How Overseas Investment Limits and Remittance Rules Affect Indian Investors (2026 Guide)

For an individual resident in India under FEMA, the Liberalised Remittance Scheme (LRS) permits up to USD 250,000 in total outward remittances during one financial year (April–March). That is a shared ceiling for permitted current- and capital-account transactions, not a separate overseas-investing allowance. An overseas share purchase, foreign bank-account funding, travel payment, education expense, gift and other eligible remittances all draw from the same annual capacity.

Staying below USD 250,000 does not by itself make an investment lawful. You must also satisfy the Foreign Exchange Management Act (FEMA), the Overseas Investment Rules, Regulations and Directions, bank documentation requirements, tax-collection rules and any platform-authorisation conditions. The practical result is a two-part test: is the remittance within your remaining LRS capacity, and is the underlying transaction permitted?

What the USD 250,000 LRS limit actually covers

The Reserve Bank of India (RBI) describes LRS as an annual facility for a resident individual, including a minor, to remit up to USD 250,000 per financial year (April–March) for permitted current-account and capital-account transactions. A minor’s declaration must be countersigned by a guardian. PAN is required for LRS transactions made through an authorised person.

The ceiling is cumulative. It is not USD 250,000 for investing plus another USD 250,000 for travel or gifts. If you remit USD 40,000 for education, USD 10,000 for a gift and USD 75,000 to fund an overseas investment, your aggregate use is USD 125,000 and your remaining capacity for that financial year is USD 125,000, subject to the transactions being permitted.

RBI permits remittances at any frequency as long as the aggregate remains within the annual cap. The amount is measured across the financial year, not the calendar year. Investment proceeds brought back to India do not restore LRS capacity already used during that same financial year.

Who can use LRS

  • Eligible resident individuals under FEMA, including minors through a guardian, may use LRS.
  • Companies, partnership firms, Hindu Undivided Families, trusts and similar non-individual entities cannot use the individual LRS facility.
  • FEMA residence is a separate determination from income-tax residence. Do not assume that an Indian tax-residency conclusion automatically answers the FEMA question, or vice versa.

The remitter remains responsible for FEMA compliance even when an authorised dealer bank processes the transfer. The bank’s acceptance of a form is not a blanket legal opinion on the investment.

Does the LRS limit include overseas share investments?

Yes. A permitted overseas share or fund investment funded from India normally consumes the same shared LRS capacity as other eligible remittances. The USD 250,000 figure should therefore be treated as a planning ceiling for all of your eligible outward transfers in that April–March period.

However, LRS capacity is only one gate. India’s overseas-investment framework is set out principally in the Foreign Exchange Management (Overseas Investment) Rules, Regulations and Directions, 2022. Those instruments determine whether the proposed investment route, instrument, entity and ownership structure are allowed. An unused LRS balance does not authorise every foreign asset a resident may wish to buy.

Two checks before committing money

  1. Check the investment route. Confirm that the overseas entity, security, fund interest, account or other asset fits the applicable 2022 overseas-investment framework and any conditions attached to it.
  2. Check the remittance balance. Add every LRS remittance made or planned in the current April–March year, including non-investment transfers, and compare the total with USD 250,000.

If either test fails, changing the transfer description or splitting the payment does not cure the problem.

Transactions that are not allowed just because you have room left

RBI’s LRS guidance excludes remittances for margins or margin calls to overseas exchanges or overseas counterparties for online forex trading. The scheme is limited to permitted transactions; it does not override other FEMA prohibitions.

“All other transactions which are otherwise not permissible under FEMA and those in the nature of remittance for margins or margin calls to overseas exchanges / overseas counterparty are not allowed under the Scheme.”

— RBI FAQ, updated 28 August 2024

Do not infer that a trading website is authorised merely because it does not appear on RBI’s Alert List. RBI says the list is non-exhaustive, so absence from it is not proof of authorisation. Verify an intermediary or electronic trading platform against RBI’s information on authorised persons and authorised electronic trading platforms before sending funds.

Can spouses or other family members combine their LRS limits?

Family members may aggregate remittances, but each person must independently comply with LRS. For a capital-account transaction—such as an overseas bank account or investment—family members cannot simply contribute from their separate limits to an asset held only by one person. The contributors must be co-owners or co-partners in the account or investment under the applicable RBI conditions.

Example: permitted co-ownership structure

A married couple each has unused LRS capacity. They plan an overseas investment held jointly, and the bank’s documentation records both as owners. Subject to the investment being permitted and each person completing the required declarations, their remittances may be aggregated for that jointly held asset.

Example: impermissible pooling

If one spouse sends funds from the other spouse’s LRS capacity into an investment registered solely in the first spouse’s name, the co-ownership condition is not met. The fact that the household’s combined amount is below USD 250,000 does not solve that ownership mismatch.

This condition applies specifically to capital-asset arrangements. It should not be read as a ban on every family-member remittance consolidation, nor as permission to disguise a single-owner investment as a family transaction.

How to prepare an overseas-investment remittance

Exact forms, purpose codes and evidence depend on the transaction and the authorised dealer. Use this sequence to reduce avoidable rejections and later documentation gaps.

  1. Establish status. Confirm that you are a resident individual under FEMA and identify whether any co-remitters are also eligible individuals. Keep the relevant identity and PAN details ready; a guardian must countersign for a minor.
  2. Describe the transaction accurately. Tell the bank whether the transfer is for an investment, account funding, education, maintenance, gift or another purpose. Do not select a convenient code that does not match the real transaction.
  3. Test the investment under the 2022 framework. Ask what evidence the bank needs to establish that the overseas entity or instrument is permitted and that any ownership, valuation or reporting conditions are met.
  4. Calculate the annual total. Include all LRS remittances already made in the April–March year and the proposed transfer. Keep a running schedule in both the foreign-currency amount and the rupee amount used by the bank.
  5. Ask for the live cost and tax treatment. Before authorising the transfer, obtain the applicable conversion rate or spread, transfer charge, intermediary-bank fee policy and tax-collected-at-source (TCS) treatment for that specific purpose.
  6. Submit declarations and records. Provide PAN, the bank’s LRS declaration and supporting documents. Retain the submitted forms, bank acknowledgement, conversion advice and final remittance confirmation.
  7. Reconcile after settlement. Match the bank confirmation with the broker, fund, custodian or overseas-bank statement. Record the date, amount, ownership percentage, asset acquired and all charges.

RBI materials establish the annual cap and the remitter’s responsibility, but they do not set one universal bank fee, exchange-rate spread or processing time. Those are provider- and transaction-specific questions.

Costs: TCS, conversion and intermediary charges

TCS is not a single universal percentage for every LRS transfer. The applicable rate and threshold can vary with the remittance purpose and can change through legislation or notifications. Confirm the live rule with the authorised dealer or a tax adviser immediately before transfer, especially when a financial year or assessment year has changed.

Ask the bank to show separately:

  • the rupee-to-foreign-currency conversion rate and any spread;
  • the bank’s outward-remittance fee;
  • possible correspondent or intermediary-bank deductions;
  • the TCS amount, threshold applied and challan or certificate information; and
  • the foreign recipient’s expected net amount.

A TCS collection at the time of remittance is not automatically the final income-tax cost. Its treatment in your tax return depends on the applicable law and your facts.

Foreign-asset and foreign-income reporting after the transfer

Whether the original remittance was permitted under FEMA and whether the resulting asset or income must be reported for Indian income-tax purposes are separate questions. Income Tax Department guidance on the Foreign Assets (FA), Foreign Source Income (FSI) and tax-relief (TR) schedules describes disclosures for relevant resident taxpayers, including foreign accounts, interests in foreign entities and foreign-source income.

Do not assume that every investor files the same schedule. The required disclosure depends on tax status, the return form, the assessment year and the nature of the asset or income. Check the current assessment-year instructions or obtain advice from a professional familiar with foreign-asset reporting.

Records to keep from day one

  • LRS declarations, remittance instructions and bank confirmations;
  • the exchange-rate advice, fee statement and TCS evidence;
  • broker or custodian account-opening documents and ownership records;
  • purchase, sale and transfer confirmations;
  • dividend, interest, distribution and foreign-tax statements; and
  • year-end statements showing balances, holdings and acquisition cost.

Keep dates and amounts consistent across bank records, overseas statements and your tax files. These records help establish ownership, acquisition cost, income, foreign tax paid and the date on which each LRS amount was used.

Planning examples

Investment after other remittances

Suppose you have already remitted USD 60,000 for education and USD 25,000 for travel during the financial year. Your proposed investment remittance is USD 150,000. The aggregate would be USD 235,000, leaving USD 15,000 of LRS capacity, assuming every transaction is otherwise permitted and the bank’s currency conversion does not create an amount that takes you over the cap.

Several investments through the year

You make three permitted investment remittances of USD 80,000, USD 70,000 and USD 100,000. The total is USD 250,000. A later return of USD 20,000 from selling one investment does not create another USD 20,000 of LRS room in that same financial year. You must wait for the next April–March limit or use another lawful route that does not rely on an impermissible workaround.

Family-funded single-owner asset

Two family members each remit USD 50,000, but the overseas account is held only by one of them. The amount may be below the household’s combined annual capacity, yet the capital-transaction co-ownership condition is not satisfied. Ownership and funding must be aligned before the transfer is made.

Common mistakes and how to prevent them

  • Treating USD 250,000 as an investment-only allowance: maintain one April–March ledger for all LRS purposes.
  • Assuming the bank’s approval proves legality: separately test the investment under FEMA and the overseas-investment framework.
  • Pooling family limits without shared ownership: document co-ownership or co-partnership for the capital asset.
  • Using an online forex platform because it is not on an alert list: verify positive authorisation; a non-listed entity is not automatically authorised.
  • Ignoring the tax-residence distinction: determine FEMA status and income-tax status under their respective rules.
  • Waiting until filing season to reconstruct records: save confirmations, statements and tax documents when each transfer and income event occurs.
  • Applying an old TCS rate: request the current purpose-specific rate and threshold immediately before remitting.

A decision checklist before you send money

  1. Am I a resident individual under FEMA, and is a guardian involved if the remitter is a minor?
  2. What is my cumulative LRS usage from 1 April through today, including non-investment transfers?
  3. Is this overseas asset or investment permitted under the current FEMA overseas-investment rules?
  4. If family money is involved, are every contributor and the account or asset’s owners aligned?
  5. Is the intermediary or electronic platform authorised, rather than merely absent from an alert list?
  6. What purpose code, declaration and supporting documents does my authorised dealer require?
  7. What are the current conversion, bank and intermediary charges?
  8. What TCS rate and threshold apply to this exact purpose today?
  9. Which foreign-asset, foreign-income and tax-relief records may be required for my assessment year?

The central discipline is to treat LRS as a shared annual capacity inside a wider compliance framework. Calculate the cap, validate the investment, document ownership, verify the platform and preserve records before the transfer—not after a problem appears.
