It may be an internal accounting entry or a decision to stop ordinary collection while the debt remains legally owed. A true waiver, release, settlement, or discharge should be supported by operative loan or settlement documents, a court order, or clear written confirmation from the creditor. Form 1099-C is useful evidence of a reportable cancellation event, but the Taxpayer Advocate Service warns that a creditor may still try to collect after issuing one.
To determine what happened, check four issues separately: what the contract and current creditor say you owe, whether the obligation was legally discharged, whether collection is continuing, and whether the cancellation creates a tax-reporting issue.

Write-off, charge-off and waiver are different things
A lender can “write off” or “charge off” an account for accounting or collection purposes without releasing the borrower. The balance may be transferred, sold, assigned to another collector, or pursued under the original agreement. An account marked charged off can therefore coexist with collection letters, a lawsuit, a remaining balance, or a later settlement.
A waiver, release, forgiveness, settlement in full, or discharge is a separate event. It changes the obligation described in the contract, a settlement agreement, a court order, or a creditor’s express written statement. A settlement offer is not proof of discharge until its conditions—such as payment by a stated date—have been met and the creditor confirms the resulting status.

Federal IRS guidance explains reporting and tax treatment. It does not provide a universal state-law answer about whether a particular debt remains enforceable. Contract language, the type of debt, security interests, court orders, and state law can all matter.
The four questions you must answer
| Question | What to examine |
|---|---|
| What does the creditor say is owed? | The current statement, payment history, balance, interest and fees, account owner, and servicer. |
| Was the obligation legally discharged? | A signed release, satisfaction, settlement agreement, bankruptcy or other court order, or explicit creditor confirmation. |
| Is collection continuing? | Statements, calls, letters, collection activity, litigation, or a written statement that collection has stopped. |
| Does the event affect taxes? | Form 1099-C details, cancellation amount, applicable exclusions, and any Form 982 filing requirement. |
Do not collapse these into one “forgiven or not” label. A tax form can report an event without answering whether a creditor has stopped collecting, and an account’s zero balance can result from a transfer or servicing change rather than a release.
Use the strongest evidence first
When records conflict, weigh them by their source and legal force rather than by the most reassuring label.
| Evidence | What it can establish | What still needs checking |
|---|---|---|
| Express release, satisfaction, settlement-in-full, or discharge document | The creditor’s stated legal treatment of the obligation and any effective date or conditions. | Whether all conditions were met and whether the document covers the entire debt or only part of it. |
| Final contractual or court-approved agreement | The agreed balance, payment terms, preserved rights, and consequences of default. | Proof that required payments or other conditions were completed. |
| Written confirmation from the current creditor or servicer | What the account owner currently says is owed and whether collection will continue. | Whether the sender is authorized to speak for the current owner and whether the statement conflicts with the governing agreement. |
| Account history showing a zero balance and a reason | The servicer’s current ledger entry. | Whether the zero reflects a discharge, sale, transfer, correction, or another accounting event. |
| Form 1099-C or an account label such as “charged off” | A clue about a reportable event or internal status that should be investigated. | Whether the debt was legally released, whether collection continues, and how tax rules apply to your facts. |
How to check your loan, step by step
1. Identify the exact account and current creditor
Match the notice to the correct borrower, loan number, dates, and property or collateral if applicable. Identify both the creditor that owns the debt and any servicer or collector communicating for it. A servicer may send statements without owning the obligation, so ask who has authority to confirm a discharge.

2. Read the operative document, not just the account label
Locate the original promissory note, credit agreement, modification, settlement agreement, bankruptcy order, judgment, or other document that controls the account. Search for words such as released, discharged, forgiven, satisfied, and settled in full. Then check:
- the effective date;
- whether the release is complete or limited to a stated amount;
- conditions such as a payment deadline;
- any remaining principal, interest, fees, deficiency, or collateral rights; and
- rights the creditor expressly preserves if you default.
A letter offering to settle for less than the balance is not the same as a completed settlement. Keep proof of every required payment and the creditor’s final acceptance.
3. Reconcile statements and payment history
Review the last statement before the alleged write-off, later statements, payment records, and notices of transfer or sale. Record the balance, the date it changed, and the explanation given. If the ledger shows zero, ask whether that means paid, settled, discharged, transferred, sold, or merely removed from that servicer’s system.
Keep a dated log of calls, the representative’s name, promises made, and copies of letters or online messages. Verbal assurances are difficult to prove and may not amend a written agreement.

4. Inspect Form 1099-C, if you received one
Compare the form with the creditor’s records. Box 1 shows the date of the reported identifiable event, box 2 shows the amount reported as canceled, and box 6 shows the event code. The date and code can indicate what the creditor reported, but they do not replace the loan agreement, settlement paperwork, court order, or a direct answer about collection.
IRS instructions revised in April 2025 describe identifiable events including bankruptcy discharge, certain judicial or administrative proceedings, an agreement to discharge debt for less than full consideration, and a creditor decision or defined policy to discontinue collection and cancel the debt. For event code G, the instructions describe a creditor decision or defined policy to stop collection and cancel; an established business practice may constitute such a defined policy.
The Taxpayer Advocate Service states: “You may receive an IRS Form 1099-C while the creditor is still trying to collect the debt. If so, the creditor may not have canceled it. Contact the creditor and verify your situation.” If any name, account number, date, or amount is wrong, ask the lender to correct the form and keep your request and supporting records.

Re: account [account number]Please confirm in writing:1. Who currently owns this account and who is servicing it;2. Whether any principal, interest, fees, deficiency, or other amount remains due;3. Whether the obligation has been released, discharged, forgiven, satisfied, or settled in full, and the effective date;4. What document or event supports that status;5. Whether collection will continue, and by whom; and6. What event date, cancellation amount, and event code were reported on any Form 1099-C.If the account or tax reporting is inaccurate, please explain the correction process and provide a corrected statement or form.
Send the request using a method that preserves delivery and a copy. A written answer that clearly identifies the remaining balance and collection status is more useful than a generic statement that the account was “charged off.”
6. Compare the answer with the governing records
Check whether the response matches the operative agreement, payment history, court order, and any 1099-C. If the creditor says the debt was released, ask for the release or final settlement document. If it says a balance remains, ask for an itemized calculation and the contractual basis for each amount.

Applicable entities generally file Form 1099-C for canceled debt of $600 or more when an identifiable event has occurred. That $600 figure is an IRS filing rule, not a threshold that decides whether your debt was forgiven or whether you owe tax. The form may be filed regardless of whether the borrower ultimately has to include the amount in income.

The reverse is also important: IRS Publication 4681 says taxable canceled debt may still need to be reported even if you did not receive Form 1099-C. Therefore:

- No 1099-C does not prove that no cancellation occurred.
- A 1099-C does not conclusively prove that collection has stopped.
- The amount in box 2 is not automatically the amount that is taxable.
- An incorrect form should be challenged with the creditor rather than ignored.
Use the form as one record in the file. The creditor’s underlying documents and current written position remain essential to determining contractual status and collection.
Keep tax treatment separate from debt status
Cancellation of debt can be included in income, but taxability depends on individual facts and circumstances. IRS guidance identifies exceptions and exclusions, including qualifying bankruptcy and insolvency situations. Publication 4681 explains the exclusions and when Form 982 may be used; IRS Topic no. 431 emphasizes that correct reporting remains the taxpayer’s responsibility.
A borrower who receives a 1099-C should not assume the whole reported amount is taxable. Gather the form, loan documents, settlement or court papers, insolvency or bankruptcy records if relevant, and payment history. A qualified tax professional can evaluate exclusions and Form 982. That tax analysis does not decide whether the creditor may enforce the contract, and a lawyer may be needed for the separate state-law question.

Consider professional help promptly if the account involves bankruptcy, foreclosure, repossession, a deficiency, a disputed large cancellation, threatened litigation, or a creditor that will not explain contradictory records.
How to resolve conflicting signals
When one record says “zero balance,” another reports a charge-off, and a 1099-C arrives, compare each record on five axes:
- Source and force: Is it a signed agreement, court order, creditor letter, tax form, statement, or internal label?
- Date and event: What happened on the stated date, and does the timeline show a transfer, settlement, discharge, or correction?
- Scope: Was the release complete, partial, conditional, or limited to a particular borrower or collateral?
- Current collection: Is anyone still demanding payment, reporting a balance, or asserting collection rights?
- Tax versus enforceability: Does the record answer a tax-reporting question, a contract question, or both?
For example, a servicer’s zero balance after a servicing transfer may simply mean that servicer no longer carries the account. A 1099-C with event code G may indicate a reported decision to discontinue collection and cancel, but the creditor’s written explanation is still needed if collection messages continue. The correct response is to reconcile the records, not to choose whichever label appears most favorable.
Common mistakes that lead borrowers astray
- Treating “charged off” as “forgiven.” Charge-off language alone does not establish release.
- Assuming a 1099-C ends collection. The Taxpayer Advocate Service specifically warns that collection may continue after the form is issued.
- Ignoring a form because the creditor still calls. A disputed form should be checked and corrected while the contract and collection questions are handled separately.
- Assuming no form means no tax issue. Taxable cancellation may need reporting even without a 1099-C.
- Relying on a zero balance without its reason. Transfers, sales, servicing changes, and accounting entries can all produce a zero in one system.
- Stopping at a settlement offer. Confirm that all conditions were met and obtain final written acceptance.
- Using tax advice to answer a legal question. A tax professional can analyze income, exclusions, and Form 982; state-law enforceability may require legal advice.
- Failing to preserve records. Keep the agreement, statements, payment history, correspondence, delivery proof, and tax forms together.
A practical decision path
- If you have an express release, satisfaction, completed settlement, or court discharge, verify its scope and conditions.
- If you only have a charge-off label or zero balance, obtain the current owner’s written explanation before assuming the debt is gone.
- If you received a 1099-C, compare its date, amount, and code with the creditor’s records and request corrections for errors.
- If collection continues after an alleged discharge, preserve every communication and ask the creditor to identify the contractual basis for collection.
- If tax, bankruptcy, foreclosure, repossession, or a large cancellation is involved, obtain qualified tax or legal advice for the issue that remains unresolved.
What to retain in your file
- Original loan and modification agreements;
- Settlement offers, completed settlement agreements, and proof of payment;
- Bankruptcy or other court orders, if applicable;
- Statements and complete payment history;
- Notices of transfer, sale, or servicing changes;
- Every written request and response, with dates and delivery proof;
- Form 1099-C and any corrected form; and
- Notes identifying the current owner, servicer, and collection agency.
This file lets you answer the four separate questions—what is claimed to be owed, whether it was discharged, whether collection continues, and what tax reporting may apply—without relying on a single account label.
