Medicaid’s spousal-impoverishment rules are designed to keep the spouse who remains at home from losing every countable asset or all usable income when the other spouse qualifies for long-term-care Medicaid. They do this through two separate mechanisms: a community-spouse resource allowance and a community-spouse income allowance. The institutionalized spouse may still have to contribute income toward care after required deductions.
Those protections are not a guaranteed payment or a single nationwide calculation. The final result depends on the state Medicaid program, the couple’s residence, the date of the calculation, shelter costs, other deductions, asset ownership, and the household’s actual finances.

What the protections are meant to do
Federal Medicaid law recognizes that married couples should not be treated as though the spouse living in the community can immediately use every dollar owned or received by the spouse in a nursing facility. The framework therefore separates two questions:
- Resources: How much of the couple’s countable property may be protected for the community spouse?
- Income: How much of the institutionalized spouse’s monthly income must be applied to the cost of care, and how much may be directed to the community spouse?
These questions are answered at different points in time. Initial eligibility generally considers both spouses’ resources, subject to the statutory allowance. After eligibility is established and the institutionalized spouse remains in a continuous institutional period, the community spouse’s resources are no longer deemed available to the institutionalized spouse under the federal rule.

Resource protection: what assets can remain with the community spouse?
Initial eligibility uses a combined-resource framework
At the initial eligibility determination, resources held by either spouse are generally evaluated for the institutionalized spouse, subject to exclusions and the community spouse resource allowance. The state first identifies the couple’s countable resources under its Medicaid rules. It then applies the federal methodology for determining the amount that may be retained by or transferred for the sole benefit of the community spouse.
Countable resources can include financial accounts, investments and other property, but state exclusions and ownership rules matter. A home, vehicle, burial arrangement, business interest or specific account may receive different treatment depending on the state and the facts. Do not assume that an account titled in one spouse’s name is automatically ignored, or that every jointly owned asset is treated identically.

2026 community-spouse resource standards
CMS’s April 27, 2026 Center for Medicaid and CHIP Services bulletin lists the following federal standards, effective January 1, 2026:
| Standard | 2026 amount | What it means |
|---|---|---|
| Minimum community-spouse resource standard | $32,532 | The lower federal benchmark used in the allowance calculation. |
| Maximum community-spouse resource standard | $162,660 | The upper federal benchmark used in the allowance calculation. |
| Home-equity limit shown on the CMS chart | $752,000 minimum; $1,130,000 maximum | A federal range for home-equity treatment; it does not by itself decide whether a particular home is countable or protected. |
These figures are standards, not an automatic award. A spouse does not simply receive the maximum because it appears in the chart. The allowance is tied to the couple’s resources and the applicable state calculation. State rules, asset valuations, prior transfers and the timing of the assessment can change the result.

Protection after the eligibility month
Once the institutionalized spouse is determined eligible, a different rule applies during the continuous institutional period. The statute states: “During the continuous period in which an institutionalized spouse is in an institution and after the month in which an institutionalized spouse is determined to be eligible for benefits under this subchapter, no resources of the community spouse shall be deemed available to the institutionalized spouse.”
In practical terms, the community spouse’s resources are not continually added back to the institutionalized spouse’s available resources after eligibility. That protection does not eliminate reporting duties, state review, or rules about transfers and changes in ownership. Keep records showing account balances, property values and the date eligibility began.
Income protection: what happens to monthly income?
The community-spouse monthly income allowance
The income allowance is separate from the resource allowance. After the institutionalized spouse qualifies, the state calculates how much of that person’s income is applied toward care. A community-spouse monthly income allowance may be included when the community spouse’s income is below the applicable minimum monthly maintenance needs allowance (MMMNA).
The general formula is the applicable MMMNA minus income otherwise available to the community spouse. The allowance is limited to the amount actually made available to or for the benefit of that spouse; it is not an unrestricted transfer of all institutionalized-spouse income.
2026 federal income and housing standards
CMS lists these amounts effective July 1, 2026:
| Geography | MMMNA | Community-spouse monthly housing allowance |
|---|---|---|
| States other than Alaska and Hawaii | $2,705 | $811.50 |
| Alaska | $3,381.25 | $1,014.38 |
| Hawaii | $3,111.25 | $933.38 |
| Maximum MMMNA | $4,066.50 | Not stated as a separate maximum housing figure |
The housing figure is used in the statutory shelter-cost calculation. It does not mean every community spouse automatically receives that amount, and it is not a rent or mortgage reimbursement. The state considers qualifying shelter expenses and applies the statutory formula when determining whether an excess shelter allowance increases the income allowance.

Deductions taken before the care contribution
The institutionalized spouse’s contribution is calculated after specified deductions. Depending on the case, the state may account for:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- a personal-needs allowance;
- the community-spouse income allowance, to the extent income is made available for that spouse;
- allowances for qualifying dependent family members; and
- incurred medical or remedial-care expenses that meet the program’s requirements.
The remaining amount is the income contribution toward the cost of care. Because deductions and income classifications vary, the gross monthly benefit or pension is not the same as the amount Medicaid will require the institutionalized spouse to pay.
How timing changes the calculation
Before the Medicaid decision
During the application process, gather a complete snapshot of the couple’s resources and income. The state may need account statements, pension and Social Security records, insurance information, property documents and evidence of recurring expenses. The resource allowance is determined using the state’s method and the applicable standards in effect at that time.
The eligibility month
The month in which the institutionalized spouse is determined eligible is important because the post-eligibility resource rule begins after that month. Ask the Medicaid agency to identify the eligibility month in writing and retain the notice.
After eligibility during continuous institutionalization
During the continuous institutional period, the community spouse’s resources are not deemed available to the institutionalized spouse under the federal statute. Income is still recalculated when circumstances change, such as a pension adjustment, a change in shelter costs, a new dependent allowance or a change in the community spouse’s own income.

Annual federal updates
CMS adjusts the resource standards each January and the MMMNA and related housing allowance each July. The 2026 bulletin is the current source for the figures above. Older CMS overview text still displays 2016 dollar amounts in one post-eligibility section, so relying on that older passage can produce an incorrect estimate.
Nursing-facility care versus home- and community-based services
The rules are not automatically identical when care is delivered at home. Federal law temporarily extends specified spousal-impoverishment treatment to listed home- and community-based services (HCBS) and attendant-services cases through September 30, 2027. States also retain flexibility through waivers and state-plan amendments to disregard certain spousal income and assets in HCBS eligibility determinations.
That means a couple moving from a nursing facility application to an HCBS program may face a different resource or income methodology. Confirm the exact waiver, state-plan program and effective dates with the state Medicaid agency rather than transferring the nursing-facility calculation to home care without review.

When an allowance appears too low
Notice and fair-hearing rights
The statute requires notice of the allowance amounts and the method used to compute the resource allowance. It also provides fair-hearing rights for specified disputes, including disagreements over income-allowance and resource determinations. Read the notice for the appeal deadline, filing method and documents required by the state.
Possible adjustments for financial duress
Some circumstances can support an increased MMMNA when exceptional conditions cause significant financial duress. The statute also permits revision of the resource allowance under stated conditions. These are potential rights, not automatic increases. Explain the specific expense or hardship, provide supporting records and ask the agency to identify the legal standard it applied.
A practical application checklist
- Identify the program. Confirm whether the application is for nursing-facility Medicaid, an HCBS waiver or another category.
- Establish the timeline. Record the application date, requested resource-assessment date and eligibility month.
- Inventory resources. List every account, investment, vehicle, property interest, insurance value and burial asset, including ownership and current value.
- Separate income from resources. Gather current monthly statements for Social Security, pensions, annuities, wages and other recurring income.
- Document shelter costs. Keep mortgage or rent records, property taxes, homeowners insurance, utilities and required maintenance expenses that the state recognizes.
- Document medical expenses. Save bills and receipts for incurred medical or remedial-care costs that may qualify as deductions.
- Review the written notice. Check the resource allowance, MMMNA, deductions, effective dates and the explanation of the calculation.
- Appeal promptly when necessary. Use the notice’s fair-hearing instructions and keep proof that the appeal was filed on time.
Illustrative calculations
Income example
Assume, purely as an illustration, that the applicable MMMNA is $2,000 and the community spouse has $1,350 of income that is otherwise available. Before any shelter adjustment, the income allowance would be $650 ($2,000 minus $1,350), subject to the state’s rules and the amount actually made available. If qualifying shelter expenses trigger an excess-shelter calculation, the state may determine a different allowance.

Assume a state calculation finds $140,000 in countable resources at the assessment point and determines that $100,000 may be retained for the community spouse. The remaining resources are not automatically approved for spending; the couple must follow the state’s instructions for reducing countable resources and documenting lawful transfers. After eligibility, the community spouse’s retained resources are generally not deemed available during continuous institutionalization, but changes still must be reported.
These examples show the structure of the calculations, not an eligibility result. A state worksheet, not a generalized online estimate, controls a real case.
Common mistakes that cause delays or disputes
- Using outdated figures. The 2026 standards have different effective dates for resources and income. Older CMS text may show 2016 amounts.
- Treating the maximum as an entitlement. The maximum resource standard and maximum MMMNA are limits in the federal framework, not guaranteed household payments.
- Mixing resources and income. A protected resource allowance does not determine the monthly income contribution.
- Ignoring the eligibility month. The post-eligibility resource rule is tied to the month eligibility is determined and the continuing institutional period.
- Assuming nursing-facility and HCBS rules match. Waiver and state-plan programs can use different disregards and procedures.
- Failing to preserve records. Missing statements, shelter receipts or ownership documents can make a correct allowance difficult to prove.
- Waiting past an appeal deadline. A disagreement should be raised using the deadline and filing method in the state notice.
Where to get case-specific help
Start with the state Medicaid agency and request the current spousal-impoverishment worksheet or calculation explanation for the exact program. A qualified elder-law attorney or benefits counselor can be useful when ownership is complicated, a home-equity issue is disputed, exceptional expenses create financial duress, or the agency’s notice appears inconsistent with the statute.
Bring the written determination, account records, property documents, income statements and shelter-cost proof to any consultation. Ask specifically whether the issue concerns the resource allowance, the income allowance, post-eligibility contribution, an HCBS rule or an appeal deadline; those are separate questions with different remedies.
