How to Appeal an Income-Tax Addition for Unexplained Cash Deposits in India

By TheFinanceBase Team 13 min read

If an Indian income-tax assessment treats cash deposited in a bank account as unexplained money, the first appeal normally goes to the JCIT(A) or CIT(A). For an assessment or penalty order, the Income Tax Department says the appeal is generally due within 30 days from service of the notice of demand. File Form 35 through the e-filing portal, explain every deposit chronologically, attach records linking each amount to its actual source, and make a separate application to the Assessing Officer if you need relief from demand recovery.

A bank deposit is not automatically taxable under section 69A. The order must be tested against the statutory questions: whether you owned the money, whether it was recorded in books maintained for a source of income, and whether your explanation of its nature and source was absent or considered unsatisfactory. Your appeal should answer those questions with deposit-level evidence rather than a general assertion that the cash was explained.

What an unexplained-cash addition under section 69A means

Section 69A of the Income-tax Act, 1961 addresses money, bullion, jewellery and other valuable articles that are found to be owned by an assessee but are not recorded in the books of account, if any, maintained for a source of income. It permits the amount to be deemed income for that financial year when the assessee gives no explanation of the nature and source of acquisition, or the Assessing Officer considers the explanation unsatisfactory.

Where in any financial year the assessee is found to be the owner of any money, bullion, jewellery or other valuable article and such money, bullion, jewellery or other valuable article is not recorded in the books of account, if any, maintained by him for any source of income, and the assessee offers no explanation about the nature and source of acquisition of the money, bullion, jewellery or other valuable article, or the explanation offered by him is not, in the opinion of the Assessing Officer, satisfactory, the money and the value of the bullion, jewellery or other valuable article may be deemed to be the income of the assessee for such financial year.

For a cash-deposit case, the legal issue is therefore not simply whether money entered a bank account. Read the assessment order to see which part of the test the officer relied on. The order may dispute that you owned the cash, say it was not recorded in the relevant books, reject the claimed source, or conclude that the documents and explanation were not credible or sufficient. Your grounds of appeal should address the actual findings instead of relying on generic language.

The fact that a deposit was made in cash can be relevant evidence, but it does not by itself establish that the entire amount is undisclosed income. A source explanation must be tied to particular dates and amounts and reconciled with your account, books, returns and other records. Whether a particular explanation succeeds depends on the assessment record and the evidence available in your case.

First, identify the order, tax year and appeal route

Collect the complete assessment record

Download and preserve the assessment order, notice of demand, computation of income and tax, penalty order if one exists, notices issued during assessment, your replies, uploaded attachments and portal acknowledgements. Record the date and method by which each document was served. Keep the original electronic files as well as readable copies; service evidence can matter when limitation is calculated.

Write down the assessment year or tax year, the financial year in which the deposits occurred, the section cited for the addition, the amount added, interest and penalty amounts, and the authority shown for the first appeal. An addition under a different provision can require different legal analysis, so do not assume that every cash-deposit dispute is a section 69A matter.

Check whose account and money are involved

Confirm whether the bank account is solely yours, jointly held, operated for another person, or connected with a business, trust or family arrangement. The assessment may attribute ownership to you because the account is in your name, but the response must deal with the facts and documents that establish ownership or beneficial ownership. If you claim that another person supplied or owned the cash, identify that person and explain custody, transfer, capacity and the reason for the transaction. A bare statement that the money belonged to somebody else is unlikely to answer the order’s reasoning without supporting records.

Calculate the first-appeal deadline immediately

The Income Tax Department’s procedural guidance says an appeal against an assessment or penalty order is generally filed within 30 days from service of the notice of demand. The trigger is normally service of the demand notice, not the date printed on the assessment order and not the date on which you first discuss the case with the Assessing Officer. Calculate the deadline from your service record and check the current portal instructions before submission.

Do not wait for a recovery reminder or for a response to an informal representation. If the 30-day period may have expired, file the appeal as soon as possible and include a separate, reasoned request for condonation of delay. State the period of delay, explain the sufficient cause, and attach documents supporting the explanation. Condonation is discretionary; mentioning a delay does not guarantee that it will be excused.

Appeal-fee brackets described by the Department

The Department’s appeal page describes the following fees by assessed total income. Confirm the amount displayed by the live e-filing portal because fee rules and online processes can change.

Assessed total income Fee described in Department guidance
₹1 lakh or less ₹250
More than ₹1 lakh and up to ₹2 lakh ₹500
More than ₹2 lakh ₹1,000
Other matters ₹250

These are procedural figures, not a substitute for the amount shown during filing. Retain the payment receipt and acknowledgement with your appeal file.

Build a deposit-to-source evidence schedule

Start with a spreadsheet or indexed statement that covers every disputed credit. This is a practical way to expose gaps before you draft the grounds and to prevent the same withdrawal or receipt being used twice.

Column What to record
Deposit date The exact date shown in the bank statement
Amount The cash amount and any linked transaction reference
Bank account Account number or a masked identifier and ownership status
Claimed source For example, an earlier withdrawal, recorded sale, business receipt, gift or inheritance
Related event Date and amount of the withdrawal, receipt, sale, transfer or other event
Supporting exhibit Bank page, cash book entry, invoice, agreement, confirmation or other record
Filed during assessment? Yes or no, with the earlier submission reference where available

Reconcile the schedule to the bank statement and the total addition in the order. Mark transfers between your own accounts, redeposits and cash withdrawals that were later spent. A withdrawal can support a later deposit only if the surrounding cash flow reasonably shows that the cash was retained; the withdrawal amount alone does not prove that it remained available.

Earlier bank withdrawals

Obtain complete statements, not isolated pages, and trace the period between each withdrawal and deposit. Account for household expenses, purchases, repayments and other withdrawals. If several withdrawals are relied on, identify which one supports which deposit and avoid claiming the same cash twice.

Business receipts and cash sales

Link receipts to invoices, daily cash summaries, cash-book entries, stock movement, sales records, GST or other indirect-tax records where relevant, and the income-tax return. Explain why the amount was held in cash and when it was deposited. Consistency across books, invoices, stock and returns is more useful than a conclusion that the deposits were ordinary business money.

Sale of an asset

Provide the sale agreement or receipt, identity of the buyer, proof of delivery or transfer where relevant, consideration details and the accounting or return treatment. If the sale was in cash, explain why the cash was received in that form and how the amount moved into the bank.

Family transfers, gifts and inheritance

Identify the person who provided the funds and document identity, financial capacity, the transfer or custody trail and the reason for the payment. For inheritance, collect the will, succession or probate documents and an inventory or account showing the cash. A confirmation letter without evidence of capacity or the transaction trail may not answer the officer’s concerns.

Agricultural or other non-salary receipts

Use land or activity records, sale receipts, mandi or buyer records, crop or production details, bank entries and prior returns as applicable. These categories are possible explanations, not automatic proof; the documents must match the dates and amounts of the deposits.

Draft the statement of facts and grounds separately

Statement of facts

Give a neutral, chronological account. Identify the return, the assessment proceedings, the notices received, the explanation submitted, the deposits questioned and the findings in the order. Refer to each exhibit by a simple index number. Explain the source of every deposit or clearly identify which part remains disputed. If the order omitted or misread a document, state what was filed, when it was filed and what the document shows.

Grounds of appeal

Grounds should challenge specific findings and state the relief sought. Depending on the record, grounds may address incorrect application of section 69A, failure to consider ownership or books, rejection of a documented source without dealing with material evidence, an arithmetic mismatch, or an addition exceeding the deposits actually examined. Do not assert facts that are not supported by the documents, and do not copy grounds that do not match your order.

Ask for the addition to be deleted, or for such other relief as the appellate authority can lawfully grant on the facts. If you also contest interest or penalty, identify those issues separately rather than assuming that an appeal against the assessment automatically disposes of every consequence.

File Form 35 through the e-filing portal

  1. Open the correct appeal service. Sign in to the income-tax e-filing portal, choose the income-tax appeal or Form 35 service, and select the taxpayer, assessment year and order type shown in the assessment record. Use the live labels because portal navigation can change.
  2. Enter order and service details. Provide the date of the order, date and mode of service of the demand notice, the section involved, the assessed income, disputed amount and relevant penalty details. Check each figure against the downloaded order.
  3. Upload the memorandum and attachments. The Department lists the memorandum of appeal, statement of facts, grounds of appeal, a copy of the appealed order and the original demand notice, if any. Add an indexed evidence bundle, proof of earlier submissions and any delay-condonation application that applies.
  4. Declare additional evidence clearly. Identify documents not filed during assessment and use the portal’s field or attachment for a written request that they be admitted. Explain relevance and the reason for non-production earlier; do not hide new material in an unindexed bundle.
  5. Pay the applicable fee. Verify the current amount shown by the portal, pay it through the available method and save the receipt.
  6. Verify and submit. Complete verification in the manner required for the taxpayer and authorised representative. Download the acknowledgement, submission number and final uploaded package.

Use legible PDFs with page numbers and an index. Keep a local copy of every file exactly as submitted. If a portal error prevents filing near the deadline, preserve screenshots or error messages, contact the Department’s support channel, and submit as soon as the service is available; do not assume that an unsuccessful draft counts as a filed appeal.

When evidence was not filed during assessment

Additional evidence is restricted. The appellate authority must record reasons for admitting it and give the Assessing Officer an opportunity to examine or rebut it. Therefore, a new bank statement or confirmation is not automatically considered merely because it is attached to Form 35.

For each omitted document, write three short explanations:

  • What it proves: identify the deposit, source, ownership or accounting entry that the document supports.
  • Why it was not filed earlier: describe the factual obstacle, non-receipt, misunderstanding, illness, technical issue or other specific circumstance, and attach proof where available.
  • What admission is requested: ask expressly that the evidence be admitted under the applicable procedure and acknowledge that the Assessing Officer may examine it.

Do not use the additional-evidence request to replace a coherent statement of facts. Explain the source in the appeal itself, then use the document to substantiate the explanation.

Protect yourself from recovery while the appeal is pending

Filing an appeal does not automatically suspend collection of the demand. Treat recovery relief as a separate procedural task. Apply to the Assessing Officer for stay, instalments or treatment as not in default, as appropriate to your circumstances, and attach the appeal acknowledgement, a calculation of the disputed and undisputed portions, financial information and any payment already made.

The Department’s summary refers to a 20% disputed-demand benchmark in stay administration and separately notes that the benchmark may be increased in specified situations, such as adverse history, a relevant higher-court decision favouring the Department, or demand based on credible search or survey evidence. The benchmark is not a universal automatic stay, and the Department’s guidance contains different dated Office Memorandum references. Check the current directions and the decision on your application rather than assuming that paying 20% stops every recovery action.

Continue monitoring outstanding-demand notices, bank-account or refund adjustments and communications from the Assessing Officer. Keep proof of every payment and request. If recovery action is imminent or the amount is material, obtain advice from a qualified Indian tax practitioner experienced in first appeals and demand-stay applications.

Monitor faceless appeal notices and respond on time

The Department describes faceless appeal processing through the e-filing and National Faceless Assessment Centre-related systems. Check the portal, registered email and mobile alerts regularly. A notice may ask for a clarification, remand response, additional document or written submission by a specific date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Respond with a concise indexed PDF that identifies the notice, answers each question in order, cites the relevant exhibit page and states whether the document was already filed. Upload before the deadline and download the acknowledgement. If more time is genuinely needed, request an extension before the deadline and explain why; do not rely on an informal email or telephone conversation unless the portal records the request.

If the first appeal is unsuccessful

The Department describes the usual hierarchy as:

  1. Assessing Officer
  2. JCIT(A) or CIT(A), as applicable
  3. Income Tax Appellate Tribunal (ITAT)
  4. High Court
  5. Supreme Court

After a first-appeal order, examine the findings and the next forum’s limitation period immediately. The Department says an ITAT appeal is generally filed in Form 36 within two months from the end of the month in which the order is communicated. Verify the particular order, forum, forms and rules before filing because exceptions and procedural details can apply.

A High Court appeal is confined to a substantial question of law, not a general request to reweigh every factual dispute. The proposed question must arise from the appellate record and meet the statutory threshold. A further appeal to the Supreme Court has its own jurisdictional and limitation requirements. Preserve the complete paper trail from the first appeal so the next forum can see what evidence was filed, admitted or rejected.

The 2026 transition between tax statutes

The Income Tax Department’s transition FAQ states that proceedings relating to tax years beginning before 1 April 2026 continue under the Income-tax Act, 1961, including proceedings initiated after that date. It also says that a limitation period already expired under the 1961 Act is not revived solely because the Income Tax Act, 2025 begins to operate, although the old Act’s route for condonation of delay may remain available where sufficient cause is shown.

The FAQ specifically says an appeal for assessment year 2026–27 or an earlier assessment year remains governed by the 1961 Act even if filed after the new Act starts, and that a pending appeal does not need to be refiled. For a tax year beginning on or after 1 April 2026, confirm the operative new Act, transitional provisions, forms and portal instructions before citing section numbers or limitation rules. Do not copy a 1961 Act argument into a later tax year without checking the governing text.

Common mistakes that weaken a cash-deposit appeal

  • Missing the 30-day calculation: counting from the order date instead of service of the demand notice, or waiting for a recovery notice.
  • Using one blanket explanation: saying all deposits came from savings without mapping dates, amounts and records.
  • Ignoring ownership: claiming that another person owned the funds without documenting that person’s identity, capacity and transfer trail.
  • Assuming a withdrawal proves availability: failing to account for spending between the withdrawal and redeposit.
  • Submitting unindexed files: making it difficult to locate the page that supports a particular deposit.
  • Introducing new evidence silently: attaching documents without a reasoned admission request.
  • Combining merits and recovery: believing that the appeal itself stops collection.
  • Repeating unsupported grounds: alleging procedural defects or legal errors that the order does not contain.
  • Ignoring portal notices: missing a faceless appeal deadline because email or portal alerts were not monitored.
  • Using the wrong statute: citing the 1961 Act for a tax year governed by the post-1 April 2026 regime without checking the transition rules.

A practical pre-submission checklist

  • Assessment year or tax year and financial year are confirmed.
  • Section cited in the order and amount of addition are recorded.
  • Service date and method for the demand notice are documented.
  • Thirty-day deadline is calculated, or a supported condonation request is ready.
  • Bank statements cover the full relevant period.
  • Every disputed deposit appears in a reconciled schedule.
  • Each claimed source has a dated supporting exhibit or an explanation for its absence.
  • Ownership and account status are addressed.
  • Statement of facts and grounds are separate and tailored to the order.
  • Additional evidence is identified with reasons for non-production and a specific admission request.
  • Form 35, order, demand notice, fee receipt and verification are complete.
  • A separate stay or instalment request is prepared if recovery relief is needed.
  • Portal acknowledgement and the exact submitted files are saved.

An appeal is strongest when a reviewer can move from each line of the bank statement to a dated source record, then to the explanation in the statement of facts and the precise ground challenging the assessment. Where the record is incomplete, state the gap plainly and seek admission or further opportunity through the proper procedure instead of overstating what the documents prove.
