How to Appeal a GST Penalty Order and Preserve Your Limitation Arguments (2026 Guide)

File the first appeal in FORM GST APL-01 within three months from the date the GST decision or penalty order was communicated to you—not automatically from the date printed on the order. If you can show sufficient cause for missing that period, the Appellate Authority may allow filing during only one further month. That is a limited statutory discretion, not an open-ended delay-condonation power.

Preserve the communication evidence, submit the appeal and certified order correctly, pay the applicable pre-deposit, and keep every acknowledgement. For an order demanding only a penalty (with no tax demand), the current section 107 proviso requires a payment equal to 10% of the penalty, in addition to the admitted amount payable; that proviso applies from October 1, 2025. Confirm the governing CGST, State GST or Union Territory GST law and the version in force for your order.

What deadline applies to a GST penalty appeal?

Section 107(1) of the Central Goods and Services Tax Act, 2017 (CGST Act) gives an aggrieved person three months to appeal an adjudicating authority’s decision or order. The statutory wording is:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Any person aggrieved by any decision or order passed under this Act or the State Goods and Services Tax Act or the Union Territory Goods and Services Tax Act by an adjudicating authority may appeal to such Appellate Authority as may be prescribed within three months from the date on which the said decision or order is communicated to such person.”

The key trigger is communication. The date printed on the order remains important, but it is not necessarily the date from which your appeal period runs. Keep the order date and the communication date as separate entries in your records.

Which GST law and forum apply?

Most GST penalty orders cite the CGST Act together with a State GST or Union Territory GST enactment. Identify the statute named in the order, the issuing adjudicating authority and the Appellate Authority stated in the appeal instructions. The corresponding State or Union Territory law and current rules may affect the form, service method or portal workflow. Do not assume that an order issued under one enactment can be handled using the procedure for another jurisdiction without checking the order and live rules.

What happens after three months?

Section 107(4) permits the Appellate Authority to allow presentation within a further one month if it is satisfied that sufficient cause prevented filing within the original three-month period. The authority must exercise discretion; condonation is not automatic merely because an application is labelled “sufficient cause.” Once that additional month has expired, section 107 does not describe an open-ended power to extend the period.

Do not treat a general limitation provision, an email to the department, a payment, or an informal objection as a substitute for the prescribed appeal. Questions about writ proceedings, exclusions of time or an exceptional court direction require case-specific legal analysis and cannot be assumed to enlarge the section 107 window.

Build a limitation record before you file

Your first task is not drafting arguments. It is creating a date-and-document record that allows the Appellate Authority to see exactly when the order was communicated and what you did afterward.

Documents and dates to preserve

  • The complete penalty order, including annexures, computation sheets and the signature or digital authentication.
  • The date printed on the order, recorded separately from the date of communication.
  • Proof of how and when the order was served or communicated: GST portal notices and download history, email headers, registered-post or courier envelope and delivery record, or another service record identified in the governing rules.
  • Any portal event showing when the order became available, when it was downloaded and by which user account.
  • Dated correspondence with the officer or department, including requests for a copy, correction requests and replies.
  • The filed FORM GST APL-01, every attachment, the submission timestamp and any provisional acknowledgement.
  • Payment challans and bank or electronic payment confirmations for admitted amounts and the required pre-deposit.
  • The final APL-02 acknowledgement and appeal number, plus screenshots or downloaded PDFs of the acknowledgement trail.

A service event may count as communication differently depending on the facts and applicable service rules. Preserve the original record rather than relying on a recollection or a later printout. If the department alleges an earlier communication date, your contemporaneous evidence is what allows the date issue to be argued.

Entry What to record Why it matters
Order date Date shown on the signed or digitally authenticated order Identifies the decision, but does not by itself establish the section 107(1) start date.
Communication date Date and method by which the order was made available or served Normally anchors the three-month period under section 107(1), subject to the applicable service and computation rules.
Submission date Time and date of APL-01 submission, including provisional receipt Shows when you attempted to invoke the appeal process.
Final filing date Date APL-02 with an appeal number is issued GST Portal guidance treats final APL-02 issuance as the point at which the appeal is considered filed.

Calculate the three-month period using the applicable rules for computation of time and the documented communication event. A generic calendar calculation can be wrong where service is disputed, a portal event is ambiguous, or a court direction affects the period. If the deadline is close, file promptly while obtaining advice on the date issue.

How to file FORM GST APL-01 step by step

1. Triage the order immediately

Read the operative portion and identify:

  • the issuing adjudicating authority and statutory provisions cited;
  • the penalty amount and the conduct or default alleged;
  • whether the order also demands tax, interest or another amount;
  • the jurisdiction (CGST, State GST or Union Territory GST);
  • the Appellate Authority and filing instructions stated in the order; and
  • the communication method and date you can prove.

Create a deadline diary entry from the communication date and set an earlier internal date for completing the form and payment. Do not wait for a demand notice, recovery action or a reply to a representation before starting the appeal.

2. Assemble the appeal record

Prepare the order and all annexures, show-cause notice, reply, relied-on documents, hearing submissions, evidence of service and any later correspondence. Number the pages or files consistently. Draft a short chronology that lists the communication event, hearing dates, order date, discovery or download date, payment date and filing steps.

3. Draft grounds that address both merits and procedure

Separate each ground so the authority can decide it independently. Typical categories include lack of jurisdiction, defective notice, denial of a reasonable hearing, incorrect classification of the act or omission, failure to consider evidence, disproportionate or legally unavailable penalty, and computational errors. If communication or limitation is disputed, state the competing dates, explain the evidence for each, and ask the authority to accept the date that follows the governing service rule.

Do not bury a limitation objection in a general narrative. Include a specific ground that the appeal is within three months of proven communication, or, if necessary, a separately headed condonation request for the limited additional month.

4. Determine the payment and pre-deposit

Section 107(6)(a) requires payment of the admitted amount payable under the order. The current text also contains a proviso for an order demanding a penalty without involving a demand of tax: the appellant must pay a sum equal to 10% of the penalty. The penalty-only proviso is shown as effective from October 1, 2025.

First classify the order. If tax is demanded as well as penalty, the applicable section 107(6) disputed-tax calculation and any other statutory requirements must be checked against the current law. Do not apply the 10% penalty-only base to every order, and do not rely on an older explanation that discusses only disputed tax. Record how you classified the order and retain the payment reference.

5. Submit APL-01 with the required copy and attachments

Complete FORM GST APL-01 in the GST Portal using the jurisdiction and order details shown in the decision. Upload the grounds, statement of facts, relief sought, order and supporting documents in the permitted formats. Follow Rule 108 for the certified-copy and acknowledgement process. A portal submission that lacks the required certified order or has an unreadable attachment can create a procedural problem even when the grounds are strong.

6. Preserve the provisional receipt and obtain APL-02

Save the submission screen, provisional acknowledgement, ARN or other reference immediately. Then monitor the portal for the final APL-02 acknowledgement carrying the appeal number. The GST Portal’s APL-01 guidance describes the appeal as filed when final APL-02 is issued. Keep both stages: the initial evidence shows when you attempted submission, while APL-02 confirms the recorded appeal.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Check the filed record

Open the filed appeal after acknowledgement and verify the order number, taxpayer identification, amount, payment reference, grounds and contact details. If an attachment is missing or the portal shows an error, correct it through the prescribed process immediately and preserve the error message and correction timestamp. A later correction should not erase the original submission evidence.

How to request condonation when three months have expired

Use a separate, clearly labelled application or section in the filing when the appeal is outside the ordinary three-month period but still within the additional one-month window. Ask the Appellate Authority to exercise section 107(4) discretion and explain why the appeal could not be presented earlier.

What a sufficient-cause explanation should contain

  1. Competing dates: state the order date, the date and method of communication you rely on, the date you actually obtained the order and the date APL-01 was submitted.
  2. Chronology: give each relevant event with a day-month-year date, including illness, an unavailable portal, a missing copy, a change in authorised representative or another event that genuinely prevented filing.
  3. Evidence: attach the service record, portal logs, medical or other contemporaneous documents, correspondence and payment records that support the explanation.
  4. Reasonable diligence: show what you did once the obstacle ended and why the remaining delay was short.
  5. Relief: request condonation of the stated delay and acceptance of the accompanying APL-01, without suggesting that condonation is automatic.

A bare statement such as “the delay was inadvertent” does not explain the cause or its duration. Avoid changing the communication date merely to fit the deadline; an inconsistent record can undermine both the limitation argument and the merits.

Illustrative timeline (not a legal calculation)

Suppose an order is dated 4 January, but the portal record shows it was first communicated on 18 January. The three-month period must be analysed from the documented communication event under the applicable computation rules, not simply from 4 January. If APL-01 is submitted after that ordinary period but before the end of the permitted further month, attach the condonation request and evidence. The example does not decide how a particular month is counted; disputed service or computation requires review of the actual record.

Pre-deposit rules: penalty alone versus tax and penalty

The amount that must be paid before the first appeal depends on what the order demands and on the statutory version applicable on the relevant date.

Order type Payment issue to check Important qualification
Penalty without a tax demand Admitted amount under section 107(6)(a), plus a sum equal to 10% of the penalty under the penalty-only proviso. The proviso is effective from October 1, 2025. Confirm the order date, enactment and current text.
Tax and penalty demanded together Admitted amount and the disputed-tax pre-deposit required by the applicable section 107(6) text, with any related statutory conditions. Do not substitute the penalty-only 10% calculation for the disputed-tax calculation.
Unclear or mixed demand Reconcile the operative demand, payment ledger and computation sheet before filing. Ask for professional advice if the order describes a penalty but also recovers tax, interest or another amount.

Payment alone does not lodge an appeal. Upload the payment evidence with APL-01 and retain the challan, bank reference and portal status.

First appeal under section 107 or later Tribunal appeal under section 112?

Section 107 is the first appeal from the adjudicating authority. A later appeal from the Appellate Authority’s decision lies to the Appellate Tribunal under section 112, subject to the Tribunal’s statutory and notified procedure. The current section 112 text also contains a penalty-only pre-deposit proviso effective October 1, 2025.

Decision point Section 107 first appeal Section 112 Tribunal appeal
Starting decision Adjudicating authority’s decision or order Appellate Authority’s decision or order
Form and filing record FORM GST APL-01; preserve provisional submission and final APL-02 appeal number. Use the Tribunal form and procedure in force for the matter; confirm the notified filing date and portal requirements.
Timing Three months from communication, with only one further month potentially condonable for sufficient cause. Do not assume the section 107 period. Check the communication date, the current section 112 text and any government-notified date applicable to the Tribunal.
Penalty-only payment 10% of penalty in addition to the admitted amount under the proviso effective October 1, 2025. Check the corresponding current proviso and the Tribunal’s applicable payment procedure.

An email disputing the order or a request for reconsideration does not preserve the statutory first-appeal period unless the prescribed appeal is filed and acknowledged. If you intend to pursue further litigation, still protect the section 107 deadline first.

Common failure modes and how to repair them

Counting from the printed order date

Problem: the taxpayer starts the clock from the date shown on the order despite later communication. Repair: preserve both dates, identify the service event and state the communication-date argument expressly.

Stopping at a provisional submission

Problem: the taxpayer keeps only a draft or provisional receipt and assumes the appeal is complete. Repair: monitor for final APL-02, save the appeal number and resolve portal defects immediately.

Missing the certified-copy requirement

Problem: the order or certified copy required by Rule 108 is absent or unreadable. Repair: upload the complete certified order in the prescribed manner and keep the file that was actually submitted.

Using a generic condonation paragraph

Problem: the application says only that the delay was accidental. Repair: provide a dated chronology, causal explanation and documents showing prompt action after the obstacle ended.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Applying the wrong pre-deposit base

Problem: a penalty-only order is treated like a tax-demand order, or an order containing tax is treated as penalty-only. Repair: read the operative demand and apply the statutory version in force, including the October 1, 2025 penalty-only proviso where it governs.

Relying on payment or correspondence as the appeal

Problem: payment, a representation or an email is treated as filing. Repair: submit FORM GST APL-01 through the prescribed process and obtain the final acknowledgement.

How to preserve limitation arguments in the grounds

Use a dedicated “Limitation and maintainability” heading before the merits. State the statutory period, identify the communication event and attach the proof. If the department’s record shows a different date, explain why that event does not establish communication on the facts or under the applicable service rule, without making a conclusory assertion unsupported by documents.

Then plead in the alternative where appropriate: first, that the appeal is within three months of valid communication; second, that if the authority adopts a later date, the appeal remains within the further one-month period and the delay should be condoned for the stated sufficient cause. This preserves both positions without asking the authority to overlook an unexplained delay.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep limitation arguments distinct from the merits. A strong challenge to the penalty does not cure a missed filing period, and a limitation objection does not by itself prove that the penalty is legally unsustainable. Give the authority a clear order in which to decide the date issue, condonation request and substantive grounds.

What to do after APL-02 is issued

  • Download the final acknowledgement, appeal number and complete filed form.
  • Check the portal for notices, hearing dates, requests for additional documents and orders.
  • Respond by the stated date and keep proof of every upload or submission.
  • Maintain the original service evidence and a read-only copy of the filed record.
  • Do not assume that filing automatically stays every recovery action; check the applicable statutory consequences and seek advice if recovery is imminent.
  • If the Appellate Authority issues an adverse decision, record its communication date immediately before considering a section 112 Tribunal appeal.

Practical filing checklist

  • Jurisdiction and enactment identified from the order.
  • Order date and communication date recorded separately.
  • Service or portal evidence saved in its original form.
  • Three-month deadline calculated under the applicable time-computation rules.
  • Condonation request prepared if filing falls in the additional month.
  • Grounds, chronology, relief and indexed attachments completed.
  • Certified copy and readable order uploaded under Rule 108 requirements.
  • Admitted amount and correct pre-deposit paid; penalty-only calculation checked against the law effective October 1, 2025.
  • APL-01 submission evidence retained.
  • Final APL-02 acknowledgement and appeal number obtained and stored.

This process protects the limitation position while leaving the Appellate Authority a complete record to decide the penalty on its merits. Where service, computation, jurisdiction or an expired condonation window is disputed, obtain advice from a qualified tax practitioner, chartered accountant or lawyer using the full order and communication history.
