How moving out of Washington affects your high-earner tax liability

Moving out of Washington before a stock sale can change which state taxes the gain, but an announced move is not enough. Washington generally continues to treat an established domicile as continuing until you prove both physical presence in a new permanent home and intent to make it your domicile. A sale while you are still domiciled in Washington can leave covered long-term gains subject to Washington’s 7% capital-gains tax; a sale after a well-documented domicile change may be allocated differently, while the destination state’s rules still apply.

The key question is your domicile on the income date

Washington’s tax analysis starts with domicile, not with the date you signed a lease, listed a house, or told your employer that you were relocating. Domicile means a residence in fact combined with intent to make that place a permanent home. Once Washington domicile is established, it is presumed to continue. The former resident bears the burden of proving that the change actually occurred.

The Washington Department of Revenue administrative rule says that, to establish a new domicile, you must be physically present at the new place of intended domicile and intend to make it your permanent home. The Department evaluates the facts as a whole rather than relying on one document. Relevant evidence includes:

  • How much time you spend in Washington and in the new state.
  • Statements or other evidence showing where you intend to live permanently.
  • The location of your business or employment and where you perform services.
  • Bank, brokerage, federal-tax and state-tax addresses.
  • Leases, deeds, utility records and the location of real and personal property.
  • Driver’s-license, voter-registration and mailing-address changes.

Selling your Washington home or signing a new lease can support a move, but neither event is conclusive by itself. A transition-year travel calendar is especially important because a disputed sale date can turn on where you were actually living and what your conduct showed at that time.

The 183-day rule can create residency even without Washington domicile

Washington’s resident definition also reaches a person who is not domiciled in the state but maintains a place of abode there and is physically present in Washington for more than 183 days. That person is treated as a Washington resident for the portion of the year in which the statutory test is met.

If you claim a new domicile during a year in which you continue to use a Washington home, count your Washington days precisely. Include travel calendars, calendar entries, lodging records and work schedules that can corroborate the count. Do not rely on an estimate made after the year ends.

How the move affects stock and other capital gains

Washington’s capital-gains regime applies to Washington capital gains. For intangible personal property—such as publicly traded stock, bonds and many business interests—the enacted allocation rule generally assigns long-term gains to Washington when the seller was domiciled in Washington when the sale or exchange occurred.

That makes the timing and validity of the domicile change central:

Sale situation Primary issue Planning implication
Sale while still domiciled in Washington Washington domicile exists on the sale or exchange date. Covered Washington long-term gain is generally within the Washington capital-gains calculation, subject to the deduction and statutory exemptions.
Sale after a bona fide domicile change Whether the new permanent home and intent are documented before the sale. The gain may be allocated under the new state’s rules instead of Washington’s domicile-based rule, but the destination state can impose its own tax.
Sale during a disputed transition year Competing evidence about days, homes, addresses, work and intent. Expect a fact-intensive position; preserve contemporaneous records and obtain state-tax advice before choosing the sale date.

Moving cash between banks, changing the address on a brokerage account or announcing that you plan to leave does not, by itself, change the domicile on the date of sale. For complex transactions, review the asset type, the contract and closing date, any option-exercise date, and whether payments will be received under an installment arrangement. Those details can affect both the relevant income date and the state-sourcing analysis.

Washington’s current capital-gains figures

The Department of Revenue describes a 7% tax on covered Washington long-term capital gains. Its current guidance lists a $278,000 standard deduction for tax year 2025, along with additional statutory exemptions and deductions. The deduction and other thresholds must be checked for the tax year in which your gain is recognized; do not carry the 2025 amount into a later return without verification.

Moving may replace Washington tax with destination-state tax

A relocation is not automatically a tax elimination strategy. The state where you establish your new domicile may tax capital gains under its own resident or source-income rules. Compare that state’s treatment of long-term gains, its rates and exemptions, and its residency tests before moving the sale date.

Washington law provides a nonrefundable credit for qualifying income or excise tax legally imposed by another jurisdiction on capital gains derived from assets in that jurisdiction. The credit is limited to the lesser of the Washington tax attributable to those assets or the tax paid elsewhere. Unused credit cannot be carried back or carried forward. The credit therefore reduces double taxation in qualifying cases; it is not a blanket exemption for every gain realized after a move.

Salary, bonuses and equity compensation follow where services occur

Leaving Washington does not erase Washington tax on compensation for work physically performed in Washington. Under RCW 82A.04.430, a nonresident is subject to Washington tax on the portion of compensation derived from employment within Washington, regardless of where the employer’s commercial headquarters are located.

When services are performed in multiple states, compensation is generally apportioned by Washington workdays or another reasonable method approved by the Department. Keep a contemporaneous calendar showing the state in which each workday occurred, including travel and remote-work days, and reconcile it to payroll and employer records.

Executives and employees receiving restricted stock, stock options or other equity need a separate review of grant, vesting, exercise and sale facts. The clear sourcing principle is the location of the services that generated the compensation; the tax treatment can differ from the treatment of an investment gain on stock you already owned. Ask the employer how it will source wages and equity on the year-end wage statement, and correct the allocation if the records do not match your work locations.

The 2028 high-income tax changes the forward-looking calculation

Washington enacted a 9.9% tax on individuals and married couples filing jointly whose annual adjusted gross income exceeds $1 million, beginning January 1, 2028. The Department of Revenue’s income-tax FAQ says calculation, filing and implementation guidance is still being developed.

For a move planned for 2028 or later, model the year under both Washington’s final rules and the destination state’s income-tax rules. Verify the final definition of adjusted gross income, the filing mechanics, effective-date provisions and any legislative or litigation changes before relying on a projected savings figure. A relocation completed in 2027 does not automatically determine how income recognized in 2028 will be treated if Washington still considers you domiciled there or if you continue performing services in the state.

A practical relocation-and-sale checklist

  1. Set the intended domicile before the transaction. Identify the date you will be physically living in the new permanent home and the facts that demonstrate intent.
  2. Reduce conflicting Washington connections. Update your driver’s license, voter registration, mailing and tax addresses, banking information, employment records and insurance where appropriate. Document what happens to any Washington residence.
  3. Track every day. Keep a day-by-day calendar for the transition year, supported by travel, lodging, utility and work records. Monitor the 183-day test if you retain a Washington place of abode.
  4. Map each income item. Separate investment gains from wages, bonuses, carried compensation and equity awards. Record grant, vest, exercise, sale, closing and payment dates.
  5. Analyze both states. Determine whether the destination state taxes you as a resident, whether it sources any gain or compensation to that state, and whether Washington’s statutory credit could apply.
  6. Coordinate payroll and estimated payments. Give the employer accurate work-location information and plan for the state returns and payments that follow from the final allocation.
  7. Preserve transaction evidence. Retain trade confirmations, closing statements, brokerage statements, option records, grant and vesting notices, leases, deeds, utility bills and address-change confirmations.
  8. Obtain advice before an irreversible date. A high-value sale, option exercise or installment agreement can create a tax result that cannot be fixed by changing an address afterward.

Filing and documentation requirements

Washington capital-gains returns generally track the federal filing deadline. An extension gives additional time to file, not additional time to pay. Keep the federal return, transaction statements and the allocation workpapers together so the figures on the Washington return can be traced to the sale and to your domicile evidence.

For a former resident, the strongest file usually combines objective records rather than relying on a declaration of intent. Preserve the closing statement for a home sale, the executed lease or deed for the new home, utility-start dates, travel history, employment-location logs, voter and license records, bank and brokerage address changes, and proof of where services were performed.

Common mistakes that increase audit risk

  • Moving on paper only: A new lease or brokerage address without physical presence and consistent conduct may not establish a new domicile.
  • Using the announcement date as the tax date: Washington looks to the facts on the relevant income date, not to when you told colleagues about the move.
  • Ignoring Washington workdays: A nonresident can still owe Washington tax on compensation for services performed inside the state.
  • Assuming another state’s tax creates an automatic offset: The Washington credit is nonrefundable, limited and available only when statutory conditions are met.
  • Applying the 2025 deduction forever: The $278,000 figure is specifically listed for tax year 2025; later-year amounts require current guidance.
  • Treating equity like an investment portfolio: Compensation equity may be sourced by the services that earned it, so grant, vest and work-location records matter.
  • Forgetting the 2028 effective date: A plan intended to avoid the 9.9% tax must account for the final rules and for any Washington domicile or Washington-source income that remains.

The most defensible approach is to establish and document the new domicile before a major sale, allocate compensation by actual work location, compare destination-state taxes, and preserve records that show the facts contemporaneously. Because a high-earner transaction can involve several income categories and multiple state rules, obtain advice before fixing the sale, exercise or payment date.
