EPF and EPS are separate parts of the statutory contribution. In the older EPFO material, contributions are generally calculated up to a ₹15,000 wage ceiling unless higher-wage coverage is properly requested. An employee may contribute more, but the employer does not automatically have to match the extra amount. In addition, a specific rule in the older booklet excludes EPS for some new members who joined on or after 1 September 2014 with wages above the ceiling, sending the employer’s full share to EPF. EPFO’s employer portal now mentions a possible increase of the ceiling to ₹25,000, but the retrieved notice does not state the effective date or operative rules, so payroll should verify the implementing notification before applying it.
What EPF and EPS mean when pay is above the ceiling
EPF and EPS are not two deductions taken from an employee’s salary in the same way. EPF is the provident-fund account that receives the employee’s contribution and the employer’s EPF portion. EPS is the Employees’ Pension Scheme contribution, which is normally paid out of the employer’s share when the employee is eligible. The employee’s EPS contribution is shown as zero in EPFO’s published rate sheet.

The important word is contributory wages, not total monthly salary. A salary package can include several components, while payroll applies the legally relevant wage definition and the ceiling in force for that wage month. Therefore, a person earning ₹30,000, ₹50,000 or more may still see EPF calculated only on the applicable ceiling rather than on the full amount.

Which contribution rates EPFO publishes
EPFO’s contribution-rate sheet lists a usual employee EPF rate of 12%. A 10% employee rate applies only to specified establishments, including establishments with fewer than 20 employees and certain listed industries or establishments meeting specified financial conditions. It is not a general alternative rate for every employee.

| Contribution | Usual published rate | Who pays it | How it is treated |
|---|---|---|---|
| Employee EPF | 12% of contributory wages; 10% in specified cases | Employee | Credited to EPF, subject to the applicable wage ceiling or approved higher-wage basis |
| Employee EPS | 0% | Employee does not pay this separately | No EPS deduction should be recovered from the employee |
| Employer EPS | 8.33% in the published rate sheet | Employer | Allocated to EPS where the employee is eligible |
| Employer EPF | Balance of the employer share after the pension allocation | Employer | EPFO describes it as the difference between the employee share and the pension contribution |
The exact rupee amount depends on the contributory-wage figure and the ceiling legally operative for that month. A payslip that shows an employee deduction based on ₹15,000 does not, by itself, prove that the employee’s total salary is ₹15,000; it may simply show the capped wage used for EPF.
How the old ₹15,000 ceiling works in practice
The Employer Information Booklet and the published rate sheet retrieved from EPFO use ₹15,000 as the maximum wage ceiling. Under that material, an employer can ordinarily limit the statutory calculation to ₹15,000 even when the employee’s salary is higher.

Using the older ₹15,000 ceiling purely as an arithmetic illustration:

- The employer’s total 12% share would also be ₹1,800 where that usual rate applies.
- At the published 8.33% EPS rate, ₹1,249.50 would be the pension portion if the employee is EPS-eligible and the same capped wage is used.
- The remaining ₹550.50 of the employer share would go to EPF, making the EPF credit from both sides ₹2,350.50 before any other statutory adjustments.
This example does not establish what a current payroll must use. It reflects the older published ceiling and assumes the employee is in an establishment covered by the 12% rate and is eligible for EPS.
Illustration for a specified 10% establishment
Where the special 10% rate applies, the employee amount on ₹15,000 would be ₹1,500. The employer’s allocation must still follow the applicable EPFO rules; the 10% rate cannot be assumed merely because an employee earns above the ceiling. Employers should identify the establishment category before checking a payslip calculation.

Can you contribute on wages above ₹15,000?
EPFO’s booklet says an employee may pay at a higher rate, but the employer is not obliged to match the higher employee contribution. For higher-wage contributions under paragraph 26(6), the booklet describes a joint request from the employee and employer. It also says that administrative charges apply on the higher wages.
This creates several possible payroll outcomes:
- Capped contribution: both sides use the ordinary ceiling, so the employee’s EPF deduction does not rise in proportion to total salary.
- Employee-only increase: the employee contributes more than the statutory amount, while the employer continues with its ordinary capped share. The extra employee amount is not an employer match.
- Approved higher-wage basis: a joint request exists and payroll applies the higher contributory wage in accordance with the applicable rules. The employer’s administrative charges then apply to the higher wages.
Ask payroll for the wage figure used, whether a paragraph 26(6) joint request is on record, and whether the employer has agreed to match the higher contribution. A larger employee deduction alone does not demonstrate that the employer must contribute the same larger amount.
Does my employer have to match my higher EPF contribution?
No, not automatically. EPFO’s booklet expressly says that an employee can contribute at a higher rate but that the employer is not obliged to do so. Matching depends on the applicable legal arrangement and, for higher-wage contributions, the required joint request and the employer’s participation.
For example, if an employee asks payroll to deduct an amount above the capped 12% contribution, the employer may continue depositing only its normal statutory share. The employee should check the EPF passbook and the employer’s contribution line separately rather than assuming that equal amounts were deposited.
Higher contributions also do not automatically mean a higher EPS credit. EPS is an employer-funded allocation with its own eligibility rules. An employee cannot simply redirect a larger personal deduction into EPS.

Why is part of my employer contribution going to EPS?
When an employee is covered by EPS, EPFO allocates the pension portion from the employer’s share. That is why an employer contribution can appear split between EPF and EPS even though the employee’s own payslip shows only an EPF deduction.
The published rate sheet lists employer EPS at 8.33% and describes the employer’s EPF portion as the difference between the employee share and the pension contribution. EPS is therefore not an extra amount recovered from the employee. The booklet states that the employer alone pays the EPS contribution and must not recover it from the employee.
The split can change when EPS is not payable. The booklet identifies, among other situations, a person who reaches age 58 while still in service and an EPS pensioner drawing a reduced pension who rejoins employment. In those cases, it says the pension portion is added to the employer’s EPF share.
The special rule for some new members after 1 September 2014
The older EPFO booklet describes a separate rule for a person who was not already an EPF/EPS member and joins on or after 1 September 2014 with wages above ₹15,000. In the stated case, no EPS contribution is due and the employer’s full 12% share goes to EPF.
This rule cannot be applied from salary alone. Payroll must establish whether the person was an existing EPF or EPS member, the joining date, the contributory wage, and the ceiling and wording legally operative for that wage month. The portal’s reference to a possible ₹25,000 revision means the threshold and eligibility language must be checked against current official guidance before treating a live employee as an EPS-excluded new member.

Why the ₹15,000-to-₹25,000 change needs verification
EPFO’s employer portal, shown as updated on 12 October 2026, displays the notice: “FAQs related to recent revision of EPFO wage ceiling from Rs. 15,000 to Rs.25,000.” The retrieved page does not expose the FAQ text, a Gazette notification number, an implementation date, or the revised contribution mechanics.
That means the notice alone does not prove that ₹25,000 is already the operative ceiling for every employer and wage month. Older EPFO material still states ₹15,000. Before changing payroll or estimating arrears, confirm all of the following in the underlying official notification or accessible EPFO FAQ:
- the legal effective date and the first wage month affected;
- whether ₹25,000 is a universal ceiling or applies only to specified categories;
- whether the contribution rates and higher-wage procedures changed;
- how the revision affects new-member EPS eligibility after 1 September 2014; and
- whether past months require correction, a fresh joint request, or no action.
Until those points are confirmed, describe ₹15,000 as the ceiling in the older published material, not as an unquestionably current nationwide rule.

A practical checklist for an employee earning above the ceiling
- Read the contribution lines, not only the salary total. Identify the employee EPF deduction, employer EPF amount and employer EPS amount separately.
- Ask which contributory wage was used. Compare that figure with the wage definition used by your payroll system; do not assume total gross salary is the PF wage.
- Identify the ceiling for the wage month. The older material uses ₹15,000, while the October 2026 portal notice refers to a possible ₹25,000 revision whose effective date and details remain to be verified.
- Check your membership history. Establish whether you were already an EPF/EPS member and whether you joined on or after 1 September 2014.
- Check EPS exceptions. Age 58 while still in service and rejoining while drawing a reduced EPS pension are examples in the booklet where EPS is not payable.
- Look for a paragraph 26(6) joint request. Without the required higher-wage arrangement, an employee’s request for a larger deduction does not automatically bind the employer to match it.
- Reconcile the passbook. Confirm that the employer’s EPS amount has not been wrongly recovered from your wages and that the EPF and EPS entries correspond to the payroll statement.
- Escalate records-based disputes. If the online calculator differs from the employer’s or EPFO’s calculation, rely on the Regional Office’s record-based determination and submit supporting records through the applicable EPFO process.
What the historical court reference does—and does not—tell you
A Government of India parliamentary answer from the 2022 Monsoon Session said that the Union and EPFO had challenged the Kerala High Court judgment concerning the 2014 EPS amendments. It also said the Supreme Court had referred the matter to a bench of at least three judges in August 2021 and that the issue was sub judice at the time of that answer. The same answer noted that the Social Security Code, 2020 had not yet come into force then.
Those statements describe the position reported in 2022. They are not a declaration of the case’s status in October 2026 and should not be used by themselves to decide a current payroll contribution. For a current dispute, use the latest operative EPFO instruction, notification and Regional Office determination.
How to interpret common payslip patterns
Salary is ₹40,000, but EPF is based on ₹15,000
This can be consistent with the older ceiling-based approach. Ask whether higher-wage coverage was requested and whether the employer has chosen to match any employee increase.
Employee EPF is higher than employer EPF
This may reflect an employee-only higher contribution. It is not automatically an error if the employer has not agreed to match the additional amount.
Employer EPF appears larger and EPS is zero
That can occur where the employee falls within an EPS exception or the special new-member, above-ceiling rule described in the older booklet. Confirm membership history, joining date and the current threshold before concluding that payroll is wrong.
EPS is deducted from the employee’s salary
The booklet says EPS is payable by the employer only and must not be recovered from the employee. Ask payroll to explain and correct any line that actually reduces your wages for EPS.
