Start with the denial notice, identify whether the coverage is Medicare Part D or another type of health plan, and follow that plan’s appeal route before its deadline. For Medicare Part D, the first appeal is a plan redetermination, usually due within 65 calendar days of the denial notice. For other plans, use the insurer’s internal appeal and ask whether an independent external review is available.
Ask the prescribing clinician to address the stated denial reason with medical records and a supporting statement. If waiting could seriously jeopardize your health, request an expedited review and explain the risk. Keep the notice, your submission, proof of delivery, and every decision letter.

First, identify the plan and the decision you are challenging
The correct appeal path depends on both your coverage and what the insurer decided. Read the denial letter and plan materials before choosing a form or mailing address. Look for the exact reason, the deadline, the submission method (portal, fax, mail, or phone), and instructions for urgent requests.
| Question | Why it matters |
|---|---|
| Is the coverage Medicare Part D? | Part D has a defined coverage-determination and five-level appeal process. |
| Is this a benefit decision or a payment claim? | Benefit and payment requests can have different decision deadlines. |
| Is the request an exception? | Exceptions require prescriber support explaining medical necessity. |
| Could delay seriously jeopardize health? | You may qualify for expedited review rather than the standard timetable. |
| Will someone act for the enrollee? | Part D generally requires an appointment-of-representative form or written equivalent. |
Coverage appeal versus grievance
A coverage appeal argues that the plan should cover or pay for the drug. A grievance is a complaint about plan operations or behavior, such as customer service, notices, or refusal to process an expedited request. A grievance does not replace the coverage appeal. If the plan denied the drug, submit the coverage appeal even if you also file a grievance.

Do these steps immediately after a denial
- Read every page of the denial notice. Record the date on the notice, the stated denial reason, the drug and strength, the plan’s appeal address or portal, and the filing deadline. The date printed on the notice can control the Part D deadline.
- Check the plan documents. Confirm whether the decision concerns prior authorization, step therapy, a quantity or dose limit, formulary status, cost sharing, or payment for a prescription already obtained. Follow the plan’s current instructions if they differ from a generic explanation.
- Contact the prescriber’s office. Ask the prescriber to respond directly to the denial reason and provide relevant records. A general statement that the drug is “needed” is less useful than a documented explanation of prior treatment, response, contraindications, adverse effects, and the clinical risk of delay when those facts apply.
- Choose standard or expedited handling. State in the request why waiting for the standard decision could seriously jeopardize health. Ask the plan to treat the request as expedited and follow any urgent-submission instructions.
- Prepare the packet. Include the denial notice, identifying information, the drug and the relief requested, the prescriber’s supporting statement, relevant records, and representative paperwork if another person is filing.
- Submit exactly as instructed. Use the plan’s portal, fax, mail, or telephone route. Save a complete copy and proof showing when and how the plan received it.
- Calendar the next deadline. If the plan upholds the denial, the decision letter should explain the next review level and its deadline. Do not wait for a reminder from the insurer.
Medicare Part D: the complete appeal path
Medicare Part D calls an initial decision a coverage determination. It can involve whether the plan will provide or pay for a drug, an exception, cost sharing, a quantity or dose restriction, step therapy, or prior authorization. The enrollee, prescriber, or representative may request a standard or expedited determination.
1. Request a redetermination from the plan
The first Part D appeal is a redetermination by the plan. Medicare.gov instructs enrollees generally to request it within 65 calendar days from the date on the initial denial notice. If you are late, explain the reason for the delay and ask the plan to accept the filing.
Include your name and identifying information, the drug and the reason you are appealing, and any representative documentation. Add the prescriber’s supporting statement and other information that answers the denial reason. CMS provides a Model Request for Reconsideration of Medicare Prescription Drug Denial, but CMS also permits requests in other written formats where its instructions allow.
Part D decision deadlines
| Part D request or appeal | General decision time | Important condition |
|---|---|---|
| Initial benefit determination, expedited and not an exception | 72 hours | Use when waiting could seriously jeopardize health. |
| Initial benefit determination, standard and not an exception | 7 days | Applies to a benefit request. |
| Initial exception determination, expedited | 24 hours | The clock starts after the prescriber’s supporting statement is received. |
| Initial exception determination, standard | 72 hours | The clock starts after the prescriber’s supporting statement is received. |
| Payment request | 14 calendar days | Payment requests have a different timetable from benefit requests. |
| Redetermination, standard benefit appeal | 7 days | This is the plan’s first-level appeal decision. |
| Redetermination, payment appeal | 14 days | Payment appeals use the payment timetable. |
| Redetermination, expedited | 72 hours | Explain the health risk from waiting. |
These are general Part D timeframes described by Medicare.gov and CMS. Your notice controls the practical submission instructions. Do not confuse the 24-hour or 72-hour initial exception-determination clocks with the 65-day deadline for requesting a redetermination.
2. Ask for an exception when the ordinary coverage rules do not fit
CMS describes an exception as a type of coverage determination. An exception is appropriate when the plan’s normal formulary or utilization rules prevent access to a medically necessary drug.

- Formulary exception: You are asking the plan to cover a non-formulary drug or waive a utilization-management rule.
- Tiering exception: You are asking the plan to cover a non-preferred drug at the cost-sharing level for a preferred drug.
The prescriber’s supporting statement is required for a Part D exception. It must explain medical necessity. For a formulary exception, the statement should address why covered alternatives would be less effective, cause adverse effects, or why a dose restriction is unsuitable, as applicable to the case. CMS permits the statement orally or in writing and provides a model form.
For an exception benefit request, the plan’s decision clock begins when it receives the prescriber’s supporting statement: 24 hours for expedited handling or 72 hours for standard handling. If the plan denies the exception, use the redetermination process described in the denial letter.

If the plan upholds the redetermination denial, the next Part D level is reconsideration by the Part D Independent Review Entity (IRE). Medicare.gov generally gives you 60 days from the redetermination decision to request this review. The plan’s decision letter should explain how to file and where to send the request.
Medicare Part D has five successive levels of appeal. The first is the plan redetermination; the second is IRE reconsideration. If the IRE decision is unfavorable, read that decision for the instructions, threshold requirements, and deadline for the next level rather than assuming that the first deadline continues to apply.
How other health plans handle a prescription denial
Employer plans, individual-market plans, Medicaid arrangements, and other coverage generally use an internal appeal process rather than the Medicare Part D terminology. Start with the denial notice and the plan document because the deadline and eligibility rules can depend on the plan, state, and whether the drug was already obtained.

Internal appeal
HealthCare.gov describes a right to appeal a denied claim or canceled coverage internally. Its general guidance gives a 30-day internal-appeal limit for a service not yet received and 60 days for a service already received. Those figures are general federal guidance, not a substitute for the deadline in your notice or plan documents.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteIn the internal appeal, identify the drug, the decision being challenged, the outcome you want, and the facts that answer the denial reason. Ask the prescriber to send clinical support through the route the plan specifies. Keep the claim, denial information, records, and proof of submission.
External review
In eligible cases, you may request an independent external review after or alongside the internal appeal. HealthCare.gov explains that external review means the insurer no longer has the final say on whether to pay a claim. Eligibility, sequencing, and deadlines vary by plan and jurisdiction.
For an urgent situation, HealthCare.gov says you may request external review before completing internal appeals and may file both at once. Its guidance says an urgent final decision must arrive as quickly as the medical condition requires and at least within four business days; if the decision is given verbally, a written notice must follow within 48 hours. Ask the plan or the applicable state or federal reviewer which urgent route applies to your coverage.
What to give the prescriber
The strongest clinical submission tracks the insurer’s exact reason for denial. Give the office a copy of the notice and ask it to address the applicable points rather than sending an unrelated chart extract.

For a Part D exception, the prescriber’s statement is a required part of the request. Send it promptly because the exception decision clock does not begin until the plan receives that supporting statement.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to write and submit the appeal
Use the plan’s form when one is provided, but follow the instructions about other written formats. A concise appeal can be organized like this:
Subject: Appeal of prescription-drug denial — [drug and strength]
- Identify the enrollee: name, member or Medicare information, date of birth if requested, and contact details.
- Identify the decision: date on the denial notice, claim or authorization number, and the denial reason quoted accurately.
- State the request: ask the plan to cover or pay for the specified drug, or grant the requested formulary or tiering exception.
- Explain the medical basis: summarize the prescriber’s rationale and point to attached records.
- Request urgency when justified: explain the health risk from waiting and ask for expedited handling.
- List attachments: denial notice, prescriber statement, records, and representative documentation.
- Sign and date: use the enrollee’s signature or the authorized representative’s signature as the plan requires.
Do not mail the only copy of a medical record. Save the final appeal, attachments, fax confirmation, portal receipt, certified-mail record, or other evidence of delivery. Note the name of anyone you spoke with and the date, time, and substance of the conversation.
If the deadline has passed
For Medicare Part D, submit the redetermination anyway if you have a reason for the late filing and explain that reason in the request. The general window is 65 calendar days from the date on the initial denial notice, but the plan decides whether the explanation supports accepting the late filing.

Appeal and grievance: use both when necessary
Use the coverage appeal to challenge the drug decision. File a grievance separately when the problem concerns plan conduct, such as a service failure, an incorrect notice, or refusal to process a request as expedited.
CMS states that a Part D grievance about refusal to expedite can receive a response within 24 hours when the enrollee has not yet received or purchased the drug. That grievance response does not decide whether the drug is covered, so continue with the redetermination or other coverage appeal.
Common mistakes that delay a decision
- Using the wrong route: A grievance, customer-service ticket, or prescriber phone call is not necessarily a coverage appeal. Use the appeal address, portal, fax, or form in the denial notice.
- Missing the plan’s date: Calculate from the date specified in the notice, not from the day you happen to open the envelope.
- Leaving out the denial reason: Quote or accurately summarize the reason and answer it with evidence.
- Calling an exception request an ordinary appeal: A Part D exception needs the prescriber’s medical-necessity statement and has its own initial decision clock.
- Failing to request urgency: If delay could seriously jeopardize health, say so clearly and request expedited handling.
- Sending no proof: Without a receipt or transmission record, it is harder to show that the appeal was timely.
- Assuming one deadline applies forever: Part D uses separate deadlines for the redetermination and IRE reconsideration; later decision letters provide the next instructions.
- Using a representative without paperwork: Include the appointment-of-representative form or written equivalent when someone else acts for the enrollee.

Use this decision framework before you file
| If your situation is… | Start with… | Key evidence or deadline |
|---|---|---|
| Medicare Part D plan denied coverage or payment | Part D coverage determination or redetermination instructions | Redetermination generally within 65 calendar days of the initial denial notice. |
| Part D non-formulary or utilization rule is medically unsuitable | Exception request with prescriber support | Exception decision clock begins after the supporting statement is received. |
| Part D plan upheld the redetermination | IRE reconsideration | Generally request within 60 days of the redetermination decision. |
| Employer or individual health plan denied a drug claim | Plan internal appeal | Use the notice and plan documents; HealthCare.gov gives general 30-day and 60-day examples. |
| Urgent risk from waiting | Expedited internal review and, where eligible, urgent external review | Explain the medical risk and ask whether both reviews can be filed at once. |
| Complaint about handling rather than coverage | Grievance, alongside any needed coverage appeal | A grievance does not replace the appeal of the drug decision. |
Check current instructions before sending
CMS’s Part C and Part D appeals guidance was updated effective July 6, 2026. Because plan instructions and urgent-review standards can change, compare the current CMS or Medicare.gov guidance with the denial letter and your plan materials on the day you file. The notice’s stated route and deadline should control how you submit the request.
