If your employer deducted provident-fund (PF) money from your salary but did not deposit it, act through two channels at the same time: file a grievance with the Employees’ Provident Fund Organisation (EPFO) through EPFiGMS and submit a documented claim to the insolvency professional handling the company. One route investigates and enforces compliance; the other puts your unpaid contributions into the corporate insolvency resolution or liquidation record.
Keep the insolvency commencement date (ICD) at the centre of your calculation. Tribunal decisions have protected unpaid PF through that date, while post-commencement amounts and disputed interest or damages can require fact-specific treatment.

What happens to PF when a company enters insolvency?
“Bankrupt” is commonly used for a company that has entered the Insolvency and Bankruptcy Code (IBC) process. In a corporate insolvency resolution process (CIRP), an interim resolution professional (IRP) or resolution professional (RP) takes control of the process. In liquidation, a liquidator administers the company’s assets and claims.

PF money is not treated like an ordinary supplier or unsecured-loan debt. Section 11 of the Employees’ Provident Funds and Miscellaneous Provisions Act describes amounts due from an employer—including employee and employer contributions—as a first charge on the establishment’s assets, payable in priority to other debts. Section 36(4)(a)(iii) of the IBC excludes provident-fund sums from the liquidation estate, and section 53’s ordinary waterfall does not govern those protected amounts.

In an order dated 8 December 2023, the National Company Law Tribunal (NCLT), New Delhi, described PF, gratuity and pension funds held by a corporate debtor as third-party assets: “The assets comprising of provident funds, gratuity funds or a pension fund maintained by Corporate Debtor, are assets on which employees and workmen have right although assets are in possession and control of the Corporate Debtor.” The NCLT Kochi order similarly records the statutory position that PF dues do not enter the section 53 distribution waterfall.
The National Company Law Appellate Tribunal (NCLAT) ruled on 21 October 2022 that employees are entitled to unpaid provident-fund dues up to the ICD. A further NCLAT decision dated 24 April 2026 states that unpaid employee and employer contributions, section 7Q interest and section 14B damages fall within the protected category and are not subject to section 53 distribution, while directing payment of unpaid PF through the ICD. Those decisions support a strong demand for the protected period, but they do not guarantee identical treatment in every case, especially where an amount is disputed, unadjudicated, held in an exempted trust, or accrued after the ICD.
Use both recovery channels, not one
| Route | What it does | What it cannot replace |
|---|---|---|
| EPFiGMS grievance with EPFO | Asks EPFO to investigate missing deposits, determine statutory dues and pursue employer compliance. | A claim or submission to the IRP, RP or liquidator. |
| Insolvency submission | Places your month-by-month PF schedule and evidence in the CIRP or liquidation record and seeks separate accounting and payment. | EPFO’s statutory investigation and enforcement role. |
| Member-benefit forms | Process a final settlement, transfer or specified withdrawal after you become eligible. | Recovery of contributions that the employer never deposited. |
Filing only on EPFiGMS can leave your claim out of the insolvency professional’s working records. Filing only with the insolvency professional may not establish the statutory default in EPFO’s systems. Send the same core schedule and evidence through both channels and retain proof of delivery.

| Column | What to record |
|---|---|
| Wage month | Month for which salary was earned and PF was calculated. |
| PF wages | The wage figure used by payroll, if shown on the salary slip. |
| Employee share deducted | Amount withheld from your pay, supported by the salary slip and bank credit. |
| Employer share expected | Employer contribution shown on payroll or calculated under the applicable PF rate; mark uncertain figures for EPFO verification. |
| Amount credited | Contribution actually visible in the UAN passbook or trust statement. |
| Shortfall | Employee deduction, employer share or both that remain unpaid. |
| Timing | Mark whether the month is before, on or after the ICD. |
| Proof | File names for salary slips, bank statements, correspondence and passbook entries. |
Include months before the ICD even if the employer later entered CIRP or liquidation. Put post-ICD months in a separate section rather than combining them with the protected pre-ICD schedule. Continued work after the ICD can involve wages incurred during administration and needs case-specific analysis.
Step 2: Preserve evidence before access disappears
Download and store records in two places, such as an encrypted drive and a personal cloud account. Do not rely on an employer email account or an internal payroll portal that may be shut down.
- UAN passbook, contribution history and screenshots of missing months.
- Salary slips showing employee PF deductions and the employer’s stated share.
- Bank statements proving the net salary payment and the deduction reflected in payroll.
- Appointment, confirmation, transfer, resignation and termination or exit letters.
- Your UAN, PF member identification number and the employer’s establishment or PF code.
- Form 16, attendance records, payroll exports and annual compensation statements.
- Emails, messages, notices and HR responses concerning delayed or missing PF.
- Any notice naming the IRP, RP or liquidator, plus the insolvency case number and claim deadline.
If the employer ran an exempted PF trust
Some establishments operate an exempted PF trust rather than sending every contribution to the EPFO-managed account. A blank UAN passbook does not by itself prove that no money exists. Request the trust’s member ledger, annual statement, trustee contact details and correspondence about settlement. Notify both the trust and the insolvency professional. The payment and verification route can differ from a non-exempted establishment, so obtain India-specific advice if the trust records conflict with payroll.

- Enter your UAN or PF member number, establishment name and PF code, and current contact details.
- State the exact wage months missing from the passbook and the total employee deductions shown on your schedule.
- Identify the employer’s insolvency status: CIRP, liquidation or another formally notified stage. Name the IRP, RP or liquidator if known.
- Attach the schedule, passbook, salary slips, bank evidence and relevant correspondence. Keep the original files unchanged.
- Request an enforcement determination of employee and employer contributions, applicable section 7Q interest and any legally assessed damages, with confirmation of the amount payable.
- Submit the complaint and save the grievance number, date, attachments and acknowledgement screen.
The EPFO Citizen Charter (2023) gives a general target of seven working days for grievance settlement. That is a service target, not a promise that the money will be recovered in seven days. A complicated insolvency, missing employer records or an exempted trust can take longer.
Step 4: Notify the IRP, RP or liquidator separately
Send a signed copy of the same schedule by a traceable channel—such as the address or email stated in the public insolvency notice—and request written acknowledgement. Use the exact corporate debtor name and insolvency case details.
- Label the submission “Unpaid EPF contributions—employee claim” and identify your employment period and UAN.
- Show employee deductions, employer contributions, interest and any damages in separate rows.
- Split the schedule at the ICD and identify which evidence supports each month.
- Ask that PF amounts be recorded separately from ordinary operational or unsecured claims, excluded from the liquidation estate and not placed in the section 53 waterfall.
- Request confirmation of the amount admitted, the basis for any reduction and the next payment step.
- Monitor IBBI and NCLT notices for claim forms, revised deadlines, hearings and the identity or contact details of the current professional.
Tribunal orders support special treatment of protected PF, but an insolvency professional may still ask for reconciliation, proof of employment or an EPFO determination. Respond promptly and retain every version of your schedule.

The strongest claim is unpaid employee and employer PF through the ICD. The cited NCLAT authorities also support protection for section 7Q interest and section 14B damages, including the 24 April 2026 ruling, but the amount may need to be adjudicated and accepted in the particular case.

| Component | How to present it | Qualification |
|---|---|---|
| Employee contribution deducted from salary | List each deduction by month and attach the salary slip and bank evidence. | Withholding without deposit is an employer default; EPFO should verify the statutory amount. |
| Employer contribution | Use payroll records and the applicable wage base; mark calculations that need EPFO confirmation. | Do not assume the amount from a payslip is conclusive if records conflict. |
| Section 7Q interest | Request a month-by-month statutory calculation or EPFO assessment. | Disputed or unadjudicated interest can require case-specific treatment. |
| Section 14B damages | Ask EPFO to determine any damages and include the determination in the insolvency record. | Damages are not the same as the principal contribution and may not yet be assessed. |
| Post-ICD accruals | Keep them in a separate schedule and identify who operated the business after the ICD. | The cited authorities directly protect the period up to the ICD; later amounts require factual analysis. |
Member forms do not fix an employer default
After leaving employment, you may use an EPFO member route that fits your circumstances:
- Form 19: final PF settlement where eligibility conditions are met.
- Form 13: transfer of the PF balance to another member account.
- Form 31: specified advances or withdrawals allowed under the scheme.
- Form 10C: EPS withdrawal benefit or a scheme certificate, depending on service and eligibility.
These forms deal with money already credited to your member account or a permitted benefit. If the passbook is missing months, keep the EPFiGMS grievance and insolvency submission active. A successful transfer or withdrawal does not prove that the employer deposited the missing contributions and does not waive the default.

Check the EPFiGMS status after the seven-working-day Citizen Charter target and save each response. If the grievance is closed without correcting the missing months, reopen or appeal through the escalation option stated in the portal or contact the responsible EPFO regional office with the original grievance number.
EPFO’s 2025 About EPFO information describes an office presence across 122 locations. Office jurisdictions and contact details can change, so verify the current regional office information in the live EPFO portal rather than relying on an old directory. Send escalation correspondence to the insolvency professional as well, especially if your claim was omitted from a list of creditors or a status report.

- Comes with secure packaging
- Helpful in various ways
Escalate to India-specific insolvency or employment counsel when:
- an exempted trust’s ledger differs from EPFO or payroll records;
- the professional rejects section 7Q interest or section 14B damages as unadjudicated;
- the company continued operations and PF accrued after the ICD;
- a resolution plan argues that a “clean slate” eliminates the liability;
- the ICD itself is disputed; or
- you receive a partial admission without a written calculation.
Legal limits and unresolved issues
The EPFO Central Board agenda records Supreme Court proceedings concerning whether PF can be used to pay employer debts and how the IBC clean-slate principle applies. That means a tribunal result from one company should not be presented as an automatic answer for every claim. Confirm the latest judgment and the docket-specific orders before relying on a disputed interest, damages amount, trust arrangement or post-ICD accrual.
Keep pursuing both channels while the issue is being clarified. A written EPFO determination, a properly evidenced schedule and proof that the insolvency professional received your claim give you a stronger record than an unsupported request for payment.
