How GST Refunds Work in India for Exports and Inverted Duty Structure

India’s GST refund system has two separate mechanisms that are often confused: refunds connected with zero-rated exports, and refunds of credit accumulated under an inverted duty structure. The qualifying event, tax-payment route, calculation, documents and exclusions differ. Exporters may claim eligible unutilized input tax credit (ITC) or, where permitted, obtain a refund of IGST paid on exported goods. An inverted-duty claim is capped by the Rule 89(5) formula and is not an automatic payout of the electronic credit-ledger balance.

What the two GST refund routes actually cover

A GST refund is not a single universal claim. You first identify why the credit or tax became refundable, then apply the procedure for that category. For this topic, the important routes are:

As an Amazon Associate I earn from qualifying purchases.

  • Exports (zero-rated supplies): a refund of eligible unutilized ITC when exports are made without payment of IGST under the applicable bond or letter-of-undertaking route, or a refund of IGST paid on eligible exports where that route is available.
  • Inverted duty structure: a refund of eligible unutilized ITC accumulated because the GST rate on inputs is higher than the rate on the outward supplies made with those inputs.

These routes have different eligibility tests and evidence. A credit balance by itself does not establish that either refund is payable. The taxpayer must classify the supplies, confirm the applicable restrictions, reconcile invoices and returns, and use the prescribed electronic process.

Export refunds: choose the correct tax-payment route

Exporting without payment of IGST

Zero-rated exports can be made without payment of IGST under the applicable bond or letter-of-undertaking route. In that case, the refund claim generally concerns eligible unutilized ITC attributable to the zero-rated supplies. The calculation and supporting records must connect the credit claimed with the relevant export turnover and period.

For exported goods, retain the shipping-bill or bill-of-export details together with the corresponding export-invoice information. The refund rules provide that the application is filed after the export manifest or export report has been delivered. A claim prepared before that event may not satisfy the procedural requirement even if the goods have physically left India.

Exporting with payment of IGST

Where the permitted route is to pay IGST on exported goods, the refund relates to that IGST. CBIC’s sectoral FAQ describes the shipping bill as the refund application for such goods when the registered person has filed the required return and the carrier’s export manifest or report has been furnished. The shipping bill therefore cannot be treated as a stand-alone shortcut: return filing, export reporting and data consistency still matter.

Do not assume that every export can use this route. The available route can depend on the type of supply, the tax actually paid, the export documentation and restrictions such as export duty, drawback treatment or other statutory conditions.

Export of services

Service exporters using a refund route that requires an electronic claim should be prepared to provide invoice details and the relevant Bank Realization Certificates or Foreign Inward Remittance Certificates listed in the refund rules. The evidence must support the service-export transaction and the receipt of consideration in the manner required by the applicable law and portal workflow.

Export-refund eligibility limits you must check

CBIC material identifies important restrictions on refunds of unutilized ITC for exporters. These include exported goods that are subject to export duty and specified combinations involving drawback or an IGST refund. The exact interaction depends on the facts and the legal provision in force for the period of the claim.

  • Check whether the exported goods attract export duty.
  • Identify whether any drawback has been claimed and which taxes the drawback covers.
  • Confirm whether IGST was paid on the export or the supply was made without payment under the applicable route.
  • Reconcile the shipping bill, export invoice, return and manifest or report data.
  • Check current notifications, portal validations and any restriction applicable to the relevant goods, services or period.

These checks are material because export refunds are not interchangeable. A claim for unutilized ITC uses a different legal basis from a claim for IGST paid on export, and a restriction affecting one route does not automatically answer the other.

Inverted duty structure: when accumulated ITC can be refundable

The qualifying problem

An inverted duty structure exists when the GST rate on a business’s inputs is higher than the rate on its outward supplies. The difference can cause ITC to accumulate: tax paid on purchases enters the credit ledger faster than tax is discharged on sales. Section 54(3) of the CGST Act provides for refund of unutilized ITC in this situation, subject to the statutory conditions and exclusions.

“Sub-section (3) of section 54 of CGST Act, 2017, provides for the refund of unutilized input tax credit in cases where credit has accumulated on account of rate of tax of inputs being higher than the rate of tax on output supplies i.e. on account of inverted duty structure.”

— Central Board of Indirect Taxes and Customs, Circular No. 181/13/2022-GST, 10 November 2022

The existence of an input rate higher than an output rate is the starting point, not the end of the analysis. You still need eligible inputs, eligible outward supplies, the correct period and the prescribed calculation. Other credits and transactions may be excluded by the rule or by the applicable notification.

Rule 89(5) sets a ceiling

Rule 89(5) provides the maximum refund formula for an inverted-duty claim:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Maximum Refund Amount = {(Turnover of inverted rated supply of goods and services) × Net ITC ÷ Adjusted Total Turnover} − tax payable on such inverted rated supply of goods and services

In this formula, Net ITC is defined by reference to ITC availed on inputs during the relevant period, subject to the exclusions stated in the rule. “Turnover of inverted rated supply” refers to the relevant outward supplies covered by the inverted-rate calculation, while “Adjusted Total Turnover” is the denominator prescribed by the rule.

The result is a maximum amount. It does not promise payment of the entire balance in the electronic credit ledger. A claim can be lower because the formula produces a lower ceiling, because some credit is excluded from Net ITC, because tax is payable on the inverted-rated supplies, or because another statutory condition is not met.

Illustrative calculation

Assume, only for illustration, that during a claim period the turnover of inverted-rated supplies is ₹10,00,000, eligible Net ITC is ₹1,80,000, Adjusted Total Turnover is ₹15,00,000 and tax payable on the inverted-rated supplies is ₹20,000:

  1. Multiply ₹10,00,000 by ₹1,80,000: ₹1,800,000,000.
  2. Divide by ₹15,00,000: ₹1,20,000.
  3. Subtract ₹20,000 tax payable: ₹1,00,000 maximum refund under the formula.

This example demonstrates the cap only. It is not a determination of any taxpayer’s eligibility, and the actual values must be taken from reconciled records for the relevant period.

What Circular 181/13/2022-GST adds

CBIC Circular 181/13/2022-GST, dated 10 November 2022, discusses refund issues arising from the amended Rule 89(5) formula. Use the circular for the clarifications it expressly addresses, but keep the rule text and the circular’s interpretation distinct. A circular does not turn an otherwise ineligible credit balance into a refundable amount.

How to file a GST refund claim

For applicable refund categories, the rules provide for electronic filing in Form GST RFD-01. The exact portal screens and validations can change, so use the current instructions displayed for the claim category and period.

  1. Classify the claim. Decide whether you are claiming unutilized ITC for zero-rated exports, IGST paid on eligible exported goods, or an inverted-duty refund. Do not combine categories merely because the credit appears in one ledger.
  2. Confirm the tax-payment route. For exports, establish whether IGST was paid or the supply was made without payment under the applicable bond or letter of undertaking route.
  3. Check statutory restrictions. Review export duty, drawback and IGST-refund interactions, and any restriction applicable to the goods, services or period.
  4. Build the evidence set. For goods, reconcile shipping bills or bills of export with export invoices and the export manifest or report. For services, assemble invoice details and relevant BRC or FIRC evidence. For inverted duty, prepare the statement of inward and outward invoices required for the period.
  5. Calculate the claim. For an inverted-duty claim, apply Rule 89(5), use only eligible Net ITC and retain the working papers showing each input to the formula. For an export-ITC claim, use the calculation applicable to that refund category rather than the inverted-duty formula.
  6. File Form GST RFD-01 electronically where required. Enter the claim period, turnover and tax figures exactly as supported by the records. Resolve portal validation errors rather than bypassing them with unsupported adjustments.
  7. Preserve the submission trail. Keep the filed form, statements, invoices, shipping data, return data, calculation workbook and correspondence together. If the department seeks clarification, answer from the same reconciled records.

Records and reconciliations that prevent avoidable disputes

For exported goods

  • Match each export invoice to the shipping bill or bill of export.
  • Confirm that the export manifest or report has been furnished before filing where the rules require that sequence.
  • Reconcile the export figures with the relevant return and the tax-payment route.
  • Document any drawback and verify whether it affects the chosen refund route.

For export of services

  • Maintain the invoice-level statement required for the claim.
  • Link the invoices to the relevant Bank Realization Certificate or Foreign Inward Remittance Certificate.
  • Check that the receipt evidence covers the transactions and period included in the claim.

For inverted duty

  • Prepare the inward-invoice and outward-invoice statement for the relevant period.
  • Separate eligible input credit from credits excluded by Rule 89(5) or another applicable provision.
  • Reconcile Net ITC, inverted-rated turnover, Adjusted Total Turnover and tax payable to the books, returns and electronic credit ledger.
  • Retain a calculation that shows how the formula ceiling was reached; do not use the closing ledger balance as a substitute for the formula.

Important 2024 clarification on IGST refunds

CBIC Circular 233/27/2024-GST, dated 10 September 2024, addresses regularization of IGST refunds claimed contrary to Rule 96(10) in a specified fact pattern involving exporters who imported certain inputs without payment of integrated tax and compensation cess under particular concessions. It is a narrow clarification for the circumstances it describes. It should not be presented as blanket permission for every exporter or every import-concession arrangement.

Before relying on that circular, establish that the imports, concessions, periods and refund facts match its scope and check any later amendment, notification or instruction.

Export refunds versus inverted-duty refunds

Comparison point Export-related refund Inverted-duty refund
Qualifying reason Zero-rated export, with the claim route linked to the export and the tax-payment treatment ITC accumulation because input tax rates are higher than output-supply rates
Tax treatment Either eligible unutilized ITC on exports made without payment under the applicable route, or IGST paid on eligible exported goods where permitted Unutilized ITC subject to the statutory inverted-duty conditions
Calculation Calculation applicable to the selected export-refund route Rule 89(5) maximum-refund formula
Core evidence Shipping-bill and export-invoice details for goods; invoice and BRC/FIRC evidence for services; manifest or report where required Statement of inward and outward invoices and reconciled Rule 89(5) inputs
Key exclusions or cautions Export duty, drawback and specified IGST-refund combinations can restrict eligibility Net ITC exclusions and the formula ceiling can reduce the amount below the ledger balance

Common mistakes and how to correct them

Treating every export refund as automatic

Export status alone does not guarantee a refund. Correct the analysis by identifying the tax-payment route, confirming that the return and export-report requirements are met, and checking the exclusion rules.

Using the inverted-duty formula for an export claim

Rule 89(5) belongs to the inverted-duty calculation. An export-ITC claim follows the method applicable to its own category. Reclassify the claim before filing and rebuild the supporting statement.

Claiming the entire electronic credit-ledger balance

The ledger shows available credit; it does not calculate the refundable amount. For inverted duty, apply the Rule 89(5) ceiling and remove excluded credit. For exports, attribute the eligible credit or IGST to the qualifying supplies under the applicable route.

Filing before export reporting is complete

For exported goods, the rules place the filing after delivery of the export manifest or export report. Verify that event and retain evidence before submitting the claim.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ignoring drawback or export duty

These facts can change eligibility. Capture them in the claim review rather than treating them as post-filing details.

Relying on an outdated portal checklist

Use the current RFD-01 workflow, notifications and instructions for the period. The broad rule description is not a substitute for checking the live filing requirements.

A practical decision checklist

  • Is the supply an eligible zero-rated export, or is the accumulation caused by an inverted rate structure?
  • For exports, was IGST paid, or was the supply made without payment under the applicable route?
  • Are export duty, drawback or other specified restrictions present?
  • For goods, are shipping-bill, invoice and manifest or report data reconciled?
  • For services, do invoices and BRC or FIRC evidence support the amount claimed?
  • For inverted duty, are inward and outward invoice statements complete for the period?
  • Has Net ITC been calculated using the rule’s definition and exclusions?
  • Has the Rule 89(5) ceiling been calculated separately from the ledger balance?
  • Are the current law, notifications, portal instructions and any relevant litigation checked before filing?

Because eligibility depends on transaction-level facts, this framework cannot decide an individual taxpayer’s claim without examining invoices, returns, export records and the applicable period. Treat the cited CBIC rules, FAQs and circulars as the starting legal framework, then verify the consolidated law and live portal requirements before submission.
