If you need the money sooner, the exact cost depends on your CD agreement: some institutions charge a stated dollar amount, others take a number of days or months of interest, reduce the interest rate, reclaim a promotional bonus, or—when earned interest is insufficient—deduct part of your principal.
Before opening or breaking a CD, get the current account agreement and ask the institution for a written payoff quote. Confirm the penalty trigger, formula, minimum charge, maturity and renewal dates, grace-period rules, partial-withdrawal rights, call provisions, and whether the product is insured. There is no single penalty amount that applies to every CD.

What an early-withdrawal penalty is—and why the contract matters
A CD is designed for a fixed term. In exchange for committing your money, the institution generally pays a stated interest rate or yield. Taking funds out before the term ends is an early redemption, and the agreement normally permits the institution to impose a penalty.

The Office of the Comptroller of the Currency (OCC) describes CDs as accounts that are not intended to be liquid and says banks generally must assess an early-withdrawal penalty when funds are withdrawn before maturity, subject to exceptions. Federal law establishes a minimum penalty in the circumstances covered by the regulation, but the OCC says there is no universal maximum for CDs issued by national banks. The agreement for your specific account controls the amount.

Regulation DD requires a bank to disclose whether an early-withdrawal penalty will or may apply, how it is calculated, and the conditions under which it is assessed. Read the disclosure and the full account agreement rather than relying on a verbal description or a generic rate sheet.
Common penalty formulas
| Method in the agreement | How it can affect you | What to verify |
|---|---|---|
| Stated dollar charge | A fixed amount is deducted when you redeem early. | Exact dollar amount, whether it applies per withdrawal or per account, and any minimum balance requirement. |
| Days or months of interest | The institution withholds a specified period of interest, such as several months, calculated under the agreement. | Number of days or months, interest rate used, compounding method, and whether accrued but uncredited interest is included. |
| Reduced interest or altered compounding | The account may be repriced under a less favorable rate or compounding rule for the period before redemption. | The replacement rate, calculation period, and whether the change applies retroactively. |
| Bonus reclamation | A promotional bonus or premium may be taken back in addition to other adjustments. | Eligibility conditions, vesting period, and whether the bonus can be reclaimed from principal. |
| Interest first, principal second | If earned interest is not enough to cover the penalty, the agreement may reduce the amount of principal returned. | The order of deductions and the minimum amount, if any, protected from reduction. |
CFPB examples of disclosed penalties include a specified amount such as “$10.00,” a stated period of interest plus accrued but uncredited interest, adverse changes to the rate or compounding, and reclamation of bonuses. Those examples illustrate possible disclosures; they do not establish a standard charge for your CD.
How to avoid the penalty before you open a CD
Match the term to your cash-flow calendar
Choose a maturity date you can realistically reach without using the deposit. List known expenses—taxes, tuition, insurance premiums, planned moves, and large purchases—and keep enough cash outside the CD for emergencies. A higher yield is not necessarily a better choice if accessing the money early would erase the interest or reduce principal.
Read the account agreement, not just the advertised APY

- the early-withdrawal penalty formula, minimum, and deduction order;
- whether partial withdrawals are permitted and whether they trigger a penalty;

- automatic-renewal instructions and the length of the grace period;
- whether the bank can call the CD before maturity; and
- any market-linked redemption limits or special conditions.
Keep a maturity and grace-period reminder
Set reminders well before maturity and again on the first day of the grace period. A CD that renews automatically can move into a new term if you do nothing. During the disclosed grace period, you may be able to withdraw or change instructions without an early-redemption charge. The exact length and procedure vary, so follow the agreement rather than assuming the window lasts a particular number of days.
What to do when you need the money before maturity
Do not authorize an early redemption until you know the net amount you will receive. Use this sequence:
- Locate the governing documents. Find the CD receipt, disclosure, account agreement, current balance, and transaction history. Confirm the maturity date, renewal date, grace period, and whether the CD is callable or market-linked.
- Request a written payoff quote. Ask for the exact penalty in dollars, interest lost or repriced, principal returned, effective redemption date, and the net amount that will be paid to you. Ask the institution to identify the paragraph in the agreement that supports the calculation.
- Ask about exceptions and partial access. Find out whether the institution permits a partial withdrawal, a penalty-free withdrawal under the product terms, or another contractual exception. Do not assume that a hardship automatically waives the charge; the available exceptions depend on the law and the agreement.
- Compare the alternatives. If the need is temporary, compare the penalty with liquid savings, a lower-cost loan, or waiting until maturity. Calculate the total cost of any loan, including interest and fees, rather than assuming borrowing is cheaper.
- Check the calendar. If maturity is close, waiting may eliminate the fee. If the CD is about to renew, follow the stated grace-period process promptly so the funds do not roll into a new term.
- Preserve records. Save the quote, agreement, confirmation, and year-end tax statement. These documents let you verify the calculation and support the separate tax treatment of interest and the penalty.
When waiting can eliminate the charge
At the stated maturity date
A redemption on or after the maturity date is generally not an early withdrawal. Verify the institution’s cut-off time and instructions for transferring the funds. Some agreements require advance notice or specify how interest is handled on the maturity date.
During an automatic-renewal grace period
Many CDs renew for another term unless you give different instructions. The agreement should state the grace-period length and how to submit a withdrawal or transfer request. Missing the window can leave you in a new term with a new maturity date, at which point a withdrawal may again be subject to a penalty.

When the bank calls a callable CD
A callable CD is different from a standard maturity-only account. A call provision permits the bank to end the CD early under specified conditions, often after a stated noncall period. If the bank calls it, the event is not the same as you voluntarily breaking the CD. Read the call schedule, the notice procedure, and what happens to your principal and interest after a call. Do not assume the bank will call the CD when rates fall or when you want liquidity.
Can a penalty reduce your principal?
Yes. Some agreements deduct the penalty from earned interest first and then from principal if the available interest is not enough. That means you can receive less than the amount originally deposited. The possibility is especially important when you redeem soon after opening the CD, when the stated penalty covers several months of interest, or when the account includes a bonus that can be reclaimed.
Consider this illustrative calculation, not a prediction of any institution’s terms. Suppose a CD has a $10,000 deposit, $60 of earned interest, and a contract penalty of 90 days of interest totaling $180. If the agreement takes interest first, the $60 is used and the remaining $120 is deducted from principal, producing a $9,880 payment before any other adjustments. Your actual result could be different because the agreement may use another rate, compounding method, minimum, or deduction order. Obtain the written quote instead of estimating from the APY alone.

Understand the product type before you redeem
| CD structure | Typical liquidity rule | Questions to ask |
|---|---|---|
| Fixed-rate CD | Usually redeemable before maturity only under the agreement’s penalty terms. | Penalty period, minimum, partial-withdrawal rights, and automatic renewal. |
| No-penalty CD | Designed to permit withdrawals without the usual early-redemption charge, subject to product rules. | When withdrawals become available, whether all or only part of the balance can be taken, and whether the rate is lower than a comparable fixed CD. |
| Callable CD | The bank may end the account under a call provision; you may still face a penalty for your own early redemption. | Call dates, notice, noncall period, and post-call reinvestment options. |
| Market-linked CD | Most generally do not allow early redemption, according to FDIC guidance, or impose special restrictions. | Whether any secondary-market sale is available, how the value is determined, and what fees or losses apply. |
| Variable-rate or promotional CD | Terms can include rate changes, bonus conditions, or special redemption rules. | Rate-reset formula, bonus-reclamation clause, and whether the advertised APY depends on holding to maturity. |
FDIC guidance says most fixed-rate CDs generally allow redemption before maturity for a fee, while most market-linked CDs generally do not allow early redemption. It also advises checking automatic-renewal and call features. Treat these as broad product patterns, not a substitute for your contract.

Use a break-even comparison before you break the CD
Write down three numbers: the net proceeds from redeeming now, the cost of each alternative source of cash, and the value of waiting until maturity. Include the interest you would earn or lose in each scenario.
Liquid savings
If you have an emergency fund or other liquid deposit, compare the interest you would give up by using it with the CD penalty. Replenishing savings later may be preferable to losing principal, but only if using the reserve will not leave you unable to meet near-term obligations.
Borrowing
A loan or line of credit can avoid the CD penalty, but the total borrowing cost may exceed the charge. Include origination fees, recurring fees, variable-rate risk, and the repayment schedule. Compare the after-tax cost where relevant, and do not borrow merely to preserve a nominal CD yield if the loan rate is materially higher.

Waiting
Calculate the number of days until maturity and the additional interest expected during that period. If the waiting period is short and the need is negotiable, postponing the expense may be the least costly option. If the need is urgent, document why the immediate cost is justified before redeeming.

Federal minimums, exceptions, and what they do not tell you
Regulation D defines a deposit that cannot be withdrawn within six days unless the institution assesses at least seven days of simple interest on amounts withdrawn during that period. This is a federal minimum in the circumstances described by the regulation; it is not a universal cap or a complete formula for every CD. Your agreement can impose a larger penalty, subject to applicable law and disclosed terms.
OCC guidance notes that exceptions exist, but it directs consumers to the account agreement and applicable rules. Because eligibility and documentation differ, ask the institution to identify the specific exception and required proof rather than assuming a personal emergency qualifies.
Taxes: report the interest and handle the penalty separately
IRS Publication 550 says to report total interest paid or credited on the CD without subtracting the early-withdrawal penalty. The penalty is handled separately under the applicable penalty-on-early-withdrawal deduction rules. In practice, keep the year-end tax statement, the redemption confirmation, and the written payoff quote so you can distinguish the interest reported from the penalty charged.
Do not reduce the interest figure on your tax return simply because the bank withheld part of it. If you are unsure how the deduction applies to your filing situation, consult current IRS guidance or a tax professional.
Verify insurance before moving the money
When comparing a replacement CD, confirm that the issuing bank or credit union is covered by the appropriate deposit-insurance system and that your total deposits remain within applicable coverage rules. CFPB describes bank and credit-union deposit insurance as covering up to $250,000, subject to the ownership category and other coverage rules. Accounts at different institutions, ownership categories, and products can affect the calculation, so check how the new CD would be titled and aggregated with your existing deposits.
How to challenge a fee that looks wrong
- Recalculate from the contract. Match the institution’s formula, rate, compounding, dates, minimum, and deduction order against the agreement you received.
- Request a written explanation. Ask customer service or the branch to identify the exact clause and show each calculation step.
- Escalate internally. Submit the dispute through the institution’s formal complaint or executive-resolution channel and keep copies of all correspondence.
- Use the appropriate regulator. If the response does not resolve a discrepancy, contact the regulator or complaint channel responsible for the institution’s charter. Provide the agreement, quote, transaction confirmation, and explanation of the difference.
A disagreement about the amount is different from dissatisfaction with a clearly disclosed penalty. Regulators can review whether the institution followed applicable disclosure and contract requirements; they do not generally rewrite a valid agreement to remove a charge.
Checklist for minimizing your next CD penalty
- Keep emergency and near-term spending money outside a term deposit.
- Read the early-withdrawal, renewal, call, and bonus clauses before funding.
- Record the maturity date and grace-period deadline in two places.
- Ask whether partial or penalty-free withdrawals are available.
- Obtain a written payoff quote before authorizing redemption.
- Compare the penalty with waiting, liquid savings, and the full cost of borrowing.
- Confirm FDIC or NCUA insurance eligibility and your aggregate coverage.
- Save the agreement, payoff quote, confirmation, and tax statement.
The practical rule is simple: treat a CD as money committed until maturity unless the written terms clearly provide another exit. The contract, not the advertised rate or a generic online calculator, determines what an early redemption will cost.
