How Social Security Survivor Benefits Work After Remarriage and Multiple Marriages

Short answer: Remarrying before age 60 usually stops aged survivor benefits on an earlier deceased spouse’s record while the new marriage continues. Remarrying at 60 or later generally preserves eligibility on the earlier record. A narrow exception can protect a disabled widow(er) or disabled surviving divorced spouse who remarries after 50 and after becoming disabled. With multiple marriages, Social Security reviews each deceased spouse’s record separately, then pays the highest amount for which you qualify.

The basic remarriage rule

Social Security survivor benefits are tied to a deceased worker’s earnings record. Your marital status at the time you claim—and your age when a later marriage began—can determine whether a previous record remains available.

When the later marriage began Typical effect on an earlier survivor record Important qualification
Before age 50 Generally blocks survivor benefits while the later marriage continues. If the later marriage ends, eligibility may return from the month it ended if every other requirement is met.
Age 50–59 Generally blocks aged survivor benefits before age 60. A disability exception may apply when the person remarried after age 50 and was already disabled at the time.
Age 60 or later Generally does not prevent benefits on a prior deceased spouse’s record. Other survivor-eligibility rules still apply.

These are general U.S. rules, not an automatic award. The Social Security Administration (SSA) must verify the dates, relationship, work record and any disability facts in your case.

Why age at remarriage matters

For an aged widow(er) or surviving divorced spouse, the key age is usually 60. A person who marries again before 60 normally cannot receive survivor benefits on an earlier deceased spouse’s record during the later marriage. The restriction applies even if the new spouse has a modest earnings record or the earlier survivor benefit would be larger.

Remarriage at 60 or later is treated differently. A qualifying survivor can generally marry again and still claim on the earlier deceased spouse’s record. The rule concerns the age when the remarriage occurred, not simply the age when you later file an application. Keep documentation showing the marriage date because SSA may need it to establish which rule applies.

If the later marriage ends

A later marriage that ended through divorce, annulment or death can change the analysis. When a marriage that began before age 60 ends, a person may become eligible—or eligible again—on the earlier deceased spouse’s record beginning with the month the later marriage ended, provided all other requirements are satisfied. SSA will check the exact ending date and whether the earlier record otherwise qualifies.

Do not assume that a short second marriage automatically restores payment. The agency still evaluates age, relationship, filing date, the deceased worker’s insured status and any other conditions that apply to the particular survivor category.

The disability exception after age 50

Disability creates a narrow exception to the usual before-60 rule. A disabled widow(er) or disabled surviving divorced spouse may qualify when the remarriage happened after age 50 and after the person became disabled. Both timing conditions matter:

  • The remarriage must have occurred after the claimant’s 50th birthday.
  • The claimant must have become disabled before that remarriage (or otherwise meet SSA’s required disability timing).
  • The claimant must satisfy the applicable disabled-survivor rules in addition to the remarriage test.

“Remarried after 50” alone is not enough. Someone who married again at 52 but did not become disabled until 55 cannot rely on the exception merely because the remarriage occurred after 50. Because disability onset and SSA’s definition of disability can be decisive, provide medical or adjudication records when you call.

Rules for a surviving divorced spouse

A surviving divorced spouse may claim on a deceased former spouse’s record, but the marriage-duration test is separate from the remarriage test. Generally, the claimant must have been married to the deceased worker for at least 10 years immediately before the divorce became final. The claimant must also meet the applicable age or disability and marital-status conditions.

The deceased former spouse’s own later remarriage does not, by itself, eliminate the surviving divorced spouse’s possible claim. The relevant questions are whether your marriage to the worker lasted long enough, whether the divorce was final, whether the worker died, and whether you meet the survivor category’s age or disability requirements.

For multiple former spouses, calculate the 10-year period for each marriage independently. A 10-year marriage to one deceased former spouse does not cure a nine-year marriage to another.

How multiple marriages are evaluated

There is no single “multiple-marriage” benefit. SSA reviews each potentially relevant deceased spouse’s earnings record as its own claim. Build a timeline before applying:

  1. List every marriage start date and, where applicable, the date each divorce became final.
  2. Record each spouse’s date of death and whether that person was a current spouse or former spouse when they died.
  3. Write down your age on every remarriage date.
  4. Note when any disability began and whether SSA has made a disability determination.
  5. Identify whether a later marriage is still active or exactly when it ended.
  6. Record your birth date, current age, and any retirement or disability benefit you already receive.

SSA then determines which records support entitlement and which payment is payable. More than one deceased spouse may be relevant to eligibility, but you do not simply add multiple survivor checks together.

Current spouse versus former spouse

If the deceased person was your spouse when they died, SSA examines the surviving-spouse rules. If the deceased person was an ex-spouse, the surviving-divorced-spouse rules apply, including the general 10-year marriage requirement. Keep the two categories separate when describing your history to SSA; using “ex” and “spouse” interchangeably can create confusion about which test applies.

When two records appear to qualify

Ask SSA to compare both records rather than choosing one informally. The agency can determine whether each record is legally available, calculate the payable amount and explain whether a filing date affects one or both claims. The answer depends on your complete timeline, not just on the largest benefit estimate shown in a prior statement.

How much a survivor can receive

SSA’s 2026 guidance says survivor benefits generally range from 71.5% to 100% of the deceased spouse’s benefit, depending on the survivor’s age when applying. The range is not a promise that every claimant will receive either endpoint. The calculation also depends on the deceased worker’s benefit, the survivor category and the age-based reduction rules.

The survivor full retirement age is between 66 and 67, depending on birth year. Claiming before that age can reduce the monthly amount; waiting until the applicable survivor full retirement age can produce up to the full eligible amount under the rules. Ask SSA for an age-specific estimate instead of applying a generic percentage to a past statement.

Your own retirement benefit

If you qualify for a benefit on your own work record and a survivor benefit, Social Security does not pay both full amounts added together. The agency pays the higher eligible amount under its coordination rules. In some circumstances a person can receive one type first and later switch, but the best sequence depends on age, reductions and the size of each record. Have SSA compare the options before filing.

Applying in 2026

SSA’s 2026 instructions say survivor benefits cannot be applied for online. Call SSA to start a monthly survivor-benefit claim and to ask about the one-time death payment. A representative can tell you which documents are needed and schedule any follow-up.

Documents and facts to gather

  • Your birth certificate or other proof of birth accepted by SSA.
  • Marriage certificates for each relevant marriage.
  • Final divorce decrees, including the date each divorce became final.
  • The deceased spouse’s death certificate or funeral-home information, if available.
  • Your Social Security number and the deceased worker’s number, if known.
  • Disability onset information and SSA determination notices, if you are relying on the disability exception.
  • Details of any current retirement, disability or survivor payments.
  • Bank information and tax-withholding choices requested during the application.

Do not delay a call while trying to locate every paper. Tell SSA what you have; the agency can explain which records it can verify and what must be supplied.

The $255 death payment

SSA identifies a one-time $255 lump-sum death payment. It is subject to its own eligibility rules and is not an extra monthly survivor benefit. Ask about it when reporting the death or applying for monthly benefits because the payment has different qualifying conditions and timing requirements.

Worked examples

Remarriage at 58, then divorce at 62

Suppose a widow remarried at 58 and could otherwise claim on her first husband’s record. While the second marriage continued, the before-60 remarriage rule generally blocked aged survivor payments on the first record. If the second marriage ended at 62, she may become eligible from the month it ended, assuming she still meets the other requirements. SSA must confirm the dates and payable amount.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Remarriage at 61

A survivor who married again at 61 generally keeps the possibility of claiming on the first deceased spouse’s record. The survivor still must meet the applicable relationship, age and filing rules, and the amount may be reduced if claimed before the relevant survivor full retirement age.

Disabled surviving divorced spouse who remarried at 53

A divorced survivor married the deceased worker for 12 years, became disabled at 51 and remarried at 53. The 10-year marriage condition is met, and the after-50, after-disability timing may fit the narrow exception. SSA must still establish the disability and every other requirement; the facts do not create an automatic award.

Common mistakes that delay or reduce a claim

  • Using 60 as a universal rule. The disability exception uses age 50, but only when the disability timing also qualifies.
  • Ignoring the month a later marriage ended. Re-entitlement can begin in that month, so keep the official termination date.
  • Assuming an ex-spouse’s remarriage cancels your claim. The former spouse’s later marriage does not itself bar a qualifying surviving divorced spouse.
  • Counting years incorrectly. The divorced-survivor test generally requires at least 10 years immediately before the divorce became final.
  • Expecting two full checks. SSA coordinates your own benefit and survivor benefit rather than adding both full amounts.
  • Applying only online. SSA’s 2026 guidance directs survivor applicants to call.
  • Quoting a percentage without your age. The 71.5%–100% range changes with application age and does not replace an SSA calculation.

A practical decision checklist

  1. Separate current-spouse and former-spouse records.
  2. For every deceased spouse, verify the marriage length, divorce-final date (if any) and death date.
  3. Mark your age at each remarriage and whether that marriage is still active.
  4. Document disability onset before relying on the after-50 exception.
  5. Estimate your age at filing and survivor full retirement age based on your birth year.
  6. Compare any benefit on your own record with each possible survivor amount.
  7. Call SSA, report all marriages—not only the one you think will pay—and request a record-by-record determination.

The safest approach is complete disclosure of the timeline. A remarriage that blocks one record may not affect another, and a marriage that initially blocks benefits may later end and reopen eligibility. Only SSA can make the binding determination and calculate the amount payable under your facts.
