A show-cause notice generally requires a reply in the adjudication process; an appeal in FORM GST APL-01 is the first appeal against an adjudicating authority’s decision or order. For an appeal under section 107, preserve the communication date, prepare the required facts and grounds, pay the applicable pre-deposit, submit the order and supporting documents within the specified time, and obtain the final APL-02 acknowledgment.
Start by identifying exactly what you received
The phrase “invalid GST notice” can describe several different problems, but the correct remedy depends on the document in your hands. Read the heading, issuing authority, statutory provision, tax period, date, and communication method before choosing an appeal.

| Document or stage | What it means | Immediate question |
|---|---|---|
| Show-cause notice | The department is proposing a demand, penalty, cancellation, or another action and is inviting a response. | Has an adjudication order been issued, or is a reply and hearing still available? |
| Adjudication decision or demand order | The authority has made a decision that may be appealable. | When and how was the order communicated, and what is the last day for a first appeal? |
| First-appeal stage | An appeal has been submitted to the appellate authority. | Has the final APL-02 acknowledgment and appeal number been issued? |
| Later appellate or judicial stage | The first appeal has been decided, or another review route is being considered. | Which further remedy is available under the applicable central or State/UT law? |
The official first-appeal framework directly concerns an adjudicating authority’s decision or order. It does not establish that a show-cause notice by itself is appealed by filing APL-01. If you have only a notice, examine the reply deadline, hearing opportunity, and the authority’s power to issue it before assuming an appeal is available.
Record the facts that determine the route
- Name and designation of the issuing authority.
- Section or rule cited in the notice or order.
- Tax period and the goods or services involved.
- Date, method, and proof of communication.
- Date of your reply, if any, and whether a personal hearing occurred or was requested.
- Whether a final order, demand, penalty, or other adjudication has been issued.
- Whether the matter concerns central GST, a State or Union Territory GST law, or both.
These details should be kept together in a dated case file. The applicable legislation and portal instructions can differ by jurisdiction and may change, so verify the current version before filing.

Protect the section 107 deadline
The general first-appeal period stated in section 107 of the Central Goods and Services Tax Act and the GST portal FAQ is three months from communication of the decision or order. The appellate authority may allow up to one further month when sufficient cause prevented a timely filing. That additional month is a maximum extension, not an automatic entitlement.
| Timing point | What to do |
|---|---|
| Date of communication | Save the electronic message, portal record, email, or other delivery proof and note the date in a calendar. |
| Within the ordinary period | Complete APL-01, arrange the applicable pre-deposit, and submit the appeal with the required documents. |
| After the ordinary period but within the possible extension | File as soon as possible and explain the sufficient cause with supporting evidence; do not assume condonation will be granted. |
| After the possible extension | Obtain professional advice immediately about any available statutory or judicial remedy. A late filing may face a jurisdictional objection. |
Do not calculate the deadline from the date printed on an order unless that is also the date it was communicated. Keep evidence showing when you could actually access or received it. If the portal record and the document show different dates, preserve both and explain the difference in the appeal record.
Understand what APL-01 requires
FORM GST APL-01 is not just a cover sheet. It asks for enough information for the appellate authority to identify the challenged order, the disputed period and amounts, the factual narrative, and the remedy requested. The form version available in older materials is dated 1 June 2021; check the current portal form and instructions before relying on a downloaded copy.
Identify the appellant and the order
Enter the taxpayer’s legal name, GSTIN and contact details as requested, then identify the order number, order date, issuing authority, and date of communication. Attach the complete order, not only the page containing the demand. If the order was uploaded or served electronically, retain the portal download and the communication record.
Describe the issue, period, and supplies
State the goods or services, tax period, and issue in plain language. Separate tax components and other amounts in the form’s fields. If the dispute concerns more than one period, order, registration, or type of tax, make the allocation clear rather than combining unrelated figures.

Write a chronological statement of facts
The statement of facts should let a reader reconstruct the case without searching through attachments. Set out the return or transaction background, the notice, your reply, any documents supplied, hearing dates, and the order’s conclusions. Use dates and document references. Distinguish an admitted amount from an amount you dispute.
Make each ground specific to the record
A ground should identify the finding or action challenged, explain why it is wrong or procedurally defective on the facts, and point to the supporting document or statutory provision. Avoid labels such as “the notice is illegal” without explaining the precise defect. Do not present a generic list of possible objections as if any one of them automatically invalidates every notice.
Useful drafting questions include:
- What exact demand, tax period, or conclusion is being challenged?
- Which statement in the notice, order, reply record, or calculation is inconsistent with the documents?
- What legal provision does the order rely on, and how does that provision apply to the facts?
- Was a response or hearing requested, and what evidence shows what happened?
- What calculation should replace the department’s figure?
- Is the challenge to the entire order or only specified issues and amounts?
State the relief you want
The prayer for relief should match the grounds. Depending on the record and applicable law, an appellant may need to request relief concerning the disputed tax, interest, penalty, or another direction, or ask for the order to be modified or set aside. State the result sought for each issue and avoid requesting relief that the appellate authority cannot grant under the governing provision.
Choose whether to request a personal hearing
APL-01 allows the appellant to indicate whether a personal hearing is sought. Make that choice deliberately. If the dispute turns on a technical calculation, contested documents, or an explanation that is difficult to convey in writing, explain why an oral hearing would assist. Keep the written grounds complete even when a hearing is requested.
Prepare the evidence before opening the portal
Organize attachments in the same order as the grounds. A practical index can include:

- The challenged notice and final order, including annexures.
- Proof of communication and a deadline calculation.
- Returns, invoices, ledgers, contracts, payment records, e-way records, or other transaction evidence relevant to the disputed issue.
- Your reply to the notice and proof of submission.
- Hearing notices, attendance records, written submissions, and correspondence.
- A reconciliation showing the department’s figure, the admitted amount, and the amount disputed.
- Documents supporting any explanation for delay, if the appeal is not filed within three months.
Use legible files with descriptive names and a consistent numbering system. A document that is mentioned in a ground but not attached can make the ground difficult to verify. Keep the original electronic files and a read-only copy of everything uploaded.
File the appeal on the GST portal
The GST portal FAQ gives the following user path for an appeal against a demand order. Labels can change, so compare the screen with the current instructions while filing.
- Sign in to the GST portal using the taxpayer’s credentials.
- Open Services > User Services > My Applications.
- Set Application Type to Appeal to Appellate Authority.
- Select New Application.
- Choose Demand Order and identify the order being challenged.
- Complete the appellant, order, issue, period, amount, facts, grounds, prayer, and personal-hearing fields in APL-01.
- Upload the order and supporting documents in the permitted format and size.
- Review the disputed tax and pre-deposit figures against the current demand and applicable law.
- Submit using the permitted electronic signature method: DSC or EVC where available. A digital signature certificate is mandatory for companies and limited liability partnerships under the portal instructions.
- Save the submission reference, downloaded form, payment record, and every acknowledgment shown on screen.
The filing process is not complete merely because an application number or draft appears in the account. The official procedure provides a seven-day window for the required order copy and supporting documents under the applicable rules. Follow the portal’s current instructions for any documents that must be furnished after the initial submission.
Pay the required pre-deposit carefully
The GST portal FAQ states that a minimum pre-deposit of 10% of the disputed tax is payable before filing an appeal. The figure must be calculated from the disputed tax, not casually applied to every line of the demand. Interest, penalty, late fee, and undisputed amounts may be treated differently under the applicable provision and order.

- Total tax, interest, penalty, and other amounts in the order.
- Amount admitted and amount disputed for each tax component.
- Pre-deposit already paid, if any.
- Additional amount required for the appeal.
- Payment reference and date.
Verify the calculation against the current demand, the governing central or State/UT legislation, and the portal’s payment screen. A payment made on an incorrect base may create a filing defect or leave an unpaid balance. Keep the challan and electronic ledger entries with the appeal file.
Obtain and preserve the final APL-02 acknowledgment
CBIC’s appeal rules and the GST portal FAQ describe a seven-day period for supplying the specified certified or self-certified order copy and supporting material. After the requirements are met, the appellate authority issues FORM GST APL-02 with an appeal number. The appeal is treated as filed when that final acknowledgment is issued, not merely when information is entered or a preliminary reference is generated.
Check the account until APL-02 appears. Download it, record the appeal number, and compare the acknowledged order and amounts with your submission. If the acknowledgment does not issue, look for a deficiency message, missing document request, failed payment, signature problem, or portal error. Correct the issue promptly and retain screenshots, help-desk references, and timestamps.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Examine the alleged defect without assuming the conclusion
Whether a notice or order is legally defective depends on its text, authority, statutory basis, chronology, and evidence. A careful challenge tests the document against the record rather than relying on the word “invalid.” Review:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Authority: Is the issuing officer identified, and does the cited provision apply to that officer and proceeding?
- Identity and scope: Does the notice or order correctly identify the taxpayer, registration, tax period, supplies, and amounts?
- Communication: Can you prove when and how the document was served or made available?
- Opportunity to respond: Were the reply and hearing procedures stated and followed in the particular case?
- Reasoning: Does the final order address the material explanations and documents submitted?
- Quantification: Can each component of tax, interest, penalty, and other demand be reconciled to records?
- Consistency: Do the notice, order, return data, and attachments refer to the same issue and period?
- Time limits: Does the applicable provision contain a deadline relevant to the proceeding, and what dates establish it?
These are investigation points, not universal grounds that guarantee cancellation. A tax professional should map each alleged defect to the exact provision and evidence before it is pleaded.

What if you have only a show-cause notice?
Do not wait for an appeal deadline while a notice is pending. Read the notice’s response method and due date, submit a fact-specific reply with supporting documents, and request a hearing when appropriate. Explain any issue with jurisdiction, facts, calculation, or procedure in that reply. If an order is later issued, preserve the notice, reply, hearing record, and order together so the first appeal can show how the dispute developed.
Because the first-appeal sources concern a decision or order, filing APL-01 against a notice alone may be the wrong procedural step. The correct immediate remedy can depend on the section cited, the authority, and the stage of the proceeding.
What if the three-month period has expired?
File promptly if you are still within the possible one-month extension and provide a documented explanation of sufficient cause. Examples must be tied to your facts; an unexplained oversight is not the same as a documented event that prevented filing. Attach evidence such as communication logs, portal outage records, medical records, or other material that actually explains the delay, where relevant.
Recommended Free Tools
If more than the possible extension has elapsed, obtain advice on the available route before making assumptions. Do not backdate a filing, alter a communication record, or omit a late-filing explanation. Preserve the original order and all portal timestamps.
Central, State, and Union Territory differences
The three-month period, pre-deposit, forms, and portal workflow described here come from the central first-appeal framework and GST portal guidance. A State or Union Territory proceeding may involve corresponding legislation, a different authority, or updated instructions. Confirm:
- Which Act and rules govern the order.
- Whether the order is visible in the correct GST portal account.
- Which appellate authority has jurisdiction.
- Whether the current APL-01 and acknowledgment process applies.
- Whether any state-specific direction changes document submission or payment steps.
Common filing failures and recovery steps
| Problem | Why it matters | Immediate response |
|---|---|---|
| Wrong document selected | An appeal against a notice may not satisfy the procedure for an order appeal. | Confirm the stage and order details before submission; obtain advice if the portal selection is unclear. |
| Communication date omitted or wrong | The date controls the limitation calculation. | Use the electronic record and other proof of service, then explain any discrepancy. |
| Generic grounds | The authority cannot tell which finding or amount is challenged. | Number each ground, cite the record, and state the requested result. |
| Pre-deposit miscalculated | The appeal may be treated as incomplete. | Reconcile disputed tax and payment references before final submission. |
| Order copy not supplied within the required window | The final acknowledgment may not issue. | Upload or furnish the specified copy and supporting documents within the applicable seven-day procedure and monitor the application. |
| No APL-02 saved | A preliminary submission may not establish a filed appeal. | Continue checking for the final acknowledgment and resolve any deficiency notice. |
When professional help is justified
A qualified GST practitioner or tax-litigation lawyer can review the notice, order, limitation calculation, pre-deposit, evidence, and requested relief as one record. Professional review is especially important where the order involves multiple tax periods, a significant disputed amount, a possible limitation issue, a hearing or service dispute, related registrations, or a deadline that has already passed. Give the adviser the complete unedited document set and the portal acknowledgment trail rather than only the demand summary.
