How to Check for Liens on a Home Before Buying It

To check for liens before buying a home, identify the exact parcel, search the county land-record system under the current owner and parcel or legal description, check separate court, tax and municipal records, and have a title company or closing attorney verify every apparent claim. An online recorder search is only an initial check—not proof that the title is clear. The title professional’s commitment should show what must be paid, released or otherwise resolved before you accept the deed.

What a lien can mean for a home buyer

A lien is a claim that can secure payment from real estate. Common examples include an unreleased mortgage or deed of trust, a judgment lien, a federal or state tax lien, delinquent real-estate taxes, municipal charges, a contractor or mechanic’s lien, and certain homeowners-association claims. A title search may also reveal easements, restrictions and rights of way. Those items are encumbrances even when they are not liens, and they can affect how you use the property.

Priority, filing requirements and the office that keeps each record depend on state and local law. One county’s recorder may not maintain court judgments or tax claims. Maryland Courts, for example, separates land records from court judgments and directs users to tax or municipal offices for other charges. Montgomery County, Pennsylvania, likewise says its recorder handles mortgages while federal and state tax liens may be filed with the Prothonotary and delinquent property taxes with the Tax Claim Bureau. See Maryland Courts’ land-record guidance and the Montgomery County Recorder of Deeds FAQ for examples of this division.

If a valid lien remains attached when ownership changes, the creditor may retain enforcement rights under applicable law. Do not decide from a search-result snippet whether a claim is valid or whether you can safely close. Confirm the property, the debtor, the recording details and any release with the title professional handling your transaction.

The practical six-step lien check

1. Get the exact parcel and legal description

Ask the seller or agent for the parcel, account or assessor number and the legal description shown in the listing, deed or tax record. An address is a useful starting point, but official indexes may use the owner’s name, parcel number, document number or legal description instead. Compare the legal description and parcel identifier in every result so that a similarly named owner or a neighboring property does not get mistaken for the home you are buying.

  • Record the property’s street address, county and state.
  • Obtain the current owner’s full legal name, including middle initials or suffixes when shown in the records.
  • Note alternate spellings, former names and business or trust names connected with the ownership.
  • Save the parcel number and legal description from an official record rather than relying only on a listing.

2. Search the county recorder or equivalent land-record office

Find the recorder, register of deeds, clerk of court or other office that records deeds in the property’s county. Search the current owner’s name and reasonable name variations. If the system allows it, search the parcel number and legal description as well. Look for deeds, mortgages or deeds of trust, assignments, recorded lien notices, releases, satisfactions and reconveyances.

Maricopa County says its recorded documents are searchable and advises searching the property owner’s name to locate a lien. Its Recorder of Deeds FAQ also warns that the website search is not a guarantee that a property is free of liens. That warning applies broadly: online indexes can be incomplete, delayed or limited to particular document types.

Download or print the complete document for each possible lien. Capture the recording date, instrument or document number, claimant, debtor, amount stated, legal description and any later release. A result that merely displays a name is not enough to establish that the claim attaches to this parcel.

3. Check offices outside the land-record index

Ask the county or state which offices maintain records that do not appear in the recorder’s search. Depending on the jurisdiction, check:

  • Court clerk or judgment index: civil judgments, money judgments and other court-created claims.
  • Tax collector, tax-claim bureau or finance office: unpaid real-estate taxes, tax sales and some tax liens.
  • City or county finance department: municipal assessments, utility charges, code-enforcement costs or other charges that can become liens.
  • State or federal filing office: certain tax liens or other claims filed under state or federal procedures.

Maryland Courts specifically directs users to case search because some judgment liens may be outside the land-record system. The state’s guidance is available at https://maintenance.mdcourts.gov/legalhelp/landrecords. Montgomery County’s FAQ gives a separate example of searching the Prothonotary for federal or state tax liens and the Tax Claim Bureau for delinquent property taxes: https://www.montgomerycountypa.gov/departments/recorder-deeds/faqs.

Use the property’s location to identify the correct offices. There is no universal United States search page that contains every lien category for every property.

4. Verify every apparent match and look for releases

For each possible lien, compare four things:

  1. The legal description or parcel identifier in the filing.
  2. The debtor’s identity, including middle names, suffixes and entity names.
  3. The recording or case information and the claimant’s identity.
  4. A later release, satisfaction, discharge, reconveyance or court order showing that the claim was resolved.

A mortgage that still appears in the index may have been paid off without the release being recorded or properly indexed. Conversely, a judgment against someone with the same name may concern a different person or property. Treat both situations as verification issues for the title company or closing attorney.

Some government databases update less often than the underlying records. Missouri’s tax-lien search, for example, says its information updates weekly and tells users to contact the circuit clerk or county recorder for official information. The search is available at Missouri’s Find Tax Liens portal. A recent filing or release may therefore require confirmation directly from the filing office.

5. Obtain and read the title commitment before closing

After your offer is accepted, ask the title company or closing attorney for the title search results and the title commitment or equivalent report. A professional search is intended to identify open mortgages, judgments, real-estate taxes and other title defects or encumbrances before settlement. Maryland’s Insurance Administration explains this pre-settlement process in its Title Insurance consumer guidance.

Read the commitment’s requirements and exceptions, not just the phrase “title search complete.” For every item, ask:

  • What record created the lien or exception?
  • Does it attach to this parcel and this seller?
  • Is a payoff, release, satisfaction, court order or other document required?
  • Who is responsible for obtaining it, and by what point in the closing process?
  • Will the final policy list the item as an exception?

The seller typically must resolve items that prevent delivery of the promised title, but the contract and local law control. Do not assume a seller’s verbal assurance is a release. Ask to see the recorded or officially confirmed document and make sure the closing statement reflects any payoff.

6. Review the title insurance you will receive

A lender’s title policy protects the lender’s loan interest. It does not substitute for coverage of your equity. Ask whether an owner’s policy will be issued, request the actual jacket and endorsements, and review the exceptions, exclusions and effective date.

The Indiana Department of Insurance states that a seller’s policy does not protect the buyer and explains the purpose of a title search at https://www.in.gov/idoi/title/what-is-a-title-search/. Massachusetts describes separate owner’s and lender’s policies and notes that an owner’s policy is not legally required there; that state-specific rule should not be generalized to other states. Its information is at https://www.mass.gov/info-details/title-insurance.

Title insurance is governed by the policy’s terms. A policy may exclude a lien that was listed as an exception, a matter created by the buyer, or a defect outside the policy’s coverage. North Carolina’s Department of Insurance provides additional consumer information at https://www.ncdoi.gov/consumers/homeowners-insurance/title-insurance. Ask the issuing company to explain any exception you do not understand before signing.

Where to look for each type of claim

Possible issue Likely record source What to verify
Unreleased mortgage or deed of trust County recorder or register of deeds Original loan document, assignments, payoff and recorded release or reconveyance
Money or judgment lien Court clerk, judgment index and sometimes land records Correct debtor, case number, property connection, judgment status and satisfaction
Federal or state tax lien Recorder, court or state/federal filing office, depending on jurisdiction Taxpayer identity, filing office, notice details and official release or withdrawal
Delinquent property taxes or tax sale Tax collector, tax-claim bureau or county/city finance office Tax period, balance, sale status and conditions for discharge
Municipal charges City or county finance, utility or code-enforcement office Account balance, property assignment and whether payment clears the claim
Contractor or mechanic’s lien Land records and, in some states, a court docket Improvement address, claimant, filing deadline, amount and release or bonding
Homeowners-association claim Land records, association records or both Assessment ledger, notice, recorded claim and payoff amount

The exact filing office and legal effect of each category vary by state and locality. Use the table as a checklist for questions, not as a substitute for the property’s local procedure.

Can you search property liens by address?

Sometimes, but an address-only search is unreliable. Many official systems index documents by owner name, parcel number, document number or legal description, and some do not offer address searching at all. Start with the address to find the correct county and parcel, then search the owner and parcel identifiers. Confirm that every result’s legal description matches the home.

Search name variations carefully. A filing may use a middle initial, a former surname, a trust, a corporation or a different spelling. At the same time, broadened name searches create false matches. A matching name without the correct parcel, debtor and recording details is not proof of a lien on the home.

What to do when a lien appears

An old mortgage still shows as open

Ask the seller and title professional to trace the loan through assignments, payoff records and the recorder’s index. The title company may request a payoff statement from the lender and a recorded release or reconveyance. Do not close on the assumption that the debt was paid merely because the seller says it was.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A judgment or tax lien matches the seller

Have the title professional confirm the identity, case or filing number and attachment to the parcel. The responsible party may need to pay the claim, obtain a satisfaction or release, or secure a court order before closing. If the amount, priority or validity is disputed, ask a real-estate attorney licensed in that jurisdiction to advise you.

Delinquent property taxes or municipal charges are found

Request an official payoff or tax certificate from the relevant office. Clarify the period covered, interest or penalties, payment deadline and whether the office will issue evidence that the claim is cleared. Make sure the closing documents allocate the payment as required by the contract and local practice.

A contractor, HOA or other private claim is recorded

Do not negotiate solely with the seller. Ask the title company or attorney to identify the claimant, determine whether the filing is enforceable and specify the required release, satisfaction, bond or other cure. Keep the issue open until the professional confirms how it will be reflected in the commitment and final policy.

The seller cannot establish authority to convey

Stop and obtain legal advice if ownership is disputed, a foreclosure or tax sale is involved, an estate or trust lacks documentation, or the seller cannot show authority to sign. The reviewed government guidance supports professional help for fact-specific title and legal questions; it does not provide a universal cure for these situations.

Self-search versus a professional title search

A public-record search is useful for spotting questions early, but it is not equivalent to the search and underwriting performed for a title commitment. Compare the approaches on the issues that affect your risk:

Question Your preliminary search Title company or closing attorney
Records and jurisdictions covered Only the offices and databases you locate and search Should identify the local land, court, tax and municipal sources relevant to the transaction
Indexing May rely on an address or one name variation Can review owner names, parcel/legal description and document chains
Releases and satisfactions You must interpret filings and connect later documents Reviews whether requirements and releases support insurable title
Unresolved exceptions You may find a document but not know its effect Lists exceptions and requirements in the commitment
Cure responsibility No formal party is assigned to resolve an issue Closing professionals coordinate payoffs, releases and documentation
Insurance No policy is created by a website search Can issue or arrange an owner’s and lender’s policy under stated terms

Government sources do not establish a single nationwide price or service standard for these searches. Ask the closing professional what records were examined, what remains pending and what the quoted title charges cover.

Common mistakes that create false confidence

  • Searching only the address: the record may be indexed under an owner, parcel or legal description.
  • Using only the recorder’s website: judgments, taxes and municipal charges may be maintained elsewhere.
  • Treating a name match as conclusive: similar names and unrelated parcels are common sources of error.
  • Ignoring releases: an original lien may remain visible even after payoff, while a release may be filed separately.
  • Assuming the database is current: some systems update periodically; Missouri’s tax-lien search, for example, reports weekly updates.
  • Reading the lender’s policy as your protection: that policy protects the lender’s interest, not automatically your equity.
  • Closing before requirements are cleared: ask what must be paid or recorded and confirm the final documents.

Questions to ask before you sign closing documents

  1. Which land-record, court, tax and municipal offices were searched?
  2. Were the owner’s name variations, parcel number and legal description all checked?
  3. Does every apparent lien match this parcel and this seller?
  4. Which mortgages, judgments, taxes or other charges remain open?
  5. What payoff, release, satisfaction or court document is required for each item?
  6. Who is responsible for obtaining each cure, and has it been received or recorded?
  7. Which exceptions will appear on the final owner’s policy?
  8. What does the owner’s policy exclude, and when does coverage begin?
  9. Is any issue serious enough that an independent real-estate attorney should review it?

When to get an attorney

Use a local real-estate attorney when the parties dispute whether a lien is valid, priority is uncertain, a foreclosure or tax sale is involved, the seller’s ownership authority is unclear, or the title professional cannot explain how the issue will be cured. The relevant law is jurisdiction-specific, and a general internet search cannot resolve those facts.

The safest workflow is to use public records to identify questions, then rely on the title commitment and qualified local professionals to determine what must happen before ownership transfers. Keep copies of the search results, payoff statements, releases and final policy with your purchase records.
