How to Appeal a Property Tax Assessment When Your Home’s Value Seems Too High

If your property tax assessment appears higher than your home’s market value, start by reading the valuation notice and finding the local filing deadline. Then identify the valuation date, gather evidence such as comparable sales near that date, and submit the required appeal to the correct assessor or appeal board. Property-tax appeals are controlled by state, county, and municipal rules, so do not rely on a deadline or form from another jurisdiction. Keep paying tax installments unless your tax collector gives different written instructions.

Start with the notice, not the tax bill

A tax bill tells you what you owe; the assessment notice usually tells you why the taxing authority believes you owe it. Before collecting documents, make a one-page record of the notice details:

As an Amazon Associate I earn from qualifying purchases.

  • the assessment year and the valuation date;
  • the assessed value, market or “full value” figure, and any exemption or classification shown;
  • whether the notice concerns a regular assessment, a supplemental assessment, a reassessment after purchase or construction, a decline-in-value claim, or an equalization issue;
  • the date the notice was mailed or received;
  • the filing deadline and the office that must receive the appeal;
  • accepted delivery methods, such as an online portal, mail, hand delivery, or a specified form; and
  • instructions for an informal review with the assessor.

Those details determine which rules apply. If the notice is missing, illegible, or unclear, contact the assessor’s office or the clerk of the local appeal board promptly and record the name of the office, the date, and the answer you receive. A general internet search cannot establish your deadline because the same state may use different dates for regular, supplemental, and other assessment types.

Confirm that the disputed value is measured on the right date

An appeal is not simply a request to lower a high tax bill. You are asking the government to correct a property value under the valuation standard and date that apply to your notice. A home that has fallen in value since the relevant date may not qualify for a reduction if the decline occurred afterward; conversely, a sale or condition problem that existed on the valuation date may be important even if the market later changed.

Write the valuation date at the top of your evidence file. Every sale, listing, repair record, photograph, and appraisal should be evaluated for its relationship to that date. Local rules also control which sale dates may be considered. For example, California State Board of Equalization guidance says its board may not consider comparable sales occurring more than 90 days after the valuation date. That is a California example, not a rule to apply in another state. Read the local appeal instructions before filtering your sales.

Build evidence that supports a lower value

Officials expect evidence of market value, not only a statement that the bill is unaffordable or that a neighbor pays less. California’s Board of Equalization says, “For a residential property, the best supporting documentation is information on sales of comparable properties.” Washington’s Board of Tax Appeals similarly states, “For residential appeals, comparable sales are often the most useful evidence.” The strength of your case depends on how closely the evidence matches the property and the applicable valuation date.

Comparable sales

Begin with nearby homes that are genuinely similar. For each candidate sale, record the address, sale date, sale price, living area, lot size, age, construction type, condition, number of bedrooms and bathrooms, parking, view, pool or other major features, and any unusual transaction terms. Explain material differences instead of treating every nearby sale as interchangeable. A smaller home in substantially worse condition may not be a useful comparison merely because it is on the same street.

Use the sale price as evidence of what a willing buyer and seller may have agreed to around the valuation date, subject to local rules. A cluster of well-matched sales is generally more persuasive than one outlier. If the local assessor’s records contain errors about your home’s size, additions, condition, or features, identify each error and attach documentation that corrects it.

A sale of your own home

A recent arm’s-length purchase of the subject property can be important evidence. Include the closing date, contract or settlement documents when permitted, and facts showing that the transaction was not a forced sale, family transfer, foreclosure, or other arrangement that may not reflect market value. Ask the local board whether the sale date falls within its permitted period and whether confidential portions may be redacted.

Listings, offers, records, and photographs

Official guidance also recognizes listing information and offers to purchase. A listing is an asking price, not proof that a buyer would have paid it, so explain whether the property actually attracted offers and what happened. Keep dated copies of the listing, price changes, withdrawn status, offers, and inspection-related negotiations.

Property records and photographs can document physical facts that affect value: deferred maintenance, water or fire damage, access problems, unusual construction, easements, environmental conditions, or a feature incorrectly attributed to the home. Date the photographs and identify what each image shows. If the condition was temporary, explain whether it existed on the valuation date.

A professional appraisal

A licensed appraisal may help when the property is unusual or the comparable-sales pool is thin. It is not universally required. Indiana’s state guidance says its law does not require an appraisal, while California guidance permits appraisal material and notes that the person who prepared it may be required to answer questions. An appraisal costs money and does not guarantee that the board will adopt the appraiser’s conclusion. Before ordering one, ask the local appeal authority whether it accepts the report, what effective date it requires, whether the appraiser must attend, and how many copies are due.

Use the local review path in the correct order

Many jurisdictions offer an informal assessor review before a formal appeal, but the sequence differs. California recommends contacting the county assessor first. Indiana describes beginning with written notice to the local assessing official. An informal conversation or review may resolve a factual error quickly, but do not let it replace a formal filing if the deadline is approaching. Ask the assessor’s office whether an informal request extends the statutory deadline; never assume that it does.

If the informal review does not produce an acceptable value, file the prescribed application or notice with the authority named on your notice. California requires its county assessment-appeal application, and local filing fees or submission requirements may apply. The California State Board of Equalization explains the overall process in its Assessment Appeals Frequently Asked Questions, its Assessment Appeals Description, and Publication 30, Residential Property Assessment Appeals.

File a property-tax appeal step by step

  1. Locate the controlling office. Use the notice to identify the county or municipal assessor, county board of equalization, assessment appeals board, or state tax appeals body that has jurisdiction.
  2. Verify the deadline in writing. Confirm whether the date is based on mailing, receipt, the assessment roll, or the type of assessment. Ask what happens if the notice was not mailed or was defective.
  3. Obtain the current form and instructions. Download the form from the government office named on the notice or request a paper copy. Check whether every owner must sign and whether electronic signatures are accepted.
  4. State the requested value and basis. Tie the requested value to the valuation date and explain the comparable sales, factual corrections, condition evidence, or other material supporting it.
  5. Attach or identify evidence as required. Follow local rules on page limits, file formats, confidentiality, copies, and whether evidence must be submitted with the application or exchanged before a hearing.
  6. Submit to the correct place and preserve proof. Keep a complete, dated copy of the form and every attachment. Save an electronic receipt, certified-mail record, hand-delivery stamp, or other proof showing when the filing was received.
  7. Track every notice. Record requests for additional information, hearing dates, postponement rules, assessor responses, and appeal decisions. Missing a later evidence or hearing deadline can harm an otherwise timely appeal.

Prepare for a hearing instead of assuming your file was reviewed

Some boards decide from written submissions; others schedule a hearing. Read the appeal body’s instructions about witness availability, evidence exchange, the number of copies, and whether an appraiser or report preparer must attend. Organize your presentation around three questions: What value does the assessment use? What value does your evidence support? Why are your selected sales and adjustments appropriate for the valuation date?

California’s Board of Equalization warns that information given to the assessor before filing is not automatically part of the evidence the appeal board considers. Evidence must be presented under the board’s hearing and filing rules. In practice, bring the documents the board requires even if the assessor already has them, and be ready to explain each adjustment rather than handing over an unexplained stack of listings.

Prepare a short chronology of the property’s condition and transactions. Use a comparable-sales grid or clearly labeled exhibit, but do not rely on a computer screen or a link that may disappear. If a report contains an opinion from an appraiser, contractor, broker, or other professional, confirm whether that person must appear for questions. Answer factual questions directly; an appeal board may accept a lower value, leave the value unchanged, or, in some jurisdictions, raise it. California’s state FAQ expressly describes all three possible outcomes.

Do not confuse the appeal with payment of the tax

A pending appeal does not automatically suspend tax installments. Ask the tax collector, separately from the assessor or appeal board, whether payments remain due, whether payment under protest is available, and how a reduction is credited. California State Board of Equalization guidance and Orange County instructions tell taxpayers to pay timely while an appeal is pending and describe a refund when the value is reduced. That is California guidance, not a promise for every state or county. Missing a payment can trigger penalties or collection action even while the valuation dispute is unresolved.

Choose between self-preparation and professional help

Self-preparation is often practical when the property is typical, the assessor’s records are accurate, and several close-in-time comparable sales support a clear adjustment. A professional may be worth considering when the home has extraordinary construction, a mixed residential and commercial use, extensive damage, a unique location, or too few credible comparable sales. Orange County guidance identifies licensed appraisers, real-estate agents or brokers, attorneys, and property-tax agents as possible sources of help for unusual properties or inadequate comparable information.

Compare assistance by the filing deadline, the quality and date relevance of your evidence, the professional’s cost, and the local board’s rules. Ask what work is included, whether the professional will attend the hearing, and whether fees are owed regardless of the result. No adviser can guarantee a reduction, a refund, or a particular outcome.

Common mistakes that weaken an appeal

  • Using a national deadline. A date from another state, county, or assessment type can cause a missed filing.
  • Arguing only that the bill is unaffordable. The issue is supportable value under the applicable standard, not the household’s ability to pay.
  • Submitting weak comparables. Distance alone does not make a sale comparable; differences in size, condition, age, location, and features matter.
  • Ignoring the valuation date. A later market decline or a sale outside the permitted window may not be considered.
  • Assuming an informal review preserves a formal appeal. Obtain explicit confirmation before relying on that assumption.
  • Failing to present evidence at the hearing. Prior delivery to an assessor may not place the material before the appeal board.
  • Stopping tax payments. Keep installments current unless the tax collector directs otherwise in writing.
  • Expecting only a lower result. Ask whether the board may leave the value unchanged or increase it.

Appeal preparation checklist

  • Valuation notice and tax bill, with the assessment year and valuation date marked.
  • Written confirmation of the filing deadline and correct appeal office.
  • Completed current application or notice, with required signatures and fee.
  • Comparable-sales list showing addresses, dates, prices, characteristics, and adjustments.
  • Subject-property sale documents, if relevant and permitted.
  • Listings, offers, records, repair documents, and dated photographs that support the requested value.
  • Appraisal and the appraiser’s hearing availability, if an appraisal is used.
  • Copies, delivery receipts, portal confirmations, and a calendar of every later deadline.
  • Separate payment plan confirmed with the tax collector.

Bottom line

Appeal promptly, but localize every step. The strongest basic case combines the correct valuation date with credible comparable sales and a clear explanation of differences, filed on the required form with proof of timely delivery. Use an informal assessor review when your jurisdiction offers one, preserve the formal deadline, present your evidence under the board’s rules, and continue paying taxes unless the tax collector says otherwise.
