How to Assess Labor Standards and Working Conditions at Garment Factories

By TheFinanceBase Team 12 min read

Assess a garment factory against the labor laws that apply in its country, then test performance against internationally recognized labor principles. A credible assessment covers child labor, discrimination, forced labor, freedom of association and collective bargaining, occupational safety and health, compensation, contracts and human-resources practices, and working time. It triangulates records, physical observations, and confidential worker and management accounts, with every conclusion tied to an assessment date and scope.

Do not treat a policy, a single announced visit, or a public listing as proof of current conditions. The result should identify verified compliance, verified non-compliance, unresolved allegations, and gaps where evidence was unavailable.

What a garment-factory labor assessment actually measures

A factory assessment is a structured examination of whether a workplace respects applicable national law and core labor rights in practice. It is not simply a safety walk-through or a review of written policies. The assessor checks how recruitment, pay, supervision, production pressure, and worker representation operate on the factory floor and in payroll and personnel records.

Better Work’s Compliance Assessment Tool (CAT) provides a useful organizing framework. It combines five international labor-standard clusters with working-condition areas based on national law. The five clusters are child labor; discrimination; forced labor; freedom of association and collective bargaining; and occupational safety and health. The working-condition areas are compensation; contracts and human resources; and working time. Better Work describes the tool as a set of clusters, compliance points, and questions that can feed a factory improvement plan.

The framework must be translated into questions for the factory’s jurisdiction. A legal breach is assessed against the current law where the factory operates. If national law is absent or unclear on an issue, an international standard or good-practice benchmark can be used, but it must be labeled as a benchmark rather than presented as local law.

Set the legal and factual baseline before visiting

Identify the jurisdiction and workforce covered

Record the country, subnational area, factory legal entity, production sites, dormitories, warehouses, and labor brokers included in scope. Confirm whether the review covers direct employees only or also agency workers, migrants, apprentices, temporary staff, security guards, cleaners, and home-based or subcontracted production. A conclusion about one site or employment category cannot automatically be extended to another.

Compile the rules that apply

Obtain the current versions of laws and regulations governing minimum wages, wage payment and deductions, social insurance, benefits, contracts, probation, termination, minimum working age, maximum hours, overtime, rest days, leave, union rights, discrimination, forced labor, building safety, fire protection, machinery, chemicals, and occupational injury reporting. Note effective dates, sector-specific rules, exemptions, and rules for foreign or migrant workers.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

No single authoritative source establishes any country’s current wage, hour, age, benefit, or safety thresholds. Those figures must be verified with the relevant labor ministry, official gazette, or another authoritative source for the factory’s location before the assessment starts.

Define the assessment period

Choose a records period long enough to reveal ordinary and peak-season conditions. State the exact payroll months, timekeeping months, incident period, and recruitment cohort reviewed. A factory may appear compliant during a quiet month while excessive overtime occurs before shipment deadlines, so ask management which periods are atypical and test those periods deliberately.

Use the eight-domain assessment framework

Domain Questions to answer Evidence to collect
Child labor Are all workers above the legal minimum age? Are age-verification and remediation procedures effective? Personnel files, identity and age documents, recruitment logs, apprentice records, age-interview results
Discrimination Do hiring, pay, promotion, discipline, pregnancy protections, and termination operate without prohibited discrimination? Job adverts, wage and promotion data, disciplinary records, grievance cases, worker interviews
Forced labor Are recruitment fees, debt, document retention, movement restrictions, threats, or coercive conditions present? Broker contracts, fee receipts, loan records, identity-document procedures, resignation and exit records, confidential interviews
Freedom of association and collective bargaining Can workers form or join organizations and bargain without retaliation or interference? Union or committee records, collective agreements, election materials, disciplinary cases, worker and representative interviews
Occupational safety and health Are buildings, fire systems, machinery, chemicals, ergonomics, emergency care, and safety training controlled? Inspection certificates, risk assessments, maintenance logs, drills, injury registers, walkthrough observations, worker testimony
Compensation Are legally required wages, overtime premiums, benefits, and deductions paid accurately and on time? Payroll, payslips, bank or cash-payment evidence, time records, deduction authorizations, benefits filings
Contracts and human resources Do workers receive understandable contracts, fair discipline, lawful termination, and access to records and complaints? Contracts, handbooks, disciplinary and termination files, grievance logs, personnel-file samples, HR interviews
Working time Do normal hours, overtime, breaks, rest days, and leave comply with local rules and actual production practices? Clock-in data, manual edits, production schedules, overtime approvals, leave records, worker interviews

Triangulate evidence instead of relying on one source

For each compliance question, preserve the document, observation, and account that support the finding. Compare sources for consistency and record contradictions rather than silently choosing the most convenient version.

Document review

Request complete records for the defined period, including raw timekeeping data and payroll registers rather than only management summaries. Sample personnel files across departments, genders, contract types, nationalities, ages, and tenure. Check whether documents are created contemporaneously, altered after the fact, translated accurately, and retained as required by law.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Physical observation

Walk every production area, storage room, chemical point, canteen, clinic, toilet, exit route, and worker accommodation included in scope. Observe conditions during normal production, shift changes, meal breaks, and—when relevant—night work. Photograph or map hazards only in a way that protects worker privacy and does not expose sensitive personal data.

Worker and management accounts

Interview managers responsible for HR, payroll, production, safety, recruitment, and worker representation. Interview workers privately, without supervisors, interpreters chosen by management, or retaliation risks. Ask open questions about recruitment, deductions, hours, rest, injuries, discipline, complaints, and freedom to leave. Treat an allegation as an allegation until corroborated; treat a missing record as an evidence gap, not automatic proof of a violation.

Protect confidentiality

Explain the purpose, voluntary nature, and confidentiality limits before interviews. Do not provide management with names or identifiable details unless a worker expressly authorizes disclosure and the law requires it. Plan a safe referral route for urgent risks such as a child worker, imminent fire danger, violence, or confiscated identity documents.

Step-by-step assessment procedure

  1. Set scope and criteria. Name the sites, worker groups, assessment period, legal sources, international benchmarks, sampling plan, and evidence rating method.
  2. Prepare the visit. Request records in advance, check prior complaints or incidents, arrange an independent interpreter where needed, and schedule unannounced or short-notice access when legally and practically possible.
  3. Hold an opening meeting. Explain the domains, worker-interview protections, documents required, emergency escalation process, and prohibition on coaching or retaliating against participants.
  4. Test records. Reconcile headcount lists, payroll, timekeeping, contracts, age records, recruitment files, benefits, injury logs, and disciplinary cases. Follow samples from hiring through payment and, where applicable, termination.
  5. Walk the workplace. Check exits, alarms, extinguishers, electrical systems, machine guards, ventilation, lighting, chemical labels and storage, personal protective equipment, lifting and repetitive-work controls, first aid, sanitation, drinking water, and accommodation conditions in scope.
  6. Interview workers privately. Sample across shifts, lines, contract types, genders, nationalities, and tenure. Compare what workers say with records and observations.
  7. Conduct a closing meeting. Separate confirmed findings, credible allegations requiring follow-up, and evidence limitations. Do not negotiate away a finding because production is busy or a manager disagrees.
  8. Write and validate the report. For every finding, state the requirement, evidence, affected population, date, severity, root cause, and corrective action. Give management a chance to correct factual errors, but not to remove evidence-based conclusions.
  9. Track remediation. Assign an owner and deadline, define proof of completion, and verify effectiveness with records, observation, and worker feedback rather than accepting a new policy alone.

How to test each labor-rights domain

Child labor and young workers

Compare identity or age documents with recruitment records and production rosters. Look for altered dates of birth, missing documents, school-age apprentices, and workers moved between lines or subcontractors. Check whether young workers receive legally required protections, such as restrictions on hazardous tasks or night work, where those rules apply. If a child is found, protect the child from further harm and follow a remediation process that does not simply dismiss the worker into greater vulnerability.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Discrimination

Analyze hiring, starting pay, overtime allocation, promotion, training, discipline, pregnancy or parental treatment, accommodation for disability, and termination by relevant worker characteristics, while respecting privacy law. Ask whether workers can refuse sexual harassment, religious pressure, or discriminatory instructions without losing work. A neutral policy is insufficient if payroll or worker accounts show unequal outcomes.

Forced labor

Examine recruitment fees, deposits, debt, wage advances, threats, confinement, document retention, restrictions on movement, and the ability to resign. Interview workers recruited through brokers in their own language where possible. Check whether deductions are transparent, lawful, and authorized, and whether workers can leave after required notice without coercive penalties.

Freedom of association and collective bargaining

Verify that workers can form or join organizations of their choice, elect representatives, meet, communicate, and bargain as permitted by local law. Review whether organizers or committee members suffered unusual discipline, dismissal, transfers, or reduced overtime. A management-created committee may provide communication but does not automatically demonstrate independent worker representation.

Assess wages, contracts, and working time together

Payroll and timekeeping must be reconciled. Select workers and calculate gross pay, regular hours, overtime, premiums, deductions, benefits, and net pay from source records. Compare the result with the legal minimum and contractual terms in force for the relevant pay period. Verify that workers receive understandable pay information and can challenge errors without retaliation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compensation checks

  • Confirm payment dates, method, currency, payslip information, and proof of receipt.
  • Test deductions for legality, written authorization, accurate calculation, and a clear business or statutory basis.
  • Check recruitment-fee repayment and wage advances for coercive or indefinite debt.
  • Reconcile statutory insurance, pension, leave, and other mandatory benefits with filings and worker accounts.
  • Look for off-the-clock work, unpaid training, production-based penalties, and cash payments that do not appear in payroll.

Contracts and HR controls

Workers should receive contracts in a language they understand, stating employer identity, job, pay, hours, probation, benefits, leave, termination terms, and grievance channels as required locally. Compare the written contract with actual practice and with the contract registered with authorities where registration is required. Review disciplinary rules for due process, proportionality, appeal, and bans on abusive fines or physical punishment.

Working time

Reconstruct hours from electronic clocks, manual registers, line schedules, gate logs, production targets, and worker testimony. Check regular hours, overtime authorization, break duration, weekly rest, public holidays, annual leave, and night-work rules against the applicable law. Investigate edited time records, identical entries for many workers, work brought home, and pressure to clock out before finishing. Record peak-season patterns separately from ordinary weeks.

Occupational safety and health: verify controls in practice

Start with imminent hazards: blocked exits, locked doors, disabled alarms, unstable structures, exposed electrical parts, unguarded machinery, uncontrolled chemicals, or conditions that could cause serious injury. Escalate urgent danger immediately under the agreed protocol rather than waiting for the final report.

Rate findings with date, scope, and confidence

Use a finding format that prevents overstatement:

  • Requirement: the exact national-law provision or clearly labeled international benchmark.
  • Condition: what was observed or documented, including dates and affected locations or workers.
  • Evidence: records, observations, interviews, and any contradictory information.
  • Status: verified non-compliance, verified compliance, credible allegation pending verification, or insufficient evidence.
  • Risk and cause: actual or potential harm and the process failure behind it.
  • Action and verification: remedy, responsible owner, deadline, and proof required.

Do not convert missing evidence into a pass. State whether access was denied, records were incomplete, interviews were too few, or a legal interpretation remains uncertain. Include the assessment date prominently; conditions can change after the visit.

How to interpret public factory information

Better Work’s Transparency Portal publishes assessment information for participating factories in selected country programs. Its own description says assessments reflect compliance at the time of assessment and that portal coverage and displayed data are limited. Before relying on a listing, confirm the factory identity, country, assessment date, issues covered, and data limitations. A listing is a dated evidence point, not a warranty of present conditions; absence from the portal proves neither compliance nor non-compliance.

The 2025 Better Factories Cambodia report states that its compliance summary is based primarily on assessments conducted in Cambodia during 2024 and records 381 garment-factory assessments. That number describes the Cambodia program dataset, not the global garment industry and not every factory operating in Cambodia.

Use Plan–Do–Check–Adjust for improvement

The International Labour Organization’s 2024 “Good work!” due-diligence tool illustrates a Plan–Do–Check–Adjust process for garment workshops in Argentina. Its examples include checking that workers receive legally required wages and benefits, receive pay information, and have verifiable timekeeping. The legal references and workshop scope are Argentina-specific, so use the process structure while verifying requirements in the factory’s own jurisdiction.

Plan

Map risks, legal duties, responsible managers, worker representatives, resources, and deadlines. Prioritize imminent safety risks, child or forced-labor indicators, retaliation, and unpaid or unlawfully deducted wages.

Do

Implement controls such as age verification, fee-free recruitment, accurate clocks, payroll reconciliation, safety maintenance, accessible grievance channels, and worker training.

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check

Re-test records, inspect conditions, and ask workers whether the change is real. Check both completion and effectiveness; a posted procedure is not proof that workers can use it.

Adjust

Correct the root cause, revise targets, provide remedy to affected workers, and escalate repeated failures to senior management or the relevant authority.

Frequent assessment mistakes and their fixes

  • Policy-only audits: Match every policy to payroll, time records, observations, and worker experience.
  • Announced, one-day snapshots: Include peak periods, night shifts, surprise checks where lawful, and follow-up verification.
  • Management-only interviews: Interview workers privately and protect identities.
  • Global checklist applied unchanged: Translate each question into the local legal baseline and label international benchmarks.
  • Ignoring subcontractors and brokers: Trace recruitment and production beyond the factory’s front gate.
  • Scoring without context: Publish date, scope, sample, method, and evidence limitations beside any score.
  • Immediate dismissal as a remedy: For child labor, debt, or recruitment abuse, use a lawful, protective remediation plan that addresses lost income and vulnerability.
  • Closing findings without worker feedback: Revisit affected workers and records to confirm that corrective action changed conditions.

What a useful final report contains

A reader, buyer, worker representative, or board should be able to reproduce the assessment logic from the report. Include:

  • Factory identity, locations, ownership or operating entity, and in-scope worker groups.
  • Assessment dates, records period, assessors, languages, sampling, and access restrictions.
  • Applicable national laws and separately identified international benchmarks.
  • Domain-by-domain findings with evidence, affected population, severity, and confidence.
  • Immediate actions taken for serious or imminent risks.
  • Remediation plans with owners, deadlines, worker remedy, and verification evidence.
  • Unresolved allegations, missing records, and issues outside the assessment scope.
  • A follow-up date and the conditions that would trigger an earlier review.

The central test is simple: does the factory’s documented system match what workers experience, what the workplace shows, and what the law requires? A defensible assessment answers that question with dated, localized, triangulated evidence rather than a reputation, logo, certificate, or isolated score.
