Usually, severance paid after you claim Social Security retirement benefits does not count against the retirement earnings test when it is compensation for work completed before you stopped working. Social Security calls this a “special payment” and specifically lists severance as an example. The key question is not the payment date or the label in the agreement; it is whether the last task required to earn the payment was completed before your work ended.

Severance can still require review when payment depends on continued work, post-termination services, a release of an unexpired employment contract, or another condition. Wages and net self-employment income from other work remain subject to the earnings test while you are below full retirement age.

What the earnings test is—and where severance fits

The Social Security retirement earnings test can reduce current retirement benefits when a beneficiary works before reaching full retirement age (FRA). For retirement beneficiaries below FRA, Social Security generally counts wages, net earnings from self-employment, or both. Starting with the month you reach FRA, there is no earnings limit for retirement benefits.

Severance is treated differently when it is a special payment for earlier work. Social Security’s reader guidance says that payments received after retirement usually do not affect benefits when they are for work done before retirement. Its special-payments guidance says qualifying payments are excluded from the annual earnings limit.

That exclusion applies to the qualifying payment, not automatically to every dollar received after you claim benefits. If you receive severance plus wages from a new job, consulting income, or net self-employment income, those other earnings can still trigger withholding.

The controlling test: when was the payment earned?

Employee severance

For an employee, Social Security’s practical rule is that the last task performed to earn the payment must have been completed before you stopped working. If your employment ended on June 30 and the severance was earned solely because you completed the required work through that date, a payment made in July or later can qualify as a special payment.

Severance paid on account of retirement is identified by Social Security as a common special wage payment on Form SSA-131. The form is designed for an employer to explain special wage payments and when they were earned. The fact that an employer issues a Form W-2 in the year you receive the money does not, by itself, make the payment countable in that later year under the earnings test.

The label is not decisive

An agreement calling a payment “severance” is useful evidence, but the substance of the arrangement matters. Read the payment clause and identify every condition. A payment that is earned entirely through prior service is different from a payment that requires you to remain available, perform consulting work, train a replacement, or complete another task after your separation.

A step-by-step way to analyze your payment

  1. Identify your employment end date. Use the date on which you actually stopped working, not necessarily the date the employer approved or mailed the severance.
  2. Read the severance agreement. Note whether the payment is based on completed service, years of employment, unused leave, a retirement event, a release, confidentiality obligations, continued availability, or future services.
  3. Find the last task needed to earn the money. Ask what you had to do before the employer became obligated to pay. If that last task was completed before work stopped, the payment may be a special payment.
  4. Separate post-separation obligations. Determine whether any work or substantial service after termination is a condition of receiving or retaining the payment.
  5. Separate the payment from other earnings. List wages, bonuses for new work, commissions, and net self-employment income earned after you claimed benefits. Analyze those amounts under the ordinary earnings test.
  6. Collect employer documentation. Ask whether the employer can complete Form SSA-131 and explain the payment’s amount, nature, and earning period.
  7. Tell Social Security if necessary. Social Security may not know that reported earnings are special payments. Provide the agreement and employer explanation if the agency asks, or if the payment appears to have been counted incorrectly.

Common payments and their likely treatment

Payment or situation How Social Security guidance treats it What determines the result
Severance for work completed before employment ended Generally a special payment excluded from the annual earnings limit The last task required to earn it was completed before work stopped
Payment made after retirement for earlier work Usually does not affect retirement benefits The payment relates to work performed before retirement
Accumulated vacation or sick pay Listed by Social Security as an example of a special payment It was earned before you stopped working
Back pay, standby pay, commissions, or deferred compensation earned earlier Can be special payments The earning period and final required task occurred before work stopped
Severance requiring continued work or post-termination services Not resolved by the general severance example alone The agreement and facts must be reviewed
Wages from a new job after claiming benefits Ordinary earnings-test income Your age, the applicable annual limit, and when the wages were earned
Net self-employment income after claiming benefits Ordinary earnings-test income Net earnings and, in some cases, whether you performed substantial services

Installments, releases, and other conditions

Severance is often paid in installments. Installments do not automatically become countable merely because they arrive in later months or years. The central issue remains what you had to do to earn them. If the installments are simply the employer’s payment schedule for a benefit earned before separation, the special-payment analysis may continue to apply.

Conditions can make the analysis less certain. For example, an agreement may require continued employment through a transition date, consulting after termination, or compliance with a condition that involves services rather than only a promise. In those circumstances, identify the precise event that makes each installment payable. The available Social Security guidance gives a general timing and work-completion standard, not a separate ruling for every contract design.

Social Security’s Handbook separately lists payments made to secure release of an unexpired contract of employment among items that do not count under the earnings test. That is a distinct category. Do not automatically treat an ordinary severance payment as a contract-release payment, or assume that the existence of a release clause resolves the entire question.

Your age and the year you claim matter

Below full retirement age for the entire year

If you are below FRA for the whole year, Social Security deducts $1 in benefits for every $2 of earnings above the applicable annual exempt amount. The annual amount changes by year, so use the limit for the specific calendar year rather than an old figure. A qualifying special severance payment is excluded from that calculation; countable wages and net self-employment earnings are not.

In the year you reach full retirement age

A different earnings limit and calculation apply to earnings received before the month you reach FRA. Once that month begins, the earnings test stops applying. A severance payment still must be analyzed under the special-payment rules; reaching FRA does not turn a payment that was earned through post-termination work into an earlier-work payment.

At or above full retirement age

Beginning with the month you reach FRA, you can receive retirement benefits without an earnings limit. This removes the retirement earnings test for subsequent earnings, but it does not eliminate the need to report facts accurately if Social Security is reviewing an earlier period.

The first-year monthly rule

If you claim benefits partway through a calendar year, Social Security has a special monthly earnings rule. It can allow full benefits for whole months in which the agency considers you retired, even if your total annual earnings are high. This rule concerns earnings in particular months and, for self-employed people, whether they performed substantial services. It is not a rule that classifies severance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For 2026, Social Security states a monthly limit of $2,040 for a person who is under FRA throughout the year and $5,430 for a person who reaches FRA during 2026. These are 2026 figures and should be checked against Social Security’s current-year announcement before relying on them. A payment that is excluded as a special severance payment does not become countable merely because it was deposited during a month covered by this rule.

How other earnings can cause withholding

Suppose you receive a qualifying severance payment after leaving work, then earn wages from a new employer. The severance may be excluded, while the new wages are tested under the annual rule that applies to your age and calendar year. The same separation applies when you have net self-employment income.

For an illustration using the under-FRA-all-year formula, if countable earnings are $4,000 above the applicable annual limit, the statutory reduction would be $2,000 because $1 is withheld for each $2 over the limit. The example does not establish the annual limit for any particular year; it shows how the ratio works after Social Security determines which income is countable.

Social Security can withhold benefits during the year while it determines the final earnings amount. A later reconciliation may change the number of months or dollars withheld. Do not assume that a qualifying severance payment must be repaid simply because it appears on a later-year tax form.

Reporting the payment to Social Security

Social Security says it may not know that reported earnings are special payments unless you provide that information. The agency may contact you for details. Form SSA-131 is the employer’s report of special wage payments and can help establish what the payment was for and when it was earned.

Documents to keep

  • The separation notice showing your final day worked.
  • The complete severance agreement and any amendments.
  • Payroll statements showing payment dates and amounts.
  • A description of services, if any, required after termination.
  • The employer’s Form SSA-131, when available.
  • W-2 forms and records of any other wages or self-employment income in the same year.

When you contact Social Security, describe the payment in factual terms: the employment end date, the work period that produced the payment, the date of the last required task, and any post-separation conditions. Avoid relying only on the word “severance.”

If Social Security counted the severance as earnings

  1. Ask what income was included. Confirm whether the agency counted the severance, other wages, self-employment income, or a combination.
  2. Explain the special-payment basis. Provide the agreement and identify the work completed before separation.
  3. Request employer confirmation. An SSA-131 or a detailed employer letter can clarify the earning period and payment type.
  4. Check the calculation after correction. Make sure the agency removed only the qualifying special payment and continued to apply the earnings test to genuinely countable income.
  5. Keep the determination and correspondence. They establish how Social Security handled your facts if a later review occurs.

The sources do not establish a single outcome for every severance agreement. If the payment depends on disputed services, a contract release, or unusual conditions, the agency’s determination will depend on the documents and facts.

What happens to benefits withheld before FRA?

Earnings-test withholding is not simply a permanent dollar-for-dollar forfeiture. Social Security explains that when you reach FRA, it adjusts the reduction factor to account for months in which benefits were withheld because of the earnings test. The adjustment is applied to the benefit calculation rather than paid automatically as a lump-sum refund.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Your earnings record is also reviewed under the normal benefit-computation rules. Additional earnings can increase your monthly benefit if they replace a lower year in the calculation. That separate earnings-record review does not change whether a particular severance payment qualifies as a special payment.

Worked scenarios

Severance paid after a clean separation

You stop working on June 30. The agreement pays six weeks of severance based on your completed service, with no work required after June 30. The employer pays in July and August. The delayed payment date does not by itself make the severance countable. Its treatment depends on the documented fact that the last task needed to earn it was completed before you stopped working.

Severance plus a new job

You receive the same type of qualifying severance, then begin a part-time job in September. The severance and September wages are analyzed separately. The severance may be excluded as a special payment, while the wages are countable earnings for the months and year covered by the earnings test.

Installments tied to post-termination work

An agreement pays the first installment at separation but makes later installments contingent on training a replacement for three months. The first installment and later installments may not have the same treatment because the later payments depend on post-separation services. The contract language and evidence of what was actually done become essential.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common mistakes to avoid

  • Using the deposit date as the only test. A later payment date does not decide whether earlier work earned the money.
  • Assuming every severance payment is exempt. The exclusion is for qualifying special payments, not every payment carrying the severance label.
  • Ignoring other work. Wages and net self-employment income can still reduce benefits below FRA.
  • Using an outdated earnings limit. Annual limits change, and the year you reach FRA has a different calculation.
  • Failing to tell Social Security. The agency may not recognize a special payment from payroll reporting alone.
  • Expecting a lump-sum refund at FRA. Social Security adjusts the reduction factor for affected months instead.
  • Confusing tax treatment with earnings-test treatment. A payment’s appearance on a W-2 does not by itself answer when it was earned for Social Security purposes.

Practical decision checklist

Before assuming your severance is excluded, answer these questions in writing:

  • What was your exact last day of work?
  • What service or event earned the payment?
  • What was the last task required before the employer owed you the money?
  • Was any work, availability, or substantial service required after termination?
  • Are you below FRA, in the year you reach FRA, or already at or above FRA?
  • Did you receive wages or net self-employment income in addition to severance?
  • Can the employer complete Form SSA-131 or provide an equivalent explanation?
  • Have you given Social Security the documents needed to distinguish the special payment from countable earnings?

If the answers show that the payment was earned entirely through work completed before you stopped working, it generally fits Social Security’s special-payment treatment. If the agreement ties payment to later services or another unresolved condition, do not rely on the label alone; submit the facts and let Social Security evaluate the arrangement.
