Start with the official land-records office for the property’s county or other recording jurisdiction. Search the parcel identifier or legal description, then search the current and prior owners’ names. Read the underlying deeds, mortgages, releases, judgments, tax records and other recorded documents rather than relying on a result label or an address-only search.
That search is only the first layer. Court judgments, delinquent property taxes and municipal charges may be maintained elsewhere. For a purchase, refinance or loan secured by real estate, have a title professional examine the relevant records and issue a preliminary title report or commitment. Investigate every exception, obtain an authoritative payoff when necessary, and confirm that the required release or other clearing document is recorded before closing or funding.

What a lien check can—and cannot—tell you
A lien is a claim against property or an owner’s interest that may secure payment of a debt or obligation. A recorded mortgage, mechanic’s lien, judgment lien or tax lien can affect whether a buyer receives clear title or whether a lender’s security interest is adequately protected.

It may not establish the current balance, enforceability, priority, expiration, foreclosure effect or treatment in a sale. Record systems are not uniform across the United States. A county recorder, register of deeds or clerk may index documents differently from a court, tax collector or municipal finance office. Some offices provide an online index but do not certify that the index is complete. The Indiana State Board of Accounts’ 2024 County Recorders Resource Library, for example, describes a jurisdiction in which the recorder has no affirmative duty to search and certify records on request. Treat a free online lookup as a starting point, not proof that no liens exist.
For a transaction, the practical standard is a documented search scope, a review of the title report or commitment, and recorded evidence that unresolved claims have been cleared or accepted under the transaction’s terms.
Step 1: Identify the property and the governing recording jurisdiction
Confirm where the records are held
Determine the county, city or other jurisdiction that records instruments affecting the property. A property near a boundary may have a mailing address associated with a different municipality, so confirm the recording office from the legal description, tax bill or assessor information.

Search interfaces, fees, image availability and name-index conventions vary. The office may be called a recorder, register of deeds, clerk, land records department or another local equivalent.
Collect reliable identifiers
- Parcel identification number or assessor’s parcel number.
- Full legal description, including lot, block, subdivision, metes-and-bounds or condominium information when available.
- Current street address and prior addresses, if the property has been renumbered or renamed.
- Current owner’s exact legal name, including middle initials, business suffixes and entity names.
- Names of recent prior owners shown in the deed chain.
An address can be misspelled, changed or indexed inconsistently. A parcel number and legal description generally provide a more dependable path to the property index, while owner-name searches help locate documents that are indexed by party rather than parcel.
Step 2: Search land records and read the documents
Follow the chain of title
Begin with the current deed and work backward through prior conveyances far enough to satisfy the title professional’s search period. Check that the names, legal description and ownership sequence are consistent. A deed may refer to an earlier instrument or contain a legal-description error that needs examination.
Review security instruments and their status
Look for mortgages, deeds of trust, assignments, modifications, assumptions and satisfactions or releases. An old mortgage entry is not necessarily an active debt, but it should have a recorded satisfaction, release or other documented disposition. Verify that the release covers the correct borrower, property and instrument.

Depending on local law and indexing, land records may contain mechanics’ or construction liens, judgment liens, federal or state tax liens, condominium or homeowners-association claims, utility or municipal charges, and other encumbrances. Clark County Recorder guidance lists mechanics’, government and judgment liens as examples of recordable liens.

Open the scanned document instead of relying on the index description. Record the recording date and number, claimant, debtor, amount stated, property description, expiration or continuation language, and any release, dismissal, rescission, termination or cancellation that follows it. Compare every apparent lien with later documents.
Check maps and other encumbrances
A title examination may also consider easements, restrictions, rights-of-way, covenants, leases and maps. These may not be liens, but they can affect use, value or a lender’s collateral. The California Department of Insurance describes title searches as examinations of public records that can include deeds, mortgages, court judgments, tax records, liens, encumbrances and maps.
Step 3: Search court records under the owner’s name
A parcel-only land-record search may miss a judgment entered against an owner. Search the relevant state and local court systems for the current owner and, when the title professional advises it, recent owners. Use exact and reasonably varied name forms, including business names and common abbreviations.
Maryland Courts’ land-record guidance tells users to search court case records for judgments against an owner when the relevant lien may not appear in land records. A court search may reveal the case, judgment creditor, amount, status, appeal, satisfaction or other information needed to determine whether a judgment affects the property.
Do not treat a name match as proof that the property is encumbered. Common names, similar entities and unrelated cases are frequent sources of false matches. Match the defendant’s identity, address, case details and applicable recording or indexing rules, then ask counsel or the title professional how the judgment attaches, if at all.
Step 4: Check property taxes and municipal charges separately
Contact the office responsible for the property-tax account, such as the county tax collector or treasurer. Ask for the current balance, delinquent installments, penalties, payment arrangements, pending sales or certificates, and the date through which the figures are valid.
Also contact the city, town, county finance department, utility authority or other responsible office about municipal liens and charges. Maryland Courts directs users to local finance offices for unpaid taxes and other municipal liens. These balances may not be indexed in the same land-record system as deeds and mortgages.
Obtain written payoff or status information when a closing depends on it. A tax balance can change after a search date, so the settlement agent or title company should request an updated figure close to closing and document payment.

Step 5: Decide whether a professional title search is necessary
When self-searching may be useful
A self-search can help a prospective buyer or lender understand the public record, spot obvious issues and prepare questions. It is especially useful before spending money on an appraisal or inspection, or when screening a property that is not yet under contract.
Its limits are substantial: indexes differ, some records are maintained elsewhere, historical documents may be difficult to interpret, and an office may not certify completeness. Maryland Courts warns that finding all liens can be difficult and suggests considering counsel or a title company for a transfer.
What a professional search adds
A title company or qualified title examiner examines historical public records to determine ownership, identify outstanding debts and other defects, and prepare a preliminary title report or commitment. The report identifies the proposed insured, legal description, requirements to be satisfied and exceptions that the policy will not cover unless removed or modified.

- Which jurisdictions, record systems and search periods were covered?
- Were both parcel indexes and owner-name indexes searched?
- Were court judgments, tax accounts and municipal records checked, or are those separate items?
- What search date applies, and will the records be updated immediately before closing or funding?
- Which exceptions remain, and what document or action will remove each requirement?
- Who will verify that releases and payoffs have been recorded?
For a purchase, refinance or secured loan, professional examination is the practical way to turn scattered records into a transaction-ready assessment. The title professional’s scope should be explicit rather than assumed.
Self-search versus professional examination
| Question | Self-search | Professional examination |
|---|---|---|
| Primary purpose | Initial screening and issue spotting | Transaction-focused ownership and defect analysis |
| Records | Usually starts with the local land-record index | Scope can include land records, court records, tax and municipal offices, and applicable UCC records |
| Search keys | Parcel, address and names searched by the individual | Parcel and owner-name indexes reviewed under a defined search period |
| Output | Documents and notes gathered by the searcher | Preliminary title report or commitment with requirements and exceptions |
| Release verification | Must be arranged and checked by the buyer or lender | Title professional or closing team coordinates required evidence and final update |
| Legal interpretation | Limited unless the searcher obtains advice | Issues are presented for review by the title professional and, when needed, real-estate counsel |
Step 6: Investigate and clear a potential lien
Identify the correct claimant
Match the recorded document to the creditor, contractor, taxing authority, judgment creditor or other liening party. Confirm that the claimant has authority to provide a payoff or release. An outdated phone number, third-party collection contact or copied document is not enough to establish current status.
Request an authoritative payoff or status statement
Ask for the amount required to satisfy the claim through the proposed closing or funding date, payment instructions, expiration date of the quote and the document that will be recorded after payment. Clark County Recorder guidance says the payoff amount should be obtained from the liening party.
Do not assume the amount written on the original lien is the current balance. Interest, fees, partial payments, renewals, assignments and court orders may change it. A payoff quote also is not the same as a recorded release.

Require the right clearing document
Depending on the claim and jurisdiction, clearance may involve a release, satisfaction, discharge, termination, dismissal, rescission, cancellation, withdrawal or an amended filing. Clark County identifies these kinds of recordable documents as ways recorded actions can be reversed or cleared.

Confirm the document is signed by the proper party, identifies the original recording information and property, meets local formatting rules and is filed in the correct office. Obtain the recording number or certified copy and have the title professional review it before treating the requirement as satisfied.
Use closing controls
When the parties agree to pay a lien from closing proceeds, the settlement statement should identify the payee and amount, and the closing instructions should require recording or delivery of the release. If the release cannot be recorded promptly, ask the title professional and counsel whether an escrow, undertaking or other jurisdiction-specific procedure is acceptable. Do not fund solely on an unverified promise that a release will be filed later.

Define the collateral first
Real-property title work answers questions about the land and interests recorded against it. A loan may also take fixtures, equipment, inventory, crops, accounts or other personal property as collateral. Those assets can require different filings and searches.
Recommended Free Tools
The USDA Farm Service Agency’s procedures illustrate a lending context in which county records and Secretary of State UCC records are searched. That is an example of transaction-specific practice, not a universal checklist. Ask the lender’s counsel whether the collateral includes personal property or fixtures and which debtor names, jurisdictions and filing offices apply.
Check priority without assuming a national rule
Mortgage and lien priority can depend on the lien category, recording date, notice, statutory rules, renewals, subordination agreements and the facts of the loan. No single rule determines whether every lien survives a sale or foreclosure nationwide. Obtain a jurisdiction- and lien-specific opinion from qualified counsel when priority affects underwriting.
Update the search before funding
A search performed weeks or months earlier may not capture a newly recorded mortgage, judgment, tax lien or construction claim. Establish a date for the final update and require evidence that intervening filings have been reviewed. The lender should also verify execution, recording and coverage requirements for its mortgage or deed of trust.
Title insurance: separate protection for owners and lenders
A title search and a title policy are related but distinct. The search examines records and identifies potential defects. A policy is a contract that covers specified risks subject to its issue date, face amount, exclusions and exceptions.

Owner’s policy
An owner’s policy protects the buyer’s covered interest under the policy terms. The California Department of Insurance explains that a buyer may insure the full purchase price. Coverage still depends on the policy language and on matters excluded or listed as exceptions.

Lender’s policy
A lender’s policy protects the lender’s covered security interest, generally in relation to the loan. The California Department of Insurance explains that the required lender coverage is tied to the loan amount. It does not protect the buyer’s equity and is not a substitute for an owner’s policy.
What to review
- Named insured and whether the policy is for the owner or lender.
- Policy date and amount of insurance.
- Schedule of exceptions, including liens, easements, restrictions and other matters.
- Exclusions, endorsements and conditions for making a claim.
- Requirements that must be completed before the policy is issued.
Insurance complements due diligence; it does not make an unresolved lien harmless or eliminate the need to read the commitment and clear requirements.
Common mistakes and how to avoid them
Relying on an address-only search
Addresses can be inconsistent, and a parcel may have multiple historical addresses. Search the parcel or legal description and the relevant owner names.
Searching only the recorder’s index
Judgments, taxes and municipal charges may be maintained in court or finance systems. Add those checks or obtain a professional scope that covers them.
Reading a label without opening the instrument
An index entry may not reveal an assignment, partial release, expiration, correction or property-description problem. Read the recorded document and related filings.
Assuming payoff equals release
Payment and recording are separate events. Require the appropriate clearing document and verify its recording before closing or funding.
Using a stale balance
Tax accounts and creditor balances change. Request current figures valid through the transaction date.
Assuming a title policy covers everything
Exceptions and exclusions can remove important risks from coverage. Review the commitment and policy with the title professional or attorney.
Applying another state’s priority rule
Priority and foreclosure effects are jurisdiction- and lien-specific. Obtain local advice rather than relying on a nationwide rule of thumb.
A transaction-ready lien-check checklist
- Confirm the recording jurisdiction, parcel number and legal description.
- Search current and prior owner names in the official land-record system.
- Review deeds, mortgages, assignments, releases, judgments and other recorded claims.
- Search relevant court records for judgments under the owner’s legal names.
- Obtain current property-tax and municipal-charge status from the responsible offices.
- Determine whether the loan collateral includes fixtures or personal property requiring UCC or other searches.
- Order a professional title search and obtain the preliminary report or commitment for a purchase, refinance or secured loan.
- List every requirement and exception, assigning an owner and deadline for each cure.
- Obtain payoff statements directly from the liening parties or government offices.
- Confirm that releases, satisfactions, dismissals, terminations or other clearing documents are properly recorded.
- Review the final title update and policy terms before closing or funding.
When to stop searching and obtain legal help
Obtain advice from a real-estate attorney or qualified title professional when the property has a judgment, estate or divorce issue, bankruptcy, foreclosure history, construction dispute, tax sale, boundary problem, entity-name ambiguity or conflicting releases. Also seek advice when a creditor will not provide a payoff, a release cannot be located, or the parties propose closing with an exception still open.
The key question is not simply whether an index contains the word “lien.” It is whether the transaction team can establish who owns the property, what claims affect it, what must be paid or recorded, what remains excluded, and whether the buyer’s or lender’s risk is addressed by enforceable documents and the selected title policy.
