How to Check Whether a Canadian Property Is in a Restricted Area Before You Buy

Use the Canada Mortgage and Housing Corporation’s official CMA/CA address lookup to answer one federal question: whether the exact property address is inside a Census Metropolitan Area (CMA) or Census Agglomeration (CA) for the Prohibition on the Purchase of Residential Property by Non-Canadians Act. That map is not a complete “restricted area” search. You must also confirm the buyer’s legal status, the property’s dwelling-unit type, any statutory exception, and separate provincial, territorial, municipal and title-related restrictions.

What “restricted area” means in Canada

The phrase can describe several different legal issues. In the context of a non-Canadian buying a home, the federal rule uses statistical geography rather than a municipal boundary or a general idea of whether a place is urban or rural. The relevant question is whether the exact civic address falls within a CMA or CA under Statistics Canada’s Standard Geographical Classification 2021.

As an Amazon Associate I earn from qualifying purchases.

A property can therefore be outside the federal foreign-buyer prohibition and still face another limitation. Municipal zoning, provincial or territorial land-ownership rules, conservation or flood designations, Indigenous land interests, easements, restrictive covenants, title defects and development approvals are separate matters. The federal map cannot answer those questions.

The federal address check: step by step

1. Collect the exact address

Obtain the complete civic address, including the street number, street name, municipality, province or territory and postal code when available. Use the address for the parcel you intend to buy, not the name of the nearest city, a neighbourhood label, a rural route, or the location shown in a broad listing search. A large municipality can contain addresses with different statistical classifications, and a property that feels rural can still be inside a CMA or CA.

2. Open the official CMA/CA address lookup

CMHC’s official FAQ links to an address map. Enter the complete address and submit the search. CMHC says the map indicates whether that address is in a CMA or CA. Save a copy or screenshot of the result with the search date and the address you entered; it creates a useful transaction record, although it is not a legal opinion.

3. Record the geographic result precisely

Write down whether the map identifies the address as being inside a CMA, inside a CA, or outside both. The regulations use the 2021 Standard Geographical Classification, so do not substitute an older census map or a third-party boundary layer. If the map cannot locate the address, correct the formatting and try the postal code or the official civic-address format supplied by the municipality.

4. Treat the map as one condition, not a purchase decision

An “inside” result does not automatically make a purchase illegal, and an “outside” result does not make every acquisition permissible. The prohibition applies to specified non-Canadians buying qualifying residential property, subject to exceptions and detailed conditions. Complete the buyer-status and property-type checks before relying on the geographic result.

5. Escalate uncertainty

Ask a Canadian real estate lawyer to review the matter when the address is ambiguous, ownership will use a corporation or trust, the buyer’s immigration status is unusual, several purchasers are involved, or a local restriction may apply. CMHC describes its information as general guidance rather than legal or professional advice.

How the CMA and CA categories work

Category CMHC’s population description Why it matters here
Census Metropolitan Area (CMA) At least 100,000 total population, including at least 50,000 in the core An address inside a CMA is within the federal geographic area covered by the prohibition, subject to buyer, property and exception rules.
Census Agglomeration (CA) At least 10,000 people in the core An address inside a CA is treated the same way for the federal geographic test.
Outside both a CMA and a CA The regulations exclude these locations from the federal geographic prohibition This answers only the location element. Other federal, provincial, territorial, municipal or title rules can still apply.

The population thresholds explain how the statistical categories are defined; they are not a substitute for checking an individual parcel. Use the address lookup for the property you are considering.

Who is restricted under the federal Act?

The Act’s “non-Canadian” definition is broader than “someone who lives outside Canada.” It includes an individual who is neither a Canadian citizen, a person registered under the Indian Act, nor a permanent resident. It also reaches specified corporations and other entities, including certain privately held Canadian entities controlled by non-Canadians.

That means a Canadian-incorporated company is not automatically outside the rule. The ownership and control structure, the identities of all purchasers and the way title will be registered can change the analysis. A lawyer should review shareholders, beneficial owners, partnerships, trusts and nominees where relevant.

Conversely, a person who appears to be a non-Canadian may qualify for a statutory exception. Do not infer eligibility from nationality, a work permit, a student status or a spouse’s status without checking the precise conditions in the Act and regulations.

What kinds of property are covered?

The federal prohibition concerns qualifying residential property. CMHC’s guidance generally describes covered buildings as those with up to three dwelling units, and it includes separate residential units such as condominiums. The Act does not prohibit buying a larger building with four or more units under this particular residential-property rule.

Property situation Federal treatment described by CMHC Practical check
House or other building with up to three dwelling units Generally within the residential-property category Confirm the legal unit count and whether another rule changes the result.
Condominium or other separate residential unit Can be covered as a residential property Review the unit’s legal description and the condominium documents.
Building with four or more dwelling units The Act does not prohibit its purchase under this rule Check commercial, zoning, financing and local requirements separately.
Vacant land Outside the prohibition since March 27, 2023, according to CMHC Confirm that the transaction is genuinely vacant land and investigate intended use and local development controls.
Land or property bought for development An exception may apply, subject to conditions Obtain advice on the development plan, entity and documentary requirements before signing.

Unit counts and legal descriptions matter. A listing’s marketing description is not conclusive evidence of how many dwelling units the property legally contains.

Exceptions are conditional, not blanket exemptions

CMHC and the regulations describe several possible exceptions. They include certain temporary residents who meet prescribed conditions, protected persons, some purchases made with an eligible spouse or common-law partner, inheritances or gifts, transfers connected with divorce or separation, vacant land, and qualifying purchases for development.

Each exception has its own requirements. A temporary resident may need to satisfy residence, tax or permit conditions; a spouse-based exception depends on the spouse or common-law partner’s eligibility and the transaction structure; an inheritance or separation transfer has a specific legal context; and development transactions require more than an intention to build someday. Treat an exception as a checklist to prove, not as a label to select.

  • Identify the exact statutory provision you believe applies.
  • Gather documents proving every condition, such as immigration records, relationship evidence, probate or separation documents, corporate records and development approvals.
  • Have counsel confirm that the exception covers this purchaser, this property and this form of title.

What an “outside CMA/CA” result does—and does not—tell you

If the official map places the address outside both a CMA and a CA, the regulations except that location from the federal geographic prohibition. This is the answer to the narrow question, “Can a non-Canadian buy a home outside a CMA?” It is not a universal authorization to buy.

You still need to verify that the buyer is not otherwise captured through an entity or control arrangement, that the property classification is accurate, and that no other federal rule applies. Provincial and territorial laws can restrict land ownership or impose approval requirements. Municipal governments can regulate permitted uses, density, short-term rentals, building work and servicing. Conservation, flood and environmental overlays can limit what may be done with the land even when ownership is allowed.

Broader due diligence after the federal map

Provincial and territorial rules

Ask the relevant land registry, ministry or provincial or territorial authority whether special rules apply to non-resident ownership, agricultural land, protected areas, shoreline parcels or particular classes of land. The answer can differ by province or territory and may depend on acreage, use, residency, corporate control or approval thresholds.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Municipal planning and zoning

Request the municipality’s zoning designation, official plan information, permitted-use list, parking and servicing requirements, and any development or demolition constraints. A property advertised as a home, duplex or development site may not have that legal use.

Conservation, flood and environmental designations

Check conservation-authority or equivalent mapping, floodplain rules, wetlands, habitat protections, contaminated-site records and shoreline setbacks where relevant. These designations can affect insurance, financing, rebuilding and development even when title transfers normally.

Indigenous land interests and local agreements

Where the parcel is near reserve land, treaty areas, settlements or other Indigenous interests, ask the responsible authority and your lawyer whether consultation, consent, registration or contractual limits affect the transaction or intended use.

Title and parcel-specific encumbrances

Order a current title search and review easements, rights of way, restrictive covenants, leases, liens, notices, subdivision agreements and boundary information. A clean-looking listing does not establish that the seller owns every interest being represented or that the parcel can be used as advertised.

Current duration of the federal prohibition

The Act came into force on January 1, 2023. On February 4, 2024, Finance Canada announced the government’s intent to extend the ban from its then-scheduled January 1, 2025 end date to January 1, 2027. CMHC also reports that extension. Because the Finance release described an announcement of intent, verify the effective legal position in the consolidated Justice Laws text at the time of your transaction. The Justice Laws record was current to September 21, 2026 and listed the last amendment as January 1, 2023.

The policy objective was stated by then Deputy Prime Minister and Finance Minister Chrystia Freeland: “By extending the foreign buyer ban, we will ensure houses are used as homes for Canadian families to live in and do not become a speculative financial asset class. The government is intent on using all possible tools to make housing more affordable for Canadians across the country.” That statement explains the policy goal; it does not replace the enacted text or its regulations.

Consequences of getting the analysis wrong

A violation of the Act is a criminal offence. Parliament provides for a fine of up to $10,000, and a court may order a sale after conviction. The financial and transaction risk can therefore extend beyond losing a deposit or having a closing delayed.

Do not close first and investigate later. Put the legal review, ownership structure, exception evidence and address result into the purchase timeline, and make the agreement conditional on satisfactory legal and title due diligence where possible.

Common mistakes and how to fix them

Using the nearest city as a shortcut

Problem: A buyer assumes that a rural-looking property is outside the restriction or that every address with the same city name has the same status.

Fix: Run the exact civic address through the official map and retain the result.

Confusing the federal map with a zoning search

Problem: The buyer treats “outside CMA/CA” as proof that building, renting, subdividing or operating a business is permitted.

Fix: Obtain municipal planning information, conservation and flood checks, and a title search separately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assuming a Canadian corporation is automatically exempt

Problem: The buyer relies on incorporation in Canada without analyzing control or beneficial ownership.

Relying on stale law

Problem: A guide or old listing says the ban ended in 2025.

Fix: Check the current consolidated Act and regulations immediately before signing and again before closing, particularly as January 1, 2027 approaches.

Entering an incomplete or wrong address

Problem: The map returns no result or identifies a nearby parcel.

A practical pre-offer checklist

  1. Obtain the exact civic address, legal description and parcel identifier.
  2. Run the address through CMHC’s official CMA/CA lookup and save the dated result.
  3. Confirm whether the buyer is a Canadian citizen, person registered under the Indian Act, permanent resident, non-Canadian individual or entity potentially controlled by non-Canadians.
  4. Classify the property accurately: dwelling-unit count, condominium status, vacant land, larger multi-unit building or development transaction.
  5. Identify any claimed exception and collect documents proving its conditions.
  6. Check provincial or territorial ownership rules and required approvals.
  7. Obtain municipal zoning and permitted-use information.
  8. Check conservation, flood, environmental and Indigenous-interest issues relevant to the parcel.
  9. Order title, survey and encumbrance searches and review easements, covenants, liens and notices.
  10. Have a Canadian real estate lawyer confirm eligibility before waiving conditions or closing.

When professional advice is essential

Professional review is particularly important when the address is close to a statistical boundary, the property is vacant land or a mixed-use building, the buyer has temporary status, a spouse or common-law partner is involved, a corporation or trust will take title, or the intended use involves development. Bring the map result, purchase agreement, title information, immigration documents and ownership chart to the consultation. CMHC’s own disclaimer makes clear that its online material is general guidance, not legal or other professional advice.

The safest interpretation is narrow: the CMHC map answers whether this address is in a CMA or CA for one federal rule. Only the combined review of buyer status, property classification, exceptions, current legislation and local and parcel-specific due diligence can tell you whether the proposed purchase can proceed.
