the service description is ambiguous, or the event dates produce a difficult section 14 sequence. Provide the officer or adviser with the complete product specification, contract, invoice, classification analysis, notification entry and timeline. A question framed with documents and competing entries is more useful than a request for a rate based only on a trade name.
For a high-value or recurring supply, obtain written professional advice before issuing invoices at the changed rate. The objective is not merely to find a percentage; it is to establish a defensible classification and effective-date decision for the specific transaction.
A repeatable checklist
- Describe the exact goods or service and preserve supporting documents.
- Identify the HSN or service description that best fits the supplied item.
- Locate the official rate notification and read the complete entry.
- Note the notification number, issue date, effective date and every condition.
- Search for later amendments, corrigenda and deferred-product exceptions.
- Determine whether the supply is inter-state (IGST) or intra-state (CGST plus SGST/UTGST).
- For a rate change, record supply, invoice and payment dates and apply section 14.
- Save the evidence and reasoning, and seek clarification where the facts do not produce one clear entry.
Without the specific item, classification and transaction timeline, no precise GST rate can responsibly be stated. The process above lets you reach the correct entry from the controlling notification and explain why it applies.
