How to Check Environmental Approvals and Conditions for an Australian Gas Project

To verify an Australian gas project, first match its public name, proponent, location, gas type and any EPBC number. Then read the Commonwealth EPBC Act record and the separate state or territory approvals, including every condition, approved management plan, variation and expiry date. Finally, test current compliance against regulator audits, proponent reports and enforcement records rather than treating an approval as proof that the project is complying today.

The process is document-based. An approval tells you what action is authorised and the conditions that must be met; a current compliance conclusion requires later evidence showing whether each condition was implemented.

1. Identify the exact project before searching

Gas projects often appear under different names in Commonwealth and state or territory systems. A field development, liquefied natural gas (LNG) plant, coal-seam-gas (CSG) project, pipeline and gas-fired facility can each have separate instruments, even when a company presents them as one project. Start a file with the identifiers below.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Public project name: record the spelling used by the proponent and any abbreviated name.
  • Proponent or approval holder: include the legal entity, not only a trading name.
  • Location: list the state or territory, local government area, tenements, processing site, pipeline route and receiving waters where relevant.
  • Gas type and components: distinguish LNG, CSG extraction and gathering, transmission or export pipelines, processing plants and gas-fired generation.
  • EPBC number: capture the Commonwealth reference if one exists, for example the format used for EPBC 2009/4974.

Use the proponent, location and project components to reconcile records when names or approval numbers differ. A name match alone is not reliable where a project has been expanded, transferred or divided into stages.

Build an identity sheet

Write down the date you searched and the identifiers you used. Keep copies or stable file names for each document. This prevents a later variation or a similarly named nearby project from being mistaken for the record you intended to check.

2. Search the EPBC Act Public Portal

The Commonwealth record is the starting point for an action that may significantly affect a matter of national environmental significance (MNES). The portal record should be read as a sequence, not as a single approval summary.

  1. Search the project name, proponent and EPBC number. If the first search fails, try the location and major project component separately.
  2. Download the original referral. It describes the proposed action and the MNES issues that triggered consideration.
  3. Download the assessment material, including the assessment report or equivalent documents used for the decision.
  4. Open the original decision on approval of action notice. DCCEEW says this notice identifies the approved action, approval expiry, approver and conditions.
  5. Download every later variation notice, transfer decision, extension and management-plan decision associated with the approval.
  6. Read the full condition set in the decision notice and any instrument that changes it. A summary page is not a substitute for the operative wording.

After the Environment minister approves a project, DCCEEW publishes a notice called a “decision on approval of action.” DCCEEW’s instruction is direct: “You must comply with everything in the notice.” Conditions are legally binding, and breaches can attract civil or criminal penalties.

Separate administrative and environmental conditions

Do not skip conditions labelled administrative. They can require commencement and completion notifications, compliance records, annual reports and independent audits. These obligations create the evidence trail needed to test whether environmental conditions were met.

3. Decide whether Commonwealth approval was required

The EPBC pathway applies when an action may significantly affect an MNES. The relevant protected matters and the impact scope should be clear from the referral and assessment documents. An EPBC approval is not a general licence to operate every part of a gas business; it authorises the action described in the decision notice, subject to its conditions.

Commonwealth and state regulations operate separately. The National Environmental Protection Agency describes them this way: “Commonwealth and state regulations have distinct requirements, legal considerations, and levels of environmental protection.” A Commonwealth approval therefore does not automatically replace state or territory approvals for land use, water, pollution control or air quality.

Check the approved action against the actual project

Compare maps, capacity, extraction areas, processing units, pipeline segments and construction stages in the referral with what was built or proposed later. If a component is outside the approved action, the original EPBC number may not answer whether that component is authorised.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Collect state and territory instruments separately

For the same project, search the relevant state or territory agency for every instrument that controls construction and operation. Depending on the project, the set can include:

  • development or planning approval;
  • an environmental authority or pollution licence;
  • petroleum, gas-field or production approvals;
  • a pipeline licence;
  • water extraction, discharge or allocation approvals;
  • native-vegetation clearing or other land-disturbance permits; and
  • conditions attached to expansion, rehabilitation or closure.

State and territory agencies generally regulate land use, water, pollution control and air quality. Search by both the project and each major facility because one approval may cover a processing site while another covers wells, roads or a pipeline.

Understand bilateral assessment arrangements

Under a bilateral assessment agreement, a state or territory may conduct the environmental assessment for the Commonwealth. That arrangement changes who performs the assessment, not the need for both approvals. The project still needs Commonwealth and state or territory approvals before it can proceed, each with its own conditions and legal consequences.

5. Convert every condition into a working matrix

Copy the exact text of each condition into a spreadsheet or document and add the fields below. Do not paraphrase the operative requirement: a small qualifier such as “before,” “unless,” a geographic boundary or a threshold can change what the proponent must do.

Field What to record
Condition text The complete operative wording and condition number.
Protected matter or impact The MNES, habitat, species, water resource or impact pathway addressed.
Geographic scope The coordinates, tenements, facility, pipeline section or other boundary.
Trigger Before construction, during operations, at closure, or when a stated threshold event occurs.
Deadline The date, interval or event by which the obligation must be completed.
Management or monitoring plan The named plan, version and approval decision required by the condition.
Reporting recipient The Commonwealth or state regulator, and the report or notification required.
Audit or verification method An independent audit, monitoring result, certification or other specified check.
Evidence location The report, notice, data set, correspondence or audit finding that demonstrates performance.

Classify conditions by project phase

Sort the matrix into pre-clearance, construction, operations, closure and post-closure obligations. This exposes conditions that are easy to miss after construction, such as rehabilitation milestones, long-term offset protection or reporting that continues after production stops.

Verify approved plans before relying on them

Check that every action management plan or offset management plan was approved before the activity it governs started. Record the approved version and compare implementation against that version. A later draft, an internal procedure or a plan amended without the required approval does not demonstrate compliance with the condition that required the approved plan.

6. Check offsets and their permanence

Use the EPBC Offsets Register as a separate search, even when offsets are listed in the decision notice. Search by EPBC number, project, approval holder or jurisdiction. Open the project’s Offset Conditions tab, then download the approval or variation decision notice for the complete wording and any changed obligations.

Record what land, habitat, threatened species or other value the offset protects, the responsible holder, the timing of establishment and the monitoring or reporting duty. Pay particular attention to permanence requirements and to any condition that requires an offset management plan before disturbance starts.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The register may withhold sensitive Indigenous or ecological locations and personal information. An omitted location does not mean the offset is absent; use the public condition and decision documents to establish what obligation exists and what evidence should be available.

7. Check approval currency, variations and project changes

Record the approval expiry date and read every approved variation, transfer, extension and management-plan decision in chronological order. The latest document may change a deadline, map, condition number or approval holder without restating the entire original decision.

Ask whether a change needed a new referral

Compare the current project with the approved action. A larger production area, new processing unit, altered pipeline route, changed discharge or different impact pathway can be more than a minor administrative change. The National Environmental Protection Agency states that an action cannot simply be changed after approval without considering a new referral.

Look for a new EPBC referral or a formal variation decision. If neither appears, treat the status as unresolved rather than assuming that the old approval covers the changed project. Apply the same check to state and territory instruments, which may have their own amendment or reassessment rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Test current compliance with evidence, not the approval alone

A public approval record establishes what was authorised and the conditions attached. It does not by itself prove current compliance. For a current assessment, assemble the latest approved plans, proponent compliance reports, regulator correspondence, audit findings and enforcement or variation records.

Use National EPA and DCCEEW audit-program pages

  1. Search the audit-program pages by project name and EPBC number.
  2. Open the audit report and note the audit year, scope, sites visited, documents reviewed and conditions examined.
  3. For each condition, record whether the auditor found it compliant, non-compliant or not applicable.
  4. Compare the audit date with later annual reports, approved variations and management-plan decisions.
  5. Check whether a non-compliance finding was corrected, remained open or led to enforcement action.

Audits are time- and scope-specific evidence. A compliant finding for an earlier period does not establish performance after a later variation, new stage or missed reporting deadline.

Published example: Australian Pacific LNG

The National Environmental Protection Agency’s 2026 audit-program page publishes a 2025 audit result for EPBC 2009/4974: 73 conditions were compliant, 3 were non-compliant and 29 were not applicable. Those figures describe that audit year and scope only. They should be read condition by condition, alongside later reports and decisions, rather than treated as a permanent project-wide rating.

9. Understand the approval timetable and recurring duties

Current EPBC approvals guidance from the National Environmental Protection Agency gives useful timing expectations, but the actual schedule varies with the assessment method and the complexity of the action.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Stage or threshold Published figure and qualification
Response to a proposed decision and proposed conditions A proponent is generally given 10 business days to respond.
Final assessment decision Commonly 30 to 40 business days from the start of formal assessment, with timing varying by assessment method.
Safeguard Mechanism threshold Applies to approved projects that generate over 100,000 tonnes of greenhouse-gas emissions in a financial year.

These are guidance figures, not a guarantee that every gas project will be decided within the same period. When reviewing a record, use the dated notices and correspondence to establish the project’s actual milestones.

Track recurring administrative obligations

Set reminders for commencement and completion notifications, annual reports, compliance records and independent audits. A project can satisfy a physical mitigation requirement yet breach a separate reporting condition; the matrix should show both obligations and their evidence.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

10. Compare two gas projects consistently

If you are comparing projects for investment, policy or community analysis, use the same seven axes for each file. A side-by-side comparison is meaningful only when the projects’ stages and audited periods are aligned.

Comparison axis Questions to answer for each project
Jurisdiction and assessment Which Commonwealth and state or territory approvals exist? Was a bilateral assessment used?
Protected matters and impact scope Which MNES and other environmental values are covered, and what project components create the impacts?
Condition burden How many pre-clearance, construction, operating and closure conditions apply, and which have strict triggers or thresholds?
Monitoring and reporting What monitoring, annual reporting, compliance-record and independent-audit duties are required?
Offsets What offsets are required, how permanent are they, and which management-plan and verification duties apply?
Currency What is the expiry date, and what transfers, extensions, variations and plan decisions have been approved?
Compliance record What published findings are compliant, non-compliant or not applicable, and what period and conditions did the audit cover?

Do not rank projects by the number of conditions alone. A smaller set of tightly triggered conditions can be more demanding than a longer list of general commitments, and an apparent clean audit may cover fewer conditions or an earlier period.

11. Common search failures and how to correct them

Failure: searching only the headline project name

Correction: add the proponent, location, EPBC number and each major component. Reconcile Commonwealth and state naming before deciding that no record exists.

Failure: reading only the referral or summary

Correction: read the decision on approval of action and every variation. The legally binding conditions are in the notice and its operative amendments.

Failure: treating Commonwealth approval as the only permit

Correction: collect planning, environmental, petroleum, pipeline, water and clearing instruments from the relevant state or territory agency.

Failure: assuming an approved plan is automatically current

Correction: identify the approved version, check whether a later version was authorised, and test implementation against the version that applied when the activity occurred.

Failure: using an old audit as a present-tense verdict

Correction: note the audit year and scope, then check later reports, variations, correspondence and enforcement records.

Failure: assuming a project expansion is covered

Correction: compare the changed action with the approved maps, capacity and impact pathways and look for a new referral or formal variation.

12. A practical recordkeeping template

For each project, maintain one index with these entries:

  1. Identity sheet with names, proponent, location, gas type, components and EPBC number.
  2. Commonwealth chronology: referral, assessment material, original decision, variations, transfers, extensions and plan decisions.
  3. State or territory chronology for planning, environmental, petroleum, pipeline, water and clearing instruments.
  4. Condition matrix with the exact text, trigger, deadline, plan, recipient, verification method and evidence location.
  5. Offsets file containing the register entry, Offset Conditions tab, decision notices and permanence evidence.
  6. Compliance file containing annual reports, commencement or completion notifications, audits, regulator correspondence and enforcement outcomes.
  7. Currency check dated to the day of review, identifying the latest approval, plan and audit.

Use document dates and condition numbers in file names so that a later reviewer can reproduce the conclusion without relying on memory or a search-result snippet.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

13. What you can and cannot conclude from public records

You can establish the action that was authorised, the approval expiry, the approver, the legally binding conditions, the required plans and offsets, and the compliance findings published for a defined audit period. You can also identify whether a variation, transfer, extension or new referral appears in the public record.

You cannot establish current compliance from the original approval alone. A defensible current-status statement must identify the latest evidence reviewed and its date, explain which conditions were examined, and disclose any gap caused by missing reports, withheld sensitive information or an audit that did not cover the relevant activity.

When records conflict, match by proponent, location and project components, then prefer the latest operative decision or approval instrument. Keep Commonwealth and state or territory conclusions separate: satisfying one jurisdiction’s condition does not demonstrate that the other jurisdiction’s requirements were met.

14. A concise decision rule

Call a project “approved” only when you have identified the correct action and located the operative Commonwealth and applicable state or territory instruments. Call a condition “current” only after checking its latest variation, expiry and approved plan. Call a project “compliant” only for the specific conditions, sites and period covered by reliable reports or audits. This wording keeps the conclusion tied to what the public evidence actually establishes.
