How to apply for mortgage relief after a first responder dies in the line of duty

There is no single federal mortgage-relief application for every family after a police officer, firefighter, emergency medical worker, or other first responder dies in the line of duty. Start by notifying the mortgage servicer, identifying who has—or is establishing—a legal interest in the home, and requesting the servicer’s written successor-in-interest requirements. After confirmation, ask for the loss-mitigation application and for any payment relief available on that specific loan. The mortgage lien and payment obligation do not disappear when a borrower dies.

VA home-loan benefits and Dependency and Indemnity Compensation (DIC) are separate programs for qualifying Veterans or service members; they are not general mortgage-relief programs for every public-safety worker. The process below is general U.S. guidance. Title, estate, debt-liability, foreclosure, and survivor-benefit rules can depend on state law and the loan documents.

What to do first about the mortgage

  1. Call the mortgage servicer promptly. Use the telephone number on the latest mortgage statement or the servicer’s official website. Explain that the borrower died and ask for the department that handles deceased borrowers or successors in interest. Ask where payments should be sent while the estate or title is being handled, how to obtain account information, and what the servicer needs to discuss the loan with you. The Federal Housing Finance Agency (FHFA) recommends that homeowners facing hardship contact their servicer about possible payment relief, but FHFA does not provide individual assistance itself: FHFA mortgage assistance guidance.
  2. Do not assume that the call pauses payments. Merely reporting a death does not automatically stop interest, late charges, collection activity, or foreclosure. Ask the servicer in writing how payments should be made and whether any temporary arrangement is available while successor documents are reviewed.
  3. Tell the servicer about urgent dates. If there is a foreclosure notice, a sale date, a pending insurance cancellation, or a tax delinquency, provide the date during the first call and every written submission. Timing can affect the loss-mitigation procedures that apply.

Keep the account number, the name or identification number of every representative, the date and time of each contact, and copies of statements and correspondence.

Establish who can speak for the home

A mortgage servicer generally cannot disclose a borrower’s account or process a workout request from an unknown third party. The person seeking help must show a legal connection to the property or estate. That person might be a surviving joint borrower, an heir who has inherited title, a personal representative, or another person recognized under state law.

Ask for the successor-in-interest checklist in writing

Request a written description of the documents the servicer reasonably requires, the address or portal for delivery, whether copies are acceptable, and when certified records are required. Under the Consumer Financial Protection Bureau’s (CFPB) servicing rules, a covered servicer must facilitate communication with a potential successor, describe reasonable documentation, provide a submission method, make a prompt determination, and tell the person whether more information is needed. See 12 CFR § 1024.38.

Possible evidence can include a death certificate and proof of the survivor’s ownership route, such as an executed will, a recorded deed, trust documents, or a court or executor letter. This is not a universal checklist: the acceptable proof depends on the title, the estate, the loan, and state law. Ask before sending originals.

Submit a complete package and track delivery

Send documents exactly as instructed. Use a method that supplies delivery confirmation, save the uploaded files or a PDF of the submission, and keep a list of what was sent and when. If the servicer says a document is missing, ask for the request in writing and send only the additional item requested. A complete, traceable file makes it easier to correct delays.

What successor-in-interest status changes

Successor status and personal liability are different questions. CFPB rules can treat a confirmed successor as a borrower for specified mortgage-servicing protections even when that person has not assumed the deceased borrower’s debt under state law. The scope and definitions appear in 12 CFR § 1024.30.

Once confirmed, ask the servicer to provide account information, payment history, escrow details, and the loss-mitigation application for which the successor may be considered. A person who inherited the property generally does not need a new ability-to-repay determination merely to take over the existing mortgage, according to the CFPB’s inheritance guidance: Inherited home and ability-to-repay guidance. That does not release the deceased borrower, guarantee a modification, or approve a new loan.

Apply for payment relief on the existing loan

After the servicer confirms the successor—or while it explains how an authorized estate representative can apply—ask for the applicable loss-mitigation package. State the reason for hardship, the date income changed, the amount you can afford, and whether the home is your principal residence. Ask which investor or loan-program rules control the review.

Potential options

Option What it may do Important limit
Forbearance Temporarily reduces or suspends scheduled payments. Missed amounts usually remain due under the approved arrangement; obtain the repayment terms in writing.
Repayment plan Adds a portion of the past-due amount to regular payments for a period. The higher payment must be affordable and is subject to the servicer’s and investor’s rules.
Loan modification Changes one or more loan terms to address a continuing hardship. Approval, interest rate, payment, term, and arrears treatment are case-specific; no modification is guaranteed.
Short sale Allows a sale for less than the mortgage balance when approved. Requires servicer or investor approval and can have tax, deficiency, and moving consequences.
Deed-in-lieu of foreclosure Transfers the property to the lender instead of completing foreclosure. Eligibility, title, junior liens, relocation terms, and any deficiency release must be confirmed in writing.

These are examples, not an entitlement. The loan type, investor, delinquency status, principal-residence status, application timing, and property facts determine what the servicer must review or can offer. The federal procedures are described in 12 CFR § 1024.41; they do not require a particular workout.

What to include with a loss-mitigation request

  • A clear explanation of the death and resulting income or expense change.
  • Proof of income for the person who will make payments, if requested.
  • Recent bank or asset information when the application requires it.
  • The death certificate and successor documentation already accepted by the servicer.
  • A realistic monthly budget showing housing, insurance, taxes, utilities, debts, and available income.
  • Any foreclosure notice, sale date, or prior loss-mitigation decision.

Ask the servicer to identify missing items and the deadline for supplying them. Keep proof of delivery and every decision letter. Do not stop making payments unless the servicer gives written instructions or an approved plan changes the amount due.

Use the right route for the survivor’s situation

Route Who may qualify Decision-maker Purpose Typical evidence and timing
Successor-in-interest servicing A person with a legally recognized interest in the mortgaged property or estate. Mortgage servicer, subject to applicable federal, investor, and state rules. Obtain account information and seek servicing or loss-mitigation treatment on the existing loan. Death certificate plus proof of title, inheritance, trust, or estate authority; request promptly.
VA-backed new loan or other VA housing benefit Qualifying surviving spouses of Veterans or service members under VA rules. VA issues eligibility evidence; a private lender underwrites the loan. Potentially obtain a new VA-backed mortgage or use other qualifying housing assistance. Service and survivor records, VA eligibility evidence, and a separate lender application.
VA Dependency and Indemnity Compensation Eligible surviving spouses, dependents, or parents when the death and service connection meet VA requirements. Department of Veterans Affairs. Separate survivor compensation, not a mortgage-servicing workout. Service, relationship, and death evidence; eligibility and forms depend on the circumstances.
Public-safety survivor benefits Eligible survivors of covered law-enforcement officers, firefighters, and other public-safety personnel. The relevant benefit agency or program. Compensation or other survivor assistance that may help household finances. Program-specific proof and deadlines; does not by itself change the mortgage contract.

Do not treat these routes as interchangeable. A mortgage servicer decides what can happen to the existing loan; VA decides military-benefit eligibility; another agency decides survivor compensation.

When VA benefits may apply

If the deceased was a Veteran or service member, a surviving spouse may qualify for a VA home-loan Certificate of Eligibility (COE) under specified service-related circumstances and other listed conditions. Review the current VA home-loan guidance for surviving spouses and the broader VA home-loan eligibility rules.

A COE confirms VA eligibility; it is not loan approval. The lender still evaluates credit, income, debts, occupancy, and the property. If the surviving spouse is already receiving DIC, or if the survivor’s circumstances differ, VA may direct the applicant to a different application route or supporting evidence. The VA’s DIC information explains the separate compensation program.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A first responder who was not a qualifying Veteran or service member should not be told that VA home-loan eligibility applies merely because the death occurred in the line of duty. VA programs do not replace the successor and loss-mitigation process for a civilian police officer, firefighter, EMT, or other public-safety worker.

What public-safety survivor programs do—and do not—establish

The Department of Justice’s Public Safety Officers’ Benefits (PSOB) materials describe survivor benefits for eligible public-safety officers: PSOB program funding document. Those benefits are separate from the mortgage account. The material does not establish a universal mortgage payoff or a dedicated mortgage-relief entitlement. Verify current PSOB eligibility, forms, and deadlines directly with the program and do not delay the servicer call while waiting for a benefits decision.

If foreclosure is threatened or the servicer will not cooperate

Escalate in writing

Send a dated letter or secure-message request stating that the borrower died, identifying your legal relationship to the property, listing documents already supplied, and asking for the successor determination and any loss-mitigation package. Include a foreclosure sale date in the first line if one exists. Keep the tracking number and proof of receipt.

Get housing-counseling help

A HUD-approved housing counselor can explain foreclosure-prevention choices and help organize an application. The CFPB inheritance guidance identifies the national housing-counselor line as 888-995-HOPE. Counseling does not replace legal advice or guarantee a workout.

File a complaint when servicing failures persist

If the servicer refuses to explain its successor process, repeatedly loses documents, withholds account information, delays a determination, or pressures you to refinance before addressing the existing loan, consider a complaint to the CFPB. The CFPB’s December 17, 2024 report on homeowners facing servicing problems after divorce or a death describes these reported difficulties and the complaint channel: CFPB servicing-problems report.

A complaint does not automatically stop foreclosure. If a sale is scheduled, consult a qualified foreclosure or probate attorney immediately because state deadlines can be short.

Title, estate, and liability questions to resolve separately

  • Who owns the property? A deed, survivorship clause, trust, probate order, or state inheritance law can determine who may become the successor.
  • Who owes the debt? A co-borrower may remain personally liable. An heir may receive the property subject to the lien without becoming personally liable under state law. Confirm the distinction with a lawyer in the property’s state.
  • Are taxes and insurance current? The mortgage payment may include escrow, but the estate or successor must verify property taxes, hazard insurance, association dues, and utilities separately.
  • Is the home the principal residence? Occupancy and property status can affect available loss-mitigation rules and investor requirements.
  • Is a new loan being considered? A refinance or new purchase loan is a separate credit transaction. The inherited-home servicing protections do not guarantee approval or release the deceased borrower from the old loan.

CFPB Director Richard Cordray said in the Bureau’s July 8, 2014 announcement, “Losing a loved one should not mean also losing your home.” The announcement explains the rule clarification for surviving family members: CFPB clarification on mortgage rules for surviving family members.

A practical record-keeping checklist

  • Death certificate copies and the date each was sent.
  • Deed, trust, will, probate, executor, or court documents showing the ownership route.
  • Mortgage statements, loan number, escrow balance, and payment history.
  • Names, departments, dates, and reference numbers for servicer contacts.
  • Delivery receipts, uploaded-file confirmations, and complete copies of every application.
  • Foreclosure notices, sale dates, insurance or tax notices, and all decision letters.
  • A household budget and evidence supporting the proposed payment.

Use one secure folder—digital and paper—and never mail irreplaceable originals unless the servicer or court specifically requires them and you have confirmed the destination.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to ask on the first servicer call

  1. Which department handles a deceased borrower and successor in interest?
  2. What documents do you reasonably require to confirm my status?
  3. Where should I send them, and do you require certified copies?
  4. How should payments be made while you review the documents?
  5. Is there a foreclosure, default, escrow, insurance, or tax issue on the account?
  6. After confirmation, which loss-mitigation options and application forms are available?
  7. What is the deadline for each document or application, and how will you confirm receipt?

Write down the answers and request written confirmation. The goal is to establish a documented successor pathway and protect the home while the servicer evaluates the loan—not to assume that a line-of-duty death automatically cancels the mortgage.
