Short answer: The GDPR applies whenever an AI service processes personal data. You must examine each operation—collecting data, training or validating a model, accepting prompts, producing inferences, and deploying outputs—then identify the purpose, responsible parties, legal basis, transparency duties, retention, transfers, and safeguards for that operation. The same service may also fall under the EU AI Act, whose transparency obligations in Article 50 are stated by the European Commission to apply from 2 August 2026.

There is no universal “GDPR-compliant AI” label. The result depends on the data, purpose, roles, decision process and controls actually used. The European Data Protection Board (EDPB) describes its AI-model analysis as case-by-case; legitimate interest can support some development or deployment activities only when strict necessity and a balancing of people’s rights are demonstrated.

When does the GDPR apply to an AI service?

The trigger is processing of personal data. That includes information about an identified or identifiable person, whether the service receives it directly, obtains it from another source, uses it to train or validate a model, receives it in a prompt, or generates information about someone in an output.

Start with the actual processing operation rather than the marketing description of the product. A “general-purpose” model may involve several separate purposes and datasets. A customer-support assistant, for example, could process account records during retrieval, employee messages in prompts, and inferred customer characteristics in its responses. Each use needs its own analysis.

Typical processing points

  • Collection: Data may come from public internet sources, third parties, customers, employees or institutional files.
  • Development: Data can be cleaned, labelled, combined, trained on and used for model testing or validation.
  • Deployment: A live service may retain prompts, outputs, logs, feedback and performance data.
  • Inference: The system may derive or predict personal aspects, even when the user did not supply those attributes explicitly.

Document what enters and leaves each stage. A model-development purpose and a customer-service purpose are not automatically the same purpose, so a lawful basis and notice that fit one phase may not fit another.

How to map an AI service’s data and purposes

A defensible GDPR analysis follows the data through the entire lifecycle. Create a record for every flow, including data supplied by a vendor or another group company.

Lifecycle stage Questions to answer Controls to verify
Collection What personal data are obtained, from whom, and from which sources? Source records, data-minimisation review, provenance and retention rules
Training and validation Why is each dataset needed for this model and this purpose? Purpose statement, lawful-basis assessment, filtering, testing and deletion process
User prompts Can prompts contain account details, identifiers, confidential text or special-category information? Input warnings, access controls, redaction, retention settings and staff procedures
Outputs and inferences Does the service generate or infer information about a person, and who receives it? Accuracy checks, disclosure controls, human review and rights-handling route
Operational logging Which prompts, outputs, user actions and model events are retained? Defined retention period, role-based access, deletion and incident procedures

The EDPB’s opinion stresses that AI models vary greatly and evolve quickly. A written map should therefore be updated when the dataset, model, supplier, purpose or user population changes.

Who is responsible: provider, deployer, controller or processor?

Identify the organisation deciding why and how each processing operation occurs. That organisation may be a controller. Another party may process data on its instructions as a processor, while two organisations may jointly determine purposes and means. An AI provider can have a different role during model development from the role it has when a customer deploys the service.

Do not assign roles from a product label alone. Examine contracts, technical settings and actual decision-making. Record who selects training data, who determines retention, who can reuse prompts, who answers data-subject requests and who decides how an output affects a person.

For procurement, obtain reliable, current information about a supplier’s datasets and processing. The European Data Protection Supervisor’s revised orientations make this point for EU institutions; the practical lesson is to request evidence rather than relying on a generic “no training” statement. Ask what data are used, for which purpose, in which regions, for how long, and whether they are reused to improve a shared model.

What legal basis is needed?

Every processing purpose needs an applicable GDPR legal basis. Assess development and deployment separately when their purposes differ. The EDPB says legitimate interest may be available for some AI-model development or use, but only after demonstrating two things: the processing is strictly necessary for the stated interest, and the organisation’s interest does not outweigh people’s rights and freedoms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Legitimate-interest assessment

  1. Define the interest and purpose. State the concrete objective, such as detecting account fraud or improving a support workflow. A broad aim to “develop AI” is not a sufficient explanation by itself.
  2. Test strict necessity. Show why the same objective cannot reasonably be achieved with less personal data, less intrusive data or an anonymised approach.
  3. Balance impacts and safeguards. Consider people’s reasonable expectations, sensitivity of the data, scale, potential harm and whether individuals can exercise their rights. Document mitigations such as technical filtering, stronger transparency and easier rights requests.

Consent, contractual necessity and other GDPR legal bases may be relevant depending on the operation, but the basis must match the purpose and the facts. Do not treat a user’s general acceptance of terms as proof that every later model-development use is covered.

What information must people receive?

EU guidance says privacy information should be clear and in plain language. Depending on the circumstances, explain:

  • the controller’s identity and contact details;
  • the purpose or purposes of processing and the legal basis for each;
  • recipients or categories of recipients;
  • the data-protection officer, where applicable;
  • any legitimate interests relied on;
  • international transfers and the safeguards used;
  • how long data will be stored, or the criteria used to set that period;
  • people’s rights, including withdrawal of consent where consent is the basis; and
  • whether providing the data is required and what happens if it is not provided.

When automated decision-making or profiling is relevant, the explanation must also address the logic involved and the significance and consequences for the person. “An algorithm decided” is not meaningful information. Describe the factors used at a level that lets an affected person understand the process and challenge an outcome, without exposing security-sensitive details.

When are automated decisions and profiling restricted?

The European Commission distinguishes profiling—evaluating personal aspects to make predictions—from automated decision-making, in which technology makes a decision without human involvement. The special GDPR protection concerns a solely automated decision that produces legal effects or similarly significant effects.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Examples can include an automated outcome that determines a person’s contractual eligibility, access to a service or another comparably serious consequence. The label “AI-assisted” does not remove the rule if the human role is merely nominal. A real reviewer should have authority, time and information to assess the case rather than automatically approving the system’s result.

Limited exceptions and required safeguards

The Commission describes exceptions where the decision is necessary to enter into or perform a contract, where the person has explicitly consented, or where EU or Member State law authorises it with safeguards. Where an exception applies, people must be told about the possibility of human intervention and allowed to express their view and contest the decision.

Build an escalation path before launch. It should identify the reviewer, the records the reviewer can inspect, the deadline for a response and how a person submits evidence that the system missed. Keep the explanation and challenge route separate from a generic customer-service channel so requests are not lost.

How the GDPR interacts with the EU AI Act

The GDPR and the AI Act are separate regimes. A service can have GDPR duties because it processes personal data and additional AI Act duties because of how it interacts with people or generates content. Satisfying one regime does not automatically satisfy the other.

Article 50 transparency duties

The European Commission says Article 50 requires providers to inform people when they directly interact with an AI system, unless that interaction is obvious from the circumstances. It also describes obligations to facilitate detection of AI-generated or manipulated content through machine-readable marking.

Deployers have additional notice duties in specified contexts, including emotion-recognition systems, biometric categorisation, deepfakes and certain public-interest text published without human review or editorial control. Check the precise provision, role, exception and technical conditions before applying an example to a particular service. The Commission lists 2 August 2026 as the application date for these Article 50 rules.

High-risk AI obligations

The Commission’s broader AI Act overview schedules listed obligations for high-risk AI systems to start on 2 December 2027. The overview identifies risk assessment and mitigation, dataset quality, logging, documentation, information for deployers, human oversight, robustness, cybersecurity and accuracy. These dates and implementation guidance can change, so maintain a versioned compliance calendar and verify the applicable category for the system.

Regime What it addresses Date stated by the Commission
GDPR Personal-data processing, lawful basis, fairness, purpose limitation, minimisation, transparency, rights and safeguards Applies according to the processing and the organisation’s circumstances
AI Act Article 50 Specified transparency for direct AI interactions and generated or manipulated content, plus listed deployer notices 2 August 2026
AI Act high-risk obligations listed in the overview Risk controls, data quality, logging, documentation, human oversight, robustness, cybersecurity and accuracy 2 December 2027

What the EDPS guidance does—and does not—prove

The European Data Protection Supervisor’s 2025 revised orientations describe personal-data processing in generative-AI development and use, including public-internet collection, third-party or institutional files, training, validation, user inputs, inferences and generated information. They recommend distinct lawful-ground analysis for development and deployment when the purposes differ and call for reliable, current supplier information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Those orientations address EU institutions under Regulation (EU) 2018/1725. They provide useful operational context, but they are not the governing GDPR text for every commercial provider. Apply the GDPR to the facts of the organisation and consult the competent supervisory authority or qualified counsel for a specific deployment.

The EDPS’s Wojciech Wiewiórowski said in the 2025 guidance announcement, “Artificial intelligence is an extension of human ingenuity, and the rules governing it must evolve just as dynamically.” EDPB Chair Anu Talus similarly noted in a 18 December 2024 statement that “AI technologies may bring many opportunities and benefits to different industries and areas of life.” Neither statement decides whether a particular processing operation is lawful.

A practical compliance workflow for an AI service

  1. Inventory the data. List personal data at collection, training, prompting, inference and logging stages. Mark sensitive categories and data about children or vulnerable people where relevant.
  2. Write a purpose for each operation. Separate model development, validation, product improvement, customer support, fraud detection and any other use.
  3. Assign roles. Document provider, deployer, controller, joint-controller and processor responsibilities for every flow.
  4. Select and document a legal basis. For legitimate interest, retain the necessity analysis, balancing assessment and mitigation plan. Revisit the basis when the purpose changes.
  5. Minimise and secure. Remove unnecessary fields, restrict access, set retention limits and prevent prompts or logs from being reused outside the documented purpose.
  6. Prepare the notice. Explain identity, purposes, basis, recipients, retention, transfers, rights and automated-decision logic in plain language.
  7. Test rights handling. Provide routes for access, correction, deletion, objection or other applicable rights, and test whether the model, logs and vendor can respond within the required process.
  8. Assess decision impact. Identify outputs that could produce legal or similarly significant effects. Add meaningful human intervention, a chance to express a view and a contest mechanism where required.
  9. Check AI Act status. Determine whether Article 50 transparency duties or the high-risk obligations apply, recording the relevant role, system category and date.
  10. Monitor changes. Reassess when data sources, model versions, prompts, suppliers, geographic locations or decision uses change.

Common failure modes and fixes

  • “The data were public, so they are free to train on.” Public availability does not remove the need to identify a purpose, legal basis, fairness assessment and safeguards.
  • One blanket notice for every use. Split notices or explanations when development and deployment have different purposes or recipients.
  • Calling a rubber-stamp review “human oversight.” Give reviewers authority, relevant information and a genuine ability to change the result.
  • Buying a model without dataset evidence. Require current descriptions of sources, processing, retention, transfers and reuse from the supplier.
  • Ignoring prompts and outputs. Treat them as potential personal-data processing, including inferred information, and apply access and retention controls.
  • Assuming GDPR and AI Act compliance are interchangeable. Maintain separate assessments and a cross-reference showing which obligation each control addresses.

How to compare two AI services

For a meaningful comparison, score both services against the same questions:

  • Which personal data are used at collection, training, prompting and inference stages?
  • What is the purpose and legal basis for each operation?
  • Which party is provider, deployer, controller, joint controller or processor?
  • What notice, rights process, retention period and transfer arrangement are offered?
  • Could an output feed a solely automated decision with legal or similarly significant effects?
  • Which AI Act transparency or high-risk obligations apply, and from what date?

A service with fewer visible features is not automatically lower risk. The decisive differences are the data flows, purposes, roles, safeguards and consequences for people.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Bottom line

Apply EU data-protection rules to the processing actually performed by an AI service. Map the lifecycle, separate purposes, establish a defensible legal basis, minimise and secure data, give people meaningful information, and provide the safeguards required for significant automated decisions. Then run a separate AI Act assessment, including the 2 August 2026 Article 50 date and the 2 December 2027 high-risk schedule stated by the European Commission. Because the EDPB treats AI-model questions case by case, a named service cannot be declared compliant without examining its data, contracts, settings and real-world use.
