For an Indian bank or other RBI-regulated lender, the usual calculation is ₹5,000 multiplied by each attributable calendar day after the applicable deadline. For property documents whose release became due on or after 1 December 2023, the ordinary deadline is 30 days after full repayment or settlement. If originals are lost or damaged, the lender gets an additional 30 days to arrange duplicate or certified copies, so the penalty calculation generally begins after 60 days. The rule is India-specific, and the lender must be an entity covered by the RBI directions.

First confirm that the RBI rule covers your loan

The ₹5,000-per-day amount comes from the Reserve Bank of India notification Responsible Lending Conduct – Release of Movable / Immovable Property Documents on Repayment/Settlement of Personal Loans, issued on 13 September 2023. It is not a universal compensation rate and does not automatically apply to every lender or every historical delay.

Coverage question What must be true
Type of lender The lender is a commercial bank other than a payments bank, a specified cooperative bank, an NBFC (including a housing-finance company), or an asset reconstruction company covered by the directions.
Relevant date The release of the documents became due on or after 1 December 2023.
Loan status The borrower has fully repaid or settled the personal loan, and the lender is required to return the originals and remove registered charges.
Cause of delay The days beyond the deadline are attributable to the regulated entity, rather than being explained by an event for which the lender is not responsible.

If any of these points is uncertain, calculate the amount as a provisional claim and obtain Indian banking or consumer-law advice before presenting it as a fixed entitlement. A different country, an unregulated private lender, or a different type of transaction requires a separate legal analysis.

Find the correct deadline

Ordinary return of intact originals

Start with the date on which the lender received full repayment or settlement. For a release covered by the post-1 December 2023 regime, the lender has 30 days after that event to return every original movable or immovable property document and remove registered charges. The documents may include title deeds or other originals deposited as security; use your receipt or acknowledgement to identify exactly what was handed over.

Do not treat the date on a no-dues letter, an internal account-closing entry, or a later telephone promise as the settlement date unless the lender’s records support that interpretation. Keep the full-settlement statement and any written confirmation because the date controls the start of the 30-day period.

Lost or damaged originals

When an original is lost or damaged, the lender must help you obtain duplicate or certified copies and must bear the associated costs. The directions provide an additional 30 days for that process. Consequently, the delayed period generally starts only after a total of 60 days from full repayment or settlement: the initial 30-day release period plus the additional 30 days for replacement documentation.

This is a calculation of the period before the lender completes the required replacement assistance, not a licence to treat a missing original as an ordinary late handover after 30 days. Preserve invoices and receipts for certified copies, searches, registration work, or other replacement expenses.

Older delays

The fixed amount is not automatically retroactive. A delay that began before the relevant 1 December 2023 application date may still support a claim, but the result is generally fact-specific and may depend on contract terms, consumer law, proof of loss, and the lender’s conduct rather than a mechanical ₹5,000-per-day award.

Apply the ₹5,000-per-day formula

Once the applicable deadline is known, use this calculation:

Compensation = ₹5,000 × attributable calendar days after the applicable 30-day deadline (or 60-day loss/damage deadline)

“Attributable” matters. Count only days for which the regulated entity is responsible. Your evidence should establish when the lender had to act, what it failed to deliver, and when the documents or certified replacements were actually made available.

Worked ordinary-delay example

Assume a loan was fully settled on 1 January and the post-1 December 2023 regime applies. The ordinary 30-day deadline is 31 January. If the lender hands over the documents on 10 February, the period after the deadline is the calendar interval from 1 February through 10 February, subject to the day-count convention accepted in the claim. On that assumption, 10 attributable days would produce ₹50,000 (10 × ₹5,000).

Confirm the precise counting method, the date on which the documents were legally available for collection, and any lender-responsibility issue with counsel before filing. A dispute about whether the handover date is inclusive, whether a day was a holiday, or whether the borrower caused part of the delay can change the total.

Worked loss or damage example

If the same settlement occurred on 1 January but the lender acknowledged that the originals were lost, the replacement process ordinarily receives 60 days in total. A completion date of 10 March would be tested against the 60-day deadline, not the 30-day deadline. Only attributable days after that longer period enter the ₹5,000 calculation.

Use the right comparison for your situation

Situation Starting point for delay How compensation is assessed
Intact originals; release due on or after 1 December 2023 After 30 days from full repayment or settlement ₹5,000 for each attributable calendar day beyond the deadline.
Originals lost or damaged; release due on or after 1 December 2023 Generally after 60 days total, including the additional 30 days for duplicate or certified copies ₹5,000 for each attributable day after the extended period, plus documented replacement costs where applicable.
Delay beginning before the post-1 December 2023 regime Determined from the contract, applicable law, and proven facts No automatic retroactive ₹5,000 rate; a consumer forum or court may award discretionary compensation.
Delay by a lender outside RBI coverage or outside India Determined by the governing law and contract No general RBI figure can be assumed.

What older and exceptional cases show

Long-running title-deed delay

In State Bank of India v. Vinay Kumar, decided by the National Consumer Disputes Redressal Commission on 11 May 2026, the Commission observed that the 2023 directions did not strictly apply to a title-deed delay that began in 2016. It nevertheless used the directions as guidance and upheld ₹10 lakh for a decade-long failure to return the deed. The Commission removed separate interest on that compensation and ordered 9% interest only if the award was not paid as directed.

The decision recognized that a borrower can suffer uncertainty and lose the ability to negotiate, sell, or otherwise deal with property even when the property’s underlying value has not fallen. It stated: “Merely because the complainant continued to reside in his property does not absolve the Bank from its liability to secure the original Title Deed.”

Missing originals and mental agony

An RBI Ombudsman publication records a separate case in which missing originals and resulting mental agony led to ₹50,000 compensation. That figure is an example of a fact-specific award, not a substitute for the ₹5,000-per-day formula or a guaranteed amount in every missing-document dispute.

Additional legal compensation remains possible

The RBI directions expressly preserve other remedies: “The compensation provided under these directions shall be without prejudice to the rights of a borrower to get any other compensation as per any applicable law.” A documented sale that failed, a refinancing opportunity that was lost, certified-copy expenses, litigation costs, and proven distress may therefore matter separately where the relevant forum and law permit an award.

Build the evidence before demanding payment

Your calculation is only as persuasive as the dates, documents, and attribution behind it. Assemble a chronological file containing:

  1. Settlement proof: the loan-closure or full-settlement statement showing the date on which the account was fully repaid or settled.
  2. Contract terms: the loan agreement, sanction letter, and any clause stating where, how, and when security documents would be returned.
  3. Inventory of originals: receipts, deposit acknowledgements, or custody letters identifying each title deed and other original document handed to the lender.
  4. Demand trail: written requests, branch acknowledgements, emails, SMS messages, call records that can be corroborated, and the lender’s responses.
  5. Actual completion date: the signed handover receipt, courier record, or written confirmation showing when originals or certified replacements were delivered or made available.
  6. Proof of lender responsibility: admissions that documents were misplaced, internal correspondence, repeated promises, or other evidence showing that the delay was attributable to the lender.
  7. Financial impact: invoices for certified copies and duplicate documents, evidence of a failed sale or refinancing attempt, additional transaction costs, and records supporting any other claimed loss.
  8. Regulatory closure: a request for removal of charges from the relevant registry and a written closure or no-dues confirmation.

Keep originals of the evidence and submit copies with a numbered chronology. A simple spreadsheet should show the event date, the document proving it, the applicable deadline, the disputed days, and the amount claimed.

Make the claim in a way the lender can verify

1. Send a written computation

Address the lender’s grievance or customer-service channel and the branch handling the security documents. State the settlement date, identify each missing or delayed original, set out whether the 30-day or 60-day period applies, and show the arithmetic in a separate line. Ask for payment of the calculated amount, return of every document, removal of registered charges, and written confirmation of closure.

2. Separate undisputed requests from disputed money

Even if the parties disagree about compensation, insist on the practical deliverables: the originals or certified copies, confirmation that charges have been removed, and a no-dues or closure letter. A lender’s response may clarify whether it disputes the settlement date, says a document was never deposited, or accepts that an item was misplaced.

3. Escalate with a complete record

If the lender does not resolve the matter, use the consumer-law or regulatory remedy available for the lender and transaction. The appropriate forum, limitation period, and filing route depend on the facts and the lender’s status. Attach the chronology, calculation, correspondence, and proof of loss rather than relying on a bare assertion that the bank owes ₹5,000 per day.

4. Get advice for a high-value or old claim

Consult an Indian lawyer familiar with banking or consumer disputes when the delay predates 1 December 2023, originals are permanently missing, a sale or refinance failed, multiple properties are involved, or the claimed loss is substantially greater than the daily RBI amount. Counsel can test attribution, limitation, interest, and the possibility of compensation under other applicable law.

Common calculation mistakes

  • Starting on the settlement date: the ordinary RBI penalty period starts after the 30-day release period, not immediately when the loan is paid off.
  • Using 30 days for a lost deed: the directions provide an additional 30 days for duplicate or certified copies, making the usual total 60 days before the delayed-period calculation.
  • Applying the rate to every lender: the ₹5,000 rule is an India-specific RBI direction for covered regulated entities.
  • Assuming retroactivity: a delay that began before the applicable 1 December 2023 date does not automatically receive the fixed daily amount.
  • Counting days without proving responsibility: the rule concerns delay attributable to the regulated entity; preserve evidence about requests, availability, and any disputed event.
  • Ignoring registered charges: document release and removal of charges are both part of the lender’s post-settlement obligations.
  • Claiming only the daily amount: the directions preserve other compensation under applicable law, so document replacement expenses, transaction disruption, and other legally recognized losses.
  • Relying on an oral promise: insist on written dates and acknowledgements so the deadline and handover can be proved.

A practical worksheet

Worksheet item What to enter
Lender and RBI status Name, entity type, and evidence that it falls within the covered categories.
Full repayment or settlement date Date shown on the closure statement or settlement record.
Applicable regime Post-1 December 2023 release due date, or an older case requiring a fact-specific legal assessment.
Deadline 30 days after settlement for intact originals; generally 60 days total where originals are lost or damaged.
Actual completion date Date originals or certified replacements were handed over or made available.
Attributable days Calendar days after the applicable deadline that the lender is responsible for.
RBI amount Attributable days × ₹5,000.
Other losses Documented copy, retrieval, transaction, litigation, or other losses that may be claimable under applicable law.

Use the worksheet to present one transparent figure while preserving a separate schedule for additional losses. If the lender disputes a date or responsibility, show both competing calculations and explain the evidence supporting yours.

Bottom line for an Indian borrower

For a covered RBI-regulated lender, a release due on or after 1 December 2023 ordinarily yields ₹5,000 per attributable day after 30 days from full repayment or settlement. Lost or damaged originals generally move the calculation point to after 60 days because of the additional replacement period. The amount is not automatically retroactive, does not replace other legal remedies, and cannot be calculated reliably without proof of the settlement date, document inventory, lender responsibility, and actual handover date.
