Under the Central Civil Services (CCS) pension framework, family pension is paid only to a person who fits an eligible family category and continues to satisfy the applicable conditions. If more than one child qualifies, payment is generally taken in sequence rather than paid to every child at the same time. Dearness relief (DR) is an additional, separately revised component of pension or family pension. Its rate changes through government orders, so the effective order—not an old percentage copied from a website—must be used for a current calculation.
The rules discussed here apply to Central Government employees and pensioners covered by CCS pension rules. State Government, railway, defence, public-sector and other pension systems can use different definitions, documents, authorities and DR rates.

Start by identifying the pension scheme
Before assessing a claim, establish which pension rules governed the deceased or retired employee. The Department of Pension & Pensioners’ Welfare (DoPPW) is the nodal department for pension policy for Central Government employees covered by CCS rules. The material explained in this article is therefore a Central Government framework, not a universal rule for every public-sector survivor benefit.

What family pension is—and why eligibility is conditional
Family pension is a recurring benefit for an eligible family member after the death of a Government servant or pensioner, or after the circumstances that make an earlier recipient ineligible. It is not an automatic payment to every relative and it is not necessarily shared by all eligible relatives simultaneously.
Eligibility depends on the claimant’s relationship, dependency where the rules require it, the relevant death or ineligibility event, and continuing conditions such as disability status or prescribed declarations. The claimant’s position can therefore change over time. A person who was not payable at the first event may become relevant when an earlier recipient’s entitlement ends, but must still qualify when their own turn arrives.
Family categories covered by particular instructions
CCS instructions address a spouse and children and also contain provisions for categories such as dependent parents and disabled siblings. Those categories do not share one universal test. Each has its own relationship, dependency, order-of-payment and documentary requirements. A claimant should have the sanctioning authority identify the precise rule and category rather than assume that a condition applying to a child also applies to a parent or sibling.

A disabled child can qualify beyond age 25
Rule 50(9)(h) of the CCS (Pension) Rules, 2021 provides a life-long family-pension route, subject to conditions, for a child whose qualifying mental disorder or physical disability makes the child unable to earn a living even after age 25. DoPPW’s circular dated 19 January 2022 states:
“family pension is payable for life, subject to certain conditions, to a child of a deceased Government servant/pensioner, who is suffering from any disorder or disability of mind or is physically disabled so as to render him or her unable to earn a living even after attaining the age of twenty-five years.”

The age of 25 is a rule threshold, not a guarantee of payment. The disability, inability to earn a living, relationship and other continuing conditions still have to be established under the current rules.
When a child’s eligibility is tested
DoPPW has clarified that a child’s eligibility is considered at two significant points: when the parent dies or an earlier recipient becomes ineligible, and when that particular child’s turn to receive family pension arrives. Dependency and the prescribed income condition are assessed against the facts at the relevant point.
Sequential payment when several children qualify
Where two or more children are eligible, payment is sequential. One child receives family pension for the period allowed by the rules; the next child’s entitlement is considered when that child’s turn arrives. A child who qualified at the first event can lose eligibility before payment begins if the continuing conditions are no longer met.
| Situation | What must be checked | Practical consequence |
|---|---|---|
| Parent dies and one child is the current eligible claimant | Relationship, dependency or other applicable conditions, and the current rules | Payment can begin after the authority verifies the claim and documents. |
| Several children qualify | Each child’s eligibility and the prescribed order | Children generally receive the benefit on their respective turns, not all at once. |
| An earlier recipient becomes ineligible | The next child’s conditions at that later event | The next claimant must still qualify when payment is due. |
| Child has a qualifying disability after age 25 | Disability category, inability to earn a living and required guardian or payment arrangements | Family pension may continue for life while the conditions remain satisfied. |
The clarification on sequencing uses an earlier CCS rule-numbering convention. Treat it as guidance on how the issue is assessed, then have the authority apply the current CCS rules to the individual claim.
Special procedure for a child with a mental or physical disability
The 19 January 2022 DoPPW circular describes more than the age-25 eligibility principle. It addresses how payment can be handled when the child cannot manage financial affairs independently.

Guardian payment route
For a child with a mental disorder, the circular discusses payment through a guardian. The authority may need evidence establishing who is legally able to receive and manage the pension for the child. This is a procedural route, not a presumption that every disabled child must use the same representative.
Nominated-person route in specified cases
The circular also describes nomination of a person by the Government servant, pensioner or spouse in specified circumstances. Whether that route is available depends on the facts and the rule being applied. Do not substitute a private nomination document for the formal process required by the pension authority.
National Trust guardianship certificate
For the disability categories covered by the circular, a Guardianship Certificate issued under section 14 of the National Trust Act, 1999, by a local level committee is accepted for nomination or appointment of a guardian in the listed cases. The certificate is evidence for the route described in that guidance; it does not remove the need to satisfy the family-pension eligibility conditions themselves.
Because documentation and guardianship arrangements can change with the claimant’s circumstances, confirm the current list of acceptable certificates, the issuing body and the submission channel with the pension sanctioning authority before filing.
Dependency, declarations and continuing eligibility
Dependency is not simply a claimant’s assertion that they need money. The relevant CCS provisions use a prescribed income criterion and other conditions. The authority evaluates the claimant’s facts against those requirements at the point specified by the rules.

Non-spouse recipients may have recurring declarations
DoPPW pension-payment guidance describes recurring declarations for certain non-spouse recipients, including declarations concerning non-earning status and marriage status under the cited rules. These requirements are category-specific. They should not be turned into a blanket annual checklist for every spouse, child, parent or pension scheme.
A change in circumstances—such as earning income, marriage where relevant, a change in disability status, or the end of another recipient’s entitlement—should be reported through the channel prescribed by the authority. Keep copies of declarations, acknowledgements and medical or guardianship documents so that a later review can be answered with a clear record.
How to pursue a family-pension claim
The following sequence keeps the administrative questions separate from the eligibility questions.
- Identify the governing rules. Obtain the deceased or retired employee’s pension payment order and confirm that CCS rules apply. Record the pension sanctioning authority and the office currently responsible for payment.
- Identify the claimant category. State whether the claimant is a spouse, child, dependent parent, disabled sibling or another category specifically recognised by the applicable instructions. Do not use a generic “dependent” description when a rule requires a precise relationship.
- Pinpoint the eligibility event. Note the date of death, the date an earlier recipient became ineligible, or another event that brings the claimant’s turn forward. For children, assess conditions again when their turn actually arrives.
- Compile category-specific evidence. This may include relationship records, dependency or income evidence, disability and inability-to-earn evidence, guardianship or nomination documents, and the declarations required for that category. The authority should confirm the current forms and certification standards.
- File with the responsible authority. Submit the claim through the office named in the pension records or the channel that office directs. Request an acknowledgement and keep a complete copy of every page and enclosure.
- Resolve sequencing questions. If another child or family member is already receiving family pension, ask the authority to record the order in which eligible claimants will be considered and the event that moves the next claimant’s turn forward.
- Report later changes. Notify the authority when a condition relevant to payment changes and provide the declarations or certificates required for continued payment.
These steps are an administrative guide, not individualized legal advice. A disputed relationship, uncertain disability assessment, competing claimants or a missing service record may require assistance from the sanctioning authority or a qualified adviser.
How dearness relief works with family pension
Dearness relief is an additional component associated with pension or family pension. The Government revises the DR rate through orders, and the applicable rate is tied to the order’s effective date. A pension calculation therefore needs both the eligible family-pension amount and the operative DR order.

DR is revised by government order
DoPPW’s notices page lists an additional installment for Central Government pensioners and family pensioners effective 1 January 2026. The notice listing available for this explanation does not display the new percentage. It would be unsafe to insert a rate from memory or to calculate an amount from an earlier installment. Obtain the complete operative order, confirm the percentage and effective date, and then ask the pension-paying authority how arrears or adjustments are being applied.
Spouse employment or re-employment
DoPPW pension-payment guidance states that, in the described case, employment or re-employment of the spouse does not affect the spouse’s family pension and DR continues with that spouse’s family pension. This is a specific guidance point for the circumstances covered by that instruction; it is not a rule that every recipient in every pension system can work without any reporting or eligibility consequence.
Do not confuse DR with the pension itself
Family pension is the underlying benefit determined by the applicable family relationship and conditions. DR is the separately revised relief component. A change in the DR order does not by itself create a new family-pension entitlement, alter the order in which children qualify or cure a missing eligibility document.
Common mistakes and how to avoid them
| Mistake | Why it causes trouble | Better approach |
|---|---|---|
| Applying Central Government rules to a State, railway, defence or other pension | Those systems may define family, dependency and DR differently. | Confirm the scheme from the pension order first. |
| Assuming every dependent is paid immediately | Children may be paid sequentially, and eligibility is reassessed when a turn arrives. | Ask the authority to identify the claimant’s category and position in the order. |
| Stopping the analysis at age 25 | A qualifying disabled child may remain eligible for life subject to conditions. | Assess disability and inability to earn a living under the current rule. |
| Using one guardianship document for every case | The available route depends on the disability category and specified procedure. | Confirm whether the National Trust Act certificate or another document is required. |
| Quoting an old DR percentage | DR changes by installment and effective date. | Use the full current government order before calculating. |
| Treating declarations as universal | Recurring declarations can be category-specific. | Follow the declaration schedule and content stated for the particular recipient. |
A practical record-keeping checklist
- Pension payment order and the former employee’s service or pension reference.
- Death certificate or record of the event that makes the next claimant’s turn relevant.
- Proof of relationship for the claimant.
- Dependency or income evidence where the applicable rule requires it.
- Disability assessment and evidence addressing inability to earn a living, when claiming under the disabled-child provision.
- Guardianship certificate, nomination or appointment papers where the payment route requires them.
- Copies of declarations, submissions, acknowledgements and correspondence.
- The latest DR order, including its effective date, used by the pension-paying authority.
Keep the documents together and note every date. The most important dates are the death or ineligibility event, the date a child’s turn begins, the effective date of any DR installment and the deadline for any declaration or review requested by the authority.
What to verify before relying on a payment figure
A reliable figure requires more than multiplying a pension by a remembered percentage. Verify that the claimant is in the correct family category, that the payment sequence has reached that claimant, that continuing conditions and declarations are satisfied, and that the DR order covers the relevant period. For the installment effective 1 January 2026, the percentage must be taken from the complete government order because the available notice listing does not state it.
When the authority’s calculation differs from your record, ask for a written statement showing the family-pension base, the DR rate and effective date used, any period treated as arrears, and any deduction or adjustment. That breakdown makes it possible to identify whether the disagreement concerns eligibility, sequencing, documentation or arithmetic.
