How to avoid double taxation on income earned abroad as an Indian resident (2026 rules)

Paying tax in another country does not automatically remove your Indian tax liability. If you are resident in India, you generally report foreign-source income in India and then seek relief—usually a foreign tax credit—under the applicable double taxation avoidance agreement (DTAA) or, where no treaty applies, India’s unilateral-relief rules. The credit is limited, documentation-heavy and different for years governed by the Income-tax Act, 1961 and Tax Year 2026–27 onward under the Income-tax Act, 2025.

This guide is current to 18 October 2026. It explains how to establish the correct year and residential status, report income and foreign assets, choose treaty or domestic relief, file Form 67 or Form 44, and handle disputes, refunds and common filing failures.

Start with the three decisions that control the result

  1. Identify the tax year and law. Years beginning before 1 April 2026 generally remain under the Income-tax Act, 1961, with the previous-year and assessment-year system. Tax Year 2026–27 begins on 1 April 2026 under the Income-tax Act, 2025 and uses “tax year” terminology.
  2. Calculate your Indian residential status for that specific year. Resident, resident but not ordinarily resident (RNOR), and non-resident status can produce different foreign-income and disclosure obligations. Citizenship or a current Indian address is not enough.
  3. Match the income, country and foreign levy to the correct relief route. A DTAA may control which country can tax a category of income and how relief is calculated. If no applicable agreement covers the case, domestic unilateral relief may be available if its conditions are satisfied.

These decisions must be made before completing a return. A foreign withholding slip by itself does not prove that the amount is a creditable tax or that India will allow the full amount.

Tax year first: which rules and forms apply?

The same income can require a different process solely because the relevant year changed. For periods before Tax Year 2026–27, use the applicable old-law return and forms even when you submit the return, correction or supporting statement later. For income of Tax Year 2026–27 and later, use the 2025 Act, the Income-tax Rules, 2026 and the forms specified under those rules.

Relevant period Governing framework Foreign-tax-credit process described in the rules
Years beginning before 1 April 2026 Income-tax Act, 1961; previous year and assessment year terminology Report foreign income and relief in the applicable return schedules and furnish Form 67 by the section 139(1) return due date. The old-law Form 67 FAQ says online submission is required and a CA certificate is not mandatory for that form.
Tax Year 2026–27 onward Income-tax Act, 2025; tax-year terminology Rule 76 of the Income-tax Rules, 2026 applies. Furnish Form 44 with the required certificate or statement and evidence, within the rule’s time limit and verification conditions.

Check the live e-filing portal and current rule text before filing. Transitional instructions, revised forms or later amendments can affect a deadline even when the underlying income was earned earlier.

Determine Indian residence for the exact year

Residential status is a year-by-year legal calculation. The 2026 return form distinguishes resident, RNOR and non-resident and sets out stay-based and historical-residence criteria. Do not copy a day-count threshold from another year, another taxpayer category or an internet summary without checking the complete statutory test and its exceptions.

Resident

A resident is generally within the Indian tax net for worldwide income, subject to the detailed charging, source and treaty rules. Foreign salary, business receipts, interest, dividends, rent, capital gains and other income may therefore need to appear in the Indian computation even if tax was withheld overseas.

Resident but not ordinarily resident

RNOR treatment can restrict the extent to which foreign income is brought into the Indian tax base, depending on the statutory conditions and the connection of the foreign business or profession with India. You still need to test each receipt and complete any schedule required for your status; RNOR is not an automatic exemption from every foreign-income or asset disclosure.

Non-resident

A non-resident is generally taxed in India on income received, accruing or arising in India, or deemed to do so under the applicable law. The old-law foreign-asset schedule instructions state that Schedule FA need not be completed by a non-resident or RNOR. Confirm the assessment-year return instructions, because asset disclosure and income reporting are separate questions.

Treaty residence and dual residence

If another country also treats you as resident, apply the residence tie-breaker in the relevant DTAA after determining status under Indian domestic law. The tie-breaker can examine factors such as a permanent home, centre of vital interests, habitual abode and nationality, but the wording differs by treaty. Keep the treaty analysis separate from the domestic day-count calculation.

Classify the income and identify the source country

List each foreign receipt separately before you calculate credit. The category—employment, independent services, business profit, interest, dividend, pension, rent, royalty, capital gain or another item—determines both the Indian head of income and the treaty article that may apply. Record the country where the income arose and the country that actually imposed the levy; they are not always the same.

  • Use the Indian head of income. Foreign income must be included in the normal computation under the appropriate head, not only in a foreign-income schedule.
  • Separate gross income, expenses and foreign tax. Preserve the conversion method and exchange rate used for Indian reporting, and keep the foreign payer’s statement, contract or account record supporting the amount.
  • Check whether the foreign charge is a covered tax. A social contribution, levy, interest, penalty or commercial withholding may not qualify. The treaty definition and Indian rules control.
  • Match tax to income. Credit is generally calculated for the same income, country and period; an unrelated foreign tax cannot be used to erase Indian tax on another receipt.

Choose treaty relief or unilateral relief

There are two principal routes, but neither promises that Indian tax will become zero.

Question DTAA relief Domestic unilateral relief
When used An applicable agreement covers your residence, country and income category. No applicable DTAA covers the case, but the domestic statutory conditions for relief are met.
What controls source-country taxing power The article for the specific income, plus any protocol and residence tie-breaker. Indian domestic law and the relief provision’s conditions.
Foreign tax considered Tax that qualifies under the treaty and is actually paid or deducted, subject to the treaty’s limit. Tax that qualifies under the domestic rule and is supported by evidence.
Typical ceiling Generally the lower of eligible foreign tax and Indian tax attributable to that income, with treaty-specific restrictions. Generally limited by the statutory formula and Indian tax attributable to the relevant income.
Documentation Income and tax proof, country details and the relevant DTAA article. Income and tax proof plus evidence that the unilateral-relief conditions are satisfied.

Read the actual treaty and protocol for your country and income type. If foreign tax exceeds the amount authorized by the treaty, the treaty may require a refund claim in the source country rather than an Indian credit for the excess.

Reporting under the 1961 Act: schedules and Form 67

For an old-law year, the Income Tax Department’s filing guide assigns distinct jobs to three schedules.

Schedule FSI: foreign-source income and relief

Schedule FSI is for resident taxpayers and records income accruing or arising from a foreign source. Enter the country, income category, income amount, foreign tax and relief details requested by the form. The same income must also be reported in the head-wise computation of total income; entering it only in Schedule FSI is incomplete.

Schedule TR: relief summary

Schedule TR summarizes relief by country and identifies the domestic legal basis. When you claim treaty relief, identify the relevant treaty article as requested. Reconcile its totals to Schedule FSI and the credit claimed in the return.

Schedule FA: foreign assets and interests

For resident taxpayers, Schedule FA can cover foreign depository and custodial accounts, equity or debt interests, insurance or annuity contracts, financial interests, immovable property, other capital assets, signing authority, foreign trusts and other foreign-source income. Its disclosure is separate from the tax-credit calculation. Gather year-end and peak-balance information where the form asks for it, and do not omit an asset merely because it produced no income.

Form 67: old-law foreign tax credit statement

The department’s Form 67 manual says a resident claiming credit for foreign tax paid or deducted must furnish Form 67 by the due date for the section 139(1) return. The Form 67 FAQ describes online filing and says a CA certificate is not mandatory for this old-law form. Use the form for the relevant old-law year; do not carry its deadline or certification assumptions into Tax Year 2026–27 onward.

Tax Year 2026–27 onward: Rule 76 and Form 44

Rule 76 allows a resident credit in the tax year in which the corresponding income is offered or assessed to tax in India. If the same foreign income is spread over multiple years, the credit is apportioned in the same proportion. The rule computes credit separately by source and country.

“An assessee, being a resident shall be allowed a credit for the amount of any foreign tax paid by him in a country or specified territory outside India, by way of deduction or otherwise, in the tax year in which the income corresponding to such tax has been offered to tax or assessed to tax in India, in the manner and to the extent as specified in this rule.”

— Income-tax Rules, 2026, Rule 76(1)

How the credit is capped

Rule 76 generally limits credit to the lower of Indian tax on the relevant income and foreign tax paid on that income. Where a treaty limits the source-country tax, foreign tax above the treaty amount is disregarded for the Indian credit calculation. The credit can offset Indian income tax, surcharge and cess attributable under the rule, but not interest, fees or penalties.

What Form 44 must contain

Form 44 requires a certificate or statement specifying the income and foreign tax, supported by a payment acknowledgement or proof of deduction as applicable. An accountant must verify Form 44 for a company. For other taxpayers, accountant verification is required when foreign tax paid in that tax year equals or exceeds ₹100,000. Confirm the portal’s current validation rules before submission.

Deadline

The rule generally requires filing within twelve months from the end of the relevant tax year when the return was filed within the statutory time. A special timing rule applies where the income is included in an updated return. Because the rule can be amended and portal procedures can change, use the deadline displayed for your filing and retain the acknowledgement.

Disputed foreign tax, refunds and later changes

Foreign tax under dispute

Rule 76 excludes disputed foreign tax while the dispute remains unresolved. After final settlement, credit may be available for the original year if you furnish the settlement and payment evidence and the required undertaking concerning a later refund within the specified period.

Foreign-country refund

An Indian credit is not a substitute for a refund claim abroad. If the treaty permits only a lower source-country tax, you may need to seek the excess from that country. Keep the foreign refund application, decision and payment trail separate from the Indian return.

Refunds, carry-backs and revised returns

If foreign tax previously credited is refunded, or the credit changes because of a carry-back or a revised foreign return, follow the applicable intimation and correction requirements. Recalculate the Indian credit for the affected country and income rather than leaving the original figure unchanged.

Build an evidence file before submitting

  • Passport, travel calendar and residence analysis for the relevant year.
  • Foreign payslips, dividend or interest statements, invoices, rental records, brokerage statements and contracts.
  • Foreign tax return, assessment, withholding certificate, payment receipt or bank debit proving tax paid or deducted.
  • Exchange-rate source and calculation showing how each foreign amount was converted to Indian rupees.
  • DTAA text, protocol and the article relied on for the income category, when treaty relief is claimed.
  • Details of country, taxpayer identification number, account or asset information required by Schedule FSI, TR or FA.
  • Form 67 or Form 44 acknowledgement, accountant verification where required, and any correspondence about a dispute or refund.

Retain documents for the period required under Indian tax law and any longer period needed to resolve a foreign audit or treaty claim. Make the country and income mapping obvious to a reviewer: one line of foreign income should lead to one tax-proof document and one credit calculation.

Common filing failures and how to correct them

Using the wrong year’s form

Symptom: You attach Form 67 to a Tax Year 2026–27 claim or use Form 44 for an old-law year. Fix: Reidentify the period, select the corresponding return year and use only the form prescribed for that framework.

Reporting income only in a foreign schedule

Symptom: Schedule FSI contains the receipt, but the head-wise computation omits it. Fix: Include the amount under the correct Indian head and reconcile the schedule and total-income figures before filing.

Claiming all foreign withholding automatically

Symptom: The credit equals the gross amount withheld, even though part is a non-creditable levy, penalty or treaty excess. Fix: Test the levy against the treaty and domestic definition, then cap the claim at the allowable amount.

Ignoring RNOR or treaty residence

Symptom: You apply a resident-worldwide-income assumption without calculating status or a dual-residence tie-breaker. Fix: Prepare the domestic residence test first and document any treaty analysis separately.

Missing foreign assets

Symptom: Foreign income is reported but an account, trust interest, signing authority or property is absent from Schedule FA when the schedule applies. Fix: Inventory assets independently of income and use the assessment-year instructions for each field.

Submitting after the applicable deadline

Symptom: The return is filed, but Form 67 or Form 44 is late or lacks the required verification. Fix: Check whether the law allows a correction, condonation or updated filing for your facts; do not assume a late statement is automatically accepted.

When a professional review is worthwhile

Consider a qualified Indian chartered accountant or cross-border individual-tax adviser when you have more than one foreign country, several income categories, a residency transition, a dual-residence question, a disputed foreign assessment, a treaty interpretation issue, a substantial credit claim or a foreign business, trust or property interest. Ask about credentials, the jurisdictions covered, the specific year and forms included, document-retention expectations and the adviser’s responsibility for portal filing. Professional assistance cannot guarantee acceptance of a credit; the treaty, statute, evidence and deadlines still control.

Frequently asked questions

Do I pay tax twice if tax was already withheld overseas?

You may have an Indian liability because a resident can have to report worldwide income. Double taxation relief normally reduces that liability through an allowed credit, but only to the extent permitted for the same income and country. Excess or non-creditable foreign tax can remain a foreign refund issue.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can foreign tax credit make my Indian tax bill negative?

No. The credit is limited by the applicable Indian-tax and treaty formulas and can offset only the categories of Indian tax specified by the governing rule. It cannot create a refund of Indian interest, fees or penalties merely because foreign tax was higher.

Is a tax treaty required to claim relief?

No. Treaty relief requires an applicable DTAA, but domestic unilateral relief may be available where no agreement applies and the statutory conditions are met. The calculation and documents differ, so identify the legal basis in the relevant schedule or form.

Does an RNOR always avoid Schedule FA?

The old-law department guide says Schedule FA need not be completed by an RNOR or non-resident. Confirm the exact return year’s instructions and still test whether any separate income, reporting or beneficial-interest requirement applies.

What if the foreign authority later refunds the tax?

Notify and correct the Indian credit as required by the applicable rules. Keep the refund decision and payment proof, because a credit based on tax that was ultimately refunded may need to be recomputed.

Frequently Asked Questions

Do I pay tax twice if tax was already withheld overseas?

You may still have to report the income in India, but an allowable foreign tax credit can reduce Indian tax on the same income. The credit is conditional and may be partial.

Can foreign tax credit make my Indian tax bill negative?

No. Credit is capped by the applicable Indian-tax and treaty limits and cannot offset interest, fees or penalties under Rule 76.

Is a tax treaty required to claim relief?

No. Domestic unilateral relief may apply when no DTAA covers the case, provided its statutory conditions are met.

Does an RNOR always avoid Schedule FA?

The old-law filing guide says Schedule FA need not be completed by an RNOR or non-resident, but verify the instructions for the specific return year.

What if the foreign authority later refunds the tax?

Follow the applicable intimation and correction rules and recompute the Indian credit for the refunded amount.
