How Mortgage Brokers Get Paid—and What Borrowers Should Ask

Mortgage brokers are generally paid through a loan-specific fee or commission funded either by you or by the lender. The amount and payer can vary by transaction, and a lender-paid arrangement may be reflected in the interest rate rather than as a separate line on the Loan Estimate. Before applying, ask exactly what you will pay, what the lender will pay, which lenders the broker will compare, and where each charge appears in your disclosures. Then compare complete written offers—not just the broker’s fee or the advertised rate.

What a mortgage broker does—and who pays

A mortgage broker is an intermediary that typically works with multiple lenders. A loan officer often works for one specific lender. Those are useful general distinctions, but they do not establish that a particular broker can access every lender, searches the entire market, or will always produce the lowest rate or cost. You must ask what the broker’s actual lender panel includes and which options were obtained for your circumstances.

The Consumer Financial Protection Bureau (CFPB) says mortgage loan officers and brokers are usually paid a loan-specific fee or commission. The money may come directly from the borrower, from the lender (the creditor), or under an arrangement that combines permitted forms of compensation. The broker’s compensation is only one part of the transaction’s price: interest, points, lender credits, origination charges, third-party services, prepaid items, and cash required at closing can change the overall value of an offer.

Borrower-paid compensation

With borrower-paid compensation, you pay the broker or the broker’s company directly, often as an upfront charge or a closing charge. Ask when payment is due, whether it is refundable if the loan does not close, and whether the amount is a fixed dollar fee, a percentage, or another stated formula. The written disclosures should identify consumer-paid compensation as borrower-paid at or before closing, as applicable.

Lender-paid compensation

With lender-paid compensation, the lender pays the broker or loan originator in connection with the transaction. CFPB guidance gives examples of lender-paid arrangements such as a salary, a fixed amount per loan, a fixed percentage of the loan amount, or a combination. A per-loan arrangement can have a minimum or maximum dollar amount. In some cases, the economic cost of lender-paid compensation is reflected in the interest rate or other pricing rather than a separate fee you hand to the broker.

Both sources of payment are not automatically allowed

Federal rules generally restrict dual compensation. If a loan originator receives compensation directly from the consumer for a transaction, another person generally may not pay loan-originator compensation in connection with that same transaction. The official interpretation allows a mortgage broker to pay an individual originator from the broker’s own consumer-paid compensation, subject to the other rules. Do not assume that paying an upfront broker fee and having the creditor separately pay the same originator is permissible. Ask who is being paid, by whom, and for what role.

What federal compensation rules prohibit and permit

Regulation Z § 1026.36 generally prohibits a loan originator from receiving compensation based on a transaction term, the terms of multiple transactions, or a proxy for a transaction term. A proxy can be a factor that consistently varies with a loan term over a significant number of transactions when the originator can affect that factor. The rule is detailed, has exceptions, and applies within its defined scope; it is not a blanket statement that every loan or every state requirement is identical.

Compensation cannot be tied to changing loan terms

A broker generally cannot be paid more because the borrower accepts a higher interest rate, a larger prepayment penalty, or another term the originator can influence. The regulation does allow a range of payment arrangements that are not tied to prohibited terms. A fixed amount agreed in advance per loan and hourly pay for actual hours worked are examples listed in the rule.

The amount of credit is not itself treated as a transaction term when compensation is a fixed percentage of that amount, although the arrangement may include a minimum or maximum dollar amount. That technical distinction does not tell you whether a particular offer is competitive; it tells you what to ask the broker to document.

Steering and qualification rules also matter

The CFPB identifies four principal areas in its loan-origination rules: compensation tied to transaction terms, dual compensation, steering, and loan-originator qualifications. A broker should be able to explain how offers are selected and why a recommended loan fits your stated priorities. On May 12, 2025, the CFPB withdrew several guidance documents, including Bulletin 2012-02. For a current explanation, rely on the text of Regulation Z and its current official interpretations rather than treating that withdrawn bulletin as current agency guidance.

Questions to ask before you apply

Ask these questions in writing when possible. Clear answers make offers comparable and expose costs that may otherwise be hidden in pricing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What will I pay you directly, how much is it, and when is it due? Ask whether the fee is fixed or calculated as a percentage, and what happens if the loan does not close.
  • Will a lender pay your company or you for this loan? Request the amount or formula, and ask where the payment will be disclosed.
  • If I pay you directly, will anyone else pay loan-originator compensation in this transaction? This question addresses the dual-compensation restriction without assuming the answer.
  • Which lenders will you compare for my situation? Ask for the names or categories of lenders actually contacted, not a claim that the broker searches “the whole market.”
  • How do you decide which offers to show me? Request an explanation of how rate, points, lender credits, underwriting requirements, and closing costs are weighed.
  • Can you provide a Loan Estimate for each option? Comparing standardized estimates is more useful than comparing a verbal rate quote.
  • Which services and fees can I shop for, and which providers are on the written list? The Loan Estimate identifies services you may be able to shop for and those for which the lender provides a list.
  • What does the Closing Disclosure say about third-party loan-originator compensation and who paid it? Ask the broker to walk through the actual disclosure before closing.

The CFPB’s consumer guidance puts the core instruction plainly: “Before you work with a loan officer or broker, make sure you understand their fees and who pays them.” That means asking before you commit, not waiting until the closing appointment.

How to compare broker offers with lender offers

Use the same borrower profile, loan amount, property type, occupancy, down payment, credit assumptions, and lock timing when comparing options. A lower stated rate can be offset by points, a larger origination charge, fewer lender credits, or costs that appear elsewhere.

Comparison item What to record Why it matters
Interest rate Rate, whether it is locked, lock period, expiration date, and lock conditions A quote that is not locked can change; a short lock may create extension risk.
Discount points Dollar amount and the rate reduction purchased Points are an upfront cost whose value depends on how long you keep the loan.
Lender credits Credit amount and the pricing or rate associated with it A credit can reduce closing cash while increasing the rate or changing other pricing.
Broker or origination charge Amount, payer, timing, and whether it is refundable Shows whether compensation is borrower-paid, lender-paid, or part of another permitted arrangement.
Other loan costs Underwriting, processing, appraisal, credit report, title, recording, prepaid items, and required reserves The broker’s fee alone does not determine total cash needed.
Shopping choices Services you may shop for and the written provider list You may have an opportunity to compare providers and prices for certain services.
Lender access Lenders contacted and offers actually received for your profile “Multiple lenders” is not a measure of how many relevant offers you obtained.
Expected holding period How long you expect to own the home or keep this loan Upfront costs and rate trade-offs can have different consequences over different periods.

Do not use a generic break-even period for points or lender credits. Calculate it from the specific rate difference, upfront cost, expected monthly savings, and the time you realistically expect to keep the loan. The federal consumer sources do not establish one universal break-even number.

Where compensation appears in the disclosures

The Loan Estimate

The Loan Estimate is designed to show projected loan terms and closing costs early in the process. CFPB commentary explains that compensation paid indirectly by the creditor through the interest rate is not itemized on the Loan Estimate. Therefore, you should not expect every lender-paid broker arrangement to appear as a separate dollar line there.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Read the estimate as a complete pricing document: rate, annual percentage rate, points, lender credits, origination charges, other loan costs, projected cash to close, and assumptions. Ask the broker to explain how compensation is funded when it is not separately itemized.

The Closing Disclosure

The CFPB’s Closing Disclosure commentary says all compensation paid to a third-party loan originator associated with the transaction must be disclosed, regardless of who pays it. Consumer-paid compensation is designated as borrower-paid at or before closing, as applicable; creditor-paid compensation is designated as paid by others. The commentary also states that compensation from both consumer and creditor to a third-party loan originator in the same transaction is prohibited under § 1026.36(d)(2).

Compare the final Closing Disclosure with the latest Loan Estimate. If a broker’s explanation, payer designation, rate, points, or cash-to-close figure does not make sense, ask for a written explanation before signing. A change that cannot be reconciled should be escalated to the lender’s closing contact or your settlement professional.

A practical comparison process

  1. Define one scenario. Write down the loan amount, property, down payment, occupancy, credit assumptions, loan type, term, and target closing date.
  2. Request written estimates. Get a Loan Estimate for the broker’s recommended option and for at least one direct-lender option when available. Keep the application facts consistent.
  3. Identify every payer. Mark each broker, lender, and third-party charge as borrower-paid, lender-paid, or paid by another party, and ask how any unclear item is calculated.
  4. Check rate-lock details. Record whether each rate is locked, for how long, the expiration date, and the cost or conditions of an extension.
  5. Compare total economics. Review points, credits, origination fees, other costs, prepaid amounts, cash to close, and the rate together.
  6. Test the holding-period assumption. Calculate the effect of upfront costs and monthly payment differences for the period you reasonably expect to keep the loan; do not rely on an advertised universal savings claim.
  7. Reconcile the Closing Disclosure. Confirm that the final payer designations and total costs match the explanation you received. Resolve discrepancies before closing.

Common pitfalls and how to handle them

“The broker is free, so there is no cost”

Lender-paid compensation can still affect pricing, including the interest rate. “No direct fee” is not the same as “no economic cost.” Compare the whole offer.

“The Loan Estimate will show the broker’s commission”

Indirect creditor-paid compensation through the interest rate is not itemized on the Loan Estimate. Ask for the arrangement and inspect the required payer disclosures on the Closing Disclosure.

“A broker checks every lender”

A broker typically works with multiple lenders, but access varies by provider. Ask which lenders were considered and which offers were actually available for your profile.

“The lowest rate is the cheapest loan”

Points, credits, fees, lock conditions, and expected time in the loan can change the result. Compare standardized written offers using the same assumptions.

“Any two payments are fine if the broker explains them”

Federal compensation restrictions generally prohibit dual compensation in a covered transaction, and Regulation Z has a defined scope and exceptions. If a proposed arrangement involves both a borrower payment and a lender payment, ask the lender or a qualified settlement professional to explain compliance before proceeding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Federal rules answer every state question”

This is a general U.S. federal overview. State licensing, disclosure, fee, and conduct rules may add requirements, and those rules differ by location. Confirm state-specific questions with the appropriate regulator or a qualified professional.

What borrowers should document

  • The broker’s legal business name and contact information.
  • The lenders the broker says it can access and the lenders actually contacted.
  • Every proposed broker, lender, and third-party fee, including its payer and due date.
  • Loan Estimates, rate-lock confirmations, revised estimates, and written explanations for changes.
  • The final Closing Disclosure and any correction issued before closing.

Keeping these records lets you compare the offer you were shown with the transaction you are asked to sign. It also makes a focused question possible when a fee, payer, or term changes.

Bottom line for choosing a broker

A mortgage broker can give you access to more than one lender, but “more than one” is not the same as the entire market or the lowest-cost loan. The decision should rest on the complete, borrower-specific offer: rate and lock, points, credits, broker and origination charges, other closing costs, lender access, and your expected time in the loan. Ask who pays whom, make sure the arrangement is reflected correctly in the disclosures, and compare actual written offers before you commit.
