How to Challenge ITC Blocking Under Rule 86A of the CGST Rules

Start with the order, the electronic credit ledger (ECL), and the reasons recorded by the GST officer. A Rule 86A restriction can be challenged when the blocked amount exceeds the credit available, the officer lacks the required authority, the recorded material does not support a specified statutory ground, reasons are generic or absent, or the restriction is no longer necessary. Rule 86A is a temporary revenue-protection power; it is not a final decision that input tax credit (ITC) is inadmissible and it is not a recovery mechanism.

The practical routes are a written request for reconsideration under Rule 86A(2), and, where the defect or continuing hardship warrants judicial intervention, a writ petition under Article 226 of the Constitution. The Delhi High Court in GNG Electronics Pvt. Ltd. v. Commissioner of Central Goods and Services Tax rejected “negative blocking” beyond the ledger balance, but that is a Delhi High Court ruling rather than a nationwide Supreme Court ruling. The current rule, the order, the evidence, and binding precedent in the taxpayer’s jurisdiction must be checked before action.

What Rule 86A allows—and what it does not

Rule 86A of the Central Goods and Services Tax Rules, 2017 permits the Commissioner, or an officer authorised by the Commissioner and not below the rank of Assistant Commissioner, to disallow debit of an amount from the taxpayer’s ECL. The disallowance can affect use of credit to pay a liability or a refund claim. It is triggered only when the authorised officer has reasons to believe that credit has been fraudulently availed or is ineligible for one or more grounds specified in the rule.

The power is preventive. It is intended to protect revenue while the department examines suspected credit, not to determine the final tax liability. A separate adjudication or recovery proceeding may still be required to decide whether the ITC was legally available. Conversely, release or expiry of a block does not by itself establish that the underlying ITC is valid or prevent another lawful proceeding.

The CBIC GST Policy Wing’s guideline dated 2 November 2021 describes the remedy as extraordinary and says it must be used with “utmost circumspection and with maximum care and caution.” The guideline requires an evidence-based application of mind, written reasons, and a restriction that does not exceed the credit believed to be fraudulent or ineligible.

The statutory grounds the officer must connect to evidence

A challenge should identify the exact ground relied on rather than argue only that an investigation is pending. The CBIC guideline reproduces these categories:

  • The supplier named on an invoice or debit note is found to be non-existent or is not conducting business from its registered place.
  • The recipient claims credit without actually receiving the goods or services.
  • Tax charged on the supply has not been paid to the Government.
  • The recipient itself is found to be non-existent or is not conducting business from its registered place.
  • The recipient does not possess a prescribed invoice, debit note, or another document required for the credit claim.

These are defined statutory situations, not a general power to freeze future credit whenever an inquiry begins. The order or reasons should show which category is engaged, what facts support it, and why the amount restricted corresponds to the suspected credit.

First response: preserve the position on the date of blocking

Do not rely on a later ledger printout alone. The first task is to create a dated record of the ECL and the restriction as they existed when the order was made.

  1. Save the order or portal communication. Record the date and time, reference number, issuing officer, officer’s designation, amount restricted, stated statutory ground, and any explanation displayed on the GST portal. Save downloadable notices and screenshots showing the ledger entries.
  2. Obtain ledger statements around the event. Preserve the ECL balance immediately before the restriction, the balance when the restriction was imposed, and the transaction history showing credits and debits. Include the relevant period’s GSTR-2B or other return records where they help identify the credit in question.
  3. Separate the suspected credit from unrelated credit. Prepare a transaction-level schedule linking each disputed invoice or debit note to the amount of ITC, supplier, tax period, goods or services, and the credit balance available on the blocking date.
  4. Record business consequences. Note whether the block prevents payment of a specific liability or a refund debit, and quantify any immediate cash-flow effect. This helps demonstrate urgency without treating commercial inconvenience as proof that the order is unlawful.

The comparison that matters is the ledger credit available on the date of restriction against the amount disallowed. A later credit entry cannot retroactively enlarge the amount that could lawfully be blocked at the earlier time.

Test whether the amount is legally capable of being blocked

Available credit versus an artificial negative balance

In GNG Electronics, the Delhi High Court held that Rule 86A does not authorise a restriction exceeding the credit actually available in the ECL when the order is issued. Blocking more than that balance creates an artificial negative figure and goes beyond disallowing debit of available credit. The court treated Rule 86A as a temporary measure, not a mechanism for recovering an amount that is not present in the ledger.

For example, if the ECL contains ₹4 lakh on the blocking date, an order purporting to restrict ₹7 lakh should be examined for an excess of ₹3 lakh. The court’s reasoning does not convert ₹4 lakh into an automatic entitlement; the department may still test the credit through the appropriate proceedings. It limits the reach of the immediate debit restriction.

Amount linked to the suspected ITC

The CBIC guideline says the restricted amount should not exceed the credit believed to be fraudulent or ineligible. Compare the officer’s figure with the invoices, tax periods, and calculations in the reasons. A round number unsupported by a transaction schedule, or a block that includes demonstrably unrelated credit, supports a request for correction or release of the excess.

Check the officer’s authority and written reasons

Rank and authorisation

Rule 86A places the power with the Commissioner or an officer authorised by the Commissioner who is not below Assistant Commissioner rank. Ask for the authorisation relied upon and verify the signatory’s designation on the order. A person’s involvement in an investigation does not, by itself, establish that the statutory power was validly delegated or exercised.

Reasons to believe must precede the restriction

The CBIC guideline requires reasons to believe to be recorded in writing before debit is disallowed. The reasons should identify the material considered and connect it to a listed ground. Useful questions include:

  • What supplier verification, transport record, statement, return data, site inspection, or other material supports the allegation?
  • Does the material address the particular invoices and tax period, or does it merely describe a broad investigation?
  • Does it establish a prima facie concern about receipt, supplier existence, payment of tax, the recipient’s existence, or possession of required documents?
  • How was the blocked amount calculated?
  • Why was restricting the ECL necessary to protect revenue at that time?

A short order is not automatically invalid. The Andhra Pradesh High Court in Suguna Sponge and Power Private Limited v. Superintendent of Central Tax recorded that an initially cryptic statement followed by later elaboration satisfied natural justice on the facts before it. The question is whether the available reasons and subsequent explanation allow the taxpayer and the court to understand the statutory basis, evidence, and amount—not whether every order uses a particular format.

Match the allegation with targeted evidence

A generic document bundle is less persuasive than evidence directed to the actual statutory ground. Organise the response by allegation.

Allegation in the order Evidence that may address it Point to explain
Supplier is non-existent or not operating from its registered place Supplier registration details, premises evidence, correspondence, purchase orders, invoices, payment records, transport documents, and proof of subsequent business dealings Why the records show a real transaction and how the supplier’s status on the relevant date is established
Goods or services were not received Goods receipt notes, e-way bills, lorry receipts, inventory entries, production or consumption records, service deliverables, attendance or work reports, and payment trail How receipt occurred and how the goods or services were used in the business
Supplier did not pay tax to Government Tax invoices, return and reconciliation records, payment correspondence, and information available from the supplier What is known about the supplier’s tax payment and why the recipient’s records address the department’s concern
Recipient is non-existent or not operating from its registered place Registration records, lease or ownership documents, utility bills, photographs, employee and inventory records, books, returns, and customer or supplier correspondence That the recipient conducted business from the relevant place during the disputed period
Required invoice or document is absent Original or electronic invoice, debit note, prescribed particulars, purchase register, return reconciliation, and proof of payment Which document satisfies the rule and where it is maintained

Use an indexed annexure with a line-by-line invoice schedule. Explain gaps honestly; unexplained inconsistencies can weaken an otherwise strong request. If a record is unavailable, state why and identify substitute evidence rather than asserting that every requirement has been met.

Request reconsideration under Rule 86A(2)

Rule 86A(2) allows debit to be permitted when the conditions that led to the restriction no longer exist. A written representation should ask the same competent authority to reconsider the block and should be filed promptly, without waiting for the one-year period.

Suggested contents of the representation

  1. Identify the restriction: taxpayer name, GSTIN, order or portal reference, date, amount, and officer.
  2. State the relief precisely: release the entire block, or at minimum release the excess over available or disputed credit and permit debit for specified liabilities.
  3. Address jurisdiction: explain why the officer’s rank and authorisation are absent, unclear, or satisfied, attaching the relevant records if available.
  4. Answer the statutory ground: use a separate heading for each allegation and link every factual assertion to an annexure.
  5. Reconcile the amount: show the ECL balance on the blocking date, the suspected ITC calculation, the restricted amount, and any amount already released or used.
  6. Explain changed circumstances: identify new verification, documents, supplier clarification, payment, or other development showing that the original conditions no longer exist.
  7. Ask for a reasoned decision: request written confirmation of the outcome and an updated ECL.

Keep proof of filing and delivery. If the authority does not respond, a follow-up should refer to the original representation and the continuing operational effect, not simply repeat the entire submission.

When a writ petition under Article 226 may be considered

A taxpayer may consider approaching the jurisdictional High Court when the restriction is facially beyond Rule 86A, the amount creates a negative balance, the authority or authorisation is defective, the written reasons do not disclose a statutory basis, relevant material was ignored, or the block continues despite evidence that the conditions have ceased. A writ is discretionary and fact-sensitive; it is not an automatic substitute for every departmental disagreement.

The petition should place the original order, ledger extracts, reasons, authorisation material, representation, annexures, and the department’s response before the court. The relief sought may include quashing an unlawful restriction, directing reconsideration by the competent officer, correcting an excess amount, or permitting debit pending a lawful decision. The petitioner should avoid asking the court to finally determine complex ITC entitlement if the statute provides an adjudication route and the immediate complaint concerns a provisional block.

Before filing, counsel should verify maintainability, limitation or delay issues, territorial jurisdiction, any available statutory remedy, filing requirements, and the latest binding decisions in the relevant High Court. The Delhi, Gujarat, and Andhra Pradesh decisions discussed here are persuasive or controlling according to jurisdiction and later precedent; none is a Supreme Court merits ruling that resolves every Rule 86A dispute nationally.

What the principal decisions establish

Decision Useful proposition Qualification
GNG Electronics Pvt. Ltd. v. Commissioner of Central Goods and Services Tax (Delhi High Court) Rule 86A cannot block more than the credit available in the ECL; the measure is temporary and not a recovery provision; a prior show-cause notice is not universally required before an emergent block. Delhi High Court authority; assess its application outside Delhi and under later precedent.
PMW Metal and Alloys Pvt. Ltd. v. Union of India (Gujarat High Court) Available credit, written reasons to believe, and the Commissioner’s or authorised officer’s statutory power are central to the challenge. Gujarat High Court decision; jurisdiction and subsequent rulings matter.
Suguna Sponge and Power Private Limited v. Superintendent of Central Tax (Andhra Pradesh High Court) The court considered available balance, previous use of credit, the exceptional character of Rule 86A, and authorisation; on its facts, later elaboration of initially brief reasons met the natural-justice requirement. Do not assume every case requires identical disclosure or a pre-decisional hearing.

Why some common challenges fail

“There was no show-cause notice, so the block is automatically void”

GNG Electronics treated Rule 86A as an emergent power that does not require a prior show-cause notice in every case. A stronger challenge identifies the missing statutory ground, unsupported evidence, excessive amount, defective authority, or lack of continuing necessity. The availability and quality of a post-block representation also matter.

“The supplier is registered, so the ITC cannot be questioned”

Registration alone does not answer allegations about actual receipt, operation from the registered place, payment of tax, or required documents. Address each element with transaction-specific evidence.

“The block has expired, so the ITC is finally allowed”

Rule 86A(3) provides for cessation of the restriction after one year. The one-year period is a statutory time limit, not a determination of entitlement. Separate assessment or recovery action may remain available if otherwise lawful.

“Any amount in the ledger can be frozen for the suspected total”

The available-credit principle is central. Preserve the ledger at the relevant time and show mathematically why the order exceeds the balance or the amount of credit actually identified as suspect.

Administrative request or writ: choosing the route

Question Reconsideration under Rule 86A(2) Article 226 petition
Best use New evidence, changed circumstances, an overstatement that the officer can correct, or a request for prompt operational release Facial jurisdictional defect, negative blocking, unsupported reasons, refusal to consider evidence, or continuing restriction requiring judicial directions
Evidence needed Order, ledger, invoice-level records, and documents answering the allegation The same records plus proof of representation, reasons, authorisation, and the department’s response or silence
What it does not guarantee Automatic release or a final ruling on ITC entitlement Immediate admission, final ITC determination, or success merely because a notice was not issued first
Timing issue File promptly; do not wait for expiry Address delay, maintainability, territorial jurisdiction, and current local procedure with counsel

Track the one-year limit and continuing necessity

Count one year from the date the restriction was imposed, and keep a calendar entry with the order and ledger evidence. The CBIC guideline says the restriction ceases after that period, subject to other lawful action. If the portal still shows a debit restriction after the period, seek written correction and preserve the screen showing the continuing block. Do not assume that a technical expiry resolves any separate notice, audit, assessment, or recovery proceeding.

Practical checklist before signing a challenge

  • Have you obtained the complete order or portal communication rather than relying on an oral explanation?
  • Does the ledger statement show the exact balance immediately before the block?
  • Does the blocked amount exceed that balance or the ITC identified as suspect?
  • Is the signatory the Commissioner or an authorised officer not below Assistant Commissioner rank?
  • Can you identify the statutory ground and the material said to support it?
  • Do the reasons address the actual invoices, supplier, receipt, tax payment, recipient operations, or prescribed documents?
  • Have you indexed evidence tailored to each allegation?
  • Have you requested reconsideration under Rule 86A(2) and retained proof of filing?
  • Have you diarised the one-year cessation date?
  • Has qualified counsel checked current rule text, amendments, local High Court precedent, maintainability, and any parallel proceedings?

The most persuasive challenge is usually narrow and demonstrable: identify the legal power, show the ledger balance and calculation, expose the gap between the stated ground and the evidence, and ask for a remedy that the authority or court can grant without deciding more than Rule 86A requires.
