How to Buy a Yacht Through a Yacht Broker: From Search to Closing

By TheFinanceBase Team 13 min read

Buying a yacht through a broker is a staged transaction: define how you will use the boat, engage a buyer’s broker, inspect and compare candidates, submit a written offer with conditions, place the deposit with the contract’s stakeholder or escrow holder, complete an independent survey, haul-out and sea trial, then finish financing, insurance, title checks and closing before delivery. A buyer’s broker normally searches and negotiates for you, while the listing broker represents the seller.

The signed purchase agreement—not a verbal promise or a broker’s email—controls the deposit, inspection rights, deadlines, permitted deductions and remedies. A deposit of approximately 10% is common in brokerage guidance, but the percentage, refund rights, escrow arrangement, taxes and documentation requirements depend on the contract, jurisdiction and vessel’s flag. Have a maritime lawyer review the agreement before you sign or transfer funds.

1. Define the yacht you can afford and use

A broker can only search effectively when the brief is specific. Decide what the yacht must do, where it will operate and what ownership costs you can carry after purchase.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Write a practical brief

  • Use: day trips, family cruising, fishing, liveaboard use, chartering or long-distance passage-making.
  • Type: motor yacht, sailing yacht, trawler, catamaran, sport-fisher or another design suited to the use.
  • Size and layout: length, draft, beam, number of cabins, crew accommodation, accessibility and storage.
  • Operating area: home port, intended cruising grounds, bridge and draft limits, weather and distance from service yards.
  • Budget: purchase price plus survey, haul-out, repairs, taxes, registration, insurance, financing costs, delivery and an operating reserve.
  • Timing: when you can inspect, close, take delivery and begin a refit.

Do not treat the advertised price as the ownership budget. A lower-priced yacht that needs engines, electrical work or structural repairs can cost more than a higher-priced, well-documented boat. Ask the broker to present total acquisition costs as a range, with unknown items identified rather than hidden in a single estimate.

Choose representation before viewing boats

In a two-broker transaction, the listing broker represents the seller and the buyer’s broker represents the buyer. The buyer’s broker can search across listings, arrange viewings, explain market value and negotiate terms. Commission is commonly paid from the seller’s proceeds and shared between brokers, but the actual arrangement and any conflicts should be explained in writing before you rely on it.

Ask how the broker is compensated, whether the relationship is exclusive, how long it lasts, what happens if you find a yacht yourself and how conflicts are handled when one brokerage represents both sides. Keep those terms separate from the yacht purchase agreement: representation paperwork determines the broker relationship; the purchase agreement determines the sale.

2. Build and test a shortlist

Your broker should narrow the market to yachts that fit the brief, not simply forward every listing in the price range. Request the listing history, ownership and maintenance records, known defects, engine hours, refit dates, location, flag or registration and any existing liens or encumbrances that are disclosed.

Compare candidates on the same decision axes

Decision area Questions to ask
Total acquisition cost What will price, survey, haul-out, repairs, taxes, registration, documentation and delivery cost together?
Condition and maintenance Are service records continuous? Which major systems, engines, generators, tanks and safety equipment have been replaced or deferred?
Survey risk Are there signs of moisture, osmosis, corrosion, structural damage, leaks, electrical faults or overdue safety work?
Propulsion and systems Do engine hours, service history, cooling, exhaust, steering, navigation, batteries and generators match the intended use?
Title and documentation Can the seller deliver a clean chain of ownership, bills of sale, registration or title, and evidence that liens are released?
Insurance and finance Will insurers offer the required cruising-area coverage, and will a lender accept the vessel and survey?
Fit for purpose Does draft, range, fuel capacity, layout and equipment suit your actual routes and crew?
Contract protection Will the agreement provide satisfactory-survey, sea-trial, financing and insurance conditions with usable deadlines?

View each yacht deliberately

During a viewing, look for evidence rather than cosmetic impressions. Check bilges, engine spaces, fuel and water tanks, electrical panels, deck hardware, hatches, seacocks, steering gear, electronics, safety equipment and signs of leaks or unrecorded repairs. Ask what is included in the inventory and photograph the condition of major items, subject to the broker’s and owner’s permission.

A viewing is not a survey. It helps you decide whether to spend money on professional inspection; it cannot establish that a hull, engine or system is sound.

3. Make a written offer that can become a contract

Once you select a candidate, submit a written offer or purchase agreement identifying the yacht and the commercial terms. “The cardinal rule is—get it in writing,” advises California State Parks’ used-boat buyer guidance. Oral assurances about repairs, equipment, delivery or price adjustments are difficult to enforce if they do not appear in the signed agreement.

Terms the offer should identify

  • Make, model, year, Hull Identification Number and current location.
  • Purchase price, currency, deposit amount, payment method and balance due.
  • What equipment, spares, tenders, toys, manuals and inventory are included or excluded.
  • Where and when delivery will occur, and who bears risk, transport and storage costs before delivery.
  • Conditions for a satisfactory independent survey, haul-out, sea trial, specialist inspections, financing and insurance.
  • Inspection and acceptance deadlines, notice method and the consequence of missing a deadline.
  • Required repairs, credits, price adjustments, permitted deductions and the process for resolving disagreements.
  • Closing date, documents to be delivered, prorations and the treatment of taxes, fees and deposits.

Counteroffers should be incorporated into a single clean version. Do not sign a purchase agreement that refers to an attachment, inventory or repair promise you have not received.

4. Understand the deposit before you transfer it

A yacht deposit is commonly approximately 10% of the purchase price in brokerage guidance, including 2026 guidance from Grabau International and other brokers. That figure is a convention, not a legal rule. The signed agreement controls the amount and when it is due.

Where the money goes

The contract may require payment to a brokerage client account, a named stakeholder or an escrow holder before or immediately after exchange of signed agreements. Verify the account instructions independently using a known telephone number; do not rely solely on an emailed change to bank details. Confirm who may release the funds, what documentation authorizes release and whether interest is paid.

When a deposit is refundable

A deposit is not automatically refundable. Refund rights usually depend on a valid survey, sea-trial, financing or insurance condition being exercised in the manner and time allowed by the agreement. The contract may also permit deductions for agreed repairs, buyer default or other specified losses. Ask the lawyer to point to the exact clause that permits you to reject, request a price change or recover the deposit.

Conditional versus “as is” agreements

A conditional agreement makes the listed inspections and other conditions contractual decision windows. An unconditional “as is, where is” agreement can remove those protections and may make the deposit non-refundable even when a later inspection reveals expensive work. Do not assume that a survey contingency exists because a broker mentioned a survey; it must be written into the signed agreement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Hire an independent surveyor and inspect the yacht

Choose and hire the marine surveyor yourself, with the broker helping coordinate access but not selecting a person whose independence is unclear. Jordan Yacht Brokerage notes that the buyer chooses and pays the surveyor and associated yard costs. Budget separately for the survey, haul-out, blocking, launching, travel and specialist inspections.

What the inspection can include

  • Condition and structural survey: hull, deck, superstructure, moisture, laminate or metal condition, fittings, tanks and visible systems.
  • Haul-out: underwater hull, propellers, shafts, rudders, thrusters, through-hulls, anodes and coatings.
  • Mechanical inspection: engines, transmissions, generators, cooling, exhaust, controls and service records.
  • Electrical and systems checks: batteries, charging, wiring, navigation, plumbing, air-conditioning, hydraulics and safety equipment.
  • Specialist reports: rigging, sails, electronics, gas systems, stabilizers, generators or other equipment when the yacht or surveyor warrants it.

Give the surveyor the listing information and your intended use. Ask for defects to be separated into safety-critical, operationally important and cosmetic items, and request estimates or recommendations where feasible. A survey report is an expert opinion based on the inspection scope; it is not a warranty that future failures cannot occur.

6. Complete the sea trial and use the contract’s decision window

A sea trial tests the yacht under operating conditions. It can reveal overheating, vibration, smoke, transmission faults, steering problems, poor handling, excessive noise, electrical failures or performance that does not match the representation. Boatcrowd describes the sea trial and condition survey as the two moments when a buyer finds out what the yacht is actually like.

  • Detailed Deck Superstructure, Realistic Luxury Design
  • Max Speed: 16 mph (25 kmph); Powered by twin 380 type high speed racing motors
  • Perfect for pools, small ponds, rivers and lakes; Precise Radio Control Boat: forward, left/right turn, stop

  • Boat Dimension: 28"L x 8"W x 8"H approx.; Factory assembled and painted, Ready to Run (RTR)

Prepare a useful sea trial

  1. Confirm in advance who will attend, what equipment will be operated and how fuel, crew and yard charges will be handled.
  2. Start engines and generators from cold when practical; record alarms, smoke, temperatures, pressures and charging behavior.
  3. Run at idle, cruising and higher loads appropriate to the vessel, checking acceleration, speed, vibration, steering and transmission.
  4. Operate navigation, communications, pumps, toilets, refrigeration, air-conditioning, thrusters, stabilizers and other systems material to your use.
  5. Record observations and give the surveyor access to the engine room and relevant instruments.

Do not turn a sea trial into an informal acceptance. After the trial and survey, follow the agreement’s notice procedure. Depending on the findings and the contract, you may accept the yacht, request specified repairs or a price adjustment, or reject it. Missing the written notice deadline can convert a conditional purchase into an accepted one, so use the contract’s exact date, time and delivery method.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Decide whether to accept, renegotiate or reject

Accept

Accept when the report and trial fit your risk tolerance, the seller has completed any agreed work and the contract allows you to issue a clear written acceptance. Record the agreed inventory and repairs so there is no dispute at closing.

Renegotiate

Use documented findings to request a repair, credit or price change. Prioritize safety, seaworthiness and major systems rather than cosmetic preferences. Put the resolution in a signed amendment that states who performs the work, the standard, timing, invoices or receipts required and what happens if the work is incomplete.

Reject

Rejection is available only when the agreement permits it and you comply with its notice and timing rules. Have counsel confirm that the stated reason fits the condition clause, that the notice is effective and that the stakeholder can return the deposit. Do not simply stop responding or instruct the bank to reverse a payment; that can create a breach and a dispute.

8. Arrange financing and insurance before the closing date

Seek financing pre-approval before making an offer, then obtain final approval against the specific yacht. Lenders commonly request the signed purchase agreement, survey, valuation, title or registration records, insurance evidence, financial statements and information about the vessel’s age, flag and intended use. Approval is not guaranteed merely because you were pre-approved personally.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask insurers for an indication early and for binding requirements before the balance is due. Underwriting can depend on vessel type and age, condition, claims history, operator experience, cruising area, navigation limits, survey recommendations and safety equipment. A policy that excludes your intended waters or requires repairs you cannot complete is not usable coverage.

Make the conditions operational

  • State in the agreement whether acceptable financing and marine insurance are conditions of completion.
  • Set the date by which approval, binding coverage and any lender or insurer repairs must be confirmed.
  • Tell the surveyor about lender and insurer requirements so the report addresses them.
  • Budget for lender fees, appraisal or documentation charges, insurance deductibles and required upgrades.

9. Verify title, liens and registration

Before releasing the balance, confirm that the seller can convey the promised ownership free of undisclosed liens or encumbrances. The required search depends on the registration system and flag. Review the chain of bills of sale, current title or registration, builder’s certificate where relevant, deletion or export documents, tax evidence and any mortgage release.

Ask a maritime lawyer or documentation agent to verify the documents and conduct the appropriate lien or registry searches. A clean-looking registration certificate alone may not answer every jurisdiction’s lien question. Tax, VAT or sales-tax status, import history and registration eligibility can affect both closing and future resale; obtain advice for the vessel’s current and intended jurisdictions.

10. Prepare the closing and delivery

Closing is the coordinated exchange of the balance, ownership documents and possession. It is different from the sea trial: acceptance of condition does not by itself transfer title.

Closing checklist

  • Final purchase price, deposit credit, prorations and every agreed repair or credit shown on the closing statement.
  • Signed bill of sale and any other transfer instruments required by the registration authority.
  • Original or otherwise acceptable title, registration, builder’s certificate and ownership chain.
  • Written releases of mortgages, liens or other encumbrances, and confirmation that searches are satisfactory.
  • Final inventory, manuals, keys, remote controls, spare parts, tenders and safety equipment.
  • Insurance bound from the agreed time and lender conditions satisfied, if financed.
  • Delivery location, date, fuel and consumables, storage, transport, risk of loss and prorations handled as the contract states.
  • Wire instructions independently verified and funds released only under the stakeholder or escrow procedure.

A documentation agent or maritime lawyer may prepare and verify the paperwork. Read the closing statement line by line; a small proration or fee can signal that a larger agreed item was omitted. The closing receipt should identify the documents delivered and the date and time ownership and risk changed.

Handover after funds clear

At delivery, make a joint inventory check, photograph the yacht’s condition and meter readings, test keys and remotes, and obtain passwords or codes for installed equipment. Confirm that the seller has removed personal property and that the agreed safety equipment remains aboard. Keep copies of the signed closing package, survey, sea-trial notes, insurance policy, registration filings and repair invoices.

11. Costs to budget beyond the purchase price

Cost What determines it When to plan it
Deposit Often approximately 10% in brokerage guidance; exact amount, holder and refund rules are contractual. When the agreement is signed or exchanged.
Survey and haul-out Survey scope, vessel size, travel, yard rates, blocking, launch and specialist reports. Before the inspection is scheduled.
Repairs or credits Survey and sea-trial findings, agreed standards and local labor and parts costs. After inspection and before acceptance or closing.
Financing Lender interest, appraisal, documentation, legal and registration charges. During application and closing.
Insurance Vessel, age, condition, claims history, operator, cruising area, deductible and insurer requirements. Before the financing and closing conditions expire.
Taxes and registration Location, residence, import status, flag, use and local tax law. Before signing and again before delivery.
Delivery Distance, crew, fuel, transport, storage, weather and risk allocation. When negotiating delivery terms.
Ownership reserve Maintenance, dockage, haul-outs, upgrades, safety gear and unexpected failures. Before deciding what price is affordable.

No universal figure covers these items. Obtain written estimates and identify which amounts are one-time, recurring, tax-dependent or still unknown.

12. Common pitfalls and how to avoid them

Assuming the broker is your advocate

Risk: The listing broker’s duty may be to the seller, or a dual-agency arrangement may create conflicts.

Fix: Confirm representation and compensation in writing and use a buyer’s broker when you want independent search and negotiation advice.

Relying on a recent survey

Risk: A prior report may have a different scope, date, owner or intended use, and it does not replace your contractual inspection.

Fix: Commission an independent survey and add specialist inspections where the vessel’s systems warrant them.

Transferring funds after an emailed bank change

Risk: Wire fraud can divert a deposit or balance before anyone notices.

Fix: Verify account details through a trusted, independently obtained telephone number and confirm the stakeholder’s release process.

Waiting until closing to solve title or insurance problems

Risk: A lien, tax issue, registration failure or unavailable cruising coverage can stop delivery after you have spent money.

Fix: Start searches, lender review and insurance underwriting as soon as the yacht is under contract.

13. Questions to ask each professional

Buyer’s broker

  • Who represents whom, and how are commissions and conflicts handled?
  • What comparable sales or listings support the asking price?
  • What records, defects and exclusions are known?
  • Which contract form and jurisdiction will govern?

Surveyor

  • What is included and excluded from the survey?
  • Will you attend haul-out and sea trial?
  • Which findings are safety-critical or likely to affect insurance and financing?
  • What specialist inspections should be added?

Maritime lawyer or documentation agent

  • Who holds the deposit and under what release conditions?
  • What searches establish clear title and lien status?
  • Which bills of sale, tax records and registration filings are required?
  • What law governs rejection, default and dispute resolution?

Lender and insurer

  • What survey age, valuation, repairs and safety equipment are required?
  • Are the intended cruising area, operator and use covered?
  • What must be completed before funds or coverage are released?

14. The complete buyer’s sequence

  1. Define use, type, size, budget, cruising area and timing.
  2. Confirm buyer-broker representation and conflicts in writing.
  3. Shortlist yachts and compare total acquisition cost, condition, records, insurance, finance and contract protection.
  4. View candidates and request records and inventory details.
  5. Submit a written offer identifying the yacht, price, deposit, included items, delivery and conditions.
  6. Have the agreement reviewed before signing or paying.
  7. Place the deposit exactly as the contract requires with the named stakeholder or escrow holder.
  8. Hire an independent surveyor; complete haul-out, condition, mechanical and specialist inspections.
  9. Conduct the sea trial and document performance and defects.
  10. Accept, negotiate repairs or price, or reject only through the agreement’s notice procedure.
  11. Finalize financing and bind insurance that covers the vessel and cruising area.
  12. Complete title, registration, lien, tax and documentation checks.
  13. Review the closing statement, transfer funds under verified instructions, exchange documents and record delivery.
  14. Complete the handover inventory, obtain keys and manuals, and retain the closing file.

Tax, flag-state, registration, VAT or sales-tax, lien-search, insurance and contract-law rules vary by jurisdiction and vessel. A buyer’s broker can coordinate the transaction, but a maritime lawyer, tax adviser, insurer, lender and registration authority should answer the questions specific to your yacht and location.
