Do not ignore an income-tax reassessment notice. First identify the assessment year (or tax year), the law in force for that year, the notice section, the issue and receipt dates, and the response deadline. For most proceedings under the Income-tax Act, 1961, a section 148A show-cause notice is the opportunity to contest the department’s information before a section 148 reassessment notice is issued. If a section 148 notice has already arrived, file the required return within the stated period while preserving your objections.
The law changed on 1 April 2026. The Income-tax Act, 2025 applies to tax years beginning on or after that date, while earlier assessment years and proceedings preserved under the transition rules generally remain governed by the 1961 Act. The notice date alone does not determine the regime.

Start with the year, dates and governing Act
Reassessment disputes are often lost on chronology before the underlying tax issue is examined. Create a one-page timeline as soon as you receive a notice. Record the relevant assessment year under the 1961 Act, or tax year under the 2025 Act, the date printed on every notice, the date you actually received it, the section cited, the response deadline, every extension request and every submission acknowledgement.

The Income Tax Department states that sections 279–286 of the Income-tax Act, 2025 apply to tax years 2026–27 onward. A tax year beginning before 1 April 2026 remains under the Income-tax Act, 1961. Proceedings for earlier years can continue after the new Act starts, subject to the old Act’s conditions and limitation rules. Therefore, a notice received after 1 April 2026 may still concern a pre-transition year and an existing 1961 Act proceeding.
#1 Best Overall
- Write the relevant assessment year or tax year at the top of every working document.
- Keep the PDF or physical copy of the notice exactly as received, including its issue date, document identification number and annexures.
- Save the portal acknowledgement, email headers, SMS notification and any proof of actual receipt.
- Check whether the notice cites section 148A, section 148, an assessment order, a demand notice or an appealable order; each has a different response and remedy.
Do not rely on a general internet explanation of “the new law.” Use the statutory text and transition material applicable to the specific year, and have a tax professional check the version in force on the relevant date.
Understand the ordinary reassessment sequence
Section 148A: the pre-notice opportunity
Under the ordinary Income-tax Act, 1961 process, the Assessing Officer (AO) starts by communicating information that allegedly suggests income chargeable to tax escaped assessment and gives the taxpayer an opportunity to show cause why a section 148 notice should not be issued. The officer must consider the reply and decide whether issuing a section 148 notice is fit, with the approval required by the statute. Section 148A has statutory exceptions, including specified search-related situations, so it is not a universal preliminary step.
The central statutory requirement is expressed in these words:
Recommended Free Tools
“Where the Assessing Officer has information which suggests that income chargeable to tax has escaped assessment in the case of an assessee for the relevant assessment year, he shall, before issuing any notice under section 148 provide an opportunity of being heard to such assessee by serving upon him a notice to show cause as to why a notice under section 148 should not be issued in his case and such notice to show cause shall be accompanied by the information which suggests that income chargeable to tax has escaped assessment in his case for the relevant assessment year.”
A section 148A notice is not an assessment order and does not itself establish that tax was underpaid. It is your chance to test whether the information is connected to you, the correct year and a taxable amount, and whether the department has overlooked material already on the record.

Section 148: the reassessment notice
If the officer decides reassessment is fit, a section 148 notice requires you to furnish a return for the relevant year. The 1961 Act generally allows three months from the end of the month in which the notice is issued, unless the notice specifies a different period permitted by law. You may apply for additional time, but an extension request should be made before the original deadline and retained with proof of submission.
Filing the return does not automatically waive every legal objection. A taxpayer can comply with the filing requirement and separately state objections about jurisdiction, limitation, missing information or procedural defects in the reassessment record.

1. Match the allegation to the right year and taxpayer
Read every transaction description, account number, information source, amount and date. Compare it with the return, books, tax audit report, withholding statements, bank records and earlier correspondence for that assessment year. Common factual defects include a wrong taxpayer with a similar name or Permanent Account Number, a transaction assigned to the wrong year, a duplicate entry, a gross figure treated as income, or a document that was already explained during the original assessment.
Make a reconciliation table for your own use:
| Notice item | Your record | Difference or explanation | Supporting document |
|---|---|---|---|
| Transaction date and description | Date and description in books or return | Wrong year, duplicate, cancelled or already reported | Ledger, invoice, contract, bank statement or filing acknowledgement |
| Amount cited | Gross receipt, cost, loan, repayment or income actually reported | Nature of amount and taxable portion | Computation, agreement, confirmation or reconciliation |
| Information source | Whether the source relates to you | Identity, account or ownership mismatch | Identity records, account statements or third-party confirmation |
This table is a preparation tool, not a substitute for the formal reply. It helps prevent a response that answers one allegation while leaving another unanswered.
2. Test whether the information suggests escaped income
Address the legal significance of the information, not merely its existence. Explain why the item is not income, has already been included in taxable income, belongs to another person or year, is exempt or otherwise does not result in escaped income. If the notice gives only a broad data label without the underlying material, identify precisely what is missing and ask for the information needed to make an effective response.

Do not assert that a technical defect automatically ends the case. Explain how the defect prevents a reliable conclusion on escapement and connect each point to the documents attached.
3. Build an indexed reply
A useful response normally contains:
- Header: taxpayer name, PAN, assessment year, notice number, issue date and the date of submission.
- Preliminary objections: regime, limitation, incorrect year or identity, lack of accompanying information, absence of the required opportunity, or another specific statutory defect.
- Point-by-point factual response: reproduce each allegation in a short quotation or paraphrase, followed immediately by the answer.
- Evidence index: numbered annexures with a one-line description and page range.
- Prayer: request that the proposed section 148 notice not be issued because the information does not establish escapement or because the statutory conditions are not met.
- Verification and contact details: sign or authenticate in the manner required by the portal or notice.
Use clear filenames and searchable PDFs. Explain unusual entries in plain language before attaching technical schedules. Where a document contains unrelated personal or third-party information, ask a professional how to redact it without destroying evidentiary value.
4. Submit and preserve proof
Use the channel specified in the notice, usually the income-tax e-filing portal or another officially identified facility. Download the final submitted PDF, acknowledgement number, date and time, and the complete list of attachments. If the portal fails, take dated screenshots, note the error message and send the response through the alternative channel allowed by the department or notice. A later dispute about timely filing is much easier when the contemporaneous record is complete.
Check limitation before arguing the merits
Time limits depend on the relevant year, the amount alleged to have escaped assessment, the exact statutory version and exceptions. The Income Tax Department’s current assessment overview listed these general periods in 2026:
| Alleged escaped income | General section 148A show-cause deadline | General section 148 notice deadline |
|---|---|---|
| Less than ₹50 lakh | Three years from the end of the relevant assessment year | Three years and three months from the end of the relevant assessment year |
| ₹50 lakh or more | Five years from the end of the relevant assessment year | Five years and three months from the end of the relevant assessment year |
These are the Department’s general table entries, not a complete limitation opinion. Confirm how the amount is computed, whether an exception applies, which amendment governs the year and whether a statutory exclusion or special rule changes the calculation. Count from the legally specified reference point rather than from the day you opened the email. A limitation objection should show the relevant year, the statutory end date, the notice issue date and the calculation in a single schedule.

What to do after receiving a section 148 notice
File the required return
Read the notice for the exact return period and form. Under the 1961 Act, the general period is three months from the end of the month in which the notice is issued, with further time possible on application. File within that period even if you believe the notice is invalid, unless a court or competent authority has stayed the requirement. Keep the filed return, computation, digital verification record and acknowledgement together.
Preserve objections in the reassessment record
After filing, submit a structured letter identifying any jurisdictional, limitation or procedural objection and request that it be decided by a reasoned order. Do not rely on a telephone conversation or an informal portal message. If the department asks for information, answer what is relevant, state when a requested document is unavailable and explain why a broad request is disproportionate or unrelated. A cooperative record can protect the merits without conceding a legal point.
Separate merits from procedure
Prepare two workstreams. The merits file proves what the income actually was: books, contracts, invoices, bank statements, withholding certificates and reconciliations. The procedure file proves whether the statutory steps occurred: notices, supplied information, replies, approvals, service records, orders and acknowledgements. Courts and appellate authorities may need the second file even when the tax computation is straightforward.
Choose the right challenge route
The best route depends on the stage, the record available, the defect alleged and the relief sought. The following comparison uses the ordinary pathways described in Department guidance; individual suitability requires professional review.

| Response during reassessment | After section 148 notice and during proceedings | Merits, jurisdiction, limitation and procedural objections | Drop additions, accept returned income or decide objections in a reasoned order | Meet every notice deadline; do not assume an objection suspends filing duties |
| First statutory appeal | After an appealable assessment order | Facts, law, additions, computation and procedural errors | Delete, reduce or remand disputed additions | Department guidance generally gives 30 days from receipt of the order or demand, subject to the applicable appeal rule and condonation |
| Income Tax Appellate Tribunal (ITAT) | After the first appellate decision, where permitted | Disputed factual and legal issues within the Tribunal’s jurisdiction | Modify or set aside the appellate decision | Check the statutory period and filing requirements for the particular order |
| High Court appeal | After an ITAT order where the statute permits | Substantial question of law | Decision on the legal question, with consequential relief | Not a second factual trial; obtain specialist advice on formulation of the question |
| Writ petition | In an appropriate jurisdictional or procedural case | Lack of jurisdiction, breach of mandatory procedure or a serious public-law error | Quashing, prohibition, directions or remand | Discretionary and fact-dependent; courts may require the statutory remedy to be used first |
There is no universal rule that a taxpayer must choose only one forum immediately. Filing an appeal, seeking a stay, responding to the department and considering a writ can interact in ways that affect jurisdiction and timing. Obtain advice before making parallel filings or asking a court to intervene while an assessment is continuing.

First appeal and later court proceedings
File the first appeal on time
Department guidance states that a first appeal against an assessment order is generally due within 30 days of receipt. Identify the exact appealable document, calculate the deadline from documented receipt and file the prescribed form with the required fee, grounds and statement of facts. If the deadline has passed, include a condonation request explaining the period of delay and supporting circumstances; acceptance is not automatic.
Draft grounds separately from the narrative. A ground should identify the legal or factual error and the relief requested. The statement of facts should give the chronology and evidence without argumentative repetition. Attach the assessment order, demand notice, relevant notices, submissions and proof of filing.
ITAT and High Court
The ITAT is the next appellate forum in matters for which the statute provides an appeal. It can examine the evidentiary record and applicable law within its jurisdiction. A further High Court appeal is generally confined to a substantial question of law, not a request to re-weigh every document. A lawyer should test whether the proposed question is genuinely legal, material to the outcome and properly preserved in the earlier record.

High Courts have used writ jurisdiction in suitable reassessment disputes involving jurisdiction or procedure. A writ petition is discretionary, and the court may decline to intervene where an effective statutory appeal exists or facts require detailed examination. It is more likely to be considered where the alleged defect goes to the authority to act, a mandatory precondition was omitted, or the process is fundamentally unlawful. It is not a guaranteed shortcut around an assessment or appeal.
Faceless procedure and the identity of the officer
Older litigation questioned whether a jurisdictional Assessing Officer could issue reassessment notices under the 2021 amendments and faceless-assessment arrangements. The Delhi High Court decision in Bishamber Dayal Chander Mohan and the Punjab and Haryana High Court decision in Jatinder Singh Bhangu addressed aspects of that procedural controversy. Their existence means the issue must be analysed, not reduced to a slogan that every notice from a jurisdictional officer is invalid.
An official 2026 legislative memorandum described divergent High Court views and a pending Supreme Court issue at the time of the memorandum, then explained a clarification under which the section 148/148A Assessing Officer means an officer other than the National Faceless Assessment Centre or an assessment unit. The 2026 amendment is reflected in the Department’s statutory material. Because the amendment’s wording, retrospective effect and any later binding Supreme Court ruling can change the outcome, check the current statute and case law for the notice date before relying on this argument.
Common mistakes and how to correct them
- Treating the notice date as the governing-law date: identify the year and transition rule first.
- Sending a general denial: answer every transaction, amount and information source with a document or a specific explanation.
- Missing the return deadline while researching jurisdiction: file as required and preserve objections in writing.
- Uploading an unindexed document bundle: provide a short chronology, numbered annexures and a contents page.
- Arguing limitation without a calculation: show the relevant year, statutory period, alleged amount, notice date and any claimed exception.
- Assuming a court will hear the case immediately: assess the statutory appeal, stay and condonation options before filing a writ.
- Relying on an old faceless-assessment judgment: check the 2026 amendment and later binding decisions.
- Failing to keep service proof: preserve portal logs, acknowledgements, emails and screenshots in a read-only folder.
A practical escalation checklist
- Label the file with the assessment year or tax year and the governing Act.
- Make a dated chronology of issue, service, response and order dates.
- Download the notice, annexures and information supplied by the department.
- Reconcile each allegation to the return, books and third-party records.
- Calculate limitation under the exact statutory version and note exceptions.
- Prepare and submit the section 148A reply, if applicable, before its deadline.
- If section 148 is issued, apply for any needed extension and file the required return.
- Keep separate merits and procedure files, each with an index.
- After an assessment order, calculate the 30-day first-appeal period immediately.
- Ask an Indian chartered accountant or tax lawyer experienced in reassessment matters to review forum, evidence, stay and limitation strategy before a deadline expires.
The Income Tax Department’s statute, assessment guidance, transition FAQs and appeal guidance should be checked alongside the notice. Court decisions are not substitutes for reading the current Act: a later amendment or binding judgment can change how an earlier procedural argument operates.
