There is no single U.S. appeal process for a state agency payment or interest ruling. Your deadline, filing destination, required form, evidence rules and ability to pause collection depend on the state, agency, program and type of decision. Read the notice immediately, preserve proof of when it was issued or served, and follow its instructions while checking the agency’s current rules. A missed administrative deadline can end the case before anyone considers whether the amount or interest was calculated correctly.
What kind of appeal are you making?
“Appeal” can describe several different actions. Identifying the action is the first substantive step because the wrong route or deadline can forfeit review.

Agency reconsideration or internal appeal
Some agencies let you ask the issuing office to reconsider, correct an account, or review an assessment. The notice may name a review unit, form, portal or supervisor. Check whether this step is optional or mandatory before a hearing or court case. Ask what evidence the agency will accept and whether submitting a reconsideration request preserves the separate appeal deadline. Do not assume it does.

A statute may send the dispute to an administrative tribunal or hearing office, such as a state office of administrative hearings, or keep it within the agency. The hearing process creates the factual record that may later be reviewed by a court. The notice should explain how to request a hearing, where to file and when the request is due.

Judicial review
A court petition usually challenges a final agency decision after required administrative review is complete. Courts commonly review the existing administrative record rather than conduct a new evidentiary hearing. Maryland, Massachusetts and Colorado all describe record-based review in their official guidance, but their procedures differ. A court filing is not a substitute for the initial agency appeal unless the governing law says it is.
What to do in the first 24 hours
- Identify the decision exactly. Write down the agency, program, case or account number, date on the document, date it was mailed or electronically posted, date you received it, and the precise payment, assessment, refund denial or interest calculation you dispute.
- Secure the complete notice. Save every page, attachment, envelope, portal message and email header. The document may contain the controlling deadline, filing address, required form, service instructions and information about a stay.
- Calendar every possible deadline. Record the trigger stated by the rule or notice: issuance, mailing, service, receipt, the date an order becomes effective, the payment due date or another event. If the notice gives a date that conflicts with a current rule, seek clarification immediately rather than choosing the more convenient date.
- Locate the governing procedure. Use the agency’s current appeal page, regulations and the statute cited in the decision. If instructions are missing, contact the agency promptly and document the response. An informal request for an explanation or a telephone complaint may not preserve a formal appeal period.
- Protect your position while investigating. Ask in writing whether payment, collection, enforcement or interest accrual continues during review; whether payment under protest, a bond or a deposit is available; and how to request a stay. Do not stop paying solely because you filed an appeal.
How to choose the correct review path
| Review stage | Verify before filing | Why it matters |
|---|---|---|
| Agency reconsideration or internal appeal | Office or portal, required form, deadline and trigger, permitted evidence, decision-maker, and whether the step is mandatory | An agency may be required to correct or review its own decision before another tribunal or a court has authority. |
| Administrative hearing | Hearing office, request method, deadline, record-creation process, evidence and witness rules, and appeal route from the hearing decision | The hearing may be the only stage at which witnesses and documents can be developed fully. |
| Judicial review | Finality and exhaustion, court and venue, petition form, filing deadline, record or transcript requirements, filing fee or waiver, service, and stay procedure | A court may dismiss a premature petition, refuse new evidence, or allow agency action to continue unless a separate stay is granted. |
For example, Maryland distinguishes matters assigned to the Office of Administrative Hearings from matters using an agency’s own internal process. The state’s court guidance says available OAH or agency review should be completed before circuit-court review. Massachusetts describes a Chapter 30A appeal as review of a final decision after the agency’s available review process. These are state-specific illustrations, not a nationwide menu.
Deadlines: the number is only half the rule
Never publish or rely on a bare “30-day deadline.” The legal trigger can be the date of notice, service, issuance, receipt, an order’s effective date or a payment due date. Count according to the governing rule, including any rule for weekends, holidays, electronic service or deemed receipt. If the notice and regulation appear inconsistent, ask the agency and obtain advice from a lawyer or legal-aid service before the period expires.
Examples from official state guidance
| State and route | Published time limit | Trigger and important limits |
|---|---|---|
| Maryland judicial review | 30 days to file a petition | Runs from notice of a final decision, according to Maryland Courts’ Administrative Appeals guidance. The agency then submits the prior record; after the record is received, the petitioner has 30 days to file a memorandum. New evidence is generally not considered, subject to limited exceptions. |
| Massachusetts DALA and Chapter 30A | Case-specific; the notice controls | Massachusetts DALA instructs appellants to follow the agency’s directions, contact the agency if directions are missing and meet the deadline. DALA warns that it may lack authority to extend a deadline in many case types. The court’s Chapter 30A guidance concerns a final decision after available agency review. |
| Colorado state-agency judicial review | 35 days | The Colorado Judicial Branch states that court paperwork is due within 35 days after the agency action or decision becomes effective. The described review uses the agency file and transcript rather than a new hearing; the page also addresses service and possible fee-waiver forms. |
| Pennsylvania petition for review | 30 days | The Unified Judicial System of Pennsylvania directs self-represented parties to file within 30 days of the final state-agency decision or order and to select the form matching the agency matter. |
| Washington unclaimed-property example | Different periods for different actions | The Washington Department of Revenue’s unclaimed-property appeals search excerpt says an assessment challenge is due before the assessment’s due date, a denied refund or return application may be challenged within 30 days of denial, and a penalty-and-interest appeal initial order may be reviewed within 21 days. The initial order becomes final after 21 days if no review is requested. Verify the live page and controlling rule because these details were available only in a search excerpt. |
The examples show why a deadline must always be stated with its state, agency or program, review stage, trigger and current source. A deadline for a court petition is not automatically the deadline for an internal agency appeal, and a deadline to challenge an assessment is not automatically the deadline to challenge interest.
Separate an amount dispute from an interest dispute
Explain precisely what you want changed. A payment decision may involve the underlying amount, the date payment was credited, a refund denial, penalties, interest, or collection costs. A request to correct an arithmetic or account error is different from a request to waive or stop interest. The agency’s authority and required grounds come from the particular program’s statute, regulation and order; a general appeal guide cannot establish that interest must be suspended or forgiven.

In your filing, identify the line item, period and calculation you challenge. State whether the error is factual (for example, a payment or credit is missing), legal (the agency applied the wrong rule), procedural (required notice or hearing was absent), or computational (the rate, dates or principal are wrong). If you are asking for discretionary relief rather than correction, label it as a separate request and cite any authority the notice provides.
Build a complete administrative record
Organize the evidence before filing. Courts may be limited to the record created at the agency stage. Maryland says the agency submits the prior proceeding’s record and that courts generally do not consider new evidence. Colorado describes review of the agency file and transcript without a new hearing. Pennsylvania’s instructions require a copy of the challenged decision or order.

- The complete decision, every attachment and all appeal instructions.
- Envelope, certified-mail receipt, portal timestamp or electronic notice showing issuance, service and receipt dates.
- The agency ledger, original assessment or payment calculation, itemized interest calculation, applicable rate and dates used.
- Receipts, cancelled checks, bank statements, tax or benefit records, invoices and other proof tied to the disputed amount.
- Earlier applications, objections, agency responses, hearing notices, exhibits, witness statements and transcripts.
- Copies of every submission and correspondence, with a chronology of calls that records the date, person contacted and substance of the conversation.
- Proof of filing and service, such as portal confirmation, fax receipt, certified-mail tracking or a stamped copy.
Use a short index and label attachments consistently. Keep originals and submit copies unless the rules require otherwise. If a document is unavailable, explain what it is, why it cannot be obtained before the deadline and what substitute proof you are providing.
File the agency appeal correctly
- Use the required channel. File through the named portal, address, email, fax or tribunal clerk. A copy sent to a general agency inbox may not count.
- Use the required form. If no form is prescribed, include your name and contact information, account or case number, the agency decision and date, a clear statement that you appeal it, the relief requested and a signature.
- State the grounds briefly and specifically. Tie each claimed error to a document or calculation. Avoid a general statement that the decision is unfair without explaining the factual or legal basis.
- Attach the decision and key evidence. Follow page limits, file-size rules, redaction requirements and service instructions. Do not wait for every possible document if doing so would miss the deadline; file a timely, supported appeal and ask whether supplements are allowed.
- Serve every required recipient. Some procedures require service on the agency, opposing parties or a designated legal office. Follow the method and timing in the rule.
- Preserve proof. Save the confirmation page, timestamp, tracking number, payment receipt for a filing fee and a complete copy of what you sent.
If instructions are absent, Massachusetts DALA advises contacting the agency and still meeting the deadline. Ask for written confirmation of the correct filing destination and keep evidence of your attempt to clarify.
Payment, collection, interest and stays while the appeal is pending
Filing an appeal does not automatically stop agency action. Maryland’s court guidance specifically states that a petition for judicial review does not itself stop the agency; a separate written motion to stay is required, and the court may grant or deny it. That is a Maryland rule for the described route, not a universal rule for every state or program.

Before the due date, ask the agency in writing:
- Must the disputed amount be paid while review is pending?
- Will interest, penalties or collection fees continue to accrue?
- Is payment under protest, a bond, escrow or another deposit permitted?
- Which office decides a stay request, what form is required and what facts support emergency relief?
- Does an internal appeal suspend enforcement, or is a separate stay request needed?
Continue complying with undisputed payment obligations unless the governing authority or a granted stay says otherwise. If a stay is necessary, request it separately and explain the immediate harm, the amount at issue, the likelihood of an accounting error and why the request is timely. Do not treat a pending appeal as permission to ignore a collection notice.

What happens at an administrative hearing?
Read the hearing notice for the issues, conference dates, disclosure deadlines, witness requirements and method of submitting exhibits. Prepare a chronology and a one-page calculation showing the amount you believe is correct. Bring the original records needed to authenticate payments and explain any discrepancy between your ledger and the agency’s ledger.
Ask whether testimony is sworn, whether remote appearance is allowed, how exhibits must be exchanged and whether a transcript is available. The hearing decision may be an initial order subject to agency review rather than the final decision that starts a judicial-review period. The Washington unclaimed-property example illustrates this distinction: its search excerpt describes a 21-day period to seek review of a penalty-and-interest initial order and finality if no request is made.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Moving from an agency decision to court
Determine whether the decision is final and whether every required administrative step has been completed. Massachusetts describes Chapter 30A review as following the agency’s available review process. Maryland’s guidance similarly directs appellants to complete available OAH or agency review before circuit-court review.
For a court petition, verify the proper court and venue, caption, form, filing fee or waiver, service method, record or transcript requirements and deadline. File the challenged final decision and any document the court requires. Tell the court what legal or procedural error is alleged and what relief is requested; do not assume the judge will reweigh evidence or accept documents never submitted to the agency.

After filing, track the agency’s transmission of the record and every briefing date. In Maryland, the agency submits the prior proceeding’s record and the petitioner has 30 days after receiving it to file a memorandum. The state’s guidance also notes that new evidence is generally excluded, subject to limited exceptions. Colorado’s described procedure likewise relies on the agency file and transcript rather than a new hearing.
Common failure points and fixes
“I called, so my appeal is filed.”
A call may obtain instructions but generally does not replace the required written request, form or petition. File through the designated channel and retain confirmation.
“The notice says 30 days, so I can wait.”
Count from the notice’s specified trigger and check whether the period applies to reconsideration, a hearing, an initial order or judicial review. File early enough to correct a rejected upload or service defect.
“I can add my documents in court.”
Record-based review may exclude new evidence. Submit relevant proof during the agency proceeding and preserve the hearing exhibits and transcript.
“The appeal stops collection.”
Ask about payment and enforcement in writing and request a stay if the law permits one. Maryland requires a separate stay motion for the described judicial-review route.

“The agency can always extend the deadline.”
Massachusetts DALA warns that it may lack authority to extend deadlines in many case types. Assume the deadline is firm unless the governing rule or tribunal confirms otherwise in writing.
“The agency’s calculation is too high, so interest must be waived.”
Challenge the principal, the interest calculation and any waiver request separately. Identify the legal authority for each form of relief; correction and discretionary waiver are not the same remedy.
When professional help is worth considering
Consider a state-specific administrative-law attorney or legal-aid referral when the amount is substantial, the deadline is imminent, records are incomplete, a lien or license is at risk, the matter involves multiple proceedings, or you need a stay. Ask the lawyer to verify the current statute, rule, service requirements and exhaustion path for your exact agency and program. A general explanation cannot determine whether your appeal is timely or whether payment is required during review.

Bottom line
Appeal the decision named in the notice through the route and deadline that apply to that state, agency and program. File a formal request on time, create the factual record at the agency stage, and separately verify whether payment or collection continues and whether a stay is available. The official examples from Maryland, Massachusetts, Colorado, Pennsylvania and Washington demonstrate why no universal deadline or automatic payment suspension can safely be assumed.
