The reliable way to check is to verify both the professional and the firm in the SEC’s Investment Adviser Public Disclosure (IAPD) system, read the current Form ADV and Form CRS (relationship summary), and use FINRA BrokerCheck if the person also works as a broker. Then ask, in writing, which capacity the professional will use for your engagement, when any fiduciary duty applies, how the relationship is paid, and what conflicts could affect recommendations. A title, credential or marketing phrase is not proof that someone is a fiduciary for every service.
What “fiduciary” means in this decision
A fiduciary relationship requires the professional to meet the conduct standard that applies to the service and capacity in which they are acting. For a consumer, the practical issue is not whether an adviser uses the word fiduciary in a biography. It is whether the person and firm are properly registered for the work, what duties apply to your account or advice, and what the written agreement and disclosures say.

One person can perform different jobs. The same individual may provide investment-advisory services, brokerage services, insurance services or financial planning under separate arrangements. The applicable conduct standard can change with the role, product and service. The official records and your contract should therefore answer three separate questions:

Do not assume that every person who calls themselves a “financial advisor” is a fiduciary at all times. Credentials and titles may indicate training or a business role, but they do not replace checking registration, disclosures and the proposed agreement.

The quickest verification sequence
- Search the individual and the firm in IAPD. Confirm that the names, employer and registration information match the person who contacted you.
- Check registration status. Look for relevant active registration before hiring an investment adviser for advisory work.
- Open the current Form ADV. Read the adviser brochure for services, fees, business practices, conflicts and disciplinary disclosures.
- Read Form CRS, also called the relationship summary, when available. Use its plain-language description of services, costs, conflicts, conduct standards and disciplinary history as a quick comparison point.
- Search BrokerCheck if brokerage work is involved. Review the person’s or firm’s brokerage background, licensing, employment history and disclosures.
- Ask capacity and duty questions in writing. Compare the answers with the official filings and the contract you are asked to sign.
This sequence is free to use through the SEC’s Investor.gov tools and FINRA’s BrokerCheck. Records can change, so check the live databases rather than relying on a screenshot or an old marketing document.
Step 1: Search the person and firm in IAPD
The SEC’s Investment Adviser Public Disclosure system is the official starting point for an investment-adviser check. Investor.gov says IAPD includes SEC-registered firms, most state-registered investment-adviser firms and searchable individual representatives.
Search both names
Run a search for the individual and a separate search for the firm. A legitimate adviser may appear under a legal entity name that differs from the brand on a website or business card. Match the record against the details you were given:
Recommended Free Tools
- Full name, including middle initial or suffix where shown.
- Firm or employer name.
- Office location and other identifying information.
- Whether the individual is listed as a representative of that firm.
If you cannot find the person, try spelling variations and the firm’s legal name. Do not treat a missing or ambiguous result as proof of misconduct, but pause the hiring process until the identity and registration can be explained and verified through the relevant regulator.
Confirm the relevant registration
Review the record’s status and registration details. The question is not simply whether the person has ever been registered; it is whether the firm and individual are currently registered or otherwise authorized for the advisory service you are considering. An active record should correspond to the capacity described in the proposed engagement.
Registration does not answer every question about the relationship. It does, however, help establish that you are dealing with the correct regulated entity and gives you access to the firm’s disclosure documents.

Step 2: Read Form ADV instead of relying on a sales pitch
Form ADV is the adviser’s regulatory filing. Its brochure contains the firm’s description of its business practices, services, fees, conflicts and disciplinary information. Read the filing itself, not just a short biography, presentation or verbal promise.
Services and account scope
Identify exactly what the firm says it does. Look for the types of advice offered, account-management arrangements, financial-planning services and any limitations. Compare that description with what the professional proposed. If you were promised retirement planning but the document describes only portfolio management, ask for the difference in writing before signing.
Fees, costs and compensation
Form ADV can explain how the firm charges for advice and what other compensation it receives. Note whether costs are based on assets, a fixed fee, hourly work, commissions, referral payments or another arrangement. Also look for additional account, fund, transaction or service costs described in the filing or agreement.
A fee disclosure is not automatically a verdict that the arrangement is good or bad. It lets you compare the economic incentives with the recommendations you may receive and check whether the proposed contract matches the firm’s stated practice.
Conflicts of interest
Read the conflicts section for relationships or incentives that could affect recommendations. Examples may include compensation tied to particular products or transactions, outside business activities, affiliated companies, referral arrangements or financial incentives connected to account recommendations. The relevant question is how the firm identifies, manages and discloses each conflict.
Disciplinary information
Review disciplinary disclosures and read the surrounding explanation. A disclosure is a reason to understand the facts, dates and resolution; it is not, by itself, a conclusion about the person’s present conduct. Ask the firm to explain anything you do not understand and compare the explanation with the filing.

Step 3: Use Form CRS as a plain-language cross-check
Form CRS, also called Form ADV Part 3 or the relationship summary, is designed to summarize the relationship for retail investors. Investor.gov says it covers services, fees and costs, conflicts of interest, the required conduct standard, disciplinary history and questions you should ask.
Use it as a cross-check, not as a substitute for Form ADV or your contract. Read the sections that answer:
- What services will the firm provide, and what account monitoring or restrictions apply?
- What fees and other costs will you pay?
- What conflicts could affect recommendations?
- What conduct standard applies to the firm’s advisory or brokerage service?
- What disciplinary history is disclosed?
- What questions does the firm suggest that a prospective client ask?
Highlight any difference between Form CRS, the longer Form ADV brochure, the adviser’s verbal description and the proposed agreement. Resolve the difference before transferring money or granting discretionary authority.

If the professional is also a broker or offers brokerage services, search FINRA BrokerCheck. IAPD may direct users to BrokerCheck for brokers and registered representatives. BrokerCheck is free and can show employment history, licensing, regulatory actions, arbitrations and complaints.
Understand what BrokerCheck can and cannot show
BrokerCheck states that it does not include some civil litigation and criminal matters. Therefore, a clean-looking result is not proof that no concern exists. Conversely, a disclosure should be read in context rather than treated as a final judgment without reviewing the facts and outcome.
Use BrokerCheck to test whether the person’s brokerage history matches the role they described. If the professional says they will act only as an investment adviser but the proposed transaction is brokerage business, ask why the capacity differs and which conduct standard applies to that transaction.

Questions to ask before you hire anyone
Send these questions by email or include them in your meeting notes. Written answers make it easier to compare the response with Form ADV, Form CRS and the agreement.
- “In what capacity will you act for me on this engagement—as an investment adviser, broker or both?” Ask for the answer separately for planning, ongoing portfolio management and each proposed transaction.
- “When does your fiduciary duty apply to my account or advice?” Ask when it begins, what services it covers and whether any part of the relationship is governed by a different standard.
- “How are you and your firm paid?” Request a complete explanation of advisory fees, commissions, referral payments and other compensation connected to your account or recommendations.
- “What conflicts could affect your recommendations, and where are they disclosed?” Ask the professional to identify the relevant Form ADV or Form CRS section.
- “What services are covered by the agreement?” Confirm whether the contract includes a financial plan, investment selection, monitoring, implementation, insurance or brokerage transactions.
- “Who has discretion over my account, and what limitations apply?” Make sure any authority you grant is described in the contract and matches the filing.
Vague answers, a refusal to identify the capacity, or a request to rely on a title instead of documents are reasons to pause. A clear answer should be consistent with the official records and the agreement.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to compare two professionals
When several candidates appear qualified, compare the relationship rather than the marketing language. Form CRS summarizes several of these topics, while Form ADV supplies fuller firm disclosures.
| Comparison point | What to verify | Why it matters |
|---|---|---|
| Capacity and services | Whether the person will act as an investment adviser, broker or both, and which services are included | The applicable conduct standard may depend on the role and service |
| When the standard applies | The professional’s written explanation of when fiduciary duty applies to your account or advice | A broad marketing statement may not cover every transaction or service |
| Fees and compensation | Advisory fees, commissions, other costs and compensation described in disclosures and the agreement | Compensation affects the economic incentives surrounding recommendations |
| Conflicts | Conflicts listed in Form ADV or Form CRS and how the firm says it addresses them | Disclosure lets you evaluate incentives instead of guessing about them |
| Registration and history | Matching IAPD records, active registration and relevant BrokerCheck information | You can verify identity, authorization and disclosed regulatory history |
| Contract consistency | Whether the proposed agreement matches the verbal description and regulatory filings | The signed scope controls what you have actually engaged the firm to do |
How to interpret warning signs without jumping to conclusions
Some findings require clarification rather than an automatic yes-or-no decision.
A person is not listed exactly as expected
Check spelling, the firm’s legal name and whether the person is listed under a different registration category. Ask the firm to explain the mismatch and verify the answer through the applicable regulator before proceeding.
The professional uses “fiduciary” prominently but gives no specific answer
Ask which capacity and services the statement covers. “Fiduciary” without a defined scope does not tell you whether it applies to a particular account, recommendation or transaction.

The documents disclose a conflict
A disclosed conflict is not automatically disqualifying. Determine what the conflict is, how the firm manages it, what compensation is involved and whether the arrangement still fits your needs. If the explanation is unclear, obtain independent advice before signing.
The database shows a disclosure
Read the underlying description, dates and resolution. Ask focused questions rather than treating a database entry as either proof of wrongdoing or proof that nothing happened.
The database looks clean
Remember BrokerCheck’s stated coverage limits, including the omission of some civil litigation and criminal matters. A clean result is one data point, not a guarantee.
Keep a due-diligence file
Save the IAPD pages, current Form ADV brochure, Form CRS, BrokerCheck report when relevant, emails answering your questions and the final agreement. Record the date you checked each database because registration and disclosures can change. Recheck the records when the relationship changes, such as when the firm proposes a new service, product or account type.
Organize your notes under four headings: identity and registration, services and capacity, fees and compensation, and conflicts and disciplinary disclosures. This makes it easier to spot a discrepancy between a sales conversation and the documents you are being asked to sign.
What this check can—and cannot—establish
IAPD, Form ADV, Form CRS and BrokerCheck provide official registration and disclosure information. They do not make a hiring decision for you, guarantee investment results or establish the legal standard for every financial-planning, insurance, brokerage or advisory service. The professional’s capacity, the service, the account and the governing agreement all matter.
If an answer remains unclear, ask the firm to identify the governing document and the exact service to which its statement applies. For a complicated or high-value engagement, consider obtaining advice from an appropriately qualified independent professional who is not being paid by the adviser you are evaluating.

A practical final checklist
- Search the individual and firm in IAPD.
- Match the identity and employer to the person who contacted you.
- Confirm relevant active registration.
- Read the current Form ADV brochure.
- Read Form CRS and note services, costs, conflicts, conduct standard and disciplinary history.
- Search BrokerCheck if the person or firm has a brokerage role.
- Ask when fiduciary duty applies to your specific account or advice.
- Get compensation and conflict answers in writing.
- Compare every answer with the disclosures and proposed agreement.
- Save dated copies and pause if the documents do not match the sales explanation.
Bottom line
Checking fiduciary status is a document-and-relationship exercise, not a title check. Verify the individual and firm in IAPD, read Form ADV and Form CRS, use BrokerCheck for brokerage roles, and obtain a written explanation of capacity, scope, compensation and conflicts. Hire only after those details align with the agreement you will sign.
