Slow pending sales can give a buyer more time to investigate a home and negotiate, but they do not guarantee a discount or a safer transaction. Pending sales measure signed contracts, not completed purchases, and a national reading can hide sharply different conditions from one neighborhood to the next.
The practical approach is to use the national index only as context, then base your budget and offer on local comparable sales, competing listings, price reductions, days on market, lender terms and the protections written into your contract.

What slow pending sales actually tell you
The National Association of REALTORS’ Pending Home Sales Index (PHSI) measures signed contracts for existing single-family homes, condominiums and cooperatives. Because most signed contracts become completed sales, the index generally leads completed existing-home sales by one to two months.

That single monthly change is not a nationwide buyer’s-market verdict. It says that contract activity changed slightly during that month; it does not tell you what a particular seller will accept, how many buyers are competing for a specific property or whether prices in your target neighborhood are rising or falling.

Use the index to understand broad momentum, not to choose an offer price or predict when mortgage rates or local prices will turn. The September 2026 report was scheduled for October 20, 2026, so August was the latest monthly reading available on the cited NAR page at the time of this guidance.
Why a slow contract market can help—and still carry risk
Fewer signed contracts may mean listings sit longer, sellers consider concessions, and you have more time for an inspection and financing review. It can also signal that buyers are constrained by affordability, inventory is mismatched with demand, or local conditions differ from the national trend. A contract can still fail after a home is marked pending. Financing, inspection and appraisal problems are common reasons a transaction does not reach closing.
A recent REALTORS Confidence Index Survey reported an approximate transaction fallout rate of 5% (National Association of REALTORS, 2026 consumer guide). That is a survey figure, not a probability assigned to your purchase. Treat a returned listing as a prompt to investigate, not automatic proof that the property is defective or a bargain.

Build a local market picture before you make an offer
Ask an agent who works in the area to assemble current evidence for the exact neighborhood, property type and price band. Review the same information yourself so you understand the basis for the recommended offer.
- Recent comparable sales: Look for homes with similar size, age, condition, location, lot and amenities that closed recently. A comparable that is listed but not under contract is not evidence of what buyers have actually paid.
- Active competing listings: Count homes buyers can choose today and note whether they are receiving offers, reducing prices or offering concessions.
- Days on market: Compare the subject home with the typical time to contract for similar properties. A long marketing period can create leverage, but it may also reflect condition, an unusual layout or an unrealistic asking price.
- Price reductions: Record the original price, each reduction and the date of each change. A reduction may indicate seller flexibility, or it may simply bring the property closer to market value.
- Offer activity: Ask whether the seller has competing offers, an offer deadline or a clause allowing continued marketing. Do not assume that a “slow” national index means there are no competing buyers for this home.
Have your agent explain how each local fact affects a reasonable price range and which terms could make your offer more attractive without sacrificing protections. The available national sources do not provide a universal offer formula or current city-by-city conditions, so local evidence must fill that gap.

Set a payment-based budget, not the lender’s maximum
A preapproval tells you what a lender may be willing to lend under stated assumptions. It does not decide what payment fits your life. The Consumer Financial Protection Bureau (CFPB) emphasizes that only you can determine how much you can afford.
Start with a monthly payment you can sustain after accounting for income changes, emergency savings, retirement contributions, childcare, transportation, debt payments and maintenance. Then estimate the full housing cost:

- Principal and interest on the proposed loan.
- Property taxes and homeowners insurance.
- Mortgage insurance, if required.
- Homeowners’ association or condominium fees.
- Utilities and a reserve for repairs and replacement of major systems.
- Cash needed for the down payment, closing costs, prepaid taxes and insurance, moving and immediate work.
Stress-test the payment for a higher insurance premium, a tax increase, an adjustable-rate reset if applicable, or a period of reduced income. Decide in advance the maximum price and maximum cash-to-close amount you will accept. That boundary is your negotiating guardrail when a seller counters.
Get preapproved, then compare lenders systematically
Get preapproved when you are ready to shop seriously. A preapproval letter is tentative, based on assumptions and further verification; it is not a guaranteed loan offer. CFPB says a letter commonly expires after 30 to 60 days, although the exact period depends on the lender. It does not require you to use that lender.
- Prepare your file. Be ready to provide identification, income documentation, asset statements, employment information and permission for a credit review. Ask how long the lender expects the review to take and which documents may need updating.
- Request at least three preapprovals. Compare the loan program, rate structure, estimated fees, required cash, underwriting conditions and financing deadline the lender can realistically meet. A lower headline rate can be offset by points, fees or a less suitable program.
- Keep the letters current. If your search extends beyond the expiration date, ask the lender to refresh the letter without changing the requested loan amount or assumptions unless your finances have changed.
- After acceptance, request official Loan Estimates. Compare the standardized Loan Estimates before selecting the lender. Review the interest rate and whether it is fixed or adjustable, annual percentage rate, origination charges, lender credits, mortgage insurance, projected cash to close and other recurring costs.
Do not let a preapproval encourage you to bid up to the lender’s ceiling. It is evidence that you have begun the financing process, not a promise that every property, appraisal or debt-to-income calculation will qualify.

Make an offer that is clear and financeable
Sellers often value certainty, but certainty must be credible. Include the price, proposed closing date, financing type, earnest-money terms, requested concessions and each contingency with a specific deadline. A workable closing date can matter as much as a small price difference when the seller is coordinating another purchase or move.

Give the seller a current preapproval and permission for the lender or agent to answer reasonable status questions. Do not claim that financing is guaranteed, promise an appraisal result or waive a protection you do not understand merely to appear stronger. In a slower market, a clean, complete offer can stand out without exposing you to avoidable risk.
Keep due-diligence protections explicit
Contingencies are conditions that must be satisfied for the contract to proceed. The legal effect, customary language and deadlines vary by state and contract form. Read every provision, calendar each date and obtain local legal advice when the consequences are unclear.
Financing contingency
This provision addresses your ability to obtain the specified loan by a stated deadline. Confirm what notice you must give if the lender denies the loan or cannot meet the deadline, and whether the contingency covers a change in loan terms caused by underwriting. Continue supplying documents promptly; a contingency does not excuse avoidable delay.
Inspection contingency
Specify the inspection period, the inspections permitted and the available responses. Depending on the contract, you may be able to request repairs or credits, accept the condition, renegotiate or cancel. General inspections may need to be supplemented by specialists for structural, roof, sewer, pest, radon, mold, well or septic issues. A slow market gives you time to investigate, but it does not eliminate the need to act before the deadline.

Appraisal terms
An appraisal may come in below the contract price. Decide before offering how much, if any, appraisal gap you could cover with cash. Clarify whether the contract permits renegotiation or cancellation when value is insufficient and what notice is required. Do not rely on an expected appraisal increase to make an aggressive offer affordable.
Title and property disclosures
Review the title commitment, recorded easements, liens, restrictions and required disclosures. Ask who cures a title defect and by what date. Compare disclosure statements with inspection findings and permits where available. Title insurance protects according to its policy terms; it does not replace your review of how the property may be used.
Home-sale contingency
If you must sell your current home, state the listing and sale deadlines and the consequences if it does not sell. Understand any kick-out clause: it may allow the seller to continue marketing the property and require you to respond within a short period after receiving another acceptable offer. Know whether you must remove the contingency, provide proof of funds or terminate.
Home-close and possession terms
Specify the closing date, possession date, included items and the condition in which the property must be delivered. A seller rent-back or post-closing occupancy needs its own written terms for rent, security deposit, insurance, utilities, damage and the move-out deadline. A convenient date is valuable only if the lender, title company and your moving plan can meet it.
Negotiate the whole transaction, not just the price
When pending sales are slow, sellers may be more open to adjusting several terms. Compare the economic and practical effect of each concession rather than treating every dollar as equal.

| Term | What to evaluate | Questions to answer before agreeing |
|---|---|---|
| Purchase price | Recent comparable sales, condition and competing listings | Does the price remain affordable if the appraisal is lower than expected? |
| Closing costs or credits | Loan-program limits, eligible costs and the effect on cash to close | Will the lender permit the full credit, and does it compensate for a real expense? |
| Closing date | Lender processing, title work, moving and the seller’s next home | Can every party meet the date without waiving due diligence? |
| Inspection response | Repairs, credits, price change and completion standards | Who selects the contractor, and how will completion be verified? |
| Financing and appraisal risk | Contingency deadlines and any cash commitment from you | What is the maximum additional cash you could safely provide? |
| Title issues | Liens, easements, restrictions and cure deadlines | What happens if the defect is not resolved on time? |
| Seller occupancy | Rent, deposit, insurance, utilities and possession condition | What remedy applies if the seller stays late or causes damage? |
| Kick-out clause | Seller’s right to keep marketing and your response period | How quickly must you remove the home-sale contingency or terminate? |
Ask for documentation of any promised repair, credit or included item. Verbal assurances are difficult to enforce and can be lost when the contract is signed.
If a pending home returns to the market
Do not infer a cause from the listing status alone. Ask the listing agent what the seller is permitted to disclose, then review available disclosures, inspection reports, repair invoices and the prior contract terms. Possible causes include financing failure, an appraisal shortfall, an inspection disagreement, a title problem or a buyer’s changed circumstances.
Reinspect the property if conditions may have changed, and obtain your own inspection rather than adopting the prior buyer’s conclusions. Confirm that the seller has authority to accept a new offer and that any prior earnest-money dispute has been resolved. Price the home from current comparable sales and condition—not from the fact that it was previously under contract.
Use one comparison sheet for every home and offer
A consistent worksheet prevents a low price from hiding expensive terms or risks. Record the same fields for each candidate:
| Decision axis | Information to record |
|---|---|
| Total cost | Price, estimated cash to close, lender charges, taxes, insurance, association fees and likely repairs |
| Financing | Rate structure, APR, fees, loan program, preapproval conditions and confidence in meeting the financing deadline |
| Condition and risk | Inspection findings, appraisal-gap exposure, title questions, disclosures and known property issues |
| Contract flexibility | Contingency scope and dates, closing and possession dates, seller rent-back and any kick-out clause |
| Local market evidence | Comparable sales, active competing listings, days on market, price reductions and documented offer activity |
Score the options against your own priorities only after filling in the facts. For example, a slightly higher price with a seller credit may require less cash at closing, while a lower price with an appraisal-gap promise may expose you to more cash risk. The worksheet makes that trade-off visible.
A step-by-step process from search to closing
- Define the payment and cash limits. Include taxes, insurance, fees, maintenance and reserves, not only principal and interest.
- Collect local market evidence. Review comparable sales, active listings, reductions, days on market and competing offers for the specific area.
- Shop for financing. Obtain at least three preapprovals and compare programs, terms and costs rather than rates alone.
- Choose a search range below your absolute ceiling. Leave room for repairs, appraisal differences and changing insurance or tax costs.
- Investigate each property. Read disclosures, check permits and known hazards, and estimate immediate and future work.
- Draft a complete offer. State price, earnest money, financing, contingencies, deadlines, closing date, concessions and possession terms.
- Model the worst plausible outcome. Before waiving or narrowing a contingency, calculate the cash and legal consequences if financing, appraisal, inspection or title work goes against you.
- Perform inspections and submit documents on time. Track every contractual deadline in writing with your agent, lender, inspector and title company.
- Compare official Loan Estimates. Once accepted, select the lender whose complete terms and execution plan fit the transaction.
- Recheck the numbers before closing. Confirm final cash to close, repairs, title status, insurance, possession and the condition required by the contract.
Common mistakes in a slow market
- Reading a national index as a local forecast: Regional and neighborhood conditions can move in opposite directions.
- Confusing “pending” with “sold”: A signed contract can still fail before closing.
- Using the maximum preapproval as your budget: The lender’s ceiling does not account for every goal and risk in your household.
- Choosing a lender by headline rate: Fees, APR, loan structure, credits and the ability to meet deadlines all affect the result.
- Leaving deadlines vague: An undefined inspection, financing or home-sale period can remove leverage or create a default risk.
- Waiving protections without pricing the risk: If you cannot state the maximum cash or repair exposure, you are not ready to accept the waiver.
- Assuming a relisted home is either damaged or discounted: Find out why the prior contract ended and perform independent due diligence.
- Relying on verbal promises: Put repairs, credits, included items and occupancy obligations in the signed agreement.
Bottom line
Slow pending sales can improve your opportunity to compare homes and negotiate terms, but they are not a guarantee of lower prices or easy financing. Buy when the payment fits your finances, local evidence supports the price, your lender’s terms are competitive and the written contract preserves the inspections, financing, appraisal, title and timing protections you need.
